Delhi High Court Moves to Block ‘Kala Hiran’ Teaser, Says Salman Khan’s Reputation Cannot Be Put at Risk

The legal battle over the proposed film Kala Hiran: The Battle for Legacy intensified on Monday after the Delhi High Court signalled that it would order the removal of the film’s teaser and related online interviews.

Observing that continued circulation of the material could seriously damage actor Salman Khan’s reputation while proceedings connected to the 1998 blackbuck case are still pending before the courts.

Hearing Salman Khan’s plea, Justice Jyoti Singh viewed the teaser in open court before expressing concern over the manner in which events linked to an ongoing judicial matter had allegedly been dramatised.

The court remarked that portraying issues still under adjudication could amount to contempt and indicated that take-down directions would be issued within 24 hours.

During the hearing, the judge made it clear that the right to reputation cannot be compromised merely because material has already entered the public domain.

She observed that every passing moment the teaser remained online carried the potential to inflict further harm, adding that no individual—celebrity or otherwise—should be subjected to such treatment.

Justice Singh also criticised what she described as the producer’s growing disregard for judicial proceedings, remarking that the absence of an earlier restraint appeared to have encouraged further publication of the disputed content.

Stressing that reputation is earned over years but can be destroyed in moments, she asked Salman Khan’s legal team to compile all web links carrying the teaser and related promotional material so that comprehensive removal orders could be passed.

The actor has approached the High Court seeking an injunction against the production, promotion and release of the film.

His petition states that the court had, in December last year, protected his personality rights by restraining any unauthorised commercial use of his image, identity or likeness.

According to Khan, that protection also safeguards his right to receive a fair trial without outside influence.

The plea further contends that despite the earlier judicial order, the filmmakers released a poster on May 29, signalling that the project was inspired by—or based upon—the widely known 1998 blackbuck poaching case.

Khan argues that the central character bears an unmistakable resemblance to him and that the filmmakers are commercially exploiting his personality without obtaining his consent, allegedly violating the High Court’s previous directions.

Appearing for producer Amit Jani, counsel opposed the petition and maintained that no legal violation had occurred.

The defence argued that Jani had merely answered questions during media interviews and that the teaser neither mentions Salman Khan by name nor employs artificial intelligence or deepfake technology to recreate his appearance.

The producer’s counsel further submitted that events already in the public domain cannot become the exclusive preserve of any individual merely because they involve a public figure.

According to the defence, depicting such incidents in a cinematic work does not, by itself, amount to infringement of personality rights.

With the court preparing to pass detailed directions on the removal of the disputed content, the case is now expected to test the balance between creative expression, personality rights and the protection of judicial proceedings that remain sub judice.

अभिनेता सलमान खान से जुड़ी प्रस्तावित फिल्म ‘काला हिरण: द बैटल फॉर लेगेसी’ को लेकर कानूनी विवाद सोमवार को नया मोड़ ले गया।

दिल्ली हाई कोर्ट ने स्पष्ट संकेत दिए कि फिल्म के टीज़र और निर्माता अमित जानी के उससे जुड़े ऑनलाइन साक्षात्कारों के लिंक हटाने के आदेश जल्द जारी किए जाएंगे।

अदालत का मानना है कि 1998 के चर्चित काला हिरण शिकार मामले से जुड़े विवाद अभी न्यायिक विचाराधीन हैं और ऐसे में इस तरह की सामग्री का सार्वजनिक प्रसार अभिनेता की प्रतिष्ठा को गंभीर नुकसान पहुंचा सकता है.

सुनवाई के दौरान न्यायमूर्ति ज्योति सिंह ने अदालत में ही फिल्म का टीज़र देखा और उसके बाद कड़ी टिप्पणी करते हुए कहा कि किसी लंबित न्यायिक मामले को इस प्रकार प्रस्तुत करना न्यायालय की अवमानना का विषय बन सकता है।

उन्होंने संकेत दिया कि विवादित सामग्री को इंटरनेट से हटाने संबंधी आदेश 24 घंटे के भीतर पारित किए जाएंगे।

अदालत ने कहा कि किसी व्यक्ति की प्रतिष्ठा का अधिकार सर्वोपरि है और यह केवल चर्चित हस्तियों तक सीमित नहीं है।

न्यायमूर्ति सिंह ने टिप्पणी की कि किसी भी व्यक्ति की साख वर्षों की मेहनत से बनती है, लेकिन उसे क्षति पहुंचने में कुछ ही क्षण लगते हैं।

इसलिए टीज़र का प्रत्येक अतिरिक्त मिनट तक सार्वजनिक रूप से उपलब्ध रहना वादी के हितों के प्रतिकूल है।

निर्माता के रवैये पर भी अदालत ने तीखी नाराज़गी व्यक्त की। न्यायमूर्ति सिंह ने कहा कि ऐसा प्रतीत होता है कि पहले किसी प्रतिबंधात्मक आदेश के अभाव ने निर्माता को और अधिक निर्भीक बना दिया है।

उन्होंने सलमान खान की ओर से पेश अधिवक्ता को निर्देश दिया कि वे इंटरनेट पर उपलब्ध सभी कथित आपत्तिजनक लिंक की सूची तैयार करें ताकि उन्हें हटाने के लिए व्यापक आदेश जारी किए जा सकें।

सलमान खान ने अपनी याचिका में फिल्म के निर्माण, प्रचार और प्रदर्शन पर रोक लगाने की मांग की है। उनका कहना है कि पिछले वर्ष दिसंबर में दिल्ली हाई कोर्ट ने उनके व्यक्तित्व अधिकारों की रक्षा करते हुए उनकी अनुमति के बिना उनकी पहचान, छवि या व्यक्तित्व के व्यावसायिक उपयोग पर रोक लगाई थी।

याचिका में यह भी कहा गया है कि यह संरक्षण उनके निष्पक्ष सुनवाई के अधिकार का भी हिस्सा है।

याचिका के अनुसार, अदालत के पूर्व आदेश के बावजूद 29 मई को फिल्म का पोस्टर जारी किया गया, जिससे यह संकेत मिला कि फिल्म वर्ष 1998 के चर्चित काला हिरण शिकार प्रकरण से प्रेरित है या उसी पर आधारित है।

सलमान खान का दावा है कि फिल्म का मुख्य पात्र उनसे स्पष्ट रूप से मिलता-जुलता है और उनकी सहमति के बिना उनकी पहचान का व्यावसायिक लाभ उठाया जा रहा है, जो अदालत के आदेश का उल्लंघन है।

दूसरी ओर, निर्माता अमित जानी की ओर से अदालत में कहा गया कि उनके मुवक्किल ने केवल मीडिया के सवालों का जवाब दिया है।

बचाव पक्ष ने दलील दी कि टीज़र में कहीं भी सलमान खान का नाम नहीं लिया गया है और न ही उनकी छवि तैयार करने के लिए कृत्रिम बुद्धिमत्ता (एआई) या डीपफेक तकनीक का इस्तेमाल किया गया है।

निर्माता की ओर से यह भी तर्क रखा गया कि सार्वजनिक महत्व की घटनाओं पर आधारित कहानी प्रस्तुत करना किसी व्यक्ति के विशेष अधिकार का उल्लंघन नहीं माना जा सकता।

उनका कहना था कि केवल किसी चर्चित घटना से प्रेरित फिल्म बनाना अपने आप में व्यक्तित्व अधिकारों के अतिक्रमण के समान नहीं है।

अब सभी की निगाहें दिल्ली हाई कोर्ट के विस्तृत आदेश पर टिकी हैं, क्योंकि यह मामला अभिव्यक्ति की स्वतंत्रता, व्यक्तित्व अधिकारों और न्यायालय में लंबित मामलों के दौरान सार्वजनिक प्रस्तुति की कानूनी सीमाओं से जुड़े महत्वपूर्ण प्रश्नों को नई दिशा दे सकता है।
