Delhi HC Seeks Daily Medical Monitoring of Sonam Wangchuk as Centre Assures Care During Hunger Strike
New Delhi: With growing concern over the deteriorating health of environmentalist and education reform advocate Sonam Wangchuk, who has been on an indefinite hunger strike demanding the resignation of Union Education Minister Dharmendra Pradhan, the Central Government on Thursday assured the Delhi High Court that his health would be examined every day and all necessary medical assistance would be provided whenever required.
The assurance came during the hearing of a Public Interest Litigation (PIL) filed before the Delhi High Court by an advocate, who alleged that the 59-year-old activist was being treated in an insensitive manner despite his rapidly declining health.
The petitioner urged the court to direct the authorities to provide immediate medical care and, if necessary, administer nutrition through medical intervention to safeguard Wangchuk’s life.
Wangchuk has been observing a hunger strike at Jantar Mantar for the past 19 days as part of a protest organised by the Cockroach Janta Party (CJP).
The agitation is centred on the demand for the resignation of the Union Education Minister following the controversy surrounding the NEET-UG examination paper leak.
Hearing the matter, a Division Bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia sought clarification from Solicitor General Tushar Mehta, who appeared for both the Central and Delhi governments, regarding the medical supervision being provided to the activist.
The Bench specifically asked whether a regular mechanism existed to monitor Wangchuk’s health and whether the government had access to his medical reports.
Responding to the court’s queries, the Solicitor General informed the Bench that Wangchuk’s condition was being examined and that private doctors had also been visiting him from time to time.
He expressed no objection to the court’s suggestion that government medical experts should carry out regular health assessments.
Observing that every human life is invaluable, Chief Justice Upadhyaya remarked that government doctors should examine Wangchuk on a routine basis and take immediate medical action if his condition worsens.
He emphasised that any required intervention should be undertaken promptly in accordance with medical opinion.
While disposing of the petition, the High Court recorded the assurances given by the Solicitor General.
The order noted that the government had undertaken to ensure daily clinical monitoring of Wangchuk’s health by qualified government doctors and specialists.
The Bench further recorded that any medical treatment considered necessary by doctors to prevent further deterioration in Wangchuk’s condition would be provided without delay.
Appreciating the government’s stand, the court reiterated that protecting the life of every citizen remains a fundamental responsibility of the State.
Accordingly, the High Court directed the authorities to continue daily medical examination of the activist and ensure timely medical intervention whenever recommended by healthcare professionals.
In his petition, advocate R.K. Saini alleged that the authorities were behaving as though Wangchuk were “a hardened criminal, terrorist or traitor”, instead of responding with compassion to a peaceful protest.
He argued that the government’s approach reflected indifference towards the activist’s worsening physical condition.
The petitioner further submitted that the authorities should, at the very least, ensure that Wangchuk receives immediate medical treatment to preserve his health and save his life.
He urged the court to direct the government to shift the activist to a government hospital and, if required, provide essential nutrients, vitamins, and minerals through medically supervised liquid nutrition, even without his consent if doctors considered it necessary to protect his life.

पर्यावरणविद् और शिक्षा सुधार के पक्षधर सोनम वांगचुक की लगातार बिगड़ती सेहत को लेकर बढ़ती चिंताओं के बीच केंद्र सरकार ने गुरुवार को दिल्ली हाईकोर्ट को भरोसा दिलाया कि उनकी स्वास्थ्य स्थिति की प्रतिदिन चिकित्सकीय निगरानी की जाएगी और आवश्यकता पड़ने पर तत्काल आवश्यक उपचार उपलब्ध कराया जाएगा।
वांगचुक केंद्रीय शिक्षा मंत्री धर्मेंद्र प्रधान के इस्तीफे की मांग को लेकर अनिश्चितकालीन भूख हड़ताल पर हैं।
यह आश्वासन उस जनहित याचिका की सुनवाई के दौरान दिया गया, जिसमें एक अधिवक्ता ने आरोप लगाया था कि 59 वर्षीय सामाजिक कार्यकर्ता की गिरती स्वास्थ्य स्थिति के बावजूद सरकार पर्याप्त संवेदनशीलता नहीं दिखा रही है।
याचिका में अदालत से अनुरोध किया गया था कि वांगचुक को तत्काल समुचित चिकित्सा सहायता उपलब्ध कराई जाए तथा आवश्यकता पड़ने पर चिकित्सकीय निगरानी में पोषण भी दिया जाए, ताकि उनके जीवन को किसी प्रकार का खतरा न रहे।
सोनम वांगचुक पिछले 19 दिनों से दिल्ली के जंतर-मंतर पर आमरण अनशन कर रहे हैं। यह आंदोलन कॉकरोच जनता पार्टी (सीजेपी) के नेतृत्व में चल रहा है, जिसमें नीट-यूजी प्रश्नपत्र लीक मामले को लेकर केंद्रीय शिक्षा मंत्री के इस्तीफे की मांग की जा रही है।
मामले की सुनवाई करते हुए मुख्य न्यायाधीश डी.के. उपाध्याय और न्यायमूर्ति तेजस करिया की खंडपीठ ने केंद्र और दिल्ली सरकार की ओर से उपस्थित सॉलिसिटर जनरल तुषार मेहता से पूछा कि क्या वांगचुक के स्वास्थ्य की नियमित निगरानी की जा रही है और इसके लिए कोई व्यवस्थित व्यवस्था मौजूद है।
अदालत ने यह भी जानना चाहा कि क्या सरकार के पास उनके स्वास्थ्य परीक्षण से संबंधित रिपोर्ट उपलब्ध हैं।
सॉलिसिटर जनरल ने अदालत को बताया कि वांगचुक की चिकित्सकीय जांच की जा रही है और समय-समय पर निजी चिकित्सक भी उनका स्वास्थ्य परीक्षण करते रहे हैं। उन्होंने यह भी कहा कि सरकार को इस बात पर कोई आपत्ति नहीं है कि सरकारी चिकित्सकों द्वारा नियमित रूप से उनकी स्वास्थ्य जांच की जाए।
इस दौरान मुख्य न्यायाधीश ने मौखिक टिप्पणी करते हुए कहा कि प्रत्येक नागरिक का जीवन अत्यंत मूल्यवान है और यदि चिकित्सकीय रिपोर्ट में आवश्यकता महसूस हो तो सरकार को तत्काल हस्तक्षेप करना चाहिए।
उन्होंने कहा कि स्वास्थ्य संबंधी किसी भी गंभीर स्थिति में समय पर उपचार उपलब्ध कराना सरकार की जिम्मेदारी है।
सुनवाई समाप्त करते हुए हाईकोर्ट ने सॉलिसिटर जनरल द्वारा दिए गए आश्वासनों को आदेश का हिस्सा बनाया। अदालत ने अपने आदेश में दर्ज किया कि सरकार ने वांगचुक की स्वास्थ्य स्थिति का प्रतिदिन सरकारी चिकित्सकों और विशेषज्ञों द्वारा परीक्षण कराने का भरोसा दिया है।
अदालत ने यह भी स्पष्ट किया कि यदि चिकित्सकों की राय में उनकी बिगड़ती स्थिति को नियंत्रित करने के लिए किसी प्रकार की चिकित्सा आवश्यक हो, तो उसे बिना विलंब उपलब्ध कराया जाएगा।
पीठ ने सरकार के इस रुख की सराहना करते हुए कहा कि प्रत्येक नागरिक के जीवन की रक्षा करना राज्य का दायित्व है और इसके लिए हर संभव प्रयास किया जाना चाहिए।
इसी के साथ अदालत ने निर्देश दिया कि वांगचुक के स्वास्थ्य की प्रतिदिन चिकित्सकीय निगरानी जारी रखी जाए तथा डॉक्टरों की सलाह के अनुसार आवश्यक उपचार समय पर सुनिश्चित किया जाए।
याचिकाकर्ता अधिवक्ता आर.के. सैनी ने अपनी याचिका में आरोप लगाया कि सरकार सोनम वांगचुक के साथ ऐसा व्यवहार कर रही है मानो वे कोई “खूंखार अपराधी, आतंकवादी या राष्ट्रद्रोही” हों। उन्होंने कहा कि एक शांतिपूर्ण आंदोलन कर रहे व्यक्ति की बिगड़ती स्वास्थ्य स्थिति के प्रति प्रशासन का रवैया संवेदनहीन दिखाई देता है।
याचिका में यह भी कहा गया कि सरकार का न्यूनतम दायित्व है कि वांगचुक को तत्काल समुचित चिकित्सा सुविधा उपलब्ध कराई जाए और यदि चिकित्सकीय दृष्टि से आवश्यक हो तो उन्हें सरकारी अस्पताल ले जाकर जीवन रक्षक पोषण, विटामिन और अन्य आवश्यक तत्व तरल आहार के माध्यम से उपलब्ध कराए जाएं, ताकि उनकी जान सुरक्षित रखी जा सके।
