CJI Surya Kant Says Rajasthan High Court Allegations Will Be Examined Through Institutional Process
Chief Justice of India Surya Kant says complaints raised against Rajasthan High Court Acting Chief Justice Sanjeev Prakash Sharma will be examined through established institutional procedures, with due process and a fair opportunity to respond.
Responding to concerns raised by Justice Sanjeep Mehta against Acting Chief Justice Sanjeev Prakash Sharma, the Chief Justice of India says allegations alone cannot be treated as proof and the accused judge must be allowed to respond.
New Delhi: Chief Justice of India Surya Kant has said that serious allegations made against Rajasthan High Court Acting Chief Justice Sanjeev Prakash Sharma will be handled through the judiciary’s established institutional framework, making it clear that no adverse conclusion can be drawn merely because complaints have been raised.
The CJI’s remarks came after Supreme Court judge Justice Sanjeep Mehta wrote a series of letters flagging alleged administrative irregularities and raising concerns over the functioning of the Rajasthan High Court.
Justice Mehta has reportedly pressed for the immediate appointment of a permanent chief justice from outside Rajasthan, arguing that a change in leadership was necessary to prevent further institutional damage.
However, CJI Kant said matters involving allegations against a sitting member of the higher judiciary could not be decided based on public discussion or individual accusations alone.
According to the CJI, Justice Sharma must be given a full and fair opportunity to present his version before any decision is taken.
The Chief Justice of India emphasised that the existence of an allegation cannot automatically be regarded as evidence of wrongdoing or treated as a finding against the judge concerned.
He said the concerns raised in Justice Mehta’s communications had been noted by him and other senior members of the Supreme Court collegium.
The matter is being examined through the appropriate channel, with both the allegations and the response of the judge concerned expected to form part of the decision-making process.
Any decision regarding Justice Sharma’s administrative position, possible transfer, continuation in office or other action, the CJI said, would be taken only by the competent institutional authority after considering the relevant material.
CJI Kant also indicated that the collegium’s work concerning the appointment of chief justices to the remaining high courts was already underway.
The controversy began after Justice Mehta, a former judge of the Rajasthan High Court before his elevation to the Supreme Court, wrote three successive letters to the Chief Justice of India concerning the administration of his parent high court.
In those communications, he reportedly levelled serious allegations against Justice Sharma, including claims of corruption, nepotism, favouritism and improper exercise of administrative authority.
Justice Mehta also raised objections to the manner in which judicial rosters were allegedly being managed.
He claimed that some cases were being removed from benches to which they had originally been assigned and placed before Justice Sharma’s court.
In one of his letters, Justice Mehta said he had earlier brought several such matters to the attention of the Chief Justice of India.
He said he was initially asked to compile details of the cases in question, but later received an indication that formal written documentation was not required and that appropriate steps would be considered.
Justice Mehta nevertheless expressed dissatisfaction over the absence of what he considered a decisive intervention.
He said his request for the appointment of a chief justice from outside the state had not resulted in a positive outcome.
The Supreme Court judge also said that he had received multiple complaints relating to Justice Sharma’s judicial functioning and claimed that, in his assessment, the material raised questions about the acting chief justice’s integrity.
The allegations have not been treated as established findings, and CJI Kant’s intervention has placed the dispute firmly within the judiciary’s internal decision-making mechanism.
The controversy now moves into a process where the complaints, supporting material and Justice Sharma’s response are expected to be considered before the competent authority decides whether any administrative action is warranted.

नई दिल्ली: राजस्थान हाई कोर्ट के कार्यवाहक मुख्य न्यायाधीश जस्टिस संजीव प्रकाश शर्मा के खिलाफ सुप्रीम कोर्ट के न्यायाधीश जस्टिस संजीव मेहता द्वारा उठाए गए गंभीर सवालों पर भारत के मुख्य न्यायाधीश सूर्यकांत ने कहा है कि मामला निर्धारित संस्थागत व्यवस्था के अनुसार देखा जाएगा।
मुख्य न्यायाधीश ने स्पष्ट किया कि किसी न्यायाधीश के खिलाफ शिकायत या आरोप सामने आ जाने भर से उसे सही मानकर फैसला नहीं किया जा सकता।
संबंधित न्यायाधीश को अपना पक्ष रखने का उचित और निष्पक्ष अवसर देना भी न्यायिक प्रक्रिया का अनिवार्य हिस्सा है।
CJI सूर्यकांत ने कहा कि जस्टिस मेहता द्वारा उठाए गए मुद्दों पर सुप्रीम कोर्ट कॉलेजियम के वरिष्ठ सदस्यों ने संज्ञान लिया है।
हालांकि, ऐसे मामलों को सार्वजनिक बहस के आधार पर तय नहीं किया जा सकता और उनकी जांच सक्षम संस्थागत स्तर पर ही की जाएगी।
यह विवाद जस्टिस संजीव मेहता द्वारा मुख्य न्यायाधीश को भेजे गए लगातार तीन पत्रों के बाद सामने आया।
इन पत्रों में उन्होंने राजस्थान हाई कोर्ट के प्रशासन और कार्यवाहक मुख्य न्यायाधीश के कामकाज को लेकर गंभीर आरोप लगाए थे।
जस्टिस मेहता ने राजस्थान हाई कोर्ट में किसी अन्य राज्य से मुख्य न्यायाधीश की नियुक्ति करने की मांग की थी।
उनका तर्क था कि मौजूदा स्थिति के कारण संस्था की प्रतिष्ठा और कार्यप्रणाली को नुकसान पहुंचने का खतरा पैदा हो रहा है।
CJI ने अपने रुख में कहा कि जस्टिस शर्मा के खिलाफ लगाए गए आरोपों पर विचार करते समय उनका जवाब भी उतनी ही गंभीरता से देखा जाएगा।
शिकायतों और उनके समर्थन में पेश की गई सामग्री के साथ-साथ संबंधित न्यायाधीश की प्रतिक्रिया पर विचार किए बिना कोई निष्कर्ष निकालना उचित नहीं होगा।
उन्होंने कहा कि जस्टिस शर्मा के पद पर बने रहने, उनके स्थानांतरण या किसी अन्य प्रशासनिक कार्रवाई से संबंधित फैसला सक्षम प्राधिकरण ही उपलब्ध सामग्री पर विचार करने के बाद करेगा।
मुख्य न्यायाधीश ने यह भी संकेत दिया कि देश के जिन उच्च न्यायालयों में अभी मुख्य न्यायाधीशों की नियुक्ति होनी बाकी है, उनके संबंध में कॉलेजियम पहले से काम कर रहा है।
जस्टिस मेहता ने अपने पत्रों में जस्टिस संजीव प्रकाश शर्मा पर भ्रष्टाचार, भाई-भतीजावाद, पक्षपात और प्रशासनिक शक्तियों के कथित दुरुपयोग जैसे गंभीर आरोप लगाए हैं।
उन्होंने विशेष रूप से मामलों के आवंटन और न्यायिक रोस्टर से संबंधित निर्णयों पर सवाल उठाए। जस्टिस मेहता का आरोप है कि कुछ मामलों को अन्य पीठों से हटाकर जस्टिस शर्मा की अदालत में भेजा गया।
2 अगस्त को लिखे अपने एक पत्र में जस्टिस मेहता ने कहा कि वह पहले भी ऐसे मामलों को मुख्य न्यायाधीश के संज्ञान में ला चुके थे।
उनके अनुसार, शुरुआत में उनसे संबंधित मामलों की सूची देने के लिए कहा गया था, लेकिन बाद में उन्हें संकेत दिया गया कि आरोपों को औपचारिक रूप से लिखित रूप में दर्ज कराने की आवश्यकता नहीं है और उचित कार्रवाई की जाएगी।
इसके बावजूद, जस्टिस मेहता ने कहा कि राजस्थान के बाहर से मुख्य न्यायाधीश नियुक्त करने के उनके आग्रह पर अब तक कोई सकारात्मक परिणाम नहीं आया।
राजस्थान हाई कोर्ट से जुड़े रहे जस्टिस मेहता ने यह भी कहा कि उन्हें जस्टिस शर्मा की न्यायिक कार्यप्रणाली के संबंध में कई शिकायतें मिली हैं।
उनके अनुसार, इन शिकायतों से प्रथम दृष्टया जस्टिस शर्मा की निष्पक्षता और सत्यनिष्ठा को लेकर सवाल उठते हैं।
फिलहाल CJI सूर्यकांत ने साफ कर दिया है कि शिकायतों को स्वतः दोष सिद्ध होने के रूप में नहीं देखा जाएगा।
अब इस पूरे मामले का अगला चरण न्यायपालिका की आंतरिक संस्थागत प्रक्रिया में होगा, जहां आरोपों, उपलब्ध सामग्री और जस्टिस शर्मा के जवाब पर विचार करने के बाद ही किसी संभावित प्रशासनिक निर्णय की दिशा तय की जाएगी।
