‘Democracy Cannot Criminalise Dissent’: Justice Ujjal Bhuyan Questions Arrests, Bail Curbs and ‘Bulldozer Justice’
Bhopal: Delivering a strong defence of civil liberties and constitutional freedoms, Supreme Court judge Justice Ujjal Bhuyan on Saturday cautioned against what he described as the growing tendency to treat ordinary acts of expression and dissent as criminal offences.
Addressing the 4th Justice G.P. Singh Memorial Lecture at the National Law Institute University (NLIU), he said democratic societies thrive on debate and peaceful disagreement, not on fear of prosecution.
Illustrating his concern with a recent example, Justice Bhuyan referred to the arrest of a group of youngsters who were taken into custody for eating chicken biryani while ending their fast near the Ganga river.
Expressing disbelief over the incident, he remarked that no law prohibits the consumption of chicken over the Ganga and questioned the basis of the criminal case.
“Eating chicken biryani cannot by itself constitute an offence,” he observed, adding that the youths had reportedly remained behind bars for nearly three months despite the absence of any apparent criminality in the act.
Turning to the broader state of democratic rights, the Supreme Court judge said the freedom to express opinions and assemble peacefully forms the very foundation of India’s constitutional framework.
Yet, he noted with concern, activities that should ordinarily fall within the realm of legitimate public participation are increasingly being viewed through the lens of criminal law.
According to him, dissent is not a threat to democracy but one of its defining characteristics.
Drawing attention to recent protests across the country, Justice Bhuyan said environmental activists and university students often face disproportionate state action merely for raising their voices.
He observed that citizens protesting against ecological degradation are sometimes treated like offenders, while students participating in campus demonstrations are arrested and frequently remain in custody for several weeks before securing bail.
Many of them, he added, are simultaneously suspended from their educational institutions, forcing them to seek judicial intervention simply to continue their studies.
Justice Bhuyan also questioned whether the judiciary itself was, at times, inadvertently discouraging dissent through stringent bail conditions.
Although courts eventually grant relief in many such cases, he pointed out that delayed bail and unusually restrictive conditions attached to it raise important constitutional concerns.
He wondered whether such judicial orders indirectly discourage citizens from exercising their democratic right to voice disagreement.
Reflecting on the Supreme Court’s landmark 2024 verdict against punitive demolitions popularly described as “bulldozer justice”, the judge welcomed the ruling but remarked that it had arrived after considerable delay.
He also expressed concern over instances in which individuals released on bail were prohibited from attending public gatherings or expressing themselves on social media, observing that such conditions impose serious restrictions on personal liberty and fundamental rights.
Commenting on another recent judicial development, Justice Bhuyan criticised the Bombay High Court’s refusal to permit a solidarity demonstration in support of Palestine.
Recalling the court proceedings, he said he found the observations made during the hearing rather surprising, particularly the suggestion that citizens should concern themselves only with domestic issues instead of developments in Gaza.
He noted that India has historically recognised Palestine and continues to host a Palestinian Embassy, making such reasoning difficult to reconcile.
The Supreme Court judge also spoke candidly about the longstanding debate surrounding retired judges entering active politics.
Without naming individuals directly, he referred to the argument advanced by a former Chief Justice of India that joining the Rajya Sabha after retirement would help bridge the gap between the judiciary and the Executive.
Justice Bhuyan rejected that reasoning, saying the very premise reflected a fundamental misconception about the constitutional separation between the two institutions.
Concluding his address, Justice Bhuyan encouraged aspiring lawyers to cultivate the courage to question every institution, including the judiciary itself.
He emphasised that judicial decisions are not beyond scrutiny and that reasoned criticism of a judgment should never be mistaken for criticism of the judge who authored it.
He further remarked that the credibility of the judiciary ultimately depends not on its own assessment but on the confidence reposed in it by the people.
Expressing optimism about the future of the legal profession, he said the present generation of law students and young lawyers appears more deeply committed to constitutional values and the rule of law than earlier generations.
‘लोकतंत्र में असहमति अपराध नहीं हो सकती’: न्यायमूर्ति उज्जल भुइयां ने गिरफ्तारी, जमानत की शर्तों और ‘बुलडोजर न्याय’ पर उठाए सवाल
भोपाल: नागरिक स्वतंत्रता और संवैधानिक अधिकारों की जोरदार पैरवी करते हुए सर्वोच्च न्यायालय के न्यायमूर्ति उज्जल भुइयां ने शनिवार को आगाह किया कि देश में सामान्य नागरिक गतिविधियों और लोकतांत्रिक असहमति को धीरे-धीरे आपराधिक नजरिए से देखा जाने लगा है।
राष्ट्रीय विधि संस्थान विश्वविद्यालय (एनएलआईयू) में आयोजित न्यायमूर्ति जी.पी. सिंह की चौथी स्मृति व्याख्यानमाला को संबोधित करते हुए उन्होंने कहा कि किसी भी जीवंत लोकतंत्र की आत्मा विचार-विमर्श, बहस और शांतिपूर्ण विरोध में निहित होती है।
अपने वक्तव्य के दौरान न्यायमूर्ति भुइयां ने उस घटना का उल्लेख किया जिसमें कुछ युवकों को गंगा नदी के किनारे रोजा खोलते समय चिकन बिरयानी खाने के आरोप में गिरफ्तार किया गया था।
उन्होंने आश्चर्य व्यक्त करते हुए कहा कि गंगा के ऊपर या उसके किनारे चिकन खाने पर रोक लगाने वाला कोई कानून अस्तित्व में नहीं है।
उन्होंने टिप्पणी की कि केवल चिकन बिरयानी खाना किसी भी परिस्थिति में अपराध नहीं माना जा सकता, फिर भी उन युवकों को इसी आधार पर गिरफ्तार कर लगभग तीन महीने तक जेल में रहना पड़ा।
लोकतांत्रिक अधिकारों की चर्चा करते हुए उन्होंने कहा कि शांतिपूर्ण ढंग से अपने विचार व्यक्त करना और विरोध दर्ज कराना प्रत्येक नागरिक का मौलिक अधिकार है।
उनके अनुसार लोकतंत्र की वास्तविक शक्ति सहमति में नहीं बल्कि असहमति को सम्मान देने की क्षमता में निहित होती है।
उन्होंने चिंता व्यक्त की कि आज अनेक सामान्य और वैध गतिविधियों को भी आपराधिक रंग देकर देखा जा रहा है।
देश में पर्यावरण संरक्षण से जुड़े आंदोलनों और विश्वविद्यालय परिसरों में होने वाले छात्र प्रदर्शनों का उल्लेख करते हुए न्यायमूर्ति भुइयां ने कहा कि पर्यावरणीय क्षरण के खिलाफ आवाज उठाने वाले लोगों के साथ कई बार अपराधियों जैसा व्यवहार किया जाता है।
उन्होंने कहा कि छात्र आंदोलनों में शामिल युवाओं को गिरफ्तार कर लंबे समय तक जमानत से वंचित रखा जाता है।
इतना ही नहीं, अनेक मामलों में उन्हें शिक्षण संस्थानों से निलंबित भी कर दिया जाता है, जिसके बाद अपनी पढ़ाई दोबारा शुरू करने के लिए उन्हें अदालतों का दरवाजा खटखटाना पड़ता है।
न्यायमूर्ति भुइयां ने यह प्रश्न भी उठाया कि क्या न्यायालय स्वयं कठोर जमानत शर्तों के माध्यम से अनजाने में असहमति की भावना को हतोत्साहित कर रहे हैं।
उन्होंने कहा कि कई मामलों में अदालतें अंततः जमानत तो देती हैं, लेकिन वह काफी विलंब से मिलती है।
इसके साथ लगाई जाने वाली कड़ी शर्तें नागरिकों की मौलिक स्वतंत्रताओं पर गंभीर प्रभाव डालती हैं और यह सवाल खड़ा करती हैं कि कहीं न्यायिक आदेश अप्रत्यक्ष रूप से लोगों को अपनी राय व्यक्त करने से रोक तो नहीं रहे।
वर्ष 2024 में सर्वोच्च न्यायालय द्वारा तथाकथित ‘बुलडोजर न्याय’ के विरुद्ध दिए गए ऐतिहासिक निर्णय का उल्लेख करते हुए उन्होंने उसे स्वागतयोग्य बताया, लेकिन यह भी कहा कि यह फैसला लगभग दो वर्ष की देरी से आया।
उन्होंने उन मामलों पर भी चिंता जताई जिनमें जमानत पाने वाले आरोपियों को सार्वजनिक सभाओं में भाग लेने या सोशल मीडिया पर अपनी बात रखने से रोका गया।
उनके अनुसार ऐसी शर्तें व्यक्ति की स्वतंत्रता और संवैधानिक अधिकारों को गंभीर रूप से प्रभावित करती हैं।
अपने संबोधन में न्यायमूर्ति भुइयां ने फिलिस्तीन के समर्थन में प्रस्तावित प्रदर्शन की अनुमति देने से बॉम्बे उच्च न्यायालय द्वारा इनकार किए जाने पर भी असहमति व्यक्त की।
उन्होंने कहा कि सुनवाई के दौरान की गई कुछ टिप्पणियां उन्हें अत्यंत आश्चर्यजनक लगीं, विशेषकर यह प्रश्न कि लोग गाज़ा की घटनाओं पर विरोध क्यों करना चाहते हैं।
उन्होंने याद दिलाया कि भारत लंबे समय से फिलिस्तीन को मान्यता देता आया है और नई दिल्ली में फिलिस्तीनी दूतावास भी कार्यरत है।
सेवानिवृत्ति के बाद न्यायाधीशों के राजनीति में जाने के मुद्दे पर भी उन्होंने खुलकर अपनी राय रखी। उन्होंने बिना नाम लिए पूर्व मुख्य न्यायाधीश द्वारा राज्यसभा में जाने को न्यायपालिका और कार्यपालिका के बीच की दूरी कम करने का माध्यम बताए जाने पर आपत्ति जताई।
न्यायमूर्ति भुइयां ने कहा कि इस प्रकार की सोच संविधान द्वारा निर्धारित संस्थागत पृथक्करण की मूल भावना से मेल नहीं खाती और इसमें बुनियादी वैचारिक त्रुटि है।
अपने व्याख्यान के समापन पर उन्होंने कानून के विद्यार्थियों से हर संस्था, यहां तक कि न्यायपालिका, से भी प्रश्न पूछने का साहस विकसित करने का आह्वान किया।
उन्होंने कहा कि न्यायिक फैसलों की विवेकपूर्ण समीक्षा और आवश्यक होने पर उनकी आलोचना लोकतांत्रिक व्यवस्था का स्वाभाविक हिस्सा है।
किसी निर्णय की आलोचना को न्यायाधीश की आलोचना नहीं माना जाना चाहिए। उन्होंने यह भी कहा कि न्यायपालिका की वास्तविक प्रतिष्ठा स्वयं उसके आकलन से नहीं, बल्कि जनता के विश्वास से निर्धारित होती है।
युवा वकीलों और विधि छात्रों की संवैधानिक मूल्यों तथा कानून के शासन के प्रति प्रतिबद्धता की सराहना करते हुए उन्होंने विश्वास व्यक्त किया कि देश की न्याय व्यवस्था का भविष्य उनके हाथों में सुरक्षित है।
