The Supreme Court has asked the Allahabad High Court to defer proceedings in a disproportionate-assets case involving Rahul Gandhi and directed the CBI and ED not to file reports in the matter for now.
New Delhi: Congress leader and Leader of Opposition in the Lok Sabha Rahul Gandhi received relief from the Supreme Court on Monday as the apex court directed the Allahabad High Court to defer further proceedings in a case involving allegations that he possessed assets disproportionate to his known sources of income.
The Supreme Court also directed the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED), as well as any other authority acting under the High Court’s earlier directions, not to submit reports in the matter for the time being.
The order came while the court considered Gandhi’s challenge to the Allahabad High Court proceedings.
A three-judge bench headed by Chief Justice of India Surya Kant and comprising Justices Joymalya Bagchi and V. Mohana issued notices to Karnataka-based petitioner S. Vignesh Shishir, besides the CBI and ED.
The High Court has been asked to defer its next hearing until the Supreme Court takes up the matter again.
During the hearing, the bench questioned Additional Solicitor General S.V. Raju, who appeared for the CBI, over the agency’s apparent lack of independent action despite the seriousness of the allegations being presented before the courts.
The bench questioned why the agency had remained inactive if the allegations were indeed serious and whether it required a specific judicial direction to initiate action.
The Supreme Court’s intervention follows a series of orders by the Allahabad High Court’s Lucknow Bench concerning a petition filed by Shishir, a BJP worker from Karnataka.
He had sought an investigation by central agencies into allegations of disproportionate assets against Gandhi. Shishir had also previously raised allegations concerning Gandhi’s citizenship.
On July 20, the Allahabad High Court expressed dissatisfaction with the CBI’s response in the matter and directed a senior officer of the agency to personally submit a fresh affidavit explaining the progress of the inquiry.
The court had said the earlier affidavit did not adequately comply with its directions or provide sufficient details about the action taken on the petitioner’s complaint.
The High Court had directed the joint director or the head of the relevant zone at the CBI’s Anti-Corruption headquarters in New Delhi to provide details of the inquiry in a fresh affidavit.
The court had also observed that if the ED came across material during its examination indicating any illegality, it could take further action in accordance with law.
The proceedings before the High Court have been conducted in chambers rather than in open court, with the court treating the matter as sensitive.
The entire record was also ordered to remain sealed and in the custody of the senior registrar.
The High Court had fixed August 20 for the next hearing and granted the Union government four weeks to submit detailed counter-affidavits through the concerned departments, including the Department of Personnel and Training, the Department of Revenue, the Ministry of Corporate Affairs and the Serious Fraud Investigation Office.
Gandhi subsequently approached the Supreme Court, challenging the High Court’s orders and seeking relief from the ongoing proceedings.
His challenge has now resulted in the apex court putting the High Court proceedings on hold for the time being.
The Supreme Court has not, at this stage, ruled on the truth or merits of the allegations concerning Gandhi’s assets.
The immediate effect of Monday’s order is to pause the proceedings before the Allahabad High Court and prevent investigative agencies from submitting reports there pursuant to the earlier directions until the Supreme Court considers the matter further.
The case will therefore now return to the Supreme Court, where the next proceedings will determine whether and how the matter before the Allahabad High Court is to continue.

सुप्रीम कोर्ट ने राहुल गांधी से जुड़े आय से अधिक संपत्ति के आरोपों वाले मामले में इलाहाबाद हाईकोर्ट की कार्यवाही फिलहाल टालने का निर्देश दिया है। CBI और ED को भी रिपोर्ट दाखिल करने से रोका गया है।

नई दिल्ली: कांग्रेस नेता और लोकसभा में विपक्ष के नेता राहुल गांधी को सोमवार को सुप्रीम कोर्ट से बड़ी राहत मिली।
शीर्ष अदालत ने आय से अधिक संपत्ति के आरोपों से जुड़े मामले में इलाहाबाद हाईकोर्ट को फिलहाल आगे की कार्यवाही नहीं करने का निर्देश दिया है।
सुप्रीम कोर्ट ने केंद्रीय जांच ब्यूरो (CBI) और प्रवर्तन निदेशालय (ED) को भी निर्देश दिया कि वे हाईकोर्ट के पूर्व आदेशों के आधार पर इस मामले में फिलहाल कोई रिपोर्ट दाखिल न करें।
यह आदेश राहुल गांधी की उस याचिका पर आया है, जिसमें उन्होंने इलाहाबाद हाईकोर्ट के आदेशों को चुनौती दी थी।
मुख्य न्यायाधीश न्यायमूर्ति सूर्यकांत की अध्यक्षता वाली तीन सदस्यीय पीठ में न्यायमूर्ति जॉयमाल्या बागची और न्यायमूर्ति वी. मोहना भी शामिल थे।
पीठ ने कर्नाटक निवासी और याचिकाकर्ता एस. विग्नेश शिशिर के साथ-साथ CBI और ED को नोटिस जारी किया है।
सुप्रीम कोर्ट ने कहा कि हाईकोर्ट में अगली सुनवाई फिलहाल टाली जाए और मामले को शीर्ष अदालत में अगली सुनवाई के लिए आने दिया जाए।
सुनवाई के दौरान पीठ ने CBI की ओर से पेश अतिरिक्त सॉलिसिटर जनरल एस.वी. राजू से जांच एजेंसी की निष्क्रियता को लेकर सवाल किया।
अदालत ने पूछा कि यदि आरोप इतने गंभीर हैं तो एजेंसी अब तक शांत क्यों रही और क्या उसे कार्रवाई शुरू करने के लिए अदालत के निर्देश की आवश्यकता थी।
मामला मूल रूप से कर्नाटक के रहने वाले BJP कार्यकर्ता एस. विग्नेश शिशिर की याचिका से जुड़ा है।
उन्होंने राहुल गांधी के खिलाफ आय से अधिक संपत्ति के आरोपों की CBI और ED से जांच कराने की मांग की थी।
शिशिर इससे पहले राहुल गांधी की कथित दोहरी नागरिकता को लेकर भी याचिकाएं दाखिल कर चुके हैं।
इलाहाबाद हाईकोर्ट की लखनऊ पीठ ने 20 जुलाई को इस मामले में CBI की प्रगति रिपोर्ट पर असंतोष जताया था।
अदालत ने एजेंसी के एक वरिष्ठ अधिकारी को व्यक्तिगत रूप से नया हलफनामा दाखिल कर जांच में हुई प्रगति का विस्तृत ब्यौरा देने का निर्देश दिया था।
हाईकोर्ट ने पाया था कि CBI की ओर से दाखिल पिछला हलफनामा उसके पहले के निर्देशों के अनुरूप पर्याप्त जानकारी नहीं देता था।
इसके बाद अदालत ने नई दिल्ली स्थित CBI के भ्रष्टाचार निरोधक मुख्यालय के संबंधित जोन के संयुक्त निदेशक या प्रमुख स्तर के अधिकारी को नया हलफनामा दाखिल करने को कहा था।
हाईकोर्ट ने यह भी कहा था कि यदि मामले की जांच के दौरान ED को किसी तरह की गैरकानूनी गतिविधि से संबंधित सामग्री या दस्तावेज मिलते हैं, तो वह कानून के अनुसार आगे की कार्रवाई करने के लिए स्वतंत्र होगी।
मामले की संवेदनशीलता को देखते हुए हाईकोर्ट इस प्रकरण की सुनवाई खुले न्यायालय में करने के बजाय चैंबर में कर रहा था।
अदालत ने पूरे केस रिकॉर्ड को सीलबंद रखने और वरिष्ठ रजिस्ट्रार की सुरक्षित अभिरक्षा में रखने का निर्देश भी दिया था।
हाईकोर्ट ने मामले की अगली सुनवाई के लिए 20 अगस्त की तारीख तय की थी। साथ ही केंद्र सरकार को संबंधित विभागों की ओर से विस्तृत जवाबी हलफनामे दाखिल करने के लिए चार सप्ताह का समय दिया गया था।
इनमें कार्मिक एवं प्रशिक्षण विभाग (DoPT), वित्त मंत्रालय का राजस्व विभाग, कॉरपोरेट मामलों का मंत्रालय और गंभीर धोखाधड़ी जांच कार्यालय (SFIO) शामिल थे।
इसके बाद राहुल गांधी ने सुप्रीम कोर्ट का रुख करते हुए हाईकोर्ट के आदेशों को चुनौती दी। उन्होंने चल रही कार्यवाही पर रोक लगाने की मांग की थी।
अब शीर्ष अदालत के सोमवार के आदेश के बाद हाईकोर्ट की कार्यवाही फिलहाल आगे नहीं बढ़ेगी।
हालांकि, सुप्रीम कोर्ट ने अभी राहुल गांधी के खिलाफ लगाए गए आय से अधिक संपत्ति के आरोपों की सत्यता या उनके गुण-दोष पर कोई अंतिम फैसला नहीं दिया है।
सोमवार के आदेश का तत्काल प्रभाव केवल इतना है कि इलाहाबाद हाईकोर्ट की कार्यवाही फिलहाल टल गई है और CBI तथा ED को वहां रिपोर्ट दाखिल करने से रोक दिया गया है।
अब मामले की अगली दिशा सुप्रीम कोर्ट में होने वाली सुनवाई से तय होगी। शीर्ष अदालत यह तय करेगी कि इलाहाबाद हाईकोर्ट में लंबित कार्यवाही आगे किस तरीके से जारी रहेगी।
