Israeli Prison Case Draws Scrutiny After Palestinian Inmate Dies Following Alleged Beating

Court charges 12 prison guards over death of Thaer Abu Asab; investigation examines alleged violence, WhatsApp messages and chain of command at Ketzio.

The death of Palestinian prisoner Thaer Abu Asab inside an Israeli prison in November 2023 has become the focus of a criminal case involving 12 Israel Prison Service guards, with an investigation examining what happened during a prison cell search and whether the incident reflected broader problems within the facility.

According to an investigation by Israeli newspaper Haaretz, Abu Asab, who was serving a 25-year sentence for attacks against Israel, was allegedly subjected to a severe beating at Ketziot Prison in southern Israel.

Prosecutors filed charges against 12 guards last week, although investigators have reportedly been unable to establish which individual blows caused the prisoner’s fatal injury.

The case gained fresh significance after investigators obtained WhatsApp conversations exchanged by prison personnel.

The messages, according to Haaretz, allegedly contained references to the events surrounding the prisoner’s death as well as descriptions of other incidents involving violence against inmates.

Abu Asab was eventually transferred to Soroka Medical Center in Be’er Sheva, where he was pronounced dead.

The indictment cited by Haaretz reportedly attributes the death to a fatal heart injury resulting from the alleged assault.

What Happened Inside the Cell?

The incident reportedly followed a question from Abu Asab about whether Israel and the Palestinians had reached a ceasefire.

One of his fellow prisoners told Haaretz that a guard responded sharply and warned him against raising the issue.

The information allegedly reached a Prison Service officer referred to in court documents and the newspaper’s report as “the commander” because a judicial gag order prohibits publication of the defendants’ names.

According to the investigation, the commander subsequently ordered an operation during the evening headcount.

Prisoners told Haaretz that 15 regular guards and 15 members of Keter, the Prison Service’s tactical unit, entered the cell.

The inmates were allegedly ordered to kneel while keeping their hands above their heads.

They said guards then used batons against them for several minutes and that a dog was deployed during the incident.

The prisoners further alleged that Abu Asab endured the most severe assault and collapsed without getting back up.

The allegations are not based solely on prisoner testimony. Haaretz reported that statements given by guards to investigators also pointed towards the commander’s involvement.

Guard Diana Troitsky allegedly told investigators that the commander had spoken before the operation about two friends who had been killed in Gaza and said he was devastated by their deaths.

She reportedly said he subsequently told personnel that he would accept responsibility for whatever occurred during the night’s operation and that his superiors had given him freedom to act.

Another guard, Avia Arusi, reportedly described the commander and another colleague asking prisoners to identify the person who had raised the ceasefire question.

According to her account, the prisoner identified in response was then beaten.

The two guards’ accounts, as reported by Haaretz, placed the commander at the cell entrance during the alleged assault and indicated that he had authorised the entry into the cell.

WhatsApp Messages Raise Further Questions

The investigation also uncovered exchanges that allegedly went beyond the circumstances of Abu Asab’s death.

One prison guard, Oshrit Eliga, reportedly discussed assaults on prisoners in messages exchanged with a friend and with her partner, who worked at another prison.

The messages allegedly portrayed physical punishment of inmates as something that occurred repeatedly.

In one exchange cited by Haaretz, Eliga allegedly described guards becoming exhausted after beating newly arrived prisoners and referred to the commander using his belt to continue the assault.

In another conversation, she allegedly indicated that she would refuse to allow a prisoner into a particular wing unless the person emerged injured.

Eliga subsequently told investigators that she regretted writing the messages and claimed she had embellished her account to impress her friend.

According to Haaretz, investigators did not extend their inquiry into the wider allegations of systematic beatings contained in the messages.

Allegations Reach Senior Command

The investigation has also raised questions about whether responsibility extended beyond the personnel directly involved in the incident.

The officer identified as “the commander” reportedly told investigators that a wider culture of unreported violence existed at Ketziot and implicated the prison’s overall commander, Brigadier General Yosef Knipes.

He allegedly said senior officers sometimes put on tactical clothing resembling that worn by masked members of Keter before entering prisoner cells.

According to his account, this practice made it difficult to determine which officers had inflicted particular injuries.

The officer reportedly told investigators that he regarded himself as bound to follow Knipes’ orders and procedures.

Knipes rejected those allegations when questioned, according to Haaretz.

He reportedly accused the officer of inventing the claims and maintained that the conduct described did not represent the way Ketziot Prison operated.

The Israel Prison Service told Haaretz that the incident occurred while a previous commissioner was in charge.

The service also said that the current commissioner had removed some employees involved in the case, stressing that such behaviour would not be tolerated.

Why All 12 Guards Face the Same Charge

Prosecutors reportedly faced difficulty in determining precisely who delivered the injuries that ultimately killed Abu Asab.

Since investigators could not establish which particular blows were fatal, all 12 guards who entered the cell were charged with reckless homicide, according to the Haaretz report.

Women guards who were questioned over their presence at the entrance to the cell were not charged.

The case has another layer involving Abu Asab’s earlier dealings with prison staff.

Before his death, he had faced an indictment alleging that he paid a guard to smuggle mobile phones into the prison.

Haaretz, citing a separate report from Kan News, also reported that Abu Asab had allegedly threatened to reveal additional misconduct by prison guards before his death.

The proceedings remain before Israeli courts.

A court-imposed gag order continues to prevent the publication of the names of those facing charges.

नवंबर 2023 में हुई इस मौत की जांच के बाद 12 Israel Prison Service गार्ड्स के खिलाफ आरोप लगाए गए हैं।

जांच का एक प्रमुख पहलू यह पता लगाना है कि जेल में उस रात वास्तव में क्या हुआ और कैदी की जान जाने के लिए कौन जिम्मेदार था।

इजरायली अखबार Haaretz की जांच के मुताबिक, अबू असब इजरायल के खिलाफ हमलों के मामले में 25 साल की सजा काट रहा था।

आरोप है कि दक्षिणी इजरायल की Ketziot जेल में उसके साथ बुरी तरह मारपीट की गई, जिसके बाद उसकी हालत गंभीर हो गई।

बाद में उसे बेयर शेवा के सोरोका मेडिकल सेंटर ले जाया गया, जहां उसे मृत घोषित कर दिया गया।

मामले की जांच में पुलिस और अभियोजकों को जेल कर्मचारियों के बीच हुए व्हाट्सऐप संदेश भी मिले।

Haaretz के अनुसार, इन संदेशों में उस रात हुई घटनाओं के अलावा कैदियों के साथ कथित मारपीट से जुड़े अन्य संदर्भ भी मौजूद थे।

अभियोग में कथित तौर पर कहा गया है कि अबू असब को लगी चोटों में उसके दिल को पहुंची चोट घातक साबित हुई।

हालांकि, जांचकर्ता यह निर्धारित नहीं कर सके कि उसे लगी कौन-सी विशेष चोट या किस वार के कारण उसकी मौत हुई।

एक सवाल के बाद बढ़ा मामला

रिपोर्ट के अनुसार, घटनाक्रम उस समय शुरू हुआ जब अबू असब ने कथित तौर पर एक गार्ड से पूछा कि क्या इजरायल और फिलिस्तीनियों के बीच युद्धविराम हो गया है।

उसके एक सह-कैदी ने Haaretz को बताया कि गार्ड ने उसे इस तरह का सवाल दोबारा न पूछने की चेतावनी दी।

यह बात जेल सेवा के एक अधिकारी तक पहुंची, जिसे अदालत के आदेश के कारण रिपोर्ट में ‘कमांडर’ के नाम से संबोधित किया गया है।

आरोप है कि इसके बाद शाम की कैदी गिनती के दौरान सेल में एक कार्रवाई की गई।

कैदियों के बयानों के अनुसार, 15 गार्ड और Keter सामरिक इकाई के 15 सदस्य सेल में पहुंचे। कैदियों को कथित तौर पर घुटनों के बल बैठने और हाथ सिर के ऊपर रखने का आदेश दिया गया।

इसके बाद डंडों से मारपीट किए जाने का आरोप है। कैदियों के अनुसार, एक कुत्ते का भी वहां इस्तेमाल किया गया।

उनका कहना था कि अबू असब को बाकी कैदियों की तुलना में सबसे ज्यादा पीटा गया और इसके बाद वह उठ नहीं सका।

हालांकि, इस मामले में केवल कैदियों के बयान ही जांच का आधार नहीं हैं। Haaretz ने बताया कि कुछ जेल गार्ड्स ने भी पूछताछ के दौरान ऐसे बयान दिए, जिनसे कथित तौर पर कमांडर की भूमिका पर सवाल उठे।

गार्ड डायना ट्रोइत्स्की ने कथित तौर पर जांचकर्ताओं को बताया कि कार्रवाई से पहले कमांडर ने गाजा में मारे गए अपने दो दोस्तों का उल्लेख किया था और उनके निधन से बेहद दुखी होने की बात कही थी।

उसके अनुसार, कमांडर ने गार्ड्स से कहा था कि उस रात जो भी होगा, उसकी जिम्मेदारी वह खुद लेगा और वरिष्ठ अधिकारियों ने उसे कार्रवाई की स्वतंत्रता दी है।

एक अन्य गार्ड अविया अरुसी ने कथित तौर पर बताया कि कमांडर और उसके एक सहयोगी ने कैदियों से यह जानने की कोशिश की कि युद्धविराम के बारे में सवाल किसने पूछा था।

उसके मुताबिक, पहचान होने के बाद संबंधित कैदी की पिटाई की गई।

Haaretz में उद्धृत इन बयानों के अनुसार, कमांडर कथित कार्रवाई के समय सेल के प्रवेश द्वार पर मौजूद था और उसी ने सेल में प्रवेश का निर्देश दिया था।

जेल में हिंसा के दूसरे आरोप भी सामने आए

जांच के दौरान मिले संदेशों ने अबू असब की मौत से अलग एक और सवाल खड़ा किया—क्या जेल में कैदियों के साथ मारपीट का सिलसिला पहले से चल रहा था?

गार्ड ओशरित एलिगा के कथित संदेशों की भी जांच की गई। उसने एक दोस्त और दूसरी जेल में काम करने वाले अपने साथी के साथ बातचीत में कैदियों की पिटाई का उल्लेख किया था।

Haaretz के अनुसार, उसके संदेशों में नए कैदियों के साथ कथित मारपीट को बार-बार होने वाली घटना के रूप में पेश किया गया था।

एक संदेश में उसने कथित तौर पर नए कैदियों की पिटाई के बाद गार्ड्स के थक जाने और कमांडर द्वारा बेल्ट से मारपीट जारी रखने की बात कही।

एक अन्य संदेश में कथित रूप से उसने कहा कि वह किसी कैदी को वार्ड में तब तक प्रवेश नहीं करने देगी, जब तक वह घायल होकर बाहर न आए।

बाद में एलिगा ने जांचकर्ताओं से कहा कि उसे उन संदेशों पर पछतावा है और उसने अपने दोस्त को प्रभावित करने के लिए बात को बढ़ा-चढ़ाकर पेश किया था।

Haaretz के मुताबिक, जांचकर्ताओं ने उसके संदेशों में लगाए गए जेल में व्यापक स्तर पर मारपीट के आरोपों की अलग से आगे जांच नहीं की।

वरिष्ठ अधिकारियों की भूमिका पर भी सवाल

जांच की एक कड़ी जेल के वरिष्ठ कमांड ढांचे तक भी पहुंची। रिपोर्ट के मुताबिक, ‘कमांडर’ ने पूछताछ के दौरान Ketziot Prison में कथित तौर पर मौजूद व्यापक हिंसक माहौल के बारे में जानकारी दी और जेल के शीर्ष अधिकारी ब्रिगेडियर जनरल योसेफ निप्स की भूमिका पर भी आरोप लगाए।

उस अधिकारी ने कथित तौर पर बताया कि वरिष्ठ अधिकारी कभी-कभी Keter इकाई के नकाबपोश सदस्यों जैसी सामरिक पोशाक पहनकर कैदियों की कोशिकाओं में प्रवेश करते थे।

उसके मुताबिक, इससे यह पहचानना मुश्किल हो जाता था कि किसी कैदी को लगी चोट के लिए कौन-सा अधिकारी जिम्मेदार था।

हालांकि, निप्स ने इन आरोपों को सिरे से खारिज किया। Haaretz के अनुसार, उन्होंने पूछताछ के दौरान संबंधित अधिकारी पर आरोप गढ़ने का आरोप लगाया और कहा कि उसके द्वारा बताई गई घटनाएं जेल के सामान्य संचालन का प्रतिनिधित्व नहीं करतीं।

Israel Prison Service ने अखबार को बताया कि यह घटना उसके पूर्व कमिश्नर के कार्यकाल में हुई थी।

सेवा के मुताबिक, वर्तमान कमिश्नर ने मामले में शामिल कुछ कर्मचारियों को नौकरी से हटा दिया है और यह स्पष्ट किया है कि इस तरह का आचरण स्वीकार नहीं किया जाएगा।

12 गार्ड्स पर क्यों लगा एक जैसा आरोप?

अभियोजन के सामने एक महत्वपूर्ण कानूनी चुनौती यह रही कि जांचकर्ता यह तय नहीं कर सके कि अबू असब को लगी कौन-सी चोट उसकी मौत का सीधा कारण बनी।

इसी वजह से Haaretz के अनुसार, सेल में प्रवेश करने वाले सभी 12 गार्ड्स पर reckless homicide का आरोप लगाया गया।

सेल के प्रवेश द्वार पर मौजूद महिला गार्ड्स से पूछताछ जरूर की गई, लेकिन उनके खिलाफ आरोप नहीं लगाए गए।

अबू असब का जेल कर्मचारियों के साथ पहले भी विवाद रहा था। उसकी मौत से पहले उस पर एक गार्ड को कथित तौर पर पैसे देकर जेल में मोबाइल फोन पहुंचाने की कोशिश करने का आरोप लगा था।

Haaretz ने Kan News की एक अलग रिपोर्ट के हवाले से यह भी बताया कि अबू असब ने अपनी मौत से पहले जेल गार्ड्स के कथित अन्य कदाचार को उजागर करने की धमकी दी थी।

मामला अभी इजरायली अदालतों में विचाराधीन है। आरोपों का सामना कर रहे लोगों के नाम सार्वजनिक किए जाने पर अदालत का प्रतिबंध फिलहाल जारी है।
