Allahabad High Court Warns Against Forcing Employees to Wear Santa Caps, Cites Religious Freedom
Court says workplace instructions compelling employees to display religiously associated symbols can affect sentiments and disturb harmony; criminal case against Agra employee may continue as a complaint case

PRAYAGRAJ: The Allahabad High Court has cautioned employers and senior officials against imposing workplace instructions that may interfere with an employee’s freedom of faith, observing that forcing workers to wear Santa Claus caps could offend the religious sentiments of people holding different beliefs.
The court said such compulsion has no place in a democratic society where individuals are entitled to practise and follow their own faith and beliefs.
It also warned that similar directions could adversely affect peace and cordial relations among employees.
Justice Saurabh Srivastava made the observations while dealing with a petition filed by Vikram Singh alias Vishwa Vikram Singh, an employee of V-Bazar in Agra who was facing criminal proceedings arising from an alleged instruction to subordinate workers to wear Santa Claus red caps.
The court partly accepted Singh’s challenge, but its order did not amount to a complete termination of the underlying criminal case.
A dispute arose over workplace instruction.
The case originated from allegations that Singh had required employees working under him at V-Bazar to wear red Santa Claus caps.
A criminal case was registered invoking Sections 298 and 504 of the Indian Penal Code.
Section 298 deals with deliberately uttering words intended to hurt another person’s religious feelings, while Section 504 concerns intentional insult intended to provoke a breach of peace.
Singh approached the High Court seeking to invalidate the FIR-related proceedings, including the police chargesheet and the order through which the magistrate summoned him.
While examining the material placed before it, the High Court noted that the documents indicated that the instruction had originated from senior authorities at V-Bazar.
Court flags possible impact on religious sentiments
The court said compelling employees to wear the Santa cap could affect the sentiments of people belonging to different faiths and belief systems.
Justice Srivastava emphasised that individuals in a democratic country cannot ordinarily be compelled to follow or display a religiously associated practice against their wishes.
The court consequently cautioned Singh and the senior authorities concerned against issuing such directions again.
It observed that instructions of this nature could potentially disturb a peaceful and harmonious environment within the workplace.
The observation was made in the context of the particular circumstances before the court and alongside its examination of the criminal proceedings.
High Court finds procedural error in magistrate’s order
A separate issue before the court concerned the legal manner in which the criminal proceedings had been initiated.
Counsel representing Singh argued that the offences invoked under Sections 298 and 504 of the IPC were non-cognizable.
According to the submission, the Explanation to Section 2(d) of the Code of Criminal Procedure required a police report relating to an investigation into a non-cognizable offence to be treated as a complaint rather than as an ordinary police case.
Although the state opposed Singh’s plea, its counsel did not dispute the legal proposition advanced on behalf of the applicant.
The High Court accepted the point. It held that the chargesheet submitted in the case under Sections 298 and 504 IPC was required to be dealt with as a complaint in accordance with the statutory scheme.
The court therefore concluded that the magistrate had erred in taking cognisance of the matter as a state case.
December 2023 summoning order set aside for Singh
As a consequence of the procedural finding, the High Court quashed the December 2023 summoning order issued by the Chief Judicial Magistrate, Agra, to the extent that it related to Singh.
The application was accordingly allowed in part.
However, the September 10 judgment made it clear that the decision did not permanently close the door on the allegations.
The competent court can still consider the matter by treating it as a complaint case and proceed further if the requirements of law are satisfied.
The ruling thus combines two distinct aspects of the dispute: a caution against workplace practices that may impinge on employees’ religious sentiments, and a procedural correction concerning how the criminal proceedings were taken cognisance of by the magistrate.

प्रयागराज: इलाहाबाद हाईकोर्ट ने कार्यस्थल पर कर्मचारियों को उनकी इच्छा के विरुद्ध सांता क्लॉज की लाल टोपी पहनाने के मामले में महत्वपूर्ण टिप्पणी की है।
अदालत ने कहा कि इस तरह का दबाव अलग-अलग धर्मों और आस्थाओं को मानने वाले लोगों की भावनाओं को प्रभावित कर सकता है।
न्यायमूर्ति सौरभ श्रीवास्तव ने कहा कि लोकतांत्रिक व्यवस्था में प्रत्येक नागरिक को अपनी आस्था और विश्वास के अनुसार जीवन जीने की स्वतंत्रता है।
अदालत ने यह भी चेताया कि कार्यस्थल पर इस प्रकार के निर्देश कर्मचारियों के बीच सौहार्दपूर्ण वातावरण को प्रभावित कर सकते हैं।
अदालत यह टिप्पणी आगरा के V-Bazar से जुड़े मामले में विक्रम सिंह उर्फ विश्व विक्रम सिंह की याचिका पर सुनवाई करते हुए कर रही थी।
सिंह के खिलाफ अधीनस्थ कर्मचारियों को सांता क्लॉज की लाल टोपी पहनने के लिए बाध्य करने का आरोप था।
हालांकि हाईकोर्ट ने याचिकाकर्ता को राहत देते हुए उसके संबंध में दिसंबर 2023 का समन आदेश निरस्त कर दिया, लेकिन इसका अर्थ यह नहीं है कि मूल आरोप पूरी तरह समाप्त हो गए हैं।
कर्मचारियों को टोपी पहनाने के निर्देश पर विवाद
मामला उस समय सामने आया जब आरोप लगाया गया कि आगरा स्थित V-Bazar में सिंह ने अपने अधीन काम करने वाले कर्मचारियों को सांता क्लॉज की लाल टोपी पहनने के लिए कहा और उन्हें इसके लिए बाध्य किया।
इस संबंध में IPC की धारा 298 और 504 के तहत मामला दर्ज किया गया था।
धारा 298 किसी व्यक्ति की धार्मिक भावनाओं को जानबूझकर ठेस पहुंचाने के इरादे से शब्द कहने से संबंधित है, जबकि धारा 504 जानबूझकर अपमान कर शांति भंग के लिए उकसाने से जुड़ी है।
सिंह ने हाईकोर्ट का रुख करते हुए FIR से जुड़ी कार्यवाही, चार्जशीट और मजिस्ट्रेट द्वारा जारी समन आदेश को चुनौती दी थी।
मामले से जुड़े दस्तावेजों की जांच के बाद अदालत ने पाया कि V-Bazar के वरिष्ठ अधिकारियों की ओर से इस तरह का निर्देश दिए जाने के संकेत रिकॉर्ड में मौजूद थे।
धार्मिक स्वतंत्रता और कार्यस्थल के माहौल पर अदालत की टिप्पणी
हाईकोर्ट ने कहा कि कर्मचारियों को सांता कैप पहनने के लिए बाध्य करना विभिन्न धार्मिक विश्वासों को मानने वाले लोगों की भावनाओं को प्रभावित कर सकता है।
अदालत ने इस बात पर जोर दिया कि लोकतांत्रिक देश में व्यक्ति को अपनी आस्था और विश्वास के अनुसार जीवन जीने की स्वतंत्रता प्राप्त है। ऐसे में कार्यस्थल पर किसी धार्मिक प्रतीक या उससे जुड़े पहनावे को अपनाने के लिए दबाव डालने वाले निर्देशों से बचना चाहिए।
अदालत ने सिंह और संबंधित वरिष्ठ अधिकारियों को भविष्य में इस प्रकार का निर्देश दोबारा नहीं देने की चेतावनी दी। न्यायालय ने कहा कि ऐसे आदेश कर्मचारियों के बीच शांतिपूर्ण और सौहार्दपूर्ण माहौल को प्रभावित कर सकते हैं।
चार्जशीट की कानूनी प्रकृति पर भी उठाया सवाल
मामले में केवल धार्मिक भावनाओं का मुद्दा ही नहीं था। हाईकोर्ट के सामने यह सवाल भी था कि जिस तरह से आपराधिक कार्यवाही आगे बढ़ाई गई, वह कानून के अनुरूप थी या नहीं।
सिंह के अधिवक्ता ने दलील दी कि IPC की धारा 298 और 504 के तहत लगाए गए अपराध गैर-संज्ञेय हैं।
उनका कहना था कि CrPC की धारा 2(d) में दिए गए स्पष्टीकरण के अनुसार ऐसे मामले में जांच के बाद पुलिस द्वारा प्रस्तुत रिपोर्ट को सामान्य पुलिस केस के बजाय शिकायत के रूप में माना जाना चाहिए।
राज्य सरकार की ओर से इस याचिका का विरोध किया गया, लेकिन सरकारी अधिवक्ता ने इस विशेष कानूनी दलील पर आपत्ति नहीं जताई।
हाईकोर्ट ने इस तर्क को स्वीकार करते हुए कहा कि मामले में धारा 298 और 504 IPC के तहत दाखिल चार्जशीट को शिकायत के तौर पर देखा जाना चाहिए।
मजिस्ट्रेट का समन आदेश निरस्त
अदालत ने पाया कि मजिस्ट्रेट ने मामले में राज्य की ओर से दर्ज केस के रूप में संज्ञान लेकर कानूनी त्रुटि की।
इसके आधार पर हाईकोर्ट ने दिसंबर 2023 में आगरा के मुख्य न्यायिक मजिस्ट्रेट द्वारा जारी समन आदेश को विक्रम सिंह से संबंधित हिस्से तक रद्द कर दिया। इस तरह याचिका को आंशिक रूप से स्वीकार कर लिया गया।
हालांकि 10 सितंबर के अपने फैसले में हाईकोर्ट ने यह भी स्पष्ट कर दिया कि उसका आदेश मामले को हमेशा के लिए खत्म नहीं करता।
सक्षम अदालत कानून के अनुसार इसे शिकायत मामले के रूप में आगे बढ़ा सकती है, यदि उसके लिए आवश्यक कानूनी आधार मौजूद हों।
इस प्रकार फैसले में एक ओर कार्यस्थल पर धार्मिक भावनाओं से जुड़े संवेदनशील निर्देशों को लेकर सावधानी बरतने की बात कही गई, वहीं दूसरी ओर अदालत ने आपराधिक मामले में अपनाई गई प्रक्रिया को भी कानून के अनुरूप करने का निर्देश दिया।
