Balrampur Student Death Puts UP Noise Control Enforcement Under High Court Lens

Allahabad High Court’s Lucknow bench seeks answers from UP authorities on controlling excessive noise, monitoring violations, and fixing responsibility when rules are breached.

Lucknow: The Allahabad High Court has turned its attention to Uttar Pradesh’s enforcement of noise-control laws after the death of a young schoolgirl in Balrampur, using the incident to examine a much wider problem — the unchecked use of loudspeakers, DJs and other high-volume sound systems in public spaces.

The court’s intervention does not amount to a finding that excessive noise caused the child’s death. Instead, the Lucknow bench has used the circumstances of the September 22 incident to seek an explanation from the state machinery on how noise regulations are enforced and who is ultimately responsible when violations occur.

The matter came before a division bench of Justices Rajan Roy and Manjive Shukla during proceedings concerning noise pollution.

The judges have now brought a wide range of state departments, police authorities and local officials into the proceedings, signalling that the issue extends beyond the actions of individuals operating sound systems.

The Balrampur incident involved a Class 2 student who was inside her classroom when a procession passed outside the school.

The girl reportedly collapsed during the passage of the procession and was taken to a hospital. She was declared dead on arrival.

Following the incident, the school authorities approached the police and alleged that a DJ was being played at an excessively high volume.

Police subsequently arrested the DJ owner and the person operating the equipment. The officer heading the local police outpost was also suspended.

The circumstances surrounding the child’s death remain an issue for examination.

The High Court specifically avoided making a determination about whether the sound level was responsible for the fatal collapse.

What concerned the bench was the larger pattern of noise violations visible in everyday public life.

The judges noted that laws and regulations governing noise already exist, including provisions under the Environment (Protection) Act, 1986, and the Noise Pollution (Regulation and Control) Rules, 2000.

Yet, despite this legal framework, excessive noise continues to be reported on streets and in public areas.

This prompted the court to focus on the gap between having regulations and enforcing them.

The bench wants the authorities to explain what machinery exists to detect violations, which agencies are expected to intervene, how compliance is monitored, and what happens when restrictions are repeatedly ignored.

The court indicated that a one-time response to individual complaints may not be sufficient.

If violations remain widespread, authorities may need a continuing monitoring mechanism capable of checking compliance with statutory limits on sound.

Public awareness is another aspect that has come under the court’s scrutiny. The bench observed that people may violate noise restrictions partly because they are unaware of the applicable rules.

It has therefore sought the government’s assistance in determining how awareness about permissible sound levels and restrictions can be improved.

The court has also pointed to the question of accountability.

Where authorities take measures, but violations continue, responsibility cannot simply remain undefined, according to the thrust of the proceedings.

The applicable law already contains provisions for penalties, and the court has drawn attention to the need for effective implementation.

To examine these questions, the court has widened the scope of the proceedings considerably.

Senior officials representing the Uttar Pradesh Home Department, Transport Department, Forest and Environment Department, Housing and Urban Planning Department and Urban Development Department have been directed to be brought into the case.

The proceedings will also involve the Director General of Police, the Police Commissioner (Central), the Uttar Pradesh Pollution Control Board, Lucknow Police, municipal commissioners and the Vice-Chairman of the Lucknow Development Authority.

At the district level, Balrampur’s District Magistrate, Superintendent of Police and Chief Medical Officer have been included so that the court can obtain information concerning the incident and the administrative and medical response that followed.

The school has also been made a party to the proceedings. Its participation is intended to help the court understand what happened on the school premises before and after the child collapsed.

At the same time, the bench has placed an important safeguard around the proceedings. It has expressed the expectation that neither the child’s parents nor the school authorities should face pressure because of the case.

The court has further cautioned against unnecessary interference with the functioning of the school by government authorities or any other person.

The proceedings are scheduled to continue on October 12, when the court is expected to receive further assistance from the departments and authorities brought before it.

The Balrampur case has therefore evolved into a broader judicial examination of Uttar Pradesh’s noise-control system — not only whether individuals break the rules, but whether the state’s enforcement mechanism is capable of preventing repeated violations in the first place.

बलरामपुर की छात्रा की मौत के बाद ध्वनि प्रदूषण पर हाईकोर्ट सख्त

 इलाहाबाद हाईकोर्ट की लखनऊ पीठ ने पूछा—तेज आवाज पर रोक लगाने की जिम्मेदारी किसकी, नियम टूटने पर जवाबदेही कैसे तय होगी?

लखनऊ: उत्तर प्रदेश में डीजे, लाउडस्पीकर और अन्य ध्वनि उपकरणों के बेतहाशा इस्तेमाल पर अब इलाहाबाद हाईकोर्ट ने व्यापक स्तर पर जवाब मांगा है।

बलरामपुर में एक स्कूली बच्ची की मौत से जुड़े घटनाक्रम को आधार बनाते हुए अदालत ने यह जानने की कोशिश की है कि प्रदेश में ध्वनि प्रदूषण रोकने के लिए बने नियमों को लागू कराने की जिम्मेदारी किसकी है और उनके उल्लंघन पर प्रभावी कार्रवाई की व्यवस्था क्या है।

हालांकि अदालत ने यह नहीं कहा है कि बच्ची की मौत अत्यधिक तेज आवाज के कारण ही हुई। पीठ ने इस संबंध में कोई अंतिम निष्कर्ष नहीं निकाला है। उसका मुख्य जोर इस बात पर है कि कानून मौजूद होने के बावजूद सार्वजनिक स्थानों पर निर्धारित ध्वनि सीमा का उल्लंघन लगातार क्यों होता रहता है।

मामला 22 सितंबर को बलरामपुर में सामने आया था। एक जुलूस स्कूल के बाहर से गुजर रहा था, उसी दौरान कक्षा दो की छात्रा अचानक कक्षा में गिर गई। उसे अस्पताल पहुंचाया गया, लेकिन डॉक्टरों ने उसे मृत घोषित कर दिया।

घटना के बाद स्कूल की ओर से पुलिस को शिकायत दी गई। शिकायत में आरोप लगाया गया कि जुलूस के दौरान डीजे बहुत तेज आवाज में बज रहा था। पुलिस ने डीजे मालिक और उसे चलाने वाले व्यक्ति को गिरफ्तार किया, जबकि संबंधित पुलिस चौकी के प्रभारी को निलंबित कर दिया गया।

यह मामला बाद में ध्वनि प्रदूषण से जुड़ी जनहित याचिकाओं की सुनवाई के दौरान हाईकोर्ट के सामने आया। न्यायमूर्ति राजन रॉय और न्यायमूर्ति मंजिव शुक्ला की पीठ ने 28 सितंबर के आदेश में इस घटना को व्यापक संदर्भ में देखने का फैसला किया।

अदालत के सामने अब सवाल सिर्फ यह नहीं है कि उस दिन स्कूल के बाहर कितनी तेज आवाज में संगीत बजाया जा रहा था। उससे बड़ा सवाल यह है कि जब ऐसे नियमों का उल्लंघन रोजमर्रा की जिंदगी में होता है तो उसे रोकने के लिए प्रशासन की वास्तविक व्यवस्था क्या है।

पीठ ने ध्वनि प्रदूषण से निपटने के लिए पहले से मौजूद कानूनी ढांचे की ओर भी ध्यान दिलाया। पर्यावरण संरक्षण अधिनियम, 1986 और ध्वनि प्रदूषण (विनियमन एवं नियंत्रण) नियम, 2000 के बावजूद यदि नियमों का उल्लंघन जारी है, तो अदालत ने इसके पीछे मौजूद प्रशासनिक कमियों की पड़ताल जरूरी मानी है।

अदालत यह भी देखना चाहती है कि विभिन्न विभागों के बीच जिम्मेदारी किस प्रकार तय है। नियमों का उल्लंघन होने पर कौन अधिकारी मौके पर कार्रवाई करेगा, निगरानी किस तरह होगी और लगातार उल्लंघन करने वालों के खिलाफ क्या कदम उठाए जाएंगे—इन सवालों पर सरकार से जानकारी मांगी गई है।

पीठ ने संकेत दिया है कि केवल कानून बना देना पर्याप्त नहीं है। यदि वर्तमान व्यवस्था अपेक्षित परिणाम नहीं दे रही है, तो नियमित निगरानी की ऐसी प्रणाली विकसित करनी होगी जिससे नियमों के पालन की लगातार जांच हो सके।

जनता को नियमों की जानकारी देना भी अदालत की चिंता का हिस्सा है। पीठ के अनुसार, नियमों के बारे में पर्याप्त जागरूकता का न होना भी उनके उल्लंघन का एक कारण हो सकता है। सरकार से यह स्पष्ट करने की अपेक्षा की गई है कि लोगों को ध्वनि सीमा और लाउडस्पीकर के इस्तेमाल से संबंधित प्रावधानों के बारे में कैसे जागरूक किया जा सकता है।

इसके साथ ही अदालत ने जवाबदेही के सवाल को भी महत्वपूर्ण माना है। यदि नियमों का उल्लंघन रोकने के लिए कदम उठाए जाने के बावजूद स्थिति नहीं बदलती, तो संबंधित व्यवस्था की जिम्मेदारी तय करने की जरूरत होगी। मौजूदा कानून में दंड का प्रावधान भी मौजूद है।

मामले की अगली सुनवाई 12 अक्टूबर को होगी। इस बीच अदालत ने प्रदेश सरकार के कई महत्वपूर्ण विभागों के वरिष्ठ अधिकारियों को कार्यवाही में शामिल करने का निर्देश दिया है।

गृह, परिवहन, वन एवं पर्यावरण, आवास एवं शहरी नियोजन तथा नगर विकास विभाग के प्रमुख अधिकारियों को मामले में पक्षकार बनाया गया है।

पुलिस महानिदेशक, पुलिस आयुक्त (मध्य क्षेत्र), उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड, लखनऊ पुलिस, नगर आयुक्तों और लखनऊ विकास प्राधिकरण के उपाध्यक्ष को भी कार्यवाही में शामिल किया गया है।

बलरामपुर प्रशासन से भी जवाब मांगा गया है। जिलाधिकारी, पुलिस अधीक्षक और मुख्य चिकित्सा अधिकारी को मामले में पक्षकार बनाया गया है ताकि घटना से जुड़े प्रशासनिक और चिकित्सकीय पहलुओं पर अदालत को आवश्यक जानकारी मिल सके।

स्कूल प्रबंधन को भी कार्यवाही का हिस्सा बनाया गया है। इससे अदालत को उस दिन स्कूल परिसर में मौजूद परिस्थितियों और बच्ची के अचानक गिरने से पहले और बाद की स्थिति को समझने में सहायता मिलने की उम्मीद है।

इसी बीच पीठ ने बच्ची के माता-पिता और स्कूल प्रबंधन को लेकर विशेष सावधानी बरती है। अदालत ने उम्मीद जताई है कि परिवार पर किसी प्रकार का दबाव नहीं डाला जाएगा और स्कूल के कामकाज में राज्य की ओर से अनावश्यक दखल नहीं होगा।

इस तरह बलरामपुर की घटना अब केवल एक स्थानीय मामले तक सीमित नहीं रह गई है। हाईकोर्ट की सुनवाई ने उत्तर प्रदेश में ध्वनि प्रदूषण नियंत्रण की पूरी व्यवस्था, प्रशासनिक निगरानी, नागरिक जागरूकता और नियम तोड़ने वालों की जवाबदेही से जुड़े व्यापक सवालों को न्यायिक जांच के दायरे में ला दिया है।
