Punjab Cabinet Opposes Appointment of New Punjab and Haryana High Court Chief Justice
Bhagwant Mann government urges President, PM and Governor not to administer oath to Justice Ashwani Kumar Mishra until Punjab’s consent is obtained
Chandigarh, September 6, 2026: The Punjab government has formally challenged the appointment of Justice Ashwani Kumar Mishra as Chief Justice of the Punjab and Haryana High Court, with the state Cabinet unanimously adopting a resolution seeking a halt to his swearing-in.
The resolution was passed at a Cabinet meeting on Sunday.
Through it, the Punjab government has approached the President, Prime Minister and Punjab Governor, requesting that the oath of office to Justice Mishra should not be administered unless the state government gives its consent.
The Mann government has made the appointment a matter of constitutional procedure and the state’s rights, arguing that decisions affecting Punjab’s constitutional and administrative interests should not be taken without consultation with the state authorities.
According to the Cabinet’s position, the Centre’s decision was taken without following the required procedure and without obtaining Punjab’s consent.
The state government has described this as an instance of what it considers unilateral decision-making by the Centre on matters directly concerning Punjab.
Chief Minister Bhagwant Mann said the Cabinet had unanimously adopted the resolution in response to what he termed an infringement of the state’s constitutional rights.
Mann alleged that Punjab’s rights had repeatedly been disregarded by the Centre and specifically questioned the process through which the new Chief Justice was appointed.
He maintained that the appointment had been made without consultation with the state government and without adherence to the prescribed procedure.
The Chief Minister further contended that the process was inconsistent with the Memorandum of Procedure (MoP) as well as constitutional requirements.
He described the issue as a direct challenge to the rights and position of the state government.
The Punjab Cabinet’s intervention now places the proposed swearing-in of Justice Mishra at the centre of a dispute between the state government and the Centre over the procedure followed for appointments affecting the Punjab and Haryana High Court.
The state has called for its consent to be obtained before the oath is administered, making consultation the key demand contained in Sunday’s resolution.

चंडीगढ़, 6 सितंबर 2026: पंजाब में पंजाब एवं हरियाणा हाईकोर्ट के नए मुख्य न्यायाधीश की नियुक्ति को लेकर केंद्र और राज्य सरकार के बीच टकराव की स्थिति बन गई है।
मुख्यमंत्री भगवंत मान की अध्यक्षता वाली पंजाब कैबिनेट ने रविवार को न्यायमूर्ति अश्वनी कुमार मिश्रा की नियुक्ति पर आपत्ति जताते हुए सर्वसम्मति से एक प्रस्ताव पारित किया।
राज्य सरकार ने प्रस्ताव के जरिए राष्ट्रपति, प्रधानमंत्री और पंजाब के राज्यपाल से आग्रह किया है कि जब तक पंजाब सरकार अपनी सहमति नहीं देती, तब तक न्यायमूर्ति मिश्रा को मुख्य न्यायाधीश पद की शपथ न दिलाई जाए।
कैबिनेट का कहना है कि पंजाब से जुड़े संवैधानिक और प्रशासनिक हितों पर प्रभाव डालने वाले फैसलों में राज्य सरकार से परामर्श किया जाना चाहिए।
राज्य सरकार ने आरोप लगाया है कि ऐसे मामलों में केंद्र की ओर से एकतरफा निर्णय लिए जा रहे हैं।
पंजाब सरकार ने इस नियुक्ति की प्रक्रिया को लेकर भी सवाल उठाए हैं। उसका दावा है कि न्यायमूर्ति मिश्रा को हाईकोर्ट का मुख्य न्यायाधीश नियुक्त करने से पहले राज्य सरकार की सहमति नहीं ली गई और निर्धारित प्रक्रिया का पालन नहीं किया गया।
मुख्यमंत्री भगवंत मान ने कैबिनेट के फैसले को पंजाब के संवैधानिक अधिकारों से जोड़ते हुए कहा कि राज्य के अधिकारों की अनदेखी के खिलाफ मंत्रिमंडल ने सर्वसम्मति से प्रस्ताव पारित किया है।
मान के अनुसार, केंद्र लंबे समय से पंजाब के अधिकारों को नजरअंदाज कर रहा है। उन्होंने आरोप लगाया कि हाईकोर्ट के नए मुख्य न्यायाधीश की नियुक्ति में भी राज्य सरकार से सहमति नहीं ली गई।
मुख्यमंत्री ने दावा किया कि नियुक्ति की प्रक्रिया मेमोरेंडम ऑफ प्रोसीजर (MoP) और संवैधानिक नियमों के अनुरूप नहीं है। उन्होंने इसे राज्य सरकार के संवैधानिक अधिकारों के उल्लंघन का सीधा मामला बताया।
रविवार को पारित प्रस्ताव के बाद अब पंजाब सरकार ने न्यायमूर्ति मिश्रा के शपथ ग्रहण को रोकने और पहले राज्य से सहमति लेने की मांग सामने रखी है।
इस घटनाक्रम ने हाईकोर्ट के मुख्य न्यायाधीश की नियुक्ति को लेकर केंद्र और पंजाब सरकार के बीच संवैधानिक प्रक्रिया से जुड़ा विवाद खड़ा कर दिया है।
राज्य कैबिनेट का मुख्य जोर इस बात पर है कि पंजाब के हितों से जुड़े ऐसे निर्णयों में राज्य सरकार को प्रक्रिया का हिस्सा बनाया जाए और उसकी सहमति के बाद ही आगे की कार्रवाई की जाए।
