Sonia Gandhi, Rahul Gandhi Face Complaint Over Alleged Vande Mataram Disrespect at Congress Independence Day Event
A complaint has been filed against Sonia Gandhi and Rahul Gandhi over alleged disrespect to Vande Mataram during Congress’s Independence Day event. Congress has rejected the allegations.
A fresh political controversy erupted over the rendition of Vande Mataram at the Congress headquarters on Independence Day, with lawyers filing a complaint against senior party leaders Sonia Gandhi and Rahul Gandhi over alleged disrespect to the National Song.
The complaint, filed by advocates Kunal Vinayak and Shubh Sharma on Sunday, seeks an investigation into the conduct of the two Congress leaders during the programme.
The lawyers have relied on video footage circulating publicly and media reports concerning the incident.
According to the complaint, Sonia Gandhi appeared to make gestures and interact with people around her while the rendition of Vande Mataram was continuing.
The complainants have alleged that her conduct appeared to indicate an objection to the continuation of the song.
The complaint also refers to another portion of the footage in which Rahul Gandhi is allegedly heard saying, “We are not singing Vande Mataram.”
The lawyers have argued that the statement, when viewed alongside the other footage, warrants examination by the appropriate authorities to determine the context and intent behind the conduct.
The allegations have triggered a political confrontation between the Congress and the BJP.
Union Home Minister Amit Shah, speaking at a rally in Chittorgarh, accused the Congress of having forgotten Vande Mataram for what he described as vote-bank considerations.
BJP leader Amit Malviya also alleged that Sonia Gandhi had objected to the complete rendition of the National Song.
Congress, however, has rejected the interpretation being placed on the footage and maintained that Sonia Gandhi’s actions were unrelated to the rendition of Vande Mataram at the venue. The party has disputed the allegations of disrespect.
The controversy comes against the backdrop of a significant change in the legal status of Vande Mataram.
Parliament passed the Prevention of Insults to National Honour (Amendment) Bill, 2026, extending to the National Song the statutory protection earlier available to the National Anthem.
President Droupadi Murmu subsequently gave her assent, bringing the amendment into force.
Under the amended provision, a person who intentionally prevents the singing of the National Anthem or National Song, or deliberately causes disturbance to an assembly engaged in such singing, can face imprisonment of up to three years, a fine, or both.
The complaint against the Congress leaders therefore comes at a particularly sensitive moment, although the filing itself does not establish that any offence was committed.
Whether the alleged gestures or remarks amount to conduct prohibited under the amended law would depend on the facts, evidence, intent and findings of the competent authorities.
The episode has meanwhile added another flashpoint to the continuing political contest between the Congress and BJP over nationalism, the legacy of the freedom movement and the place of Vande Mataram in public life.

स्वतंत्रता दिवस के अवसर पर कांग्रेस मुख्यालय में वंदे मातरम् के गायन को लेकर राजनीतिक विवाद तेज हो गया है।
वरिष्ठ कांग्रेस नेताओं सोनिया गांधी और राहुल गांधी के खिलाफ रविवार को शिकायत दर्ज कराई गई, जिसमें राष्ट्रगीत के कथित अनादर की जांच की मांग की गई है।
अधिवक्ता कुणाल विनायक और शुभ शर्मा की ओर से दाखिल शिकायत में सार्वजनिक रूप से सामने आए वीडियो फुटेज और इस घटनाक्रम से जुड़ी मीडिया रिपोर्टों का हवाला दिया गया है।
शिकायतकर्ताओं ने दोनों नेताओं के कार्यक्रम के दौरान कथित आचरण की जांच की मांग की है।
शिकायत के अनुसार, वंदे मातरम् का गायन जारी रहने के दौरान सोनिया गांधी कुछ लोगों से बातचीत करती और इशारे करती दिखाई दीं।
शिकायतकर्ताओं का दावा है कि इन गतिविधियों से प्रथम दृष्टया ऐसा प्रतीत होता है कि वह राष्ट्रगीत के आगे जारी रहने पर आपत्ति जता रही थीं।
शिकायत में वीडियो के एक अन्य हिस्से का भी उल्लेख किया गया है, जिसमें आरोप के मुताबिक राहुल गांधी को यह कहते हुए सुना जा सकता है, “We are not singing Vande Mataram.”
शिकायतकर्ताओं का कहना है कि इस कथित टिप्पणी और सोनिया गांधी के व्यवहार को पूरे घटनाक्रम के संदर्भ में देखा जाना चाहिए तथा वास्तविक मंशा की जांच सक्षम एजेंसी द्वारा की जानी चाहिए।
मामले ने कांग्रेस और बीजेपी के बीच राजनीतिक टकराव को और बढ़ा दिया है।
केंद्रीय गृह मंत्री अमित शाह ने चित्तौड़गढ़ में एक रैली के दौरान कांग्रेस पर निशाना साधते हुए आरोप लगाया कि पार्टी ने वोट बैंक की राजनीति के कारण वंदे मातरम् को भुला दिया।
बीजेपी नेता अमित मालवीय ने भी आरोप लगाया कि सोनिया गांधी ने राष्ट्रगीत के पूर्ण गायन पर आपत्ति जताई थी।
हालांकि, कांग्रेस ने इन आरोपों को खारिज कर दिया है।
पार्टी का कहना है कि सोनिया गांधी की गतिविधियों का वंदे मातरम् के गायन से कोई संबंध नहीं था और वीडियो की जो व्याख्या की जा रही है, वह वास्तविक स्थिति को सही ढंग से प्रस्तुत नहीं करती।
यह विवाद ऐसे समय सामने आया है जब वंदे मातरम् को लेकर देश में कानूनी प्रावधान भी हाल में बदले हैं।
संसद ने Prevention of Insults to National Honour (Amendment) Bill, 2026 पारित किया, जिसके जरिए राष्ट्रगीत को राष्ट्रीय गान के समान वैधानिक संरक्षण देने का प्रावधान किया गया।
राष्ट्रपति द्रौपदी मुर्मू की मंजूरी के बाद यह संशोधन कानून का रूप ले चुका है।
संशोधित प्रावधान के तहत राष्ट्रीय गान या राष्ट्रगीत के गायन को जानबूझकर रोकना अथवा ऐसे गायन में लगे किसी समूह के कार्यक्रम में जानबूझकर व्यवधान डालना दंडनीय है।
इसके लिए अधिकतम तीन वर्ष तक की जेल, जुर्माना या दोनों का प्रावधान है।
हालांकि, केवल शिकायत दर्ज होने से किसी व्यक्ति के खिलाफ अपराध साबित नहीं होता।
सोनिया गांधी और राहुल गांधी के खिलाफ लगाए गए आरोपों की वास्तविक कानूनी स्थिति संबंधित साक्ष्यों, संदर्भ, कथित मंशा और सक्षम प्राधिकारी की जांच के निष्कर्ष पर निर्भर करेगी।
फिलहाल वंदे मातरम् को लेकर उठा यह विवाद कांग्रेस और बीजेपी के बीच राष्ट्रवाद, स्वतंत्रता आंदोलन की विरासत और राष्ट्रगीत की सार्वजनिक भूमिका को लेकर जारी व्यापक राजनीतिक बहस का नया केंद्र बन गया है।
