Allahabad High Court Hands Sudama Devi Missing Case to CBI After Two-Year Police Search Fails

PRAYAGRAJ: The Allahabad High Court has transferred the investigation into the disappearance of a 42-year-old woman from Maharajganj to the Central Bureau of Investigation after an extended police search failed to establish her whereabouts.

Justice Sandeep Jain ordered the CBI to take up efforts to locate Sudama Devi and directed the agency to produce her before the court on December 1, 2026.

State authorities have been told to provide the CBI with whatever assistance is required during the investigation.

The court’s intervention came after it was informed that the Uttar Pradesh Police had been unable to trace the woman despite sustained efforts.

Sudama Devi disappeared on September 8, 2024. A missing-person report was lodged at Puranderpur police station in Maharajganj district the next day. Despite the passage of more than two years, investigators had not been able to locate her.

Husband approached High Court over disappearance.

The matter reached the High Court through a habeas corpus petition filed by Sudama Devi’s husband.

The petition alleged that Sudama Devi had been kept in unlawful custody by Jameela Khatoo, who was arrayed as the fourth respondent in the proceedings. A complaint concerning the alleged custody had also been lodged with the police.

During the initial proceedings, however, the court took note of an existing dispute between the petitioners and the fourth respondent.

This led the bench to treat the allegation of illegal confinement with caution and seek a fuller account of the investigation from the state.

The court subsequently required the state to submit an affidavit detailing the steps taken to determine Sudama Devi’s whereabouts.

In its response, the state told the court that a team of police personnel had been specifically assigned to locate Sudama Devi.

The affidavit described her as a 42-year-old woman with mental health difficulties and said she did not possess a mobile phone.

According to the state, the absence of a phone and other circumstances surrounding her disappearance had complicated efforts to track her.

Despite the investigation, the state informed the bench on September 29 that the woman had still not been found.

The court took note of the fact that the missing-person case had been registered shortly after her disappearance, yet the search had produced no result over an extended period.

CBI ordered to take up search

Against this backdrop, the High Court decided that the case required an investigation by a central agency.

In its September 29 order, the court directed the CBI to make every necessary effort to locate Sudama Devi and bring her before the bench on December 1, 2026.

The order also places an obligation on Uttar Pradesh authorities to assist the CBI investigation. State officials and other concerned functionaries have been directed to extend the necessary cooperation and logistical support to the agency.

The case will return before the High Court on December 1, when the court is expected to take stock of the CBI’s efforts to trace the missing woman.

The transfer marks a significant escalation in the matter after the state police were unable to resolve the disappearance despite more than two years of investigation.

महाराजगंज की 42 वर्षीय महिला सितंबर 2024 से गायब; हाईकोर्ट ने 1 दिसंबर 2026 तक महिला को पेश करने का दिया निर्देश

प्रयागराज: महाराजगंज की 42 वर्षीय महिला सुदामा देवी के दो साल से अधिक समय से लापता रहने के मामले में इलाहाबाद हाईकोर्ट ने अब जांच केंद्रीय जांच ब्यूरो (CBI) को सौंप दी है। उत्तर प्रदेश पुलिस की लंबी तलाश के बावजूद महिला का पता नहीं चल पाने के बाद अदालत ने केंद्रीय एजेंसी को उसकी तलाश का जिम्मा दिया।

न्यायमूर्ति संदीप जैन ने CBI को सुदामा देवी का पता लगाने के लिए हर आवश्यक प्रयास करने और उन्हें 1 दिसंबर 2026 को हाईकोर्ट के सामने पेश करने का निर्देश दिया है। अदालत ने राज्य सरकार और संबंधित अधिकारियों को जांच एजेंसी को हर जरूरी सहयोग उपलब्ध कराने को भी कहा है।

सुदामा देवी 8 सितंबर 2024 को लापता हुई थीं। अगले दिन महाराजगंज जिले के पुरंदरपुर थाने में उनके लापता होने की रिपोर्ट दर्ज की गई थी। इसके बावजूद लंबा समय बीतने के बाद भी पुलिस उन्हें तलाश नहीं सकी।

पति की याचिका से हाईकोर्ट पहुंचा मामला

सुदामा देवी के पति ने उनकी तलाश और कथित हिरासत को लेकर हाईकोर्ट का दरवाजा खटखटाया था। उन्होंने बंदी प्रत्यक्षीकरण याचिका दाखिल कर आरोप लगाया कि चौथी प्रतिवादी जमिला खातून ने सुदामा देवी को कथित तौर पर अवैध रूप से अपने कब्जे में रखा है।

इस कथित हिरासत को लेकर संबंधित थाने में शिकायत दर्ज कराए जाने की बात भी याचिका में कही गई थी।

हालांकि, शुरुआती सुनवाई में हाईकोर्ट ने यह भी ध्यान में रखा कि याचिकाकर्ता पक्ष और चौथी प्रतिवादी के बीच पहले से विवाद था। इसी कारण अदालत ने केवल आरोप के आधार पर निष्कर्ष निकालने के बजाय राज्य सरकार से मामले की जांच और महिला की तलाश में उठाए गए कदमों का विस्तृत ब्यौरा मांगा।

इसके बाद राज्य को हलफनामा दाखिल कर सुदामा देवी का पता लगाने के लिए पुलिस की ओर से की गई कार्रवाई की जानकारी देने का निर्देश दिया गया।

पुलिस ने बताई महिला को तलाशने में मुश्किल

राज्य सरकार ने अपने जवाब में बताया कि सुदामा देवी को खोजने के लिए पुलिस अधिकारियों की एक विशेष टीम लगाई गई थी।

हलफनामे में महिला की उम्र 42 वर्ष बताई गई और कहा गया कि वह मानसिक रूप से अस्वस्थ थी। राज्य के अनुसार, उनके पास मोबाइल फोन भी नहीं था। इन परिस्थितियों ने पुलिस के लिए उनके संभावित ठिकाने का पता लगाने का काम और कठिन बना दिया।

29 सितंबर को राज्य की ओर से अदालत को बताया गया कि पुलिस के लगातार प्रयासों के बावजूद महिला अभी तक नहीं मिली है।

हाईकोर्ट ने इस तथ्य पर गौर किया कि महिला के गायब होने के अगले ही दिन पुलिस में रिपोर्ट दर्ज हो गई थी। इसके बावजूद दो साल से अधिक समय गुजरने पर भी उसका कोई पता नहीं चल पाया।

अब CBI तलाशेगी सुदामा देवी को

पुलिस जांच से महिला का सुराग नहीं मिलने के बाद हाईकोर्ट ने मामले को केंद्रीय एजेंसी के हवाले करने का फैसला किया।

29 सितंबर के अपने आदेश में अदालत ने CBI को सुदामा देवी को खोजने के लिए सभी आवश्यक कदम उठाने और अगली सुनवाई में उन्हें अदालत के समक्ष पेश करने का निर्देश दिया।

हाईकोर्ट ने राज्य के अधिकारियों को भी CBI के साथ पूरा सहयोग करने के लिए कहा है। संबंधित अधिकारी जांच के दौरान एजेंसी को जरूरी सहायता और सहयोग उपलब्ध कराएंगे।

मामले की अगली सुनवाई 1 दिसंबर 2026 को होगी। उस तारीख पर CBI की ओर से महिला को तलाशने के लिए किए गए प्रयासों की स्थिति अदालत के सामने रखी जा सकती है।

सुदामा देवी के मामले को CBI को सौंपे जाने का फैसला इसलिए महत्वपूर्ण है क्योंकि राज्य पुलिस की ओर से लंबे समय तक तलाश किए जाने के बावजूद महिला का कोई सुराग नहीं मिला। अब अदालत की निगरानी में केंद्रीय जांच एजेंसी उनके ठिकाने का पता लगाने की कोशिश करेगी।
