OSLO: The 2026 Nobel Peace Prize has been awarded to Navanethem “Navi” Pillay, a South African jurist whose work has helped strengthen the legal mechanisms used to confront atrocities and defend fundamental human rights.

The Norwegian Nobel Committee announced the award on October 9, recognising Pillay for her efforts to promote peace and international law.

Her career has taken her from the fight against apartheid in South Africa to some of the most consequential international proceedings involving crimes against humanity and genocide.

At the heart of her work is the principle that neither political authority nor the circumstances of armed conflict should shield individuals from legal accountability.

Her contributions have helped expand the reach of international criminal law and reinforced the role of judicial institutions in addressing grave abuses.

From South Africa’s Racial Divide to the International Bench

Born in Durban on September 23, 1941, to a family of Indian Tamil descent, Pillay grew up under apartheid, a system that institutionalised racial discrimination.

She entered the legal profession in a society where race determined access to rights and opportunities.

In 1967, she established her own law practice and defended opponents of apartheid, including activists involved in the movement associated with Nelson Mandela.

Her early legal work laid the foundation for a career that would eventually take her to international judicial institutions.

In 1995, she was appointed to South Africa’s High Court, becoming the first Black woman to hold the position.

Her subsequent work demonstrated how domestic legal experience could contribute to the development of international standards for justice and accountability.

Rwanda Tribunal Rulings Helped Define Crimes of Sexual Violence

Pillay’s service at the International Criminal Tribunal for Rwanda became one of the defining chapters of her career.

She served as a judge and later led the tribunal, which prosecuted individuals responsible for atrocities committed during the 1994 genocide.

The tribunal’s landmark jurisprudence helped establish that rape and other forms of sexual violence could constitute crimes against humanity and acts of genocide when the relevant legal requirements were satisfied.

Pillay’s contribution was significant in advancing the recognition of sexual violence as a serious international crime rather than a secondary consequence of conflict.

She also played an important role in legal proceedings concerning the use of propaganda to incite genocide.

These developments strengthened the principle that individuals who encourage mass atrocities can face criminal charges for their role in promoting such crimes.

UN Human Rights Chief and International Judge

Pillay served as the United Nations High Commissioner for Human Rights from 2008 to 2014.

In that role, she advocated compliance with international human rights standards and emphasised that governments must meet their legal obligations.

She later served as a judge at the International Criminal Court.

From 2021 to 2025, she chaired the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory.

Pillay also holds a judicial role at the International Court of Justice as an ad hoc judge appointed by The Gambia in its case against Myanmar under the Genocide Convention.

The proceedings concern allegations of genocide against the Rohingya community.

The Nobel Committee has highlighted her willingness to challenge governments and national leaders over their legal responsibilities, while giving hope to victims of violence and conflict.

The committee’s decision comes with a broader message about the role of law in maintaining international peace.

It warned that the global legal order and the institutions responsible for upholding it face mounting pressure, making the protection of judicial independence increasingly important.

भारतीय तमिल मूल की पिल्लै ने अपने लंबे न्यायिक जीवन में मानवाधिकारों की रक्षा, गंभीर अंतरराष्ट्रीय अपराधों के लिए जवाबदेही और कानून के शासन को मजबूत करने में महत्वपूर्ण योगदान दिया है।

नॉर्वे की नोबेल समिति ने 9 अक्टूबर को पुरस्कार की घोषणा करते हुए कहा कि पिल्लै को शांति और अंतरराष्ट्रीय कानून को बढ़ावा देने के उनके प्रयासों के लिए सम्मानित किया गया है।

रंगभेद के खिलाफ दक्षिण अफ्रीका में कानूनी संघर्ष से शुरू हुआ उनका सफर अंतरराष्ट्रीय न्यायाधिकरणों और संयुक्त राष्ट्र जैसे प्रमुख संस्थानों तक पहुंचा।

नवी पिल्लै का जन्म 23 सितंबर 1941 को दक्षिण अफ्रीका के डरबन में भारतीय तमिल मूल के परिवार में हुआ था। उनका बचपन रंगभेद की उस व्यवस्था के बीच बीता, जिसमें नस्ल के आधार पर लोगों के अधिकारों और अवसरों को सीमित किया जाता था।

वर्ष 1967 में उन्होंने अपनी स्वतंत्र कानूनी प्रैक्टिस शुरू की और रंगभेद का विरोध करने वाले कार्यकर्ताओं की पैरवी की। इनमें नेल्सन मंडेला के आंदोलन से जुड़े लोग भी शामिल थे। यही अनुभव आगे चलकर उनके व्यापक कानूनी और मानवाधिकार संबंधी कार्यों की आधारशिला बना।

वर्ष 1995 में वह दक्षिण अफ्रीका के हाई कोर्ट में नियुक्त होने वाली पहली अश्वेत महिला बनीं। उनकी इस उपलब्धि ने देश के न्यायिक इतिहास में एक महत्वपूर्ण स्थान हासिल किया। बाद में अंतरराष्ट्रीय न्याय संस्थाओं में उनके कार्य ने गंभीर अपराधों के लिए जवाबदेही तय करने से जुड़े कानूनी सिद्धांतों को आगे बढ़ाया।

रवांडा न्यायाधिकरण में ऐतिहासिक कानूनी योगदान

पिल्लै के करियर का एक महत्वपूर्ण अध्याय रवांडा के लिए गठित अंतरराष्ट्रीय आपराधिक न्यायाधिकरण से जुड़ा है। उन्होंने वहां न्यायाधीश के रूप में कार्य किया और बाद में न्यायाधिकरण का नेतृत्व भी किया।

यह संस्था वर्ष 1994 के नरसंहार के दौरान किए गए अत्याचारों के लिए जिम्मेदार लोगों के खिलाफ मुकदमे चलाने के उद्देश्य से स्थापित की गई थी।

न्यायाधिकरण के ऐतिहासिक फैसलों ने यह स्थापित करने में मदद की कि निर्धारित कानूनी शर्तें पूरी होने पर बलात्कार और अन्य यौन हिंसक कृत्य मानवता के खिलाफ अपराध तथा नरसंहार की श्रेणी में आ सकते हैं।

इस कानूनी विकास ने संघर्ष के दौरान यौन हिंसा को गंभीर अंतरराष्ट्रीय अपराध के रूप में मान्यता देने की दिशा में महत्वपूर्ण भूमिका निभाई।

नरसंहार के लिए प्रचार के माध्यम से उकसाने से जुड़े मामलों में भी पिल्लै का योगदान उल्लेखनीय रहा।

इन कार्यवाहियों ने इस सिद्धांत को मजबूत किया कि सामूहिक अत्याचारों को बढ़ावा देने वाले लोगों को भी उनके कृत्यों के लिए आपराधिक जवाबदेही का सामना करना पड़ सकता है।

संयुक्त राष्ट्र में मानवाधिकारों की पैरवी

वर्ष 2008 से 2014 तक पिल्लै ने संयुक्त राष्ट्र के मानवाधिकार उच्चायुक्त के रूप में कार्य किया। इस दौरान उन्होंने अंतरराष्ट्रीय मानवाधिकार मानकों के पालन और सरकारों की कानूनी जिम्मेदारियों पर जोर दिया।

बाद में उन्होंने अंतरराष्ट्रीय आपराधिक न्यायालय में न्यायाधीश के रूप में सेवाएं दीं। वर्ष 2021 से 2025 तक वह कब्जे वाले फिलिस्तीनी क्षेत्र पर संयुक्त राष्ट्र के स्वतंत्र अंतरराष्ट्रीय जांच आयोग की अध्यक्ष रहीं।

वर्तमान में पिल्लै अंतरराष्ट्रीय न्यायालय में तदर्थ न्यायाधीश के रूप में कार्यरत हैं। उन्हें गाम्बिया ने म्यांमार के खिलाफ नरसंहार संधि के तहत दायर मामले में नियुक्त किया है। इस मामले में रोहिंग्या समुदाय के खिलाफ नरसंहार के आरोपों पर कानूनी कार्यवाही चल रही है।

नोबेल समिति ने राज्यों और राष्ट्रीय नेताओं को कानून के प्रति जवाबदेह बनाने में उनकी भूमिका की सराहना की है। समिति के अनुसार, उनके कार्य ने हिंसा और संघर्ष से प्रभावित लोगों के लिए न्याय की उम्मीद को मजबूत किया है।

शांति के लिए कानून का शासन जरूरी

नोबेल समिति ने अपने निर्णय के माध्यम से अंतरराष्ट्रीय शांति बनाए रखने में कानून की अहमियत पर भी जोर दिया है।

समिति ने कहा कि वैश्विक कानूनी व्यवस्था और उसे लागू करने वाली संस्थाएं बढ़ते दबाव का सामना कर रही हैं। ऐसे समय में न्यायिक स्वतंत्रता और कानून के शासन की रक्षा करना विशेष रूप से आवश्यक है।

पिल्लै का करियर बताता है कि अंतरराष्ट्रीय न्यायालय गंभीर अपराधों के आरोपों की जांच, कानूनी मानकों के विकास और जवाबदेही तय करने के लिए महत्वपूर्ण मंच उपलब्ध करा सकते हैं।

हालांकि अदालतें अपने दम पर सभी संघर्ष समाप्त नहीं कर सकतीं, लेकिन वे यह सुनिश्चित करने में मदद करती हैं कि गंभीर उल्लंघनों की जांच हो और न्याय की संभावना बनी रहे।

रंगभेद से प्रभावित दक्षिण अफ्रीका में अपने सफर की शुरुआत करने वाली पिल्लै के लिए नोबेल शांति पुरस्कार जीवनभर के कार्यों की वैश्विक मान्यता है।

उनका जीवन यह संदेश देता है कि मानव गरिमा की रक्षा, कानून के प्रति जवाबदेही और स्थायी शांति की स्थापना एक-दूसरे से गहराई से जुड़े हुए हैं।
