Delhi High Court Flags Maternity-Related Concerns in Vinesh Phogat’s Wrestling Selection Plea

Court reserves order on Olympian’s request to enter 2026 World Championships trials; asks WFI to examine safeguards for athletes returning after childbirth.

The Delhi High Court reserved its order on Vinesh Phogat’s plea over wrestling selection trials and asked WFI to consider guidelines for women athletes returning after maternity leave.

The Delhi High Court on Thursday highlighted the need to examine how women wrestlers returning to competition after maternity leave are treated under the Wrestling Federation of India’s selection system, while reserving its decision on Olympian Vinesh Phogat’s plea seeking entry into the trials for the 2026 Senior World Wrestling Championships.

Justice Swarna Kanta Sharma made the observations while hearing Phogat’s challenge to the selection framework that kept her out of consideration for the championship.

The competition is scheduled to begin on October 24, while the selection trials are scheduled for September 14.

At the heart of the dispute is Phogat’s return to competitive wrestling following pregnancy, childbirth and post-partum recovery.

She has challenged the eligibility conditions applied by the WFI, arguing that their effect is to prevent her from re-entering the selection process after her break from the sport.

The court, however, noted that the prescribed eligibility requirements are intended to operate across the board.

Granting Phogat provisional participation, it observed, could effectively create a special exemption for her from criteria applicable to other wrestlers.

The bench also raised a broader question concerning athletes who temporarily step away from competitive sport because of maternity.

It said the WFI should consider developing a framework that allows women returning after maternity leave to compete without being unfairly disadvantaged.

At the same time, the court stressed that any such mechanism would have to reconcile the interests of individual athletes with the country’s interests and the demands of high-level competition.

Phogat’s counsel, Senior Advocate Rajshekhar Rao, attacked the federation’s approach as arbitrary.

He told the court that the wrestler was made aware of the selection requirements only on September 7.

Rao argued that the rules, in practical terms, shut Phogat out of the selection process after her return to wrestling.

He submitted that the consequences could leave her out of contention for another two years, potentially bringing her competitive career to an end.

The WFI rejected the suggestion that Phogat had been prohibited from wrestling.

Its lawyer told the court that she had not been banned and could continue competing at state and national levels before advancing through the prescribed selection route.

The federation also explained the basis of its eligibility system.

According to its submission, wrestlers who won medals at certain specified competitions conducted in 2025 and 2026 qualified for consideration for the year’s World Championships.

The competing submissions prompted the court to look beyond Phogat’s individual case and consider the implications of selection rules for women athletes who take maternity-related breaks.

Justice Sharma indicated that the federation should examine whether its policies can be supplemented with appropriate guidelines so that a maternity-related absence does not, by itself, place returning athletes at an undue disadvantage.

The court did not, however, direct that Phogat be given an immediate exception to the existing selection conditions.

After hearing arguments from both sides, the bench reserved its order on her plea.

The proceedings therefore leave two issues before the court: Phogat’s immediate request to participate in the selection process for the 2026 World Championships and the wider question of whether sports-selection systems need specific safeguards for women resuming competition after maternity.

2026 वर्ल्ड रेसलिंग चैंपियनशिप के चयन ट्रायल में उतरने की मांग पर आदेश सुरक्षित; कोर्ट ने खिलाड़ी और देशहित के बीच संतुलन की जरूरत बताई

दिल्ली हाईकोर्ट ने विनेश फोगाट की 2026 वर्ल्ड चैंपियनशिप चयन याचिका पर आदेश सुरक्षित रखा और WFI से मातृत्व के बाद लौटने वाली महिला खिलाड़ियों के लिए दिशानिर्देश पर विचार करने को कहा।

मातृत्व के बाद खेल में वापसी करने वाली महिला खिलाड़ियों के सामने आने वाली चुनौतियों पर दिल्ली हाईकोर्ट ने गुरुवार को महत्वपूर्ण टिप्पणी की।

कोर्ट ने कहा कि रेसलिंग फेडरेशन ऑफ इंडिया (WFI) को ऐसे खिलाड़ियों की प्रतिस्पर्धी खेलों में वापसी को सुगम बनाने के लिए दिशानिर्देश तैयार करने पर विचार करना चाहिए।

यह टिप्पणी ओलंपियन विनेश फोगाट की उस याचिका पर सुनवाई के दौरान आई, जिसमें उन्होंने 2026 सीनियर वर्ल्ड रेसलिंग चैंपियनशिप के लिए चयन ट्रायल में शामिल होने की अनुमति मांगी है।

जस्टिस स्वर्ण कांता शर्मा की पीठ ने दोनों पक्षों की दलीलें सुनने के बाद याचिका पर अपना फैसला सुरक्षित रख लिया।

विवाद की पृष्ठभूमि में फोगाट की प्रतिस्पर्धी कुश्ती में वापसी है। गर्भावस्था, प्रसव और प्रसवोत्तर स्वास्थ्य लाभ के कारण उन्होंने खेल से ब्रेक लिया था।

वापसी के बाद लागू चयन व्यवस्था को लेकर उन्होंने अदालत का रुख किया।

फोगाट की ओर से वरिष्ठ अधिवक्ता राजशेखर राव ने WFI की प्रक्रिया पर सवाल उठाते हुए इसे पूरी तरह मनमाना बताया।

उन्होंने अदालत को कहा कि फोगाट को चयन के मानदंडों की जानकारी 7 सितंबर को दी गई थी।

राव का तर्क था कि मौजूदा व्यवस्था का व्यावहारिक परिणाम यह है कि मातृत्व के बाद खेल में लौटने वाली फोगाट चयन प्रक्रिया से बाहर हो जाती हैं।

उनकी ओर से यह भी कहा गया कि ऐसी स्थिति बनी रही तो वह अगले दो वर्षों तक भी चयन की दौड़ से बाहर रह सकती हैं और इससे उनके खेल करियर पर गंभीर असर पड़ सकता है।

WFI ने इस दलील को स्वीकार नहीं किया कि फोगाट को प्रतिस्पर्धा से रोक दिया गया है।

महासंघ की ओर से अदालत में कहा गया कि उन पर कोई प्रतिबंध नहीं लगाया गया है और वह राज्य तथा राष्ट्रीय स्तर की प्रतियोगिताओं में हिस्सा लेकर निर्धारित प्रक्रिया के जरिए आगे बढ़ सकती हैं।

महासंघ ने अपनी चयन व्यवस्था का आधार भी अदालत के सामने रखा। WFI के अनुसार, 2025 और 2026 में आयोजित कुछ निर्धारित प्रतियोगिताओं के पदक विजेता इस वर्ष की वर्ल्ड चैंपियनशिप के लिए चयन के पात्र माने गए हैं।

इसी बिंदु पर अदालत ने मामले को व्यापक संदर्भ में भी देखा। जस्टिस शर्मा ने कहा कि यदि महिला खिलाड़ी मातृत्व के कारण कुछ समय के लिए प्रतिस्पर्धा से दूर रहती हैं, तो उनकी वापसी के बाद चयन व्यवस्था में उन्हें किस तरह प्रभावित होना पड़ता है, इस पर विचार किए जाने की जरूरत है।

कोर्ट ने संकेत दिया कि WFI ऐसी व्यवस्था तैयार करने की संभावना तलाश सकता है, जिससे मातृत्व के बाद खेल में लौटने वाली महिला खिलाड़ियों को केवल उनके ब्रेक के कारण अनुचित नुकसान न उठाना पड़े।

हालांकि, अदालत ने साथ ही यह भी स्पष्ट किया कि खिलाड़ी के हितों के साथ देश के हित और उच्चस्तरीय खेल प्रतियोगिता की आवश्यकताओं को भी संतुलित करना होगा।

यानी चयन प्रक्रिया में किसी बदलाव को व्यापक खेल व्यवस्था और समान पात्रता के सिद्धांतों के अनुरूप रखना होगा।

फोगाट को तत्काल मौजूदा पात्रता मानदंड से अलग विशेष छूट देने के सवाल पर कोर्ट ने सावधानी बरती।

अदालत ने कहा कि चयन की शर्तें सभी खिलाड़ियों पर समान रूप से लागू होती हैं और किसी एक खिलाड़ी को अस्थायी रूप से शामिल करना अन्य खिलाड़ियों पर लागू नियमों से अलग एक अपवाद बनाने जैसा हो सकता है।

इस तरह सुनवाई में फोगाट के व्यक्तिगत मामले के साथ-साथ महिला खिलाड़ियों के लिए चयन व्यवस्था से जुड़ा व्यापक मुद्दा भी सामने आया।

खास तौर पर मातृत्व के बाद प्रतिस्पर्धी खेल में लौटने वाली खिलाड़ियों के लिए भविष्य में अलग दिशानिर्देश बनाए जाने की संभावना पर अदालत ने ध्यान केंद्रित किया।

फिलहाल विनेश फोगाट को 2026 सीनियर वर्ल्ड रेसलिंग चैंपियनशिप के चयन ट्रायल में भाग लेने की अनुमति देने के संबंध में अंतिम फैसला नहीं आया है। दिल्ली हाईकोर्ट ने याचिका पर आदेश सुरक्षित रख लिया है।
