Justice Ashwani Kumar Mishra Takes Oath as Punjab and Haryana High Court Chief Justice Amid Punjab-Centre Row
Governor Gulab Chand Kataria administered the oath to Justice Mishra in Chandigarh, a day after the Punjab Cabinet urged that his appointment and swearing-in be deferred until the state’s views were considered.
Justice Ashwani Kumar Mishra was sworn in as the Chief Justice of the Punjab and Haryana High Court on Monday, despite the Punjab government’s demand that the appointment and oath-taking ceremony be kept in abeyance.
The oath was administered by Punjab Governor Gulab Chand Kataria at Lok Bhawan in Chandigarh. Haryana Chief Minister Nayab Singh Saini attended the ceremony, while Punjab Chief Minister Bhagwant Mann was absent.
Several judges of the Punjab and Haryana High Court were also present.
The swearing-in came a day after the Punjab Cabinet adopted a resolution questioning the manner in which the appointment was cleared by the Centre.
The state government maintained that its views should have been obtained before the appointment was finalised and argued that the prescribed constitutional procedure had not been followed.
The Union Ministry of Law and Justice had formally notified Justice Mishra’s elevation on September 5.
Issued by its Appointments Division under Article 217(1) of the Constitution, the notification said the President had approved his appointment as Chief Justice and that he would hold the office from the date he assumed charge.
Justice Mishra had already been performing the responsibilities associated with the top judicial post.
The Centre had asked him on June 1 to discharge the duties of Chief Justice after Justice Sheel Nagu, who was then heading the Punjab and Haryana High Court, was elevated to the Supreme Court.
The latest development has also brought into focus the procedure followed for appointments to constitutional judicial offices.
The Supreme Court Collegium had recommended Justice Mishra, along with three other judges, for appointment as Chief Justices of High Courts on August 6.
The Centre subsequently sought the views of the respective Chief Ministers and Governors on August 12.
The Memorandum of Procedure does not prescribe a fixed deadline for a state government to communicate its views on the appointment of a High Court Chief Justice.
However, the process is generally expected to move quickly.
In the case of appointments of High Court judges, inputs from the Chief Minister can ordinarily take several weeks, while the Department of Justice may facilitate communication with the state authorities during the process.
According to the account cited in the matter, Bihar, West Bengal and Maharashtra responded promptly to the Centre, whereas the delay in receiving Punjab’s response affected the timing of the appointments.
The four appointments were ultimately notified on September 5.
Punjab’s Cabinet, however, objected to the Centre proceeding without waiting for the state’s position.
In its resolution adopted at an emergency meeting on Sunday evening, the state government described the move as another instance of what it called the Centre’s disregard for Punjab’s constitutional rights and established procedures.
Mann later reiterated the government’s position in a post on X, arguing that the appointment had been made without the state government’s consent and amounted to a departure from the prescribed process under the Memorandum of Procedure.
Justice Mishra’s judicial career spans more than three decades. Born in 1968, he studied Economics at Delhi’s Kirori Mal College before earning his law degree from the Campus Law Centre at the University of Delhi.
He enrolled as an advocate in 1993 and worked mainly in civil, constitutional, and service matters.
He was designated a Senior Advocate in 2013 and was appointed an Additional Judge of the Allahabad High Court the following year.
His appointment was made permanent in 2016.
After serving at the Allahabad High Court for several years, he moved to the Punjab and Haryana High Court in July 2025 and joined the Bench there on July 21.
His tenure in the Punjab and Haryana High Court has already included proceedings involving significant questions concerning the state administration.
In August, a Bench headed by Justice Mishra directed the Punjab government to release pending instalments of dearness allowance and dearness relief to government employees and pensioners.
The Bench had questioned the state’s justification of financial constraints for withholding the payments while continuing expenditure on advertisements and other discretionary areas.
The matter added another layer to the judicial scrutiny of the state government’s financial decisions.
With Justice Mishra now formally taking over as Chief Justice, the immediate political dispute over the appointment remains distinct from his judicial responsibilities.
The episode, however, has brought renewed attention to the interaction between the Union and state governments in appointments to the higher judiciary.

पंजाब-हरियाणा हाईकोर्ट के मुख्य न्यायाधीश बने जस्टिस अश्वनी कुमार मिश्रा, शपथ पर विवाद के बीच संभाला पद
चंडीगढ़ के लोक भवन में राज्यपाल गुलाब चंद कटारिया ने दिलाई शपथ; एक दिन पहले पंजाब कैबिनेट ने नियुक्ति और शपथ ग्रहण टालने की मांग की थी।
जस्टिस अश्वनी कुमार मिश्रा ने सोमवार को पंजाब एवं हरियाणा हाईकोर्ट के मुख्य न्यायाधीश के रूप में शपथ ले ली।
उनका शपथ ग्रहण ऐसे समय हुआ जब पंजाब सरकार ने एक दिन पहले ही केंद्र से उनकी नियुक्ति और शपथ समारोह को फिलहाल रोकने का आग्रह किया था।
चंडीगढ़ स्थित लोक भवन में आयोजित समारोह में पंजाब के राज्यपाल गुलाब चंद कटारिया ने जस्टिस मिश्रा को पद एवं गोपनीयता की शपथ दिलाई।
हरियाणा के मुख्यमंत्री नायब सिंह सैनी कार्यक्रम में मौजूद रहे, जबकि पंजाब के मुख्यमंत्री भगवंत मान समारोह में शामिल नहीं हुए।
हाईकोर्ट के कई न्यायाधीश भी इस अवसर पर उपस्थित थे।
जस्टिस मिश्रा की नियुक्ति को लेकर विवाद उस समय सामने आया जब पंजाब मंत्रिमंडल ने रविवार शाम आपात बैठक कर इस संबंध में प्रस्ताव पारित किया।
राज्य सरकार का कहना था कि मुख्य न्यायाधीश की नियुक्ति आगे बढ़ाने से पहले पंजाब सरकार के विचार लिए जाने चाहिए थे।
केंद्र सरकार के कानून एवं न्याय मंत्रालय के न्याय विभाग के नियुक्ति प्रभाग ने 5 सितंबर को जस्टिस मिश्रा की नियुक्ति की औपचारिक अधिसूचना जारी की थी।
संविधान के अनुच्छेद 217(1) के तहत जारी अधिसूचना में कहा गया था कि राष्ट्रपति ने जस्टिस अश्वनी कुमार मिश्रा को पंजाब एवं हरियाणा हाईकोर्ट का मुख्य न्यायाधीश नियुक्त किया है और वह पदभार ग्रहण करने की तारीख से इस जिम्मेदारी को संभालेंगे।
जस्टिस मिश्रा इस पद की जिम्मेदारियों से पहले ही जुड़े हुए थे। सुप्रीम कोर्ट में जस्टिस शील नागू की नियुक्ति के बाद केंद्र ने 1 जून को जस्टिस मिश्रा को हाईकोर्ट के मुख्य न्यायाधीश के कर्तव्यों का निर्वहन करने के लिए कहा था।
मौजूदा विवाद का एक प्रमुख पहलू उच्च न्यायपालिका में नियुक्तियों की प्रक्रिया से जुड़ा है।
सुप्रीम कोर्ट कॉलेजियम ने 6 अगस्त को जस्टिस मिश्रा समेत चार न्यायाधीशों को विभिन्न हाईकोर्ट का मुख्य न्यायाधीश नियुक्त करने की सिफारिश की थी।
इसके बाद 12 अगस्त को केंद्र ने संबंधित राज्यों के मुख्यमंत्रियों और राज्यपालों से उनकी राय मांगी थी।
मुख्य न्यायाधीश की नियुक्ति पर राज्य सरकार की प्रतिक्रिया देने के लिए मेमोरेंडम ऑफ प्रोसीजर में कोई निश्चित समयसीमा तय नहीं है। हालांकि, ऐसी नियुक्तियों से जुड़े मामलों में प्रक्रिया सामान्यतः तेजी से आगे बढ़ती है।
हाईकोर्ट के न्यायाधीशों की नियुक्ति के मामलों में मुख्यमंत्री से प्राप्त होने वाली जानकारी में आमतौर पर कई सप्ताह लग सकते हैं और केंद्र का न्याय विभाग प्रक्रिया को आगे बढ़ाने के लिए राज्य सरकार के अधिकारियों से संपर्क करता है।
उपलब्ध जानकारी के मुताबिक बिहार, पश्चिम बंगाल और महाराष्ट्र से केंद्र को संबंधित जानकारी जल्द मिल गई थी, जबकि पंजाब की ओर से प्रतिक्रिया में हुई देरी के कारण चारों नियुक्तियों की अधिसूचना जारी होने में समय लगा। अंततः 5 सितंबर को सभी नियुक्तियों को अधिसूचित किया गया।
पंजाब सरकार ने हालांकि केंद्र के इस कदम पर कड़ा ऐतराज जताया।
रविवार को पारित कैबिनेट प्रस्ताव में कहा गया कि राज्य के विचार प्राप्त किए बिना नियुक्ति करना पंजाब के संवैधानिक अधिकारों और निर्धारित प्रक्रिया की अनदेखी है।
मुख्यमंत्री भगवंत मान ने सोशल मीडिया मंच एक्स पर भी सरकार का पक्ष रखा।
उन्होंने आरोप लगाया कि राज्य सरकार की सहमति लिए बिना मुख्य न्यायाधीश की नियुक्ति की गई और इसे मेमोरेंडम ऑफ प्रोसीजर तथा संवैधानिक प्रक्रिया के विपरीत बताया।
जस्टिस अश्वनी कुमार मिश्रा का न्यायिक और कानूनी अनुभव तीन दशक से अधिक का है।
वर्ष 1968 में जन्मे जस्टिस मिश्रा ने दिल्ली के किरोड़ीमल कॉलेज से अर्थशास्त्र की पढ़ाई की और इसके बाद दिल्ली विश्वविद्यालय के कैंपस लॉ सेंटर से एलएलबी की डिग्री हासिल की।
वर्ष 1993 में उन्होंने अधिवक्ता के तौर पर पंजीकरण कराया और मुख्य रूप से सिविल, संवैधानिक तथा सेवा संबंधी मामलों में पैरवी की।
उन्हें 2013 में वरिष्ठ अधिवक्ता का दर्जा मिला। इसके अगले वर्ष वह इलाहाबाद हाईकोर्ट में अतिरिक्त न्यायाधीश नियुक्त हुए और 2016 में स्थायी न्यायाधीश बने।
इलाहाबाद हाईकोर्ट में लंबे समय तक सेवाएं देने के बाद उनका तबादला पंजाब एवं हरियाणा हाईकोर्ट किया गया, जहां उन्होंने 21 जुलाई 2025 को कार्यभार संभाला।
पंजाब एवं हरियाणा हाईकोर्ट में उनके कार्यकाल के दौरान राज्य सरकार से जुड़े महत्वपूर्ण मामलों की सुनवाई भी हुई है।
अगस्त में जस्टिस मिश्रा की अध्यक्षता वाली पीठ ने पंजाब सरकार को कर्मचारियों और पेंशनभोगियों को लंबित महंगाई भत्ते तथा महंगाई राहत की किस्तें जारी करने का निर्देश दिया था।
पीठ ने इस बात पर भी सवाल उठाया था कि राज्य सरकार वित्तीय कठिनाइयों का हवाला देकर कर्मचारियों और पेंशनभोगियों के बकाये को रोक रही है, जबकि विज्ञापनों और अन्य विवेकाधीन मदों में खर्च जारी है।
अब जस्टिस मिश्रा के औपचारिक रूप से मुख्य न्यायाधीश का पद संभालने के साथ उनकी न्यायिक जिम्मेदारियां पूरी तरह इस नई भूमिका में केंद्रित होंगी।
हालांकि, उनकी नियुक्ति को लेकर पंजाब सरकार और केंद्र के बीच उठा विवाद उच्च न्यायपालिका में नियुक्तियों की प्रक्रिया और संघीय संबंधों से जुड़े सवालों को फिर चर्चा में ले आया है।
