Bombay High Court Allows Gadkari to Pursue Defamation Case Against Meta, X and Google Over Alleged AI Deepfake Campaign
A legal battle over alleged artificial intelligence-generated misinformation surrounding Union Road Transport and Highways Minister Nitin Gadkari gathered momentum on Monday after the Bombay High Court authorised him to initiate a civil defamation suit against Meta, X Corp, Google LLC and several unidentified social media users accused of spreading fabricated digital content.
The order was passed by Justice Abhay Ahuja, who granted the minister permission to seek urgent interim relief, including directions for the immediate removal of online material that allegedly used manipulated videos, altered images and AI-generated deepfakes to falsely connect him and his family with controversy over India’s E20 ethanol-blended fuel programme.
At the heart of the dispute is the Centre’s Ethanol Blended Petrol (EBP) initiative, introduced to reduce dependence on imported crude oil by gradually increasing ethanol content in petrol.
The programme achieved the 20 per cent blending target in 2025, well ahead of the original schedule, using ethanol derived from sugarcane, maize and rice.
Through advocate Sandeep S. Ladda, Gadkari informed the court that a series of misleading posts, reels, videos, photographs and digitally manipulated content continued to remain available across platforms controlled by Meta, X and Google despite allegedly containing false and defamatory claims.
According to the minister, artificial intelligence tools and digital editing technologies were misused to create fabricated audio-visual material reproducing his appearance, identity and public persona without authorisation.
The petition argues that the objective behind the campaign was to damage his reputation while misleading the public regarding the government’s ethanol policy.
To safeguard his legal rights, Gadkari sought the court’s leave under Clause XII of the Letters Patent Act, 1866, enabling him to institute civil proceedings and simultaneously request interim orders directing the removal of the disputed content until the matter is finally decided.
The court proceedings stem from a complaint lodged in Nagpur by BJP Social Media Cell Convener Shishir Arun Tripathi, who alleged that several online accounts had circulated misleading narratives about Gadkari and the E20 fuel programme capable of confusing citizens and disturbing public order.
After examining the digital evidence submitted with the complaint, police registered an FIR under relevant provisions of the Bharatiya Nyaya Sanhita, 2023, along with Section 67 of the Information Technology Act against persons accused of uploading and circulating the alleged deepfake material.
The controversy has emerged amid continuing debate over the E20 fuel policy. While the government maintains that greater ethanol blending reduces fuel imports and lowers emissions, owners of certain vehicles manufactured before 2023 have questioned compatibility with the new fuel.
Rejecting those concerns, Gadkari has repeatedly maintained that E20 petrol has not caused damage to vehicles.
Addressing critics earlier this month, he challenged them to identify even a single verified instance where a vehicle developed mechanical problems solely because of the use of E20 fuel.
Separate criminal complaints had already been initiated in Maharashtra against several content creators accused of spreading misinformation on the issue.
Among those named were YouTuber Manish Kasyap, whose July 3, 2026 video formed part of the complaint, along with social media accounts operating under the names ‘Desi Boys’, ‘Harshit Rathi’ and ‘Anklesh Inwati’.
Adding a political dimension to the controversy, an X account calling itself ‘E20 Janta Party’ has rapidly gained traction online after public attention shifted away from the NEET paper leak issue following Dharmendra Pradhan’s resignation.
The account is being compared with the satirical ‘Cockroach Janta Party’, which eventually became associated with a major student agitation in Delhi.

केंद्रीय सड़क परिवहन एवं राजमार्ग मंत्री नितिन गडकरी के खिलाफ सोशल मीडिया पर कथित रूप से कृत्रिम बुद्धिमत्ता (एआई) आधारित डीपफेक वीडियो और भ्रामक सामग्री प्रसारित किए जाने के मामले ने सोमवार को नया कानूनी मोड़ ले लिया।
बॉम्बे हाईकोर्ट ने गडकरी को मेटा, एक्स कॉर्प (पूर्व में ट्विटर), गूगल एलएलसी तथा अन्य संबंधित पक्षों के खिलाफ दीवानी मानहानि का मुकदमा दायर करने की अनुमति प्रदान कर दी।
न्यायमूर्ति अभय आहूजा की एकलपीठ ने गडकरी को अदालत में मुकदमा दाखिल करने के साथ-साथ अंतरिम राहत मांगने का अधिकार भी दिया।
अब वह उन वीडियो, तस्वीरों, पोस्ट, रील और अन्य डिजिटल सामग्री को तत्काल हटाने के लिए अदालत से निर्देश मांग सकेंगे, जिनमें कथित तौर पर एआई तकनीक का इस्तेमाल कर उनके और उनके परिवार की छवि को ई20 एथेनॉल मिश्रित पेट्रोल योजना से जोड़ते हुए भ्रामक तरीके से प्रस्तुत किया गया है।
पूरा विवाद केंद्र सरकार की एथेनॉल मिश्रित पेट्रोल (ईबीपी) योजना के इर्द-गिर्द घूमता है। इस कार्यक्रम की शुरुआत वर्ष 2014 में कच्चे तेल के आयात पर निर्भरता कम करने और स्वदेशी जैव ईंधन को बढ़ावा देने के उद्देश्य से की गई थी।
चरणबद्ध तरीके से एथेनॉल मिश्रण बढ़ाते हुए सरकार ने वर्ष 2025 में निर्धारित समय से पांच वर्ष पहले ही पेट्रोल में 20 प्रतिशत एथेनॉल मिश्रण यानी ई20 का लक्ष्य हासिल कर लिया। इसके लिए गन्ना, मक्का और चावल से तैयार एथेनॉल का उपयोग किया गया।
वरिष्ठ अधिवक्ता संदीप एस. लड्डा के माध्यम से दायर याचिका में कहा गया है कि मेटा, एक्स और गूगल जैसे डिजिटल मंचों पर गडकरी के खिलाफ बड़ी संख्या में ऐसे पोस्ट, वीडियो, रील, तस्वीरें और अन्य सामग्री उपलब्ध हैं, जिनमें तथ्यहीन, भ्रामक और मानहानिकारक आरोप लगाए गए हैं। याचिका का दावा है कि इन प्लेटफॉर्मों पर यह सामग्री अब भी सार्वजनिक रूप से देखी जा सकती है।
याचिका में आरोप लगाया गया है कि कुछ लोगों ने एआई, मॉर्फिंग और अन्य डिजिटल तकनीकों का इस्तेमाल कर गडकरी के चेहरे, आवाज, व्यक्तित्व और पहचान की नकल करते हुए फर्जी ऑडियो-वीडियो सामग्री तैयार की। यह सब उनकी जानकारी या सहमति के बिना किया गया और इसका उद्देश्य उनकी सार्वजनिक छवि को नुकसान पहुंचाना तथा ई20 नीति को लेकर लोगों के बीच भ्रम फैलाना था।
गडकरी ने लेटर्स पेटेंट एक्ट, 1866 की धारा 12 के तहत अदालत से अनुमति मांगी थी ताकि वह विधिवत दीवानी मुकदमा दायर कर सकें और अंतिम निर्णय आने तक कथित आपत्तिजनक सामग्री को हटाने के लिए अंतरिम आदेश भी प्राप्त कर सकें।
इस पूरे मामले की पृष्ठभूमि पिछले महीने नागपुर में दर्ज कराई गई उस शिकायत से जुड़ी है, जिसे भाजपा नागपुर शहर सोशल मीडिया प्रकोष्ठ के संयोजक शिशिर अरुण त्रिपाठी ने पुलिस को सौंपा था। शिकायत में आरोप लगाया गया था कि कई सोशल मीडिया खातों के जरिए गडकरी और ई20 ईंधन नीति के बारे में झूठे और भ्रामक दावे प्रसारित किए जा रहे हैं, जिससे आम लोगों में भ्रम फैल सकता है और कानून-व्यवस्था पर प्रतिकूल असर पड़ सकता है।
शिकायत के साथ उपलब्ध कराए गए डिजिटल साक्ष्यों की जांच के बाद पुलिस ने भारतीय न्याय संहिता (बीएनएस), 2023 की धाराओं 356, 352 और 296 के अलावा सूचना प्रौद्योगिकी अधिनियम, 2000 की धारा 67 के तहत प्राथमिकी दर्ज की है। मामला कथित डीपफेक वीडियो और अन्य डिजिटल सामग्री तैयार कर उसे सोशल मीडिया पर प्रसारित करने वालों के खिलाफ दर्ज किया गया है।
यह विवाद ऐसे समय सामने आया है जब ई20 ईंधन नीति को लेकर देशभर में बहस जारी है। सरकार का कहना है कि इससे पेट्रोलियम आयात में कमी आएगी और प्रदूषण घटेगा, जबकि वर्ष 2023 से पहले बने कुछ वाहनों के मालिक इसकी तकनीकी अनुकूलता और दीर्घकालिक प्रभाव को लेकर सवाल उठा रहे हैं।
हालांकि गडकरी लगातार इस योजना के पक्ष में मजबूती से खड़े रहे हैं। इसी महीने उन्होंने आलोचकों को खुली चुनौती देते हुए कहा था कि यदि ई20 पेट्रोल के कारण किसी वाहन में खराबी आई हो तो उसका एक भी प्रमाण सामने लाया जाए। उनका कहना था कि पूरे देश में ऐसा कोई प्रमाणित मामला अब तक सामने नहीं आया है।
हाईकोर्ट की शरण लेने से पहले महाराष्ट्र में कई सोशल मीडिया कंटेंट निर्माताओं के खिलाफ भी शिकायतें दर्ज कराई जा चुकी थीं। नागपुर में दर्ज शिकायत में तीन जुलाई, 2026 को यूट्यूबर मनीष कश्यप द्वारा अपलोड किए गए एक वीडियो का उल्लेख किया गया था। इसके अलावा ‘देसी बॉयज़’, ‘हर्षित राठी’ और ‘अंकलेश इनवती’ नाम से संचालित सोशल मीडिया खातों को भी शिकायत में शामिल किया गया है।
इस घटनाक्रम ने राजनीतिक रंग भी ले लिया है। धर्मेंद्र प्रधान के इस्तीफे के बाद जैसे-जैसे नीट पेपर लीक विवाद की चर्चा धीमी पड़ी, वैसे-वैसे सोशल मीडिया पर गडकरी को लेकर अभियान तेज होता दिखाई दिया। इसी दौरान ‘ई20 जनता पार्टी’ नाम से संचालित एक एक्स अकाउंट तेजी से चर्चा में आया है। इसकी तुलना ‘कॉकरोच जनता पार्टी’ से की जा रही है, जो शुरुआत में व्यंग्य मंच के रूप में उभरी थी, लेकिन बाद में दिल्ली में हुए बड़े छात्र आंदोलन का प्रमुख चेहरा बन गई थी।
