Poonch Courts Paralysed as Lawyers Protest After Judge’s Vehicle Stopped During Budha Amarnath Yatra Security
Lawyers in Jammu and Kashmir’s Poonch have suspended court work for two days, alleging that police personnel harassed Additional District Judge Wajahat Mir after stopping his vehicle during security restrictions for the Budha Amarnath pilgrimage.
Police say the action was part of Budha Amarnath Yatra security arrangements.
Court proceedings in Jammu and Kashmir’s Poonch remained disrupted for a second day as lawyers continued their protest over an incident involving Additional District Judge Wajahat Mir and police personnel deployed for security arrangements during the Budha Amarnath Yatra.
The Bar Association has accused the police of mistreating and harassing the judicial officer after his private vehicle was stopped during traffic restrictions imposed for the movement of a convoy of pilgrims.
Police, however, have maintained that the vehicle was intercepted as part of a security operation aimed at ensuring the safe passage of the Budha Amarnath Yatra and that the officers were unaware at the time that the vehicle was carrying a judge.
The incident occurred on Monday evening when Justice Mir was returning to Poonch from Jammu in his private vehicle.
According to lawyers associated with the protest, police personnel deployed along the route asked the judge to stop and move his vehicle to the side of the road.
Mobin Khan, a lawyer, said the judicial officer stepped out and told the personnel that they could search if required.
The lawyers alleged that an assistant sub-inspector then took possession of the vehicle’s keys, claiming that instructions had been received from senior officials to prevent the vehicle from proceeding.
As information about the incident spread, several judicial officers from Poonch reportedly reached the location and accompanied the Additional District Judge back to the town.
The Poonch Bar Association has since launched a protest and suspended normal court work.
Association president Sunil Sharma said the lawyers were seeking a formal inquiry into the incident and the suspension of the police personnel accused of misconduct.
The police version presents a different sequence of events.
A senior police officer said extensive traffic restrictions had been imposed because it was the opening day of the Budha Amarnath Yatra and the convoy of pilgrims was running behind schedule.
According to the officer, civilian and other vehicular movement between Bhimber Gali and Poonch was temporarily restricted from 4 pm to 6 pm to allow the pilgrimage convoy to pass without interruption.
The judge was travelling without personal security officers and in a private vehicle, the police said.
According to the official, the vehicle did not comply with the initial signal to stop and continued towards Surankote.
Given the area’s security history and past militant attacks, police personnel informed another team positioned near the Surankote Bypass and asked them to intercept the vehicle and verify its occupants.
The senior police officer said the vehicle was allowed to proceed once the officers learned that the occupant was a serving judge.
However, the matter did not end there, and other judicial officers from Poonch later reached the spot.
The conflicting accounts have now become the centre of the dispute that has brought court functioning in Poonch under strain.
The Budha Amarnath Yatra, being held from August 16 to August 28, has been placed under extensive security cover.
The pilgrimage leads to the Budha Amarnath temple in Mandi town of Poonch district, situated at an altitude of about 4,600 feet.
Pilgrims begin their journey from Bhagwati Nagar in Jammu each morning and travel in secured convoys under arrangements involving the police, paramilitary forces and other security agencies.
The pilgrimage holds a significant place in local religious tradition.
According to popular belief, the annual pilgrimage to the Amarnath cave shrine in south Kashmir is considered incomplete without offering prayers at Budha Amarnath.
Because of the security concerns surrounding religious pilgrimages in the region, strict movement controls and multi-layered protection are put in place along the route.
Only registered pilgrims are permitted to travel in the designated convoy under the security arrangements.
As the Budha Amarnath Yatra continues, authorities will now face the additional challenge of resolving the dispute between the legal fraternity and the police so that normal judicial work in Poonch can resume.

जम्मू-कश्मीर के पूंछ जिले में एक न्यायिक अधिकारी और पुलिसकर्मियों के बीच कथित विवाद के बाद अदालतों का कामकाज लगातार दूसरे दिन प्रभावित रहा।
स्थानीय वकीलों ने पुलिस के खिलाफ विरोध प्रदर्शन शुरू कर दिया है और अतिरिक्त जिला न्यायाधीश वजाहत मीर के साथ कथित दुर्व्यवहार की जांच तथा जिम्मेदार पुलिसकर्मियों के खिलाफ कार्रवाई की मांग कर रहे हैं।
विवाद सोमवार शाम उस समय शुरू हुआ, जब बुद्धा अमरनाथ यात्रा के लिए सुरक्षा और यातायात व्यवस्था संभाल रही पुलिस ने जम्मू से पूंछ लौट रहे अतिरिक्त जिला न्यायाधीश के निजी वाहन को रास्ते में रोक लिया।
प्रदर्शन कर रहे वकीलों के अनुसार, पुलिसकर्मियों ने वाहन को सड़क किनारे खड़ा करने को कहा।
वकील मोबिन खान ने आरोप लगाया कि न्यायाधीश वाहन से बाहर आए और पुलिसकर्मियों से कहा कि आवश्यकता हो तो वाहन की तलाशी ली जा सकती है।
वकीलों का आरोप है कि इसके बाद एक सहायक उपनिरीक्षक ने वाहन की चाबी अपने कब्जे में ले ली और कहा कि वरिष्ठ अधिकारियों के निर्देश पर वाहन को रोका गया है।
घटना की जानकारी पूंछ पहुंचने पर अन्य न्यायिक अधिकारी भी मौके पर पहुंचे और अतिरिक्त जिला न्यायाधीश को अपने साथ शहर लेकर आए।
इसके बाद पूंछ बार एसोसिएशन ने विरोध प्रदर्शन शुरू कर दिया, जिससे अदालतों का नियमित कामकाज प्रभावित हुआ।
बार एसोसिएशन के अध्यक्ष सुनील शर्मा ने कहा कि वकील पूरे मामले की निष्पक्ष जांच और घटना में कथित रूप से शामिल पुलिसकर्मियों को निलंबित करने की मांग कर रहे हैं।
हालांकि, पुलिस ने वकीलों के आरोपों से अलग घटनाक्रम बताया है।
एक वरिष्ठ पुलिस अधिकारी के अनुसार, वाहन को बुद्धा अमरनाथ यात्रा के काफिले की निर्बाध आवाजाही सुनिश्चित करने के लिए सुरक्षा उपायों के तहत रोका गया था।
यात्रा का पहला दिन होने और तीर्थयात्रियों का काफिला निर्धारित समय से पीछे चलने के कारण भिंबर गली से पूंछ के बीच सामान्य यातायात को शाम 4 बजे से 6 बजे तक अस्थायी रूप से नियंत्रित किया गया था।
पुलिस के मुताबिक, न्यायाधीश निजी वाहन में यात्रा कर रहे थे और उनके साथ कोई निजी सुरक्षा अधिकारी नहीं था।
अधिकारी ने दावा किया कि वाहन को रुकने का संकेत दिया गया था, लेकिन वह सुरनकोट की दिशा में आगे बढ़ गया।
क्षेत्र में पहले आतंकी हमले हो चुके हैं और सुरक्षा स्थिति को देखते हुए पुलिस ने सुरनकोट बाईपास पर तैनात दूसरी टीम को वाहन रोककर उसमें सवार लोगों की पहचान करने के लिए सतर्क किया।
पुलिस अधिकारी ने कहा कि जब वहां मौजूद पुलिसकर्मियों को पता चला कि वाहन में एक सेवारत न्यायाधीश हैं तो उन्हें आगे जाने की अनुमति दे दी गई।
हालांकि, इस बीच पूंछ से अन्य न्यायिक अधिकारी भी घटना की जानकारी मिलने पर मौके पर पहुंच गए।
घटना को लेकर पुलिस और वकीलों के अलग-अलग दावों के कारण विवाद बढ़ गया है और इसका सीधा असर पूंछ में न्यायिक कार्यों पर पड़ा है।
बुद्धा अमरनाथ यात्रा 16 अगस्त से 28 अगस्त तक चल रही है।
पूंछ जिले के मंडी कस्बे में समुद्र तल से करीब 4,600 फुट की ऊंचाई पर स्थित बुद्धा अमरनाथ मंदिर तक पहुंचने वाले तीर्थयात्रियों के लिए व्यापक सुरक्षा व्यवस्था की गई है।
तीर्थयात्री जम्मू के भगवती नगर से प्रतिदिन सुबह सुरक्षा काफिले के साथ यात्रा शुरू करते हैं। उनकी सुरक्षा के लिए पुलिस, अर्धसैनिक बलों और अन्य सुरक्षा एजेंसियों की बहुस्तरीय व्यवस्था की गई है।
स्थानीय धार्मिक मान्यताओं के अनुसार, दक्षिण कश्मीर के हिमालयी क्षेत्र में स्थित अमरनाथ गुफा की वार्षिक यात्रा को बुद्धा अमरनाथ में दर्शन के बिना पूर्ण नहीं माना जाता।
इसी धार्मिक महत्व और क्षेत्र की सुरक्षा चुनौतियों के कारण यात्रा मार्ग पर कड़ी सुरक्षा व्यवस्था लागू की जाती है।
यात्रा में शामिल होने के लिए श्रद्धालुओं का पंजीकरण अनिवार्य है और उन्हें जम्मू के भगवती नगर से निर्धारित सुरक्षा काफिले के साथ ही आगे बढ़ने की अनुमति दी जाती है।
अब जबकि बुद्धा अमरनाथ यात्रा जारी है, प्रशासन के सामने यात्रा की सुरक्षा बनाए रखने के साथ-साथ पुलिस और वकीलों के बीच पैदा हुए विवाद को सुलझाकर पूंछ की अदालतों में सामान्य कामकाज बहाल करने की चुनौती भी है।
