Firozabad Horror: Court Awards Death Penalty to Trader for Brutal Murder of Toddler After Woman Rejected Marriage Proposal

Firozabad court terms toddler’s murder ‘rarest of rare’, awards capital punishment

In a landmark judgment delivered within just 40 days of the crime, a court in Uttar Pradesh’s Firozabad on Friday sentenced 28-year-old trader Jitendra Pathak alias Viraj to death for the gruesome murder of an 18-month-old boy.

Declaring the offence to fall under the “rarest of rare” category, the court observed that the brutality of the crime justified the maximum punishment under the law.

The conviction was recorded on Thursday, while the quantum of sentence was pronounced a day later.

District Government Counsel Rajeev Kumar Upadhyay confirmed that the court had awarded the death penalty after considering the exceptional cruelty involved in the case.

Viral CCTV footage became crucial evidence during the trial

The prosecution relied heavily on CCTV footage that captured the horrifying assault.

The video, which later spread widely across social media platforms, was presented before the court as one of the strongest pieces of evidence against the accused.

Investigators said the visual evidence played a significant role in establishing the sequence of events and strengthening the prosecution’s case during the trial.

Marriage proposal rejected, child allegedly seen as an obstacle

According to the police investigation, Rati Sharma (24) had declined Jitendra Pathak’s proposal for marriage, explaining that she was already the mother of a young child and would never abandon her son.

Police alleged that the rejection deeply angered Pathak. As his repeated attempts to persuade her failed, he allegedly began considering the little boy as the biggest hurdle to fulfilling his personal ambitions.

The accused allegedly lured the child away before carrying out the attack

The prosecution told the court that on May 30, Pathak allegedly took the toddler out of the house after promising to buy him sweets.

Instead of taking the child to a shop, investigators said he led him nearly 50 metres away to an isolated stretch of road where he repeatedly lifted the child and slammed him onto the ground eight times, inflicting fatal injuries.

Family welcomes verdict, seeks early execution of sentence

Expressing relief after the judgment, complainant Anusuiya Sharma, the victim’s grandmother, said the family finally felt that justice had begun to prevail.

She said the incident, captured on CCTV cameras, had exposed the horrifying nature of the crime before the entire country.

While thanking the court and the police, she added that the family’s legal battle would continue until the death sentence is carried out.

Anusuiya also praised the investigating team for completing the probe in record time.

The victim’s mother had been staying with her parents.

Court proceedings revealed that Rati Sharma had been living at her parental home since January 2026 because of marital discord with her husband.

During this period, Pathak, who was related to her husband, came into regular contact with the family and gradually began visiting the house frequently.

Repeated pressure to marry despite refusal

According to the prosecution, Pathak later proposed marriage to Rati and assured her that he would support her in her ongoing legal dispute with her husband.

Despite these assurances, Rati consistently refused his proposal and distanced herself from him.

She repeatedly told him that her son was her foremost responsibility and that she would never leave the child under any circumstances.

Investigators argued that this refusal ultimately fuelled the accused’s resentment against the toddler.

The incident unfolded while the mother waited to meet the lawyer

On the day of the crime, Rati and her mother had travelled to Shikohabad to consult a lawyer regarding her matrimonial case.

As their appointment was scheduled later in the evening, they spent some time at the residence of family acquaintance Pushpalata in Yadav Colony.

The prosecution alleged that Pathak located them there and once again tried to convince Rati to divorce her husband and marry him.

After she firmly rejected him again, he allegedly took the child outside.

Residents mistook screams for construction noise

Investigators said nearby residents initially believed the repeated loud sounds were caused by cement sacks being unloaded.

Suspicion arose only after a resident monitoring CCTV footage noticed the brutal assault and rushed outside.

By then, police said, Pathak had stopped the attack, carried the unconscious child back to Pushpalata’s residence, and falsely claimed that the boy had been injured after falling.

Leaving the child at the doorstep, the accused allegedly fled from the spot.

Swift investigation led to a quick trial

Family members soon discovered that the child was unresponsive and immediately alerted the police.

Within hours, police arrested Pathak following an encounter during which he sustained bullet injuries to both legs before being taken into custody.

The investigating team completed the probe rapidly and filed the chargesheet within six days, enabling the court to conclude the trial and pronounce judgment within just 40 days.

Defence plans to challenge the verdict. 

Following the sentencing, defence counsel stated that the conviction and death sentence would be challenged before a higher court.

निर्दयता की पराकाष्ठा मानते हुए अदालत ने सुनाई फांसी की सजा

उत्तर प्रदेश के फिरोजाबाद की एक अदालत ने 18 महीने के मासूम बच्चे की निर्मम हत्या के मामले में 28 वर्षीय कारोबारी जितेंद्र पाठक उर्फ विराज को फांसी की सजा सुनाई है।

अदालत ने इस अपराध को ‘रेयरेस्ट ऑफ रेयर’ श्रेणी का बताते हुए कहा कि इसकी क्रूरता असाधारण है और दोषी को कानून के तहत सर्वोच्च दंड दिया जाना चाहिए।

मामले में गुरुवार को दोष सिद्ध होने के बाद शुक्रवार को सजा पर फैसला सुनाया गया। जिला शासकीय अधिवक्ता राजीव कुमार उपाध्याय ने बताया कि अदालत ने अपराध की भयावहता और परिस्थितियों को देखते हुए मृत्युदंड देने का निर्णय लिया।

सीसीटीवी फुटेज बनी सबसे मजबूत गवाही

अभियोजन पक्ष ने सुनवाई के दौरान घटना का सीसीटीवी वीडियो अदालत में प्रस्तुत किया, जिसने पूरे मामले को निर्णायक मोड़ दिया।

सोशल मीडिया पर व्यापक रूप से वायरल हुए इस वीडियो ने घटना की पूरी श्रृंखला को स्पष्ट किया और अभियोजन के दावों को मजबूत आधार प्रदान किया।

शादी का प्रस्ताव ठुकराए जाने के बाद मासूम को माना बाधा

पुलिस जांच के अनुसार 24 वर्षीय रति शर्मा ने जितेंद्र पाठक के विवाह प्रस्ताव को स्पष्ट रूप से अस्वीकार कर दिया था। उसने कहा था कि वह अपने बेटे को किसी भी कीमत पर नहीं छोड़ेगी।

जांच एजेंसियों का आरोप है कि इसके बाद आरोपी ने बच्चे को अपने रास्ते की सबसे बड़ी रुकावट मान लिया और उसी मानसिकता के तहत इस जघन्य अपराध को अंजाम दिया।

टॉफी दिलाने का बहाना बनाकर बच्चे को घर से ले गया आरोपी

अभियोजन के अनुसार 30 मई को आरोपी मासूम को मिठाई दिलाने का बहाना बनाकर घर से बाहर ले गया।

इसके बाद वह बच्चे को लगभग 50 मीटर दूर सुनसान स्थान पर ले गया, जहां उसने उसे बार-बार जमीन पर पटक दिया। आरोप है कि उसने बच्चे को आठ बार पूरी ताकत से जमीन पर पटका, जिससे उसकी मौत हो गई।

परिवार ने फैसले का स्वागत किया, जल्द सजा लागू करने की मांग

मृतक की नानी और मुकदमे की वादी अनुसुइया शर्मा ने अदालत के फैसले पर संतोष व्यक्त करते हुए कहा कि परिवार को न्याय मिलने की शुरुआत हुई है।

उन्होंने कहा कि पूरी घटना कैमरे में कैद होने के कारण अपराध की भयावहता पूरे देश ने देखी।

उन्होंने पुलिस की त्वरित जांच की सराहना करते हुए कहा कि उनका संघर्ष तब तक जारी रहेगा, जब तक दोषी को सुनाई गई फांसी की सजा पर अमल नहीं हो जाता।

वैवाहिक विवाद के चलते मायके में रह रही थी रति

मुकदमे के दौरान सामने आया कि जनवरी 2026 से रति शर्मा अपने वैवाहिक विवाद के कारण मायके में रह रही थी।

इसी दौरान उसके पति के रिश्तेदार जितेंद्र पाठक का परिवार में आना-जाना बढ़ गया और वह नियमित रूप से घर आने लगा।

बार-बार शादी का दबाव बनाता रहा आरोपी

अभियोजन ने अदालत को बताया कि आरोपी लगातार रति पर पति से तलाक लेकर उससे विवाह करने का दबाव डालता रहा। उसने वैवाहिक मुकदमे में हर तरह की मदद का भरोसा भी दिया।

इसके बावजूद रति ने हर बार प्रस्ताव ठुकरा दिया और साफ शब्दों में कहा कि उसका बेटा उसकी पहली जिम्मेदारी है और वह उसे कभी नहीं छोड़ेगी।

अभियोजन के अनुसार यही बात आरोपी के मन में बच्चे के प्रति घृणा का कारण बन गई।

वकील से मिलने गई थी मां, तभी हुई वारदात

घटना वाले दिन रति और उसकी मां अपने वैवाहिक मामले में सलाह लेने शिकोहाबाद गई थीं।

वकील से मिलने का समय शाम को होने के कारण दोनों यादव कॉलोनी में अपनी परिचित पुष्पलता के घर ठहरी हुई थीं।

अभियोजन के मुताबिक आरोपी वहां भी पहुंच गया और एक बार फिर विवाह का प्रस्ताव रखा। जब रति ने फिर से मना कर दिया, तब उसने मासूम बच्चे को अपने साथ बाहर ले जाकर हमला कर दिया।

आवाज सुनकर लोगों को पहले नहीं हुआ शक

जांच के दौरान सामने आया कि बच्चे को जमीन पर पटकने की आवाज सुनकर आसपास के लोगों ने पहले इसे सीमेंट की बोरियां उतारे जाने की आवाज समझा।

बाद में एक स्थानीय व्यक्ति ने सीसीटीवी कैमरे में पूरी घटना देखी और बाहर दौड़ा। पुलिस के अनुसार आरोपी तब तक बच्चे को उठाकर वापस पुष्पलता के घर के बाहर छोड़ चुका था और यह कहकर फरार हो गया कि बच्चा गिरकर घायल हो गया है।

छह दिन में चार्जशीट, 40 दिन में फैसला

परिवार ने जब बच्चे को अचेत अवस्था में पाया तो तत्काल पुलिस को सूचना दी।

कुछ ही घंटों बाद पुलिस ने मुठभेड़ के दौरान आरोपी को गिरफ्तार कर लिया। इस दौरान उसके दोनों पैरों में गोली लगी थी।

जांच एजेंसी ने केवल छह दिनों में आरोपपत्र दाखिल कर दिया, जिसके कारण अदालत ने महज 40 दिनों के भीतर मुकदमे का निस्तारण करते हुए फैसला सुना दिया।

हाईकोर्ट में चुनौती देगा बचाव पक्ष

फैसले के बाद बचाव पक्ष के अधिवक्ता ने कहा कि वे इस निर्णय के विरुद्ध उच्च न्यायालय में अपील दायर करेंगे।
