Centre Moves Tougher Anti-Paper Leak Law: Minimum 5-Year Jail, ₹10 Crore Fine, Fast-Track Courts for Time-Bound Trials

Cracking down on examination paper leaks with unprecedented severity, the Centre is set to introduce sweeping amendments to the Public Examinations (Prevention of Unfair Means) Act, 2024, proposing tougher punishments, steeper financial penalties and an accelerated judicial process.

The revised legislation, to be introduced in the Lok Sabha on Monday, seeks to restore public confidence in competitive examinations following nationwide outrage and student protests over repeated paper leak incidents.

Responding to commitments made by Prime Minister Narendra Modi after widespread protests by aspirants, the proposed legislation significantly strengthens the existing legal framework.

Besides enhancing criminal penalties, it provides for the creation of a Special Task Force, mandates time-bound investigations and introduces special fast-track courts to ensure that trials are completed within three months of the filing of a chargesheet.

Explaining the rationale behind the amendments, the Statement of Objects and Reasons accompanying the Bill states that repeated instances of question paper leaks and examination-related malpractice have undermined the transparency, fairness and credibility of public examinations.

It says the proposed changes are intended to reinforce the integrity of the examination system while ensuring prompt investigation and expeditious disposal of cases arising under the law.

Under the proposed amendments, any individual found guilty of using unfair means or committing offences connected with public examinations would face a minimum imprisonment of five years, extendable to ten years, along with a monetary penalty of up to ₹50 lakh.

This marks a substantial enhancement over the existing provisions, under which the punishment ranges from three to five years’ imprisonment with a fine of up to ₹10 lakh.

The legislation also introduces significantly harsher consequences for agencies entrusted with conducting examination-related services.

A service provider found guilty could be fined up to ₹5 crore, while the proportionate expenditure incurred in conducting the examination would also be recovered from it.

In addition, such an organisation would be prohibited from participating in any public examination work for a period of eight years.

At present, the maximum fine is ₹1 crore and the debarment period is four years.

Liability has also been expanded to cover individuals occupying key positions within service provider companies.

Directors, members of senior management and other persons responsible for the functioning of such organisations, if found culpable during investigation, would face enhanced financial penalties of up to ₹5 crore, replacing the existing ceiling of ₹2 crore.

The minimum imprisonment prescribed under the amended law would also increase from three years to five years.

The proposed Bill adopts an even stricter approach towards organised crime involving examination paper leaks.

Individuals or organised groups responsible for orchestrating such offences could face imprisonment ranging from a minimum of seven years to a maximum of ten years, besides a fine that may extend to ₹10 crore.

Union Minister of State (Independent Charge) for Personnel, Public Grievances and Pensions, Dr Jitendra Singh, who has been holding discussions with student groups alongside Union Health Minister J P Nadda, is scheduled to table the legislation in the Lok Sabha on Monday.

One of the most significant reforms proposed in the Bill is the insertion of two new provisions—Sections 12A and 12B—to ensure swift investigation and speedy disposal of cases.

While the existing law provides for investigation by central agencies, the amended legislation empowers the government to constitute a Special Task Force or Special Investigation Team whenever required.

The proposed provisions mandate that every investigation undertaken by a Central investigating agency or a Special Investigation Team must be completed within two months from the date on which the Central Government formally refers the matter for inquiry.

The objective is to eliminate prolonged investigations that often delay criminal proceedings.

To fast-track judicial proceedings, the Bill requires every State Government and Union Territory Administration, in consultation with the Chief Justice of the respective High Court, to notify a Sessions Court as a Special Fast-Track Court for trying offences under the Act.

These designated courts would exclusively handle cases arising from examination-related offences.

The legislation further prescribes that trials must proceed on a day-to-day basis until the examination of all available witnesses is completed.

Adjournments beyond the following day would be permitted only if the Special Fast-Track Court records specific reasons in writing.

Most importantly, every trial must be concluded within three months from the date of filing of the chargesheet.

Appeal provisions have also been comprehensively restructured. The Bill stipulates that any appeal against the judgment, sentence or order of a Special Fast-Track Court—except interlocutory orders—shall lie before the concerned High Court.

Such appeals are to be heard by a Division Bench comprising two judges and, as far as practicable, disposed of within three months from the date of admission.

The legislation further clarifies that no appeal or revision shall ordinarily lie against orders passed by the Special Fast-Track Court, including interlocutory orders.

However, appeals against orders granting or refusing bail would remain maintainable before the High Court.

Stringent timelines have also been introduced for filing appeals. Aggrieved parties must approach the High Court within 30 days from the date of the judgment, sentence or order.

Although the court may condone delays if sufficient cause is shown, no appeal would be entertained after the expiry of 90 days, thereby ensuring finality and expeditious resolution of cases.

देशभर में प्रतियोगी परीक्षाओं के प्रश्नपत्र लीक होने की घटनाओं पर कठोर अंकुश लगाने के उद्देश्य से केंद्र सरकार लोक परीक्षा (अनुचित साधनों की रोकथाम) अधिनियम, 2024 में व्यापक संशोधन लाने जा रही है।

सोमवार को लोकसभा में पेश किए जाने वाले संशोधन विधेयक में कठोर सजा, भारी आर्थिक दंड और समयबद्ध न्यायिक प्रक्रिया का प्रावधान किया गया है।

सरकार का मानना है कि इन बदलावों से परीक्षा प्रणाली की विश्वसनीयता और पारदर्शिता को नई मजबूती मिलेगी।

प्रतियोगी परीक्षाओं में लगातार सामने आए पेपर लीक मामलों और उनके विरोध में देशभर में छात्रों द्वारा किए गए आंदोलनों के बाद प्रधानमंत्री नरेंद्र मोदी द्वारा किए गए आश्वासनों को अमलीजामा पहनाने के लिए यह संशोधन तैयार किया गया है।

प्रस्तावित कानून में विशेष कार्यबल के गठन, निर्धारित समय सीमा में जांच पूरी करने तथा विशेष फास्ट-ट्रैक अदालतों के माध्यम से मामलों का शीघ्र निस्तारण सुनिश्चित करने की व्यवस्था की गई है।

विधेयक के उद्देश्य एवं कारणों के विवरण में कहा गया है कि हाल के वर्षों में प्रश्नपत्र लीक और अन्य परीक्षा संबंधी अनियमितताओं ने सार्वजनिक परीक्षाओं की निष्पक्षता, पारदर्शिता और विश्वसनीयता को गंभीर रूप से प्रभावित किया है।

इसलिए परीक्षा प्रणाली को अधिक भरोसेमंद बनाने, अपराधों की समयबद्ध जांच सुनिश्चित करने और मामलों का शीघ्र निपटारा करने के लिए मौजूदा कानून में संशोधन आवश्यक हो गया है।

प्रस्तावित संशोधन के अनुसार यदि कोई व्यक्ति परीक्षा में अनुचित साधनों का प्रयोग करता है अथवा ऐसे अपराध में दोषी पाया जाता है तो उसे कम से कम पांच वर्ष के कारावास की सजा होगी, जिसे बढ़ाकर दस वर्ष तक किया जा सकेगा।

इसके साथ उस पर अधिकतम ₹50 लाख तक का जुर्माना भी लगाया जा सकेगा। वर्तमान कानून में यही सजा तीन से पांच वर्ष की कैद और ₹10 लाख तक के जुर्माने तक सीमित है।

परीक्षा संचालन से जुड़े सेवा प्रदाताओं के खिलाफ भी कानून को कहीं अधिक कठोर बनाया गया है। दोषी पाए जाने पर संबंधित संस्था पर ₹5 करोड़ तक का जुर्माना लगाया जाएगा।

इतना ही नहीं, परीक्षा आयोजित कराने में हुए अनुपातिक खर्च की वसूली भी उसी संस्था से की जाएगी। इसके अतिरिक्त उसे आठ वर्षों तक किसी भी सार्वजनिक परीक्षा से संबंधित कार्य करने से प्रतिबंधित कर दिया जाएगा।

मौजूदा कानून में यह जुर्माना ₹1 करोड़ तथा प्रतिबंध की अवधि चार वर्ष है।

संशोधित विधेयक सेवा प्रदाता कंपनियों के निदेशकों, वरिष्ठ प्रबंधन और जिम्मेदार अधिकारियों की जवाबदेही भी बढ़ाता है।

जांच में दोष सिद्ध होने पर ऐसे अधिकारियों पर ₹5 करोड़ तक का जुर्माना लगाया जा सकेगा, जबकि वर्तमान सीमा ₹2 करोड़ है।

इनके लिए न्यूनतम कारावास भी तीन वर्ष से बढ़ाकर पांच वर्ष प्रस्तावित किया गया है।

संगठित तरीके से किए गए पेपर लीक मामलों के प्रति सरकार ने और भी कठोर रुख अपनाया है।

यदि कोई व्यक्ति या संगठित गिरोह प्रश्नपत्र लीक जैसी साजिश में शामिल पाया जाता है तो उसे कम से कम सात वर्ष और अधिकतम दस वर्ष तक की कैद के साथ ₹10 करोड़ तक के जुर्माने का सामना करना पड़ेगा।

कार्मिक, लोक शिकायत एवं पेंशन विभाग के केंद्रीय राज्य मंत्री (स्वतंत्र प्रभार) डॉ. जितेंद्र सिंह सोमवार को इस विधेयक को लोकसभा में प्रस्तुत करेंगे। छात्र संगठनों के साथ सरकार की ओर से संवाद स्थापित करने में केंद्रीय स्वास्थ्य मंत्री जे.पी. नड्डा के साथ डॉ. सिंह भी प्रमुख भूमिका निभा रहे हैं।

विधेयक की सबसे महत्वपूर्ण विशेषताओं में दो नई धाराओं—12ए और 12बी—को जोड़ा जाना शामिल है। इन प्रावधानों के माध्यम से जांच और मुकदमे दोनों को निर्धारित समय सीमा में पूरा करने का लक्ष्य रखा गया है। जहां वर्तमान कानून में केंद्रीय एजेंसियों द्वारा जांच का प्रावधान है, वहीं नया कानून सरकार को विशेष कार्यबल या विशेष जांच दल गठित करने का अधिकार भी देगा।

प्रस्तावित व्यवस्था के अनुसार केंद्रीय जांच एजेंसी अथवा विशेष जांच दल को केंद्र सरकार द्वारा मामला सौंपे जाने की तारीख से दो महीने के भीतर जांच पूरी करनी होगी। इसका उद्देश्य लंबी जांच प्रक्रियाओं के कारण न्यायिक कार्रवाई में होने वाली देरी को समाप्त करना है।

न्यायिक प्रक्रिया को तेज बनाने के लिए प्रत्येक राज्य सरकार और केंद्र शासित प्रदेश प्रशासन को संबंधित उच्च न्यायालय के मुख्य न्यायाधीश से परामर्श कर एक सत्र न्यायालय को विशेष फास्ट-ट्रैक अदालत के रूप में अधिसूचित करना होगा। यही अदालतें इस कानून के तहत दर्ज मामलों की सुनवाई करेंगी।

विधेयक में स्पष्ट किया गया है कि मुकदमे की कार्यवाही प्रतिदिन चलेगी और उपस्थित सभी गवाहों की गवाही पूरी होने तक सुनवाई जारी रहेगी। यदि अगली तारीख से आगे स्थगन देना आवश्यक हो तो अदालत को उसके कारण लिखित रूप में दर्ज करने होंगे। सबसे महत्वपूर्ण प्रावधान यह है कि आरोपपत्र दाखिल होने की तारीख से तीन महीने के भीतर मुकदमे का फैसला सुनाना अनिवार्य होगा।

अपील संबंधी प्रावधानों में भी व्यापक बदलाव प्रस्तावित किए गए हैं। विशेष फास्ट-ट्रैक अदालत के निर्णय, सजा या आदेश—अंतरिम आदेशों को छोड़कर—के विरुद्ध संबंधित उच्च न्यायालय में अपील की जा सकेगी। ऐसी अपील दो न्यायाधीशों की खंडपीठ द्वारा सुनी जाएगी और यथासंभव तीन महीने के भीतर उसका निस्तारण किया जाएगा।

संशोधित कानून यह भी स्पष्ट करता है कि विशेष फास्ट-ट्रैक अदालत के अंतरिम आदेशों सहित अन्य आदेशों के विरुद्ध सामान्य अपील या पुनरीक्षण का अधिकार उपलब्ध नहीं होगा। हालांकि जमानत देने या जमानत अस्वीकार करने संबंधी आदेशों को उच्च न्यायालय में चुनौती दी जा सकेगी।

अपील दाखिल करने के लिए भी सख्त समय-सीमा निर्धारित की गई है। किसी भी निर्णय, सजा या आदेश के विरुद्ध 30 दिनों के भीतर उच्च न्यायालय का दरवाजा खटखटाना होगा। यदि पर्याप्त कारण हो तो अदालत विलंब को माफ कर सकती है, लेकिन 90 दिन की अवधि समाप्त होने के बाद कोई अपील स्वीकार नहीं की जाएगी। इस व्यवस्था का उद्देश्य न्यायिक प्रक्रिया को अनावश्यक रूप से लंबा खिंचने से रोकना और मामलों का शीघ्र अंतिम निस्तारण सुनिश्चित करना है।
