Delhi Court Clears Trial in Absentia of UK-Based Gangster Kapil Sangwan Under MCOCA
Legal proceedings against fugitive gangster Kapil Sangwan, who is believed to be living in the United Kingdom, are set to enter a crucial phase as a Delhi court commences trial proceedings in his absence under the Maharashtra Control of Organised Crime Act (MCOCA).
The prosecution alleges that Sangwan continued to operate a criminal network from overseas while directing organised offences in the national capital and adjoining regions.
While passing an order on July 9, Special CBI Judge Vishal Gogne of the Rouse Avenue Courts observed that repeated efforts to secure Sangwan’s presence had failed.
The court noted that non-bailable warrants issued against him remained unexecuted, his residence was found locked during execution attempts, and reports indicated that he had not been seen there for a considerable period.
The judge recorded that all statutory safeguards prescribed under Section 356(2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for conducting proceedings against an absconding accused had been duly complied with by the prosecution.
Having examined the material placed before it, the court held that there was no legal obstacle in moving ahead with the case by taking up arguments on framing of charges.
Section 356(2) of the BNSS lays down stringent procedural requirements before an absconding proclaimed offender can be tried in absentia, including issuance of two successive warrants, publication of notices in the locality and through the media, besides informing the accused’s family members.
The court also observed that Sangwan, also known as Nandu, was not represented by any legal counsel.
Invoking Section 356(3) of the BNSS, the judge directed the Delhi State Legal Services Authority (DLSA) to appoint a lawyer to defend him during the proceedings.
Investigators believe Sangwan has been operating from Britain while allegedly controlling a criminal syndicate accused of involvement in extortion, murder, attempted murder, firing incidents and criminal intimidation.
Police claim the gang primarily targeted builders, property dealers and businessmen in Delhi and neighbouring areas through threats and extortion demands.
The organised crime case was registered by the Anti-Gang Squad of the Delhi Police Crime Branch in 2024 under Sections 3 and 4 of the MCOCA.
According to the first information report, the syndicate allegedly indulged in continuous unlawful activities through a structured criminal network engaged in extortion and other violent crimes.
Besides Sangwan, the FIR names 11 other accused, including former Aam Aadmi Party MLA Naresh Balyan.
The MCOCA prosecution traces its origin to an extortion complaint lodged by Gurcharan, a resident of Mohan Garden in west Delhi.
He alleged that he received an extortion call from Kapil Sangwan in July 2023.
During the investigation, police claimed that the alleged involvement of former AAP legislator Naresh Balyan emerged, with investigators alleging that he played a direct role in facilitating the extortion attempt on behalf of the gangster.
According to the Crime Branch, the investigation established that Sangwan remained outside India while allegedly issuing extortion threats through members of his network.
Officials concluded that this case, along with several other extortion incidents under investigation, reflected a pattern of organised criminal activity, prompting the invocation of the stringent provisions of the MCOCA.
The court further directed that, since all accused except one are presently in judicial custody, arguments on framing of charges should be heard on a day-to-day basis to ensure expeditious progress in the trial.

विदेश में छिपकर कथित रूप से संगठित आपराधिक गिरोह संचालित करने के आरोपों का सामना कर रहे गैंगस्टर कपिल सांगवान के खिलाफ दिल्ली की एक अदालत में अब उसकी अनुपस्थिति में मुकदमे की कार्यवाही शुरू होने जा रही है।
महाराष्ट्र संगठित अपराध नियंत्रण अधिनियम (एमसीओसीए) के तहत दर्ज इस मामले में अभियोजन पक्ष का आरोप है कि सांगवान ब्रिटेन में रहते हुए भी दिल्ली और आसपास के क्षेत्रों में आपराधिक गतिविधियों का संचालन करता रहा।
राउज एवेन्यू स्थित विशेष सीबीआई अदालत के न्यायाधीश विशाल गोगने ने 9 जुलाई को पारित आदेश में कहा कि आरोपी की गिरफ्तारी के लिए जारी गैर-जमानती वारंटों का पालन नहीं कराया जा सका।
अदालत ने उल्लेख किया कि पुलिस जब उसके आवास पर पहुंची तो मकान बंद मिला और यह भी रिपोर्ट दी गई कि वह लंबे समय से वहां दिखाई नहीं दिया है।
न्यायालय ने माना कि फरार आरोपी के विरुद्ध अनुपस्थिति में मुकदमा चलाने के लिए भारतीय नागरिक सुरक्षा संहिता (बीएनएसएस) की धारा 356(2) के तहत निर्धारित सभी आवश्यक कानूनी औपचारिकताओं का राज्य सरकार द्वारा पालन किया जा चुका है।
रिकॉर्ड का परीक्षण करने के बाद अदालत ने कहा कि आरोप तय करने की प्रक्रिया आगे बढ़ाने में अब कोई कानूनी बाधा शेष नहीं है।
बीएनएसएस की धारा 356(2) के अनुसार किसी घोषित फरार आरोपी के विरुद्ध उसकी गैरमौजूदगी में मुकदमा शुरू करने से पहले लगातार दो वारंट जारी करना, स्थानीय स्तर और मीडिया के माध्यम से नोटिस प्रकाशित करना तथा उसके परिजनों को सूचित करना अनिवार्य प्रक्रिया का हिस्सा है।
अदालत ने यह भी पाया कि कपिल सांगवान उर्फ नंदू की ओर से कोई अधिवक्ता उपस्थित नहीं है। इसके मद्देनजर बीएनएसएस की धारा 356(3) के तहत दिल्ली राज्य विधिक सेवा प्राधिकरण (डीएलएसए) को उसके बचाव के लिए अधिवक्ता नियुक्त करने का निर्देश दिया गया।
जांच एजेंसियों का दावा है कि सांगवान ब्रिटेन से अपने गिरोह का संचालन कर रहा था और उसके सिंडिकेट पर रंगदारी, हत्या, हत्या के प्रयास, फायरिंग तथा आपराधिक धमकी जैसे अनेक मामलों में संलिप्त होने के आरोप हैं।
पुलिस के अनुसार गिरोह मुख्य रूप से दिल्ली और आसपास के क्षेत्रों के बिल्डरों, प्रॉपर्टी डीलरों और कारोबारियों को निशाना बनाकर वसूली करता था।
दिल्ली पुलिस की अपराध शाखा के एंटी-गैंग स्क्वॉड ने वर्ष 2024 में एमसीओसीए की धाराओं 3 और 4 के तहत इस संगठित अपराध का मामला दर्ज किया था।
प्राथमिकी में आरोप लगाया गया कि सांगवान का गिरोह लगातार गैरकानूनी गतिविधियों में संलिप्त एक संगठित आपराधिक नेटवर्क के रूप में काम कर रहा था, जो रंगदारी और हिंसक अपराधों को अंजाम देता था।
इस मामले में कपिल सांगवान के अलावा 11 अन्य आरोपियों को भी नामजद किया गया है, जिनमें पूर्व आम आदमी पार्टी विधायक नरेश बालियान भी शामिल हैं।
एमसीओसीए के तहत शुरू हुई यह कार्रवाई पश्चिमी दिल्ली के मोहन गार्डन निवासी गुरचरण द्वारा दर्ज कराई गई रंगदारी की शिकायत से जुड़ी है।
शिकायतकर्ता का आरोप था कि जुलाई 2023 में उसे कपिल सांगवान की ओर से रंगदारी के लिए फोन आया था।
जांच के दौरान पुलिस ने दावा किया कि पूर्व विधायक नरेश बालियान की कथित भूमिका भी सामने आई और उन पर सांगवान की ओर से रंगदारी की कोशिश में प्रत्यक्ष रूप से शामिल होने का आरोप लगाया गया।
अपराध शाखा की जांच में यह निष्कर्ष निकाला गया कि सांगवान विदेश में रहकर अपने सहयोगियों के माध्यम से रंगदारी की धमकियां दिलवा रहा था।
जांच अधिकारियों का मानना है कि इस मामले सहित कई अन्य घटनाएं संगठित आपराधिक गतिविधियों की एक सतत श्रृंखला का हिस्सा थीं, जिसके आधार पर एमसीओसीए की कठोर धाराएं लागू की गईं।
अदालत ने यह भी निर्देश दिया कि एक आरोपी को छोड़कर सभी न्यायिक हिरासत में हैं, इसलिए आरोप तय करने संबंधी बहस प्रतिदिन की आधार पर संचालित की जाएगी ताकि मुकदमे की सुनवाई में अनावश्यक विलंब न हो।
