Allahabad High Court Declines to Entertain Jauhar Trust Plea After Commissioner Stays Demolition of 38 University Buildings

Prayagraj: Judicial proceedings concerning the proposed demolition of structures at Mohammad Ali Jauhar University took a fresh turn on Wednesday after the Allahabad High Court declined to entertain a writ petition filed by the Maulana Ali Jauhar Trust.
The court noted that the matter was already under consideration before the competent appellate authority, where interim protection had been granted against the demolition notices.
During the hearing, counsel appearing for the Trust informed the Bench that following the issuance of the demolition notices, the management had challenged the action before the Commissioner, Moradabad Division, who functions as the statutory appellate authority.
It was submitted that the appeal had already resulted in an interim order, making further proceedings before the High Court unnecessary at this stage.
The appellate proceedings had yielded immediate relief for the university.
On July 27, Moradabad Divisional Commissioner Aunjaneya Kumar Singh ordered a stay on the proposed demolition of 38 buildings situated within the Mohammad Ali Jauhar University campus, effectively putting the planned action on hold until the appeal is decided on the merits.
Taking note of this subsequent development, the Division Bench comprising Justice Mahesh Chandra Tripathi and Justice Kunal Ravi Singh dismissed the writ petition as not requiring adjudication for the present.
The Bench observed that, in view of the interim protection already granted by the appellate authority, there was no occasion for the High Court to intervene at this stage.
The demolition controversy had resurfaced after the Rampur Development Authority (RDA) served notices directing the university management to remove 38 structures allegedly raised without authorisation.
The notices warned that if the buildings were not removed within 15 days, the authority would proceed with demolition in accordance with law.
The latest legal developments have once again placed Mohammad Ali Jauhar University at the centre of public attention.
The institution, long associated with senior Samajwadi Party leader Azam Khan, has frequently figured in legal and political discussions, and the fresh action has reignited debate over the university’s regulatory compliance and its future.
Established in 2006 under the Mohammad Ali Jauhar Trust by Samajwadi Party leader Azam Khan, the university was accorded university status in 2012.
Spread across an expansive campus in Rampur, it has emerged as one of the region’s prominent educational institutions, offering programmes in medicine, engineering, law, agriculture, education and the humanities.
The campus also houses a medical college, a teaching hospital, hostels and residential accommodation, making it a significant academic and healthcare hub in the district.

रामपुर स्थित मोहम्मद अली जौहर विश्वविद्यालय से जुड़े ध्वस्तीकरण विवाद में बुधवार को नया कानूनी घटनाक्रम सामने आया, जब इलाहाबाद हाईकोर्ट ने मौलाना अली जौहर ट्रस्ट की ओर से दाखिल रिट याचिका पर सुनवाई से इनकार करते हुए उसे इस चरण पर खारिज कर दिया।
अदालत ने माना कि मामला पहले ही सक्षम अपीलीय प्राधिकारी के समक्ष लंबित है, जहां विश्वविद्यालय को अंतरिम राहत मिल चुकी है।
सुनवाई के दौरान ट्रस्ट की ओर से अदालत को बताया गया कि ध्वस्तीकरण नोटिस जारी होने के बाद उसके विरुद्ध मोरादाबाद मंडल के आयुक्त के समक्ष अपील दायर की गई थी।
याचिकाकर्ता की ओर से यह भी अवगत कराया गया कि आयुक्त, जो इस मामले में अपीलीय प्राधिकारी हैं, अपील पर सुनवाई करते हुए पहले ही अंतरिम आदेश पारित कर चुके हैं।
अपील पर विचार करते हुए मोरादाबाद मंडल के आयुक्त औंजनेय कुमार सिंह ने 27 जुलाई को मोहम्मद अली जौहर विश्वविद्यालय परिसर में स्थित 38 भवनों के प्रस्तावित ध्वस्तीकरण पर रोक लगा दी थी।
इसके साथ ही अपील के अंतिम निर्णय तक ध्वस्तीकरण की पूरी कार्रवाई स्थगित कर दी गई।
इस बीच हुए घटनाक्रम को ध्यान में रखते हुए न्यायमूर्ति महेश चन्द्र त्रिपाठी और न्यायमूर्ति कुनाल रवि सिंह की खंडपीठ ने कहा कि फिलहाल इस रिट याचिका पर विचार करने का कोई औचित्य नहीं बनता।
अदालत ने अंतरिम संरक्षण दिए जाने के मद्देनजर याचिका को इसी स्तर पर निरस्त कर दिया।
पूरा विवाद उस समय फिर से सुर्खियों में आया, जब रामपुर विकास प्राधिकरण (आरडीए) ने विश्वविद्यालय प्रबंधन को 38 कथित अनधिकृत भवनों को हटाने का नोटिस जारी किया।
नोटिस में स्पष्ट किया गया था कि यदि 15 दिनों के भीतर इन संरचनाओं को स्वयं नहीं हटाया गया, तो प्राधिकरण नियमानुसार ध्वस्तीकरण की कार्रवाई करेगा।
इस ताजा कानूनी घटनाक्रम ने एक बार फिर मोहम्मद अली जौहर विश्वविद्यालय को सार्वजनिक और राजनीतिक विमर्श के केंद्र में ला खड़ा किया है।
वरिष्ठ समाजवादी पार्टी नेता आजम खान से जुड़ा यह संस्थान पहले भी अनेक कानूनी और राजनीतिक विवादों का हिस्सा रहा है और ध्वस्तीकरण की कार्रवाई ने एक बार फिर बहस को तेज कर दिया है।
मोहम्मद अली जौहर ट्रस्ट के माध्यम से समाजवादी पार्टी के वरिष्ठ नेता आजम खान ने वर्ष 2006 में इस विश्वविद्यालय की स्थापना की थी। वर्ष 2012 में इसे विश्वविद्यालय का दर्जा प्रदान किया गया।
रामपुर में विस्तृत परिसर में फैला यह संस्थान चिकित्सा, इंजीनिय
रिंग, विधि, कृषि, शिक्षा और मानविकी सहित अनेक विषयों में उच्च शिक्षा उपलब्ध कराता है।
परिसर में मेडिकल कॉलेज, अस्पताल, छात्रावास और आवासीय सुविधाएं भी मौजूद हैं, जिससे यह क्षेत्र का एक प्रमुख शैक्षणिक एवं स्वास्थ्य संस्थान माना जाता है।
