High Court defers proceedings as parties point to pending Supreme Court matter and continuing interim protection

PRAYAGRAJ: The Allahabad High Court has scheduled November 30, 2026, for further hearing in the case concerning a proposed Archaeological Survey of India (ASI) examination of the Wazukhana area inside the Gyanvapi mosque complex in Varanasi.
The matter came up before the court on Tuesday, but lawyers appearing for the parties informed the bench that the broader dispute remains pending before the Supreme Court.
They also pointed out that the interim arrangement passed in the matter continues to remain in force.
Taking note of the submission, the High Court did not proceed further with the case and fixed November 30 as the next date of hearing.
The proceedings arise from a challenge to an October 21, 2023, order of the Varanasi district court. That court had declined a request seeking an ASI survey of the Wazukhana, while excluding the disputed structure at the centre of the area.
Petition challenges Varanasi court decision
The High Court case has been brought through a civil revision filed by Rakhi Singh, one of the plaintiffs in the underlying Gyanvapi litigation.
The revision challenges the Varanasi district judge’s decision not to order the ASI to examine the Wazukhana area, apart from the structure that the Hindu petitioners identify as a Shiva Linga.
The Muslim side has maintained that the structure is a fountain. The description of the structure remains a contested issue between the parties and is central to the dispute over any proposed survey.
The Wazukhana is an ablution area within the Gyanvapi mosque complex, located next to the Kashi Vishwanath temple in Varanasi.

Supreme Court proceedings hold key to next step
Tuesday’s proceedings did not involve a fresh decision on whether the ASI survey should take place. Instead, the court was informed that the issue continues to be connected with proceedings before the Supreme Court.
Counsel for the parties told the High Court that the apex court’s proceedings remain pending and that the interim order applicable to the matter has not yet ceased to operate.
The High Court accordingly chose to await further developments before taking up the matter again.
The legal dispute is part of the larger litigation surrounding the Gyanvapi mosque complex and competing claims concerning its religious and historical character.
Lawyers representing revisionist
Rakhi Singh was represented in the civil revision by advocates Saurabh Tiwari, Amit Shukla, Amitabh Trivedi and Vikas Kumar.
The petition seeks reconsideration of the refusal by the Varanasi district court to order an ASI survey of the Wazukhana, subject to the exclusion of the structure that is the subject of the competing claims.
The next hearing on November 30 is expected to provide a clearer indication of how the High Court will proceed in light of the Supreme Court proceedings and the interim directions that remain in place.

प्रयागराज: ज्ञानवापी मस्जिद परिसर के वजूखाने के उस हिस्से के ASI सर्वे से जुड़े मामले में इलाहाबाद हाईकोर्ट ने अगली सुनवाई के लिए 30 नवंबर 2026 की तारीख तय की है। प्रस्तावित सर्वे में उस विवादित संरचना को शामिल नहीं किया जाना है, जिसे हिंदू पक्ष शिवलिंग बताता है।
मामला मंगलवार को हाईकोर्ट के सामने आया। सुनवाई के दौरान दोनों पक्षों के वकीलों ने अदालत को बताया कि विवाद से जुड़ा मामला अभी सुप्रीम कोर्ट के समक्ष विचाराधीन है। वकीलों ने यह भी बताया कि इस मामले में लागू अंतरिम आदेश अभी प्रभावी है।
इन दलीलों को ध्यान में रखते हुए हाईकोर्ट ने मंगलवार को मामले पर आगे की सुनवाई नहीं की और अगली तारीख 30 नवंबर निर्धारित कर दी।
मामले की जड़ 21 अक्टूबर 2023 के वाराणसी जिला न्यायालय के आदेश में है। उस समय जिला अदालत ने वजूखाने के ASI सर्वे का निर्देश देने की मांग स्वीकार नहीं की थी।
वाराणसी जिला अदालत के आदेश को दी गई चुनौती
इलाहाबाद हाईकोर्ट में यह मामला सिविल रिवीजन के जरिए पहुंचा है। याचिका राखी सिंह ने दाखिल की है, जो मूल वाद में याचिकाकर्ताओं में शामिल हैं।
रिवीजन में वाराणसी जिला जज के उस फैसले को चुनौती दी गई है, जिसमें वजूखाना क्षेत्र की ASI जांच कराने का निर्देश देने से इनकार किया गया था।
याचिका में जिस संरचना को सर्वे से अलग रखने की बात कही गई है, उसे हिंदू पक्ष शिवलिंग बताता है। वहीं मुस्लिम पक्ष का कहना है कि वह शिवलिंग नहीं बल्कि फव्वारा है। इस संरचना की पहचान को लेकर दोनों पक्षों के दावे अलग-अलग हैं।
वजूखाना ज्ञानवापी मस्जिद परिसर के भीतर स्थित वह स्थान है जिसका इस्तेमाल वुजू यानी नमाज से पहले शारीरिक शुद्धि के लिए किया जाता है। यह परिसर वाराणसी में काशी विश्वनाथ मंदिर के निकट स्थित है।
इलाहाबाद हाईकोर्ट में इस सिविल रिवीजन की सुनवाई न्यायमूर्ति रोहित रंजन अग्रवाल कर रहे हैं।
सुप्रीम कोर्ट की कार्यवाही का रहेगा असर
मंगलवार की सुनवाई में हाईकोर्ट ने ASI सर्वे कराने या न कराने को लेकर कोई नया आदेश नहीं दिया। अदालत को मुख्य रूप से यह बताया गया कि मामले से संबंधित कार्यवाही अभी सर्वोच्च न्यायालय में चल रही है।
पक्षकारों के अधिवक्ताओं ने कहा कि सुप्रीम कोर्ट का अंतरिम आदेश फिलहाल लागू है। ऐसे में हाईकोर्ट ने भी मामले को आगे बढ़ाने के बजाय अगली सुनवाई की तारीख तय करना उचित समझा।
ज्ञानवापी परिसर से जुड़ा यह विवाद लंबे समय से न्यायिक प्रक्रिया का हिस्सा रहा है। इसमें परिसर के धार्मिक स्वरूप, वहां मौजूद संरचनाओं और विभिन्न पक्षों के दावों से जुड़े कई कानूनी प्रश्न शामिल हैं।

सिविल रिवीजन में राखी सिंह की ओर से अधिवक्ता सौरभ तिवारी, अमित शुक्ला, अमिताभ त्रिवेदी और विकास कुमार अदालत में पेश हुए।
याचिका का मूल उद्देश्य वाराणसी जिला अदालत के उस फैसले को चुनौती देना है, जिसमें वजूखाने के ASI सर्वे की मांग स्वीकार नहीं की गई थी। प्रस्तावित जांच से विवादित संरचना को अलग रखने की बात याचिका में शामिल है।
अब मामले की सुनवाई 30 नवंबर को होगी। उस समय सुप्रीम कोर्ट में लंबित कार्यवाही और प्रभावी अंतरिम निर्देशों की स्थिति को ध्यान में रखते हुए इलाहाबाद हाईकोर्ट आगे की कार्रवाई पर विचार कर सकता है।
