Allahabad High Court Refuses to Quash Dowry Death Case Against Mother-in-Law

Court says disputed medical evidence, alleged dowry harassment and circumstances surrounding woman’s death must be examined at trial

Prayagraj: The Allahabad High Court has declined to terminate criminal proceedings against Nirmala Devi, the mother-in-law of a woman who died less than four years after her marriage, holding that the allegations and investigation material raise factual and legal issues that cannot be conclusively decided at the stage of a quashing petition.

Justice Chawan Prakash, sitting in Court No. 83, dismissed Nirmala Devi’s application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), through which she had sought cancellation of the charge-sheet, the Magistrate’s cognizance and summoning order, as well as the criminal proceedings arising from the case.

The court found that the material collected during investigation disclosed a prima facie case requiring adjudication in a regular trial.

The case concerns Pratibha Yadav alias Pooja, who married the applicant’s son on May 4, 2021. According to the prosecution material, she allegedly faced dowry-related harassment and cruelty after marriage.

She had left her matrimonial home in June 2024 and returned in January 2025 following assurances from her in-laws, according to the case record.

The prosecution further alleged that on February 15, 2025, Pratibha told her mother that she had been assaulted by Nirmala Devi and another member of the matrimonial family.

On the night of February 18-19, she was found unconscious at her matrimonial home.

She was initially taken to a hospital in Firozabad and later shifted to Ujala Cygnus Rainbow Hospital in Agra, where she died on February 25, 2025.

Mother-in-law disputed allegation of dowry death.

Appearing for Nirmala Devi, advocate Raghubansh Misra challenged the continuation of the prosecution and maintained that the death was attributable to a medical condition rather than any criminal act.

The defence relied upon the medical records and post-mortem findings. The post-mortem report recorded the cause of death as shock resulting from myocardial infarction, while hospital records referred to fever, seizures and suspected meningitis.

On this basis, the applicant argued that there was no evidence of death caused by burns, bodily injury, poisoning or another obvious external cause.

The defence also disputed allegations of dowry demand or cruelty and contended that the statutory requirements of dowry death were not established.

Reliance was placed on Supreme Court decisions including Babu Bhai v. State of Gujarat, State of Gujarat v. Afroz Mohammad Hasanfatta and Haji Iqbal v. State of U.P. in support of the plea for quashing.

Advocate Taniya Pandey contests plea, cites alleged financial transactions

The quashing application was opposed by Taniya Pandey, Advocate, appearing for the complainant/opposite party No. ,. Sudhanshoo Shukla and the Government Advocate also appeared for the respondents, according to the High Court’s case listing.

Pandey argued that the allegations could not be brushed aside merely because the defence relied upon a cardiac cause of death.

According to the prosecution case placed before the court, the deceased had allegedly been subjected to continuing demands and harassment linked to dowry.

The prosecution material also referred to financial transactions allegedly made in favour of the applicant.

These included RTGS transfers totalling ₹16.25 lakh into the applicant’s account and an alleged cash payment of ₹7 lakh at the time of the marriage.

The complainant’s side further relied on the allegation that the deceased had complained of physical assault shortly before she became unconscious.

The court was therefore asked not to determine the disputed factual questions merely based on the medical opinion at the preliminary stage.

Court declines to treat myocardial infarction finding as conclusive

A significant aspect of the ruling was the court’s treatment of the medical evidence.

The High Court held that the post-mortem opinion identifying myocardial infarction could not, by itself, settle the question of whether the prosecution should continue.

Determining whether the medical condition was entirely natural, or whether other circumstances allegedly connected with cruelty had contributed to or precipitated the condition, would require examination of evidence during trial.

The court indicated that such an inquiry could involve the testimony of treating doctors and medical experts, together with other scientific and investigative material, including toxicological evidence and related medical records.

High Court says quashing jurisdiction cannot become a mini-trial

The bench also considered the scope of the High Court’s inherent jurisdiction under Section 528 BNSS.

Such jurisdiction can be exercised to prevent abuse of the legal process and secure the ends of justice, but the court is not expected to conduct a detailed assessment of disputed evidence as though it were hearing the criminal trial itself.

The judgment examined Sections 80, 85 and 86 of the Bharatiya Nyaya Sanhita. Section 80 deals with dowry death, while Sections 85 and 86 concern cruelty by a husband or his relatives and the statutory meaning of cruelty.

The court also referred to the evidentiary presumption associated with dowry death under Section 118 of the Bharatiya Sakshya Adhiniyam.

The court noted that the allegations against Nirmala Devi were specific and that material collected during the investigation could not be characterised, at this stage, as disclosing no offence whatsoever.

Since the prosecution allegations, medical evidence and circumstances surrounding the woman’s death raised questions requiring witness and expert examination, the High Court held that those matters were more appropriately left to the trial court.

Criminal proceedings to continue

The High Court consequently rejected Nirmala Devi’s plea to quash the charge-sheet, the cognizance/summoning order and the criminal proceedings. The case will therefore proceed in accordance with law.

The ruling does not amount to a finding of guilt against the applicant. Rather, the court concluded that the material before it was sufficient to allow the prosecution to proceed and that the disputed questions surrounding the woman’s death could not be finally determined in proceedings under Section 528 BNSS.

प्रयागराज, 24 सितंबर 2026: इलाहाबाद हाईकोर्ट ने विवाह के चार वर्ष पूरे होने से पहले हुई एक महिला की मौत के मामले में उसकी सास निर्मला देवी के खिलाफ चल रही आपराधिक कार्यवाही को समाप्त करने से इनकार कर दिया है।

कोर्ट ने कहा कि मामले में ऐसे तथ्यात्मक और कानूनी सवाल मौजूद हैं, जिनका अंतिम फैसला मुकदमे की सुनवाई के दौरान ही किया जा सकता है।

न्यायमूर्ति चावन प्रकाश की अध्यक्षता वाली कोर्ट संख्या 83 ने भारतीय नागरिक सुरक्षा संहिता (BNSS) की धारा 528 के तहत दाखिल निर्मला देवी की याचिका खारिज कर दी।

याचिका में चार्जशीट, मजिस्ट्रेट के संज्ञान एवं समन आदेश तथा उससे जुड़ी पूरी आपराधिक कार्यवाही को रद्द करने की मांग की गई थी। हाईकोर्ट ने माना कि जांच के दौरान सामने आया सामग्री प्रथम दृष्टया मुकदमा चलाने के लिए पर्याप्त है।

मामला प्रतिमा यादव उर्फ पूजा की मौत से जुड़ा है। उसका विवाह 4 मई 2021 को आवेदिका के बेटे से हुआ था।

अभियोजन पक्ष के अनुसार, विवाह के बाद से ही उसे कथित तौर पर दहेज को लेकर प्रताड़ना और उत्पीड़न का सामना करना पड़ा।

मामले के रिकॉर्ड के मुताबिक वह जून 2024 में ससुराल छोड़कर चली गई थी और बाद में ससुराल पक्ष की ओर से दिए गए आश्वासन के बाद जनवरी 2025 में वापस लौटी थी।

अभियोजन का आरोप है कि 15 फरवरी 2025 को प्रतिमा ने अपनी मां को बताया था कि निर्मला देवी और परिवार की एक अन्य महिला ने उसके साथ मारपीट की।

इसके कुछ दिन बाद 18-19 फरवरी की रात वह ससुराल में बेहोशी की हालत में मिली। उसे पहले फिरोजाबाद के अस्पताल ले जाया गया और बाद में आगरा स्थित उजाला सिग्नस रेनबो अस्पताल में भर्ती कराया गया, जहां 25 फरवरी 2025 को उसकी मौत हो गई।

सास ने दहेज हत्या के आरोपों को चुनौती दी

निर्मला देवी की ओर से अधिवक्ता रघुवंश मिश्रा ने आपराधिक कार्यवाही जारी रखने का विरोध किया। बचाव पक्ष का कहना था कि महिला की मौत किसी आपराधिक कृत्य के कारण नहीं, बल्कि गंभीर चिकित्सकीय स्थिति के चलते हुई।

बचाव पक्ष ने अस्पताल के रिकॉर्ड और पोस्टमार्टम रिपोर्ट पर भरोसा किया। पोस्टमार्टम में मौत का कारण मायोकार्डियल इंफार्क्शन के परिणामस्वरूप शॉक बताया गया था, जबकि अस्पताल के रिकॉर्ड में बुखार, दौरे और संभावित मेनिन्जाइटिस जैसी स्थितियों का उल्लेख था।

इसी आधार पर दलील दी गई कि मौत जलने, शारीरिक चोट, जहर या किसी अन्य स्पष्ट बाहरी कारण से होने का प्रमाण नहीं है।

आवेदिका की ओर से दहेज की मांग और क्रूरता के आरोपों से भी इनकार किया गया। बचाव पक्ष ने सुप्रीम कोर्ट के Babu Bhai v. State of Gujarat, State of Gujarat v. Afroz Mohammad Hasanfatta और Haji Iqbal v. State of U.P. जैसे फैसलों का हवाला देते हुए कार्यवाही रद्द करने का आग्रह किया।

अधिवक्ता तान्या पांडेय ने याचिका का विरोध किया

शिकायतकर्ता/विपक्षी पक्ष संख्या 2 की ओर से अधिवक्ता तान्या पांडेय ने याचिका का जोरदार विरोध किया। हाईकोर्ट के रिकॉर्ड के अनुसार सुधांशु शुक्ला और राज्य की ओर से सरकारी अधिवक्ता भी मामले में उपस्थित थे।

तान्या पांडेय की ओर से दलील दी गई कि केवल हृदय संबंधी चिकित्सकीय निष्कर्ष के आधार पर अभियोजन की पूरी कहानी को प्रारंभिक स्तर पर खारिज नहीं किया जा सकता।

अभियोजन के अनुसार मृतका को विवाह के बाद दहेज से संबंधित मांगों और लगातार कथित उत्पीड़न का सामना करना पड़ा था।

मामले में कथित आर्थिक लेन-देन का भी उल्लेख किया गया। अभियोजन सामग्री के अनुसार आवेदिका के खाते में RTGS के माध्यम से कुल 16.25 लाख रुपये भेजे गए थे।

इसके अतिरिक्त विवाह के समय 7 लाख रुपये नकद दिए जाने का भी आरोप सामने आया।

शिकायतकर्ता पक्ष ने यह भी कहा कि महिला ने बेहोश होने से कुछ समय पहले कथित मारपीट की जानकारी अपनी मां को दी थी।

ऐसे में केवल पोस्टमार्टम में दर्ज चिकित्सकीय कारण को आधार बनाकर इस स्तर पर पूरे मामले को समाप्त करना उचित नहीं होगा।

मायोकार्डियल इंफार्क्शन को अंतिम आधार नहीं माना

हाईकोर्ट के आदेश का एक महत्वपूर्ण पहलू पोस्टमार्टम रिपोर्ट की व्याख्या से जुड़ा रहा।

अदालत ने माना कि पोस्टमार्टम रिपोर्ट में मायोकार्डियल इंफार्क्शन का उल्लेख अपने आप में इस स्तर पर आपराधिक कार्यवाही खत्म करने का निर्णायक आधार नहीं बन सकता।

यह तय करना कि महिला की चिकित्सा स्थिति पूरी तरह प्राकृतिक थी या कथित उत्पीड़न अथवा अन्य परिस्थितियों ने उसे प्रभावित या गंभीर बनाया, साक्ष्यों की विस्तृत जांच का विषय है।

अदालत के अनुसार इस पहलू की पड़ताल में इलाज करने वाले डॉक्टरों, मेडिकल विशेषज्ञों और अन्य वैज्ञानिक साक्ष्यों की आवश्यकता पड़ सकती है। इसमें विष-विज्ञान संबंधी रिपोर्ट और अन्य चिकित्सकीय रिकॉर्ड भी महत्वपूर्ण हो सकते हैं।

हाईकोर्ट ने कहा—क्वैशिंग की कार्यवाही में मिनी ट्रायल नहीं हो सकता

अदालत ने BNSS की धारा 528 के तहत हाईकोर्ट की अंतर्निहित शक्तियों के दायरे पर भी विचार किया।

ऐसी शक्ति का इस्तेमाल न्याय के हित में और कानूनी प्रक्रिया के दुरुपयोग को रोकने के लिए किया जा सकता है, लेकिन इस अधिकार के तहत अदालत विवादित साक्ष्यों का उसी तरह विस्तृत मूल्यांकन नहीं कर सकती, जैसा किसी आपराधिक मुकदमे में किया जाता है।

फैसले में भारतीय न्याय संहिता की धाराओं 80, 85 और 86 का भी परीक्षण किया गया। धारा 80 दहेज मृत्यु से संबंधित है, जबकि धाराएं 85 और 86 पति या उसके रिश्तेदारों द्वारा क्रूरता तथा क्रूरता की कानूनी परिभाषा से संबंधित हैं।

अदालत ने भारतीय साक्ष्य अधिनियम की धारा 118 के तहत दहेज मृत्यु से जुड़ी वैधानिक धारणा का भी उल्लेख किया।

हाईकोर्ट ने कहा कि निर्मला देवी के खिलाफ लगाए गए आरोप विशिष्ट प्रकृति के हैं और जांच के दौरान जुटाई गई सामग्री को इस स्तर पर ऐसा नहीं कहा जा सकता कि उससे कोई अपराध बनता ही नहीं है।

चूंकि मामले में महिला की मौत की परिस्थितियों, कथित उत्पीड़न और मेडिकल साक्ष्यों को लेकर विवादित तथ्य मौजूद हैं, इसलिए इनकी वास्तविक जांच गवाहों और विशेषज्ञों की गवाही के माध्यम से ट्रायल कोर्ट में होना उचित होगा।

आपराधिक मुकदमा जारी रहेगा

इन परिस्थितियों में हाईकोर्ट ने निर्मला देवी की चार्जशीट, संज्ञान एवं समन आदेश तथा पूरी आपराधिक कार्यवाही रद्द करने की मांग को स्वीकार नहीं किया। परिणामस्वरूप मामले की कार्यवाही कानून के अनुसार आगे जारी रहेगी।

हालांकि, हाईकोर्ट का यह आदेश निर्मला देवी को दोषी ठहराने वाला फैसला नहीं है।

अदालत ने केवल यह तय किया है कि उपलब्ध सामग्री ऐसी है कि अभियोजन को आगे बढ़ने दिया जाना चाहिए और महिला की मौत से जुड़े विवादित तथ्यों का अंतिम निर्धारण ट्रायल के दौरान साक्ष्यों के आधार पर किया जाना चाहिए।
