‘Supreme Court Doors Always Open’: CJI Surya Kant Assures Justice Amid Student Protest Row
New Delhi: Amid the continuing nationwide student protests and the controversy surrounding the alleged police action during the July 20 demonstrations in Delhi, Chief Justice of India (CJI) Surya Kant on Friday assured citizens that the Supreme Court remains fully committed to protecting constitutional rights and ensuring justice through the due process of law.
He said the country’s youth could have complete faith that every genuine grievance would receive judicial consideration in accordance with established legal procedures.
Speaking to Hindustan Times, the Chief Justice emphasised that the apex court would examine every complaint strictly within the framework of the Constitution and judicial procedure.
He said the judiciary would make every possible effort to deliver justice wherever the facts and the law so warranted.
Reiterating the court’s commitment to safeguarding citizens’ rights, the CJI said he wished to assure every Indian, particularly young people, that if anyone had suffered injustice, the Supreme Court would hear the matter in accordance with the prescribed legal process.
He added that the judiciary has always remained prepared to respond to the concerns, hardships and grievances of the people.
While refraining from commenting on the merits of the Cockroach Janata Party (CJP)-led agitation, Justice Surya Kant rejected the perception that the Supreme Court had earlier declined to entertain the matter.
He clarified that it would be inappropriate to express any opinion because the issue was now pending before the court, but stressed that reports claiming the court had refused to hear the case were factually incorrect.
Highlighting the judiciary’s accessibility, the Chief Justice declared that the doors of the Supreme Court remain open around the clock for every citizen seeking justice.
He asserted that the institution would not permit injustice to prevail and would continue to discharge its constitutional responsibilities without fear or favour.
Clarifying the procedural background, Justice Surya Kant explained that when the controversy initially arose, no properly instituted writ petition had been filed before the Supreme Court.
According to him, only a letter or representation requesting an urgent hearing had been submitted, which could not be treated as a valid petition under the Supreme Court Rules.
The CJI pointed out that the law requires litigants to file petitions in the prescribed format and follow established judicial procedures before the court can formally take up a matter.
Once properly drafted petitions were filed and mentioned before the Bench, he said, the court agreed to list them for hearing in accordance with law.
The Chief Justice’s remarks assume significance in the wake of criticism directed at the Supreme Court after it declined on Wednesday to entertain an oral request made by an advocate seeking suo motu cognisance of the alleged police excesses during the July 20 “Chalo Sansad” march organised by the Cockroach Janata Party.
Earlier on Friday, while presiding over a Bench comprising Justices Joymalya Bagchi and V. Mohana, the Chief Justice also addressed the issue in open court.
He clarified that no writ petition had been filed before the Supreme Court until Friday morning and criticised what he described as irresponsible reporting that suggested the court had refused to register or list the matter.
Later in the day, senior advocate Gopal Sankaranarayanan mentioned two newly filed petitions alleging excessive use of force by the police during the protests.
Informing the Bench that both petitions had now been formally instituted and assigned diary numbers, he requested an urgent hearing in view of the continuing allegations concerning the treatment of student protesters.
Accepting the request, the Chief Justice directed that the petitions be listed before the appropriate Bench on Monday for hearing in accordance with judicial procedure.
The legal proceedings arise out of the July 20 “Chalo Sansad” march, during which thousands of protesters attempted to move towards Parliament demanding the resignation of Union Education Minister Dharmendra Pradhan over alleged examination paper leaks and broader reforms in the country’s public examination system.
The demonstration turned confrontational after protesters allegedly attempted to cross police barricades.
Security personnel responded with tear gas shells and a lathi-charge, while the Delhi Police maintained that the use of force became unavoidable after sections of the crowd allegedly resorted to stone-pelting and violence.
In a parallel development, the Delhi High Court has directed the authorities to preserve CCTV recordings and all other relevant evidence relating to the police action while hearing petitions challenging the crackdown on the protesters.
These judicial developments unfolded alongside renewed political engagement between the Centre and the protest leadership.

देशभर में जारी छात्र आंदोलन और 20 जुलाई को दिल्ली में हुए प्रदर्शन के दौरान कथित पुलिस कार्रवाई को लेकर उठे विवाद के बीच भारत के मुख्य न्यायाधीश (CJI) सूर्यकांत ने शुक्रवार को स्पष्ट संदेश दिया कि सर्वोच्च न्यायालय प्रत्येक नागरिक के अधिकारों की रक्षा के लिए पूरी तरह प्रतिबद्ध है।
उन्होंने कहा कि देश के युवाओं को भरोसा रखना चाहिए कि उनकी हर वैध शिकायत पर कानून और न्यायिक प्रक्रिया के अनुरूप सुनवाई की जाएगी तथा जहां भी आवश्यक होगा, न्याय सुनिश्चित किया जाएगा।
हिन्दुस्तान टाइम्स से बातचीत में मुख्य न्यायाधीश ने कहा कि सर्वोच्च न्यायालय प्रत्येक मामले का परीक्षण संविधान और विधि द्वारा निर्धारित प्रक्रिया के अनुरूप करेगा।
उन्होंने कहा कि यदि किसी व्यक्ति के साथ अन्याय हुआ है, तो न्यायपालिका उपलब्ध तथ्यों और कानून के आधार पर उसे न्याय दिलाने का हरसंभव प्रयास करेगी।
युवाओं को विशेष रूप से संबोधित करते हुए न्यायमूर्ति सूर्यकांत ने कहा कि वे देश के प्रत्येक नागरिक को यह विश्वास दिलाना चाहते हैं कि यदि किसी के साथ अन्याय हुआ है तो सर्वोच्च न्यायालय उसकी शिकायत अवश्य सुनेगा।
उन्होंने कहा कि न्यायपालिका सदैव जनता की समस्याओं, पीड़ा और कठिनाइयों के समाधान के लिए तैयार रहती है तथा संवैधानिक दायित्वों के निर्वहन में कभी पीछे नहीं हटेगी।
कॉकरोच जनता पार्टी (CJP) के नेतृत्व में चल रहे आंदोलन के गुण-दोष पर टिप्पणी करने से परहेज करते हुए मुख्य न्यायाधीश ने यह स्पष्ट किया कि यह कहना पूरी तरह गलत है कि सर्वोच्च न्यायालय ने पहले इस मामले की सुनवाई से इनकार कर दिया था।
उन्होंने कहा कि चूंकि मामला अब न्यायालय के समक्ष लंबित है, इसलिए उसके तथ्यों पर टिप्पणी करना उचित नहीं होगा, लेकिन इस संबंध में फैलाई गई धारणा सही नहीं है।
न्याय तक समान पहुंच की महत्ता पर बल देते हुए उन्होंने कहा कि सर्वोच्च न्यायालय के दरवाजे चौबीसों घंटे प्रत्येक नागरिक के लिए खुले रहते हैं।
उन्होंने दोहराया कि न्यायालय किसी भी परिस्थिति में अन्याय को कायम नहीं रहने देगा और संविधान द्वारा सौंपे गए अपने दायित्वों का निष्पक्षता से निर्वहन करता रहेगा।
प्रक्रियात्मक स्थिति स्पष्ट करते हुए मुख्य न्यायाधीश ने बताया कि विवाद सामने आने के समय सर्वोच्च न्यायालय के समक्ष कोई विधिवत दायर रिट याचिका उपलब्ध नहीं थी।
केवल एक पत्र अथवा प्रतिनिधित्व भेजकर तत्काल सुनवाई का अनुरोध किया गया था, जबकि कानून के अनुसार केवल ऐसे पत्र के आधार पर न्यायिक कार्यवाही प्रारंभ नहीं की जा सकती।
उन्होंने कहा कि सर्वोच्च न्यायालय के नियमों के अनुसार याचिका निर्धारित प्रारूप में दायर की जानी आवश्यक होती है। जब बाद में विधिवत याचिकाएं प्रस्तुत की गईं और उनका उल्लेख न्यायालय के समक्ष किया गया, तब अदालत ने उन्हें सुनवाई के लिए सूचीबद्ध करने का निर्णय लिया।
मुख्य न्यायाधीश की यह टिप्पणी उस आलोचना के संदर्भ में महत्वपूर्ण मानी जा रही है, जिसमें बुधवार को एक अधिवक्ता द्वारा 20 जुलाई के “चलो संसद” मार्च के दौरान कथित पुलिस ज्यादती पर स्वतः संज्ञान लेने का मौखिक अनुरोध अस्वीकार किए जाने के बाद सर्वोच्च न्यायालय पर सवाल उठाए गए थे।
शुक्रवार को ही न्यायमूर्ति जॉयमाल्य बागची और न्यायमूर्ति वी. मोहना के साथ गठित पीठ की अध्यक्षता करते हुए मुख्य न्यायाधीश ने खुली अदालत में भी स्पष्ट किया कि शुक्रवार सुबह तक इस मामले में कोई विधिवत रिट याचिका दायर नहीं की गई थी।
उन्होंने उन समाचारों पर भी नाराजगी जताई, जिनमें यह संकेत दिया गया था कि सर्वोच्च न्यायालय ने मामले को सूचीबद्ध करने से ही इनकार कर दिया था।
दिन में बाद में वरिष्ठ अधिवक्ता गोपाल शंकरनारायणन ने पुलिस द्वारा कथित अत्यधिक बल प्रयोग से संबंधित दो नई याचिकाओं का उल्लेख करते हुए तत्काल सुनवाई का अनुरोध किया।
उन्होंने अदालत को बताया कि दोनों याचिकाएं अब विधिवत दायर हो चुकी हैं और उन्हें डायरी नंबर भी आवंटित कर दिए गए हैं।
इस पर मुख्य न्यायाधीश ने निर्देश दिया कि दोनों याचिकाओं को सोमवार को सुनवाई के लिए सूचीबद्ध किया जाए ताकि कानून के अनुसार उन पर विचार किया जा सके।
पूरा विवाद 20 जुलाई को आयोजित “चलो संसद” मार्च से जुड़ा है, जिसमें हजारों प्रदर्शनकारी कथित परीक्षा प्रश्नपत्र लीक प्रकरण और परीक्षा प्रणाली में व्यापक सुधार की मांग को लेकर केंद्रीय शिक्षा मंत्री धर्मेंद्र प्रधान के इस्तीफे की मांग करते हुए संसद की ओर बढ़ रहे थे।
स्थिति उस समय तनावपूर्ण हो गई जब प्रदर्शनकारियों ने कथित रूप से पुलिस बैरिकेड्स पार करने का प्रयास किया। इसके बाद पुलिस ने आंसू गैस के गोले छोड़े और लाठीचार्ज किया।
वहीं दिल्ली पुलिस का कहना है कि भीड़ के एक हिस्से द्वारा पथराव और हिंसक व्यवहार किए जाने के बाद बल प्रयोग अपरिहार्य हो गया था।
इसी बीच दिल्ली हाईकोर्ट ने भी पुलिस कार्रवाई से जुड़े सभी सीसीटीवी फुटेज और अन्य संबंधित रिकॉर्ड सुरक्षित रखने का निर्देश दिया है। अदालत पुलिस कार्रवाई को चुनौती देने वाली याचिकाओं पर सुनवाई कर रही है।
न्यायिक घटनाक्रम के समानांतर राजनीतिक स्तर पर भी बातचीत जारी रही। शुक्रवार को सामाजिक कार्यकर्ता सोनम वांगचुक द्वारा सरकार के आश्वासन के बाद 26 दिन का अनशन समाप्त किए जाने के पश्चात कॉकरोच जनता पार्टी के प्रतिनिधिमंडल ने केंद्रीय मंत्रियों के साथ वार्ता की।
