Allahabad High Court Seeks UP, Rajasthan Police Reports Over Conflicting Accounts in Firozabad Encounter Case

A petition alleging a fake encounter has raised questions over how Awadhesh was arrested in Jaipur and later shown in the UP police’s encounter account as being found with co-accused in Firozabad.
The Allahabad High Court has called for detailed reports from senior police officials in Uttar Pradesh and Rajasthan after finding discrepancies between the two states’ accounts of the arrest of a theft accused and his subsequent involvement in a police encounter in Firozabad.
The case came before a division bench of Justice Ajay Bhanot and Justice Divesh Kumar Samant on a writ petition filed by Riya Gautam, wife of the accused, Awadhesh.
The petition alleges that her husband was subjected to a fake encounter, a claim that remains disputed and is now being examined in the judicial proceedings.
The court has specifically sought a personal affidavit from the Additional Director General of Police, Agra Zone, concerning the encounter.
At the same time, the Commissioner of Police, Jaipur, has been asked to submit a report detailing the circumstances surrounding the incident.
The dispute stems from two accounts that do not appear to match on a crucial question: where and how Awadhesh was arrested.
According to the petition, Awadhesh was employed at a company in Jaipur.
His wife had approached the Rajasthan Police alleging that personnel arrived at his workplace at about 10 pm on December 5, 2025, and took him away without explaining the reason for his detention or informing the family about his whereabouts.
The complaint prompted an inquiry by the Rajasthan Police.
In a communication issued by the Assistant Commissioner of Police, Jaipur, the police stated that Awadhesh was wanted in connection with a theft case registered in Firozabad.
The Rajasthan Police account further indicated that Awadhesh was later sent to judicial custody in Firozabad district.
It also said personnel from Jaipur Police had accompanied the Uttar Pradesh police team to assist in the proceedings.
The High Court, however, found that this explanation did not correspond with the narrative contained in the FIR registered in the Firozabad case.
The prosecution version in the FIR describes a substantially different sequence. According to that account, police received information from an informer about the location of Awadhesh.
Acting on the tip, officers allegedly reached an area near a cold storage on the road towards Chittrai in Firozabad, where Awadhesh was said to have been present with other accused persons.
The FIR alleges that the suspects confronted the police team and opened fire, leading to an exchange of gunfire. During the incident, Awadhesh allegedly suffered a firearm injury.
This difference in the accounts has become the central issue before the High Court.
While the Rajasthan Police inquiry refers to Awadhesh being taken from Jaipur by the Firozabad Police in connection with the theft case, the UP prosecution narrative places him in Firozabad with co-accused before the alleged encounter took place.
Riya Gautam’s counsel relied on this inconsistency to allege that the shooting was not a genuine encounter.
The petitioner’s side told the court that Awadhesh had allegedly been injured in a staged operation carried out by police authorities to project their effectiveness.
The court has not, at this stage, made a finding that the encounter was fake.
Instead, it has sought official records and explanations from senior officers of both police forces to examine the conflicting versions placed before it.
As part of its directions, the court ordered the ADGP, Agra Zone, to personally place his affidavit on the encounter before the court.
The Jaipur Police Commissioner has separately been directed to furnish a report on the matter.
The court also directed that its order be conveyed to the Jaipur Commissioner of Police through the Registrar General of the Rajasthan High Court.
The matter was considered in an order dated September 2, and the next hearing has been fixed for September 17, 2026.

फिरोजाबाद एनकाउंटर केस: गिरफ्तारी की अलग-अलग कहानी पर इलाहाबाद हाईकोर्ट ने मांगी UP और राजस्थान पुलिस की रिपोर्ट
फर्जी मुठभेड़ का आरोप लगाने वाली याचिका पर सुनवाई करते हुए हाईकोर्ट ने जयपुर से गिरफ्तारी और फिरोजाबाद में कथित एनकाउंटर को लेकर सामने आए विरोधाभासी विवरणों पर स्पष्टीकरण मांगा है।
प्रयागराज। फिरोजाबाद में चोरी के एक आरोपी को पुलिस मुठभेड़ में गोली लगने के मामले में सामने आए अलग-अलग पुलिस विवरणों ने इलाहाबाद हाईकोर्ट का ध्यान खींचा है।
अदालत ने उत्तर प्रदेश और राजस्थान पुलिस के वरिष्ठ अधिकारियों से इस पूरे घटनाक्रम पर रिपोर्ट तलब की है।
मामला रिया गौतम की ओर से दायर रिट याचिका से जुड़ा है। रिया ने अपने पति अवधेश के कथित फर्जी एनकाउंटर में घायल किए जाने का आरोप लगाया है।
मामले की सुनवाई न्यायमूर्ति अजय भनोट और न्यायमूर्ति दिवेश कुमार सामंत की खंडपीठ ने की।
अदालत ने आगरा जोन के अपर पुलिस महानिदेशक को निर्देश दिया है कि वह एनकाउंटर से संबंधित अपना व्यक्तिगत हलफनामा दाखिल करें।
इसके साथ ही जयपुर के पुलिस आयुक्त को भी पूरे घटनाक्रम के संबंध में रिपोर्ट प्रस्तुत करने को कहा गया है।
मामले में मुख्य सवाल अवधेश की गिरफ्तारी के तरीके और स्थान को लेकर सामने आया है। याचिका के मुताबिक, अवधेश जयपुर की एक कंपनी में काम करता था।
उसकी पत्नी ने राजस्थान पुलिस से शिकायत की थी कि 5 दिसंबर 2025 की रात करीब 10 बजे पुलिसकर्मी कंपनी परिसर पहुंचे और बिना कोई स्पष्ट कारण बताए उसके पति को अपने साथ ले गए।
शिकायत के बाद राजस्थान पुलिस ने मामले की जांच की। जयपुर के सहायक पुलिस आयुक्त की ओर से जारी जानकारी में बताया गया कि अवधेश फिरोजाबाद के एक थाने में दर्ज चोरी के मामले में वांछित था।
राजस्थान पुलिस की रिपोर्ट के अनुसार, बाद में अवधेश को फिरोजाबाद जिले में न्यायिक हिरासत में भेज दिया गया।
रिपोर्ट में यह भी कहा गया कि जयपुर पुलिस के कर्मचारी उत्तर प्रदेश पुलिस की टीम के साथ गए थे और उन्होंने कार्रवाई में सहयोग किया था।
हालांकि, हाईकोर्ट ने पाया कि राजस्थान पुलिस की जांच में सामने आया यह विवरण फिरोजाबाद मामले की एफआईआर में दर्ज अभियोजन पक्ष की कहानी से मेल नहीं खाता।
एफआईआर के मुताबिक, पुलिस को एक मुखबिर के जरिए अवधेश के ठिकाने की जानकारी मिली थी।
इसके बाद पुलिस टीम फिरोजाबाद में चित्तरई जाने वाली सड़क के पास एक कोल्ड स्टोरेज के निकट पहुंची, जहां अवधेश अपने कथित सह-आरोपियों के साथ मौजूद बताया गया।
पुलिस की एफआईआर में आरोप है कि वहां आरोपियों ने पुलिसकर्मियों को चुनौती दी और हथियारों से टीम पर गोलीबारी की।
इसके बाद कथित मुठभेड़ हुई, जिसमें अवधेश को गोली लगने की बात कही गई है।
यही अंतर अब अदालत के समक्ष जांच का प्रमुख बिंदु बन गया है।
एक ओर राजस्थान पुलिस की रिपोर्ट में अवधेश को जयपुर से फिरोजाबाद पुलिस द्वारा चोरी के मामले में ले जाए जाने का उल्लेख है, वहीं यूपी पुलिस की एफआईआर में उसे फिरोजाबाद में अन्य आरोपियों के साथ पाए जाने और उसके बाद हुई कथित मुठभेड़ का विवरण दिया गया है।
याचिकाकर्ता की ओर से पेश वकील ने इसी विरोधाभास को आधार बनाते हुए अदालत में आरोप लगाया कि अवधेश को वास्तविक मुठभेड़ में नहीं, बल्कि कथित रूप से पुलिस की छवि और उपलब्धियों को बेहतर दिखाने के लिए कराई गई फर्जी कार्रवाई में घायल किया गया।
अदालत ने फिलहाल इन आरोपों पर कोई अंतिम निष्कर्ष नहीं दिया है। इसके बजाय उसने दोनों राज्यों की पुलिस से आधिकारिक रिपोर्ट और स्पष्टीकरण मांगा है, ताकि गिरफ्तारी और मुठभेड़ से जुड़े अलग-अलग दावों की स्थिति स्पष्ट हो सके।
अदालत ने अपने आदेश की एक प्रति राजस्थान हाईकोर्ट के रजिस्ट्रार जनरल के माध्यम से जयपुर के पुलिस आयुक्त तक पहुंचाने का भी निर्देश दिया है।
2 सितंबर को पारित आदेश के अनुसार, मामले की अगली सुनवाई 17 सितंबर 2026 को होगी। उस तारीख को पुलिस अधिकारियों की रिपोर्ट और हलफनामे मामले की आगे की सुनवाई में महत्वपूर्ण हो सकते हैं।
