Supreme Court Gives Rajpal Yadav One-Day Window to Deposit ₹5 Crore in Cheque-Bounce Case
Actor challenges Delhi High Court order requiring him to surrender; matter involving seven dishonoured cheques will return to Supreme Court on September 15
NEW DELHI: Actor Rajpal Yadav has been given a fresh opportunity to avoid immediate surrender in a cheque-dishonour case, with the Supreme Court directing him to deposit ₹5 crore with its Registry by Wednesday.
The direction came on Tuesday as the top court took up Yadav’s challenge to a Delhi High Court ruling that had confirmed his conviction and three-month prison sentence in seven cases filed under Section 138 of the Negotiable Instruments Act.
A bench comprising Chief Justice Justice Joymalya Bagchi and Justice V. Mohana passed the order after the actor’s plea was mentioned before it.
The Supreme Court issued a conditional notice on the petition and fixed September 15 for the next hearing.
The immediate issue before the court is Yadav’s proposed surrender. The Delhi High Court had ordered him to report for custody by September 10 after rejecting his criminal revision petitions against the conviction and sentence.
The underlying dispute stems from financing provided for Yadav’s directorial venture Ata Pata Laapata.
Murli Projects Pvt Ltd had filed seven separate complaints after seven cheques issued in connection with the financing were dishonoured.
The proceedings also involved Yadav’s wife, Radha Rajpal Yadav, and their film production company.
The financial dispute dates back to 2010, when Yadav obtained ₹5 crore from Murli Projects for making his debut film as a director.
The movie failed commercially, leaving the actor unable to settle the borrowed amount.
As interest continued to accrue on the unpaid sum, the liability eventually rose to nearly ₹9 crore.
The unresolved repayment dispute subsequently developed into a lengthy legal battle between the parties.
Yadav’s legal team had previously told the court that around ₹4.25 crore had already been paid to the complainant.
The latest direction to deposit another ₹5 crore with the Supreme Court Registry now becomes central to his request for relief from surrender.
The case has been in litigation for several years. A magistrate’s court convicted Yadav and his wife in 2018 and sentenced the actor to six months in prison.
The conviction was subsequently upheld by a sessions court in 2019, prompting Yadav to move the Delhi High Court.
In June 2024, the High Court granted a temporary suspension of his sentence while asking him to make sincere and genuine efforts towards clearing the outstanding amount, which was then close to ₹9 crore.
The repayment issue continued to complicate the proceedings. In February, after the dues remained unpaid, Yadav surrendered and was taken to Tihar Jail.
He subsequently secured interim bail on February 16 after ₹1.5 crore was deposited, and the complainant’s lawyer confirmed the payment.
His interim protection was later continued by the High Court. The court said he would not be taken back into custody even after an earlier interim order granting relief had been set aside.
Yadav subsequently sought another 30 days to arrange the money needed to meet the financial obligation.
The Delhi High Court, however, declined the extension and reserved its judgment.
The actor has also received public support from sections of the Hindi film industry during the prolonged legal and financial dispute.
Among the Bollywood personalities who backed him were Sonu Sood, Ajay Devgn, Salman Khan and Gurmeet Choudhary.
The Supreme Court’s latest order does not conclude the case.
The proceedings will come up again on September 15, when the court is expected to consider the actor’s challenge to the High Court ruling and the conditions attached to his request for relief.

चेक बाउंस मामले में अभिनेता की याचिका पर सुप्रीम कोर्ट ने सशर्त नोटिस जारी किया; 15 सितंबर को होगी अगली सुनवाई
नई दिल्ली: चेक बाउंस मामले में जेल की सजा का सामना कर रहे अभिनेता राजपाल यादव को सुप्रीम कोर्ट ने बुधवार तक ₹5 करोड़ जमा करने का निर्देश दिया है।
यह राशि सुप्रीम कोर्ट की रजिस्ट्री में जमा करनी होगी और इसी शर्त के आधार पर उनके तत्काल आत्मसमर्पण से जुड़ी राहत पर विचार किया जा रहा है।
राजपाल यादव ने दिल्ली हाई कोर्ट के उस फैसले को सुप्रीम कोर्ट में चुनौती दी है, जिसमें उनकी दोषसिद्धि बरकरार रखते हुए तीन महीने की सजा को कायम रखा गया था। मामला नेगोशिएबल इंस्ट्रूमेंट्स एक्ट की धारा 138 के तहत दर्ज सात मामलों से जुड़ा है।
मंगलवार को याचिका का मौखिक रूप से उल्लेख किए जाने के बाद मुख्य न्यायाधीश जस्टिस जॉयमाल्या बागची और जस्टिस वी. मोहना की पीठ ने मामले पर सशर्त नोटिस जारी किया।
सुप्रीम कोर्ट अब इस मामले की सुनवाई 15 सितंबर को करेगा।
राजपाल यादव के लिए तत्काल चुनौती आत्मसमर्पण की है।
दिल्ली हाई कोर्ट ने उनकी आपराधिक पुनरीक्षण याचिकाएं खारिज करने के बाद उन्हें सजा भुगतने के लिए आत्मसमर्पण करने का निर्देश दिया था। इसके लिए 10 सितंबर की समयसीमा तय की गई थी।
पूरा विवाद उनकी फिल्म अता पता लापता के निर्माण के लिए जुटाई गई वित्तीय मदद से जुड़ा है। फिल्म निर्माता और फाइनेंसर Murli Projects Pvt Ltd ने सात चेकों के अनादर के बाद अभिनेता के खिलाफ सात शिकायतें दर्ज कराई थीं।
इन मामलों में उनकी पत्नी राधा राजपाल यादव और उनकी फिल्म निर्माण कंपनी भी पक्षकार थीं।
विवाद की शुरुआत 2010 में हुई, जब राजपाल यादव ने अपने निर्देशन में बनने वाली पहली फिल्म के लिए Murli Projects से ₹5 करोड़ लिए थे।
फिल्म बॉक्स ऑफिस पर सफल नहीं हो सकी और इसके बाद उधार की रकम चुकाने का मामला उलझता चला गया।
समय के साथ ब्याज जुड़ने के कारण बकाया राशि बढ़कर करीब ₹9 करोड़ तक पहुंच गई। भुगतान को लेकर दोनों पक्षों के बीच लंबे समय तक कानूनी विवाद चलता रहा।
पिछली सुनवाई के दौरान राजपाल यादव की ओर से अदालत को बताया गया था कि शिकायतकर्ता पक्ष को लगभग ₹4.25 करोड़ का भुगतान किया जा चुका है।
अब सुप्रीम कोर्ट की रजिस्ट्री में ₹5 करोड़ जमा करने का निर्देश अभिनेता की याचिका में अहम शर्त बन गया है।
कानूनी प्रक्रिया में राजपाल यादव को कई स्तरों पर राहत और प्रतिकूल आदेश दोनों का सामना करना पड़ा है। 2018 में मजिस्ट्रेट अदालत ने अभिनेता और उनकी पत्नी राधा को दोषी ठहराया था और राजपाल यादव को छह महीने की जेल की सजा सुनाई थी।
2019 में सेशंस कोर्ट ने भी दोषसिद्धि बरकरार रखी, जिसके बाद अभिनेता ने दिल्ली हाई कोर्ट का रुख किया।
जून 2024 में दिल्ली हाई कोर्ट ने उनकी सजा पर अस्थायी रोक लगाते हुए उन्हें बकाया रकम चुकाने के लिए “ईमानदार और वास्तविक प्रयास” करने को कहा था। उस समय कुल देनदारी करीब ₹9 करोड़ बताई गई थी।
भुगतान का विवाद समाप्त नहीं होने के बाद इस वर्ष फरवरी में राजपाल यादव ने आत्मसमर्पण किया और उन्हें तिहाड़ जेल भेज दिया गया।
बाद में 16 फरवरी को ₹1.5 करोड़ जमा किए जाने और शिकायतकर्ता के वकील द्वारा इसकी पुष्टि के बाद उन्हें अंतरिम जमानत मिल गई।
इसके बाद हाई कोर्ट ने उनकी अंतरिम राहत को आगे भी जारी रखा। अदालत ने स्पष्ट किया था कि पहले का अंतरिम आदेश समाप्त हो जाने के बाद भी अभिनेता को दोबारा हिरासत में नहीं लिया जाएगा।
राजपाल यादव ने बकाया रकम जुटाने के लिए 30 दिन का अतिरिक्त समय भी मांगा था। हालांकि, दिल्ली हाई कोर्ट ने यह अनुरोध स्वीकार नहीं किया और अपना फैसला सुरक्षित रख लिया।
इस कानूनी मुश्किल के दौरान फिल्म जगत के कुछ सितारों ने भी राजपाल यादव के प्रति समर्थन जताया। सोनू सूद, अजय देवगन, सलमान खान और गुरमीत चौधरी समेत कई बॉलीवुड हस्तियों ने उनके समर्थन में आवाज उठाई थी।
सुप्रीम कोर्ट का मंगलवार का आदेश मामले का अंतिम फैसला नहीं है। अब 15 सितंबर को होने वाली सुनवाई में अभिनेता की दिल्ली हाई कोर्ट के फैसले के खिलाफ चुनौती और आत्मसमर्पण से जुड़ी परिस्थितियों पर आगे विचार किया जाएगा।
