The Supreme Court has cleared the way for the recruitment of assistant professors in government-aided colleges in Uttar Pradesh, refusing to interfere with the decision of the High Court.
A bench comprising Justice Prashant Kumar Mishra and Justice S. Chandrashekhar dismissed the appeal challenging the High Court’s ruling.
The bench said it was not inclined to interfere with the order passed by the High Court.
The development removes the legal hurdle that had emerged over the recruitment process.
The matter had reached the Supreme Court after 19 participants, including Dheeraj Chandani, challenged the High Court’s decision.
While hearing the matter on May 25, the Supreme Court had directed that the existing situation be maintained, effectively putting the recruitment process on hold for the time being.
The court had also sought responses from the Uttar Pradesh government and the Uttar Pradesh Higher Education Services Commission (UPHESC).
With the latest order dismissing the appeal, the High Court’s decision remains intact, allowing the recruitment process for assistant professor posts in Uttar Pradesh’s aided colleges to move forward, subject to the applicable rules and further administrative action.

नई दिल्ली: उत्तर प्रदेश के सरकारी सहायता प्राप्त कॉलेजों में असिस्टेंट प्रोफेसर की भर्ती का रास्ता अब साफ हो गया है। सुप्रीम कोर्ट ने इस मामले में इलाहाबाद हाईकोर्ट के फैसले में हस्तक्षेप करने से इनकार करते हुए उसे चुनौती देने वाली अपील खारिज कर दी है।
न्यायमूर्ति प्रशांत कुमार मिश्रा और न्यायमूर्ति एस. चंद्रशेखर की पीठ ने सुनवाई के दौरान स्पष्ट किया कि वह हाईकोर्ट के आदेश में दखल देने के पक्ष में नहीं है। इसके साथ ही हाईकोर्ट के फैसले के खिलाफ दाखिल अपील का निपटारा हो गया।
मामला तब सुप्रीम कोर्ट पहुंचा था, जब धीरज चंदानी समेत 19 प्रतिभागियों ने हाईकोर्ट के निर्णय को चुनौती दी थी। अपील पर सुनवाई करते हुए शीर्ष अदालत ने पहले भर्ती प्रक्रिया पर अस्थायी रोक लगाते हुए यथास्थिति बनाए रखने का निर्देश दिया था।
25 मई को हुई सुनवाई में सुप्रीम कोर्ट ने उत्तर प्रदेश सरकार और उत्तर प्रदेश उच्चतर शिक्षा सेवा आयोग (UPHESC) से भी मामले में जवाब मांगा था। उस समय हाईकोर्ट के आदेश पर रोक के कारण सहायक प्रोफेसर भर्ती प्रक्रिया आगे नहीं बढ़ पा रही थी।
अब सुप्रीम कोर्ट द्वारा अपील खारिज किए जाने के बाद हाईकोर्ट का फैसला प्रभावी बना रहेगा। इससे उत्तर प्रदेश के सहायता प्राप्त कॉलेजों में असिस्टेंट प्रोफेसर के पदों पर भर्ती प्रक्रिया आगे बढ़ने का रास्ता खुल गया है।
