Allahabad High Court Seeks UP Government Report on Plea Alleging Pressure to File False Case Against Swami Avimukteshwaranand

The Allahabad High Court has sought a response from the Uttar Pradesh government on a petition alleging that a man was pressured to falsely implicate Swami Avimukteshwaranand in a criminal case.
The petitioner has claimed that after refusing to comply with the alleged demand, he and his family began receiving threats, prompting him to seek judicial protection.
The petition has been filed by Ramashankar Dixit, a resident of Shahjahanpur district, who has requested police protection and appropriate directions from the High Court to safeguard his life and that of his family members.
He has alleged that despite repeatedly approaching the authorities, no effective action has been taken to address his concerns.
While hearing the matter, a Division Bench comprising Justice JJ Munir and Justice Indrajeet Shukla directed the Uttar Pradesh government to obtain instructions and place its response before the court.
The Bench also ordered that Ashutosh Brahmchari Maharaj be added as a respondent in the case, along with his complete parentage and address details.
To ensure prompt compliance, the court instructed the Registrar (Compliance) to immediately communicate the order to the Inspector General of Police, Bareilly Zone, the Superintendent of Police, Shahjahanpur, and the Station House Officer of Sadar Bazar Police Station, Shahjahanpur, through the respective Chief Judicial Magistrates of Bareilly and Shahjahanpur.
The court has fixed July 16 as the next date of hearing and directed that the matter be listed as a fresh case on that day.
Ashutosh Brahmchari Maharaj is also among the petitioners in the ongoing Shahi Idgah–Krishna Janmabhoomi litigation pending before the Allahabad High Court in connection with the Mathura dispute.
Earlier this year, acting on an application filed by Ashutosh Brahmchari Maharaj, a Special POCSO Court in Prayagraj had directed police to register a case under the Protection of Children from Sexual Offences (POCSO) Act against 56-year-old Swami Avimukteshwaranand Saraswati and certain others over allegations of sexual assault.
According to the present petition, Ramashankar Dixit has alleged that on February 18, 2026, three unidentified individuals approached him and allegedly offered money to falsely implicate Swami Avimukteshwaranand in a fabricated criminal case.
He claimed that after refusing the proposal, he was threatened with serious consequences, including the risk to his life.
Dixit has further alleged that unknown persons have been monitoring his residence ever since the incident. Concerned for his safety, he approached the local police, following which security personnel were deployed outside his home.
However, the petitioner has claimed that the policemen assigned for his protection also attempted to persuade him to alter his original statement.
He alleged that despite raising the issue before senior police officers, no meaningful action has been initiated so far.
With no satisfactory response from the authorities, Dixit approached the Allahabad High Court seeking judicial intervention.
In his plea, he has asserted that both he and his family continue to face a serious threat to their safety and have requested the court to direct the authorities to provide adequate security and ensure the protection of their lives.
As the matter is now before the High Court, further developments are expected after the state government submits its response during the next hearing.
स्वामी अविमुक्तेश्वरानंद के खिलाफ झूठा मुकदमा दर्ज कराने के कथित दबाव के मामले में इलाहाबाद हाईकोर्ट ने यूपी सरकार से मांगी रिपोर्ट
स्वामी अविमुक्तेश्वरानंद के खिलाफ कथित रूप से झूठा मुकदमा दर्ज कराने के लिए दबाव बनाए जाने के आरोपों से जुड़े एक मामले में इलाहाबाद हाईकोर्ट ने उत्तर प्रदेश सरकार से रिपोर्ट तलब की है।
याचिकाकर्ता का आरोप है कि जब उन्होंने कथित दबाव के आगे झुकने से इनकार कर दिया, तो उन्हें और उनके परिवार को गंभीर परिणाम भुगतने की धमकियां मिलने लगीं। इसी के चलते उन्होंने न्यायालय से सुरक्षा की गुहार लगाई है।
यह याचिका शाहजहांपुर निवासी रामाशंकर दीक्षित ने दाखिल की है। उन्होंने अदालत से अपने और अपने परिवार की सुरक्षा सुनिश्चित करने के लिए पुलिस संरक्षण तथा आवश्यक दिशा-निर्देश जारी करने की मांग की है।
उनका कहना है कि कई बार प्रशासन से शिकायत करने के बावजूद अब तक कोई प्रभावी कार्रवाई नहीं की गई।
मामले की सुनवाई करते हुए न्यायमूर्ति जे.जे. मुनीर और न्यायमूर्ति इंद्रजीत शुक्ला की खंडपीठ ने राज्य सरकार को निर्देश दिया कि वह इस मामले में आवश्यक निर्देश प्राप्त कर अदालत के समक्ष अपना पक्ष प्रस्तुत करे।
अदालत ने यह भी आदेश दिया कि आशुतोष ब्रह्मचारी महाराज को उनके पूरे परिचय और पते के साथ इस याचिका में प्रतिवादी बनाया जाए।
अदालत ने रजिस्ट्रार (अनुपालन) को निर्देश दिया कि आदेश की प्रति तत्काल आईजी पुलिस, बरेली जोन, पुलिस अधीक्षक, शाहजहांपुर तथा सदर बाजार थाना प्रभारी को बरेली और शाहजहांपुर के मुख्य न्यायिक मजिस्ट्रेट के माध्यम से उपलब्ध कराई जाए, ताकि आवश्यक कार्रवाई सुनिश्चित की जा सके।
हाईकोर्ट ने मामले की अगली सुनवाई के लिए 16 जुलाई की तिथि निर्धारित करते हुए इसे उसी दिन नए मामले के रूप में सूचीबद्ध करने का निर्देश दिया है।
उल्लेखनीय है कि आशुतोष ब्रह्मचारी महाराज मथुरा के शाही ईदगाह–कृष्ण जन्मभूमि विवाद से जुड़े मामलों में भी वादी पक्ष के प्रमुख सदस्यों में शामिल हैं, जिनकी सुनवाई इलाहाबाद हाईकोर्ट में चल रही है।
इससे पहले आशुतोष ब्रह्मचारी महाराज के आवेदन पर प्रयागराज की विशेष पॉक्सो अदालत ने 56 वर्षीय स्वामी अविमुक्तेश्वरानंद सरस्वती और अन्य लोगों के खिलाफ यौन उत्पीड़न के आरोपों में पॉक्सो अधिनियम के तहत मुकदमा दर्ज करने का निर्देश पुलिस को दिया था।
वर्तमान याचिका में रामाशंकर दीक्षित ने दावा किया है कि 18 फरवरी 2026 को तीन अज्ञात व्यक्तियों ने उनसे संपर्क किया और कथित रूप से धन का लालच देकर स्वामी अविमुक्तेश्वरानंद को एक झूठे आपराधिक मामले में फंसाने के लिए कहा।
उन्होंने आरोप लगाया कि प्रस्ताव ठुकराने के बाद उन्हें जान से मारने की धमकी दी गई।
याचिकाकर्ता का कहना है कि इस घटना के बाद से कुछ अज्ञात लोग लगातार उनके घर की निगरानी कर रहे हैं। अपनी सुरक्षा को लेकर चिंतित होकर उन्होंने पुलिस से संपर्क किया, जिसके बाद उनके आवास पर सुरक्षा के लिए पुलिसकर्मियों की तैनाती की गई।
हालांकि दीक्षित का आरोप है कि सुरक्षा के लिए तैनात कुछ पुलिसकर्मियों ने भी उन पर अपना बयान बदलने का दबाव बनाने की कोशिश की। उन्होंने इस संबंध में वरिष्ठ अधिकारियों से शिकायत की, लेकिन अब तक कोई ठोस कार्रवाई नहीं हुई।
प्रशासन से संतोषजनक सहायता न मिलने के बाद उन्होंने इलाहाबाद हाईकोर्ट का दरवाजा खटखटाया।
अपनी याचिका में उन्होंने कहा है कि उनके साथ-साथ उनके परिवार की सुरक्षा भी लगातार खतरे में है। इसलिए उन्होंने अदालत से अनुरोध किया है कि उचित आदेश जारी कर उन्हें पर्याप्त सुरक्षा उपलब्ध कराई जाए।
अब यह मामला न्यायालय के विचाराधीन है और राज्य सरकार का पक्ष सामने आने के बाद अगली सुनवाई में इस मामले में आगे की कार्यवाही होने की संभावना है।
