Supreme Court Rejects Plea Against Shah Rukh Khan’s ‘Mannat’ Expansion, Questions Petitioner’s Intent
Mumbai/New Delhi: The Supreme Court on Tuesday declined to entertain a petition challenging the environmental clearance granted for the proposed expansion of Bollywood superstar Shah Rukh Khan’s iconic sea-facing bungalow, Mannat, in Mumbai’s Bandra locality.
While refusing to interfere, the court expressed reservations over the credibility and motives of the petitioner, observing that it was not inclined to proceed once doubts had arisen regarding the bona fides of the case.
A Bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, dismissed the appeal filed by activist Santosh Dhaundkar.
The petition questioned the National Green Tribunal’s (NGT) September 2025 order, which had rejected his challenge to the Coastal Regulation Zone (CRZ) approval issued in January 2025 for the construction of the seventh and eighth floors of Mannat.
Shah Rukh Khan’s wife, Gauri Khan, had also been named as a respondent in the proceedings.
Appearing for the petitioner, senior advocate Shoeb Alam contended that environmental norms had allegedly been ignored while granting permission for the project.
He argued that celebrity status should not result in preferential treatment and maintained that any construction project valued above ₹5 crore within the concerned coastal zone required prior environmental clearance from the Union Ministry of Environment, Forest and Climate Change. According to him, such mandatory approval had not been secured.
The petitioner further claimed that the land on which Mannat stands had originally been reserved for an art gallery under the statutory development plan.
He argued that the reservation was removed in June 2004 without obtaining the mandatory consent of the Maharashtra Coastal Zone Management Authority, making the subsequent approvals legally questionable.
During the hearing, it was pointed out that the residence originally consisted of six storeys along with two basement levels.
Following the CRZ approval, permission had been granted to expand the structure up to the eighth floor, taking its overall height to more than 37 metres.
The petitioner also alleged that two heritage structures were demolished during the course of redevelopment without obtaining the necessary statutory permissions.
The Bench, however, questioned the timing of the heritage-related allegations, remarking that the issue was being raised only at a much later stage.
Sensing the court’s reluctance to intervene, the petitioner requested that the matter be remanded to the National Green Tribunal for fresh consideration. The judges declined the request and brought the proceedings to a close.
Earlier, the National Green Tribunal had rejected the challenge after observing that the principal structure of Mannat had existed long before Coastal Regulation Zone regulations became applicable in 1991.
It also noted that the current proposal merely involved the addition of two new floors to an already existing building.
The tribunal recorded that the Municipal Corporation of Greater Mumbai had approved the revised building plans in November 2024 before construction commenced.
Shah Rukh Khan and his family have been living at the landmark residence for over two decades.
The approved redevelopment plan includes two additional floors designed as a duplex, connected through an internal staircase.
The heritage bungalow, spread across nearly 27,000 square feet of built-up area, remains one of Mumbai’s most recognisable private residences.
‘मन्नत’ में दो मंजिलों के विस्तार को मिली राहत, सुप्रीम कोर्ट ने याचिका खारिज कर याचिकाकर्ता की मंशा पर जताया संदेह

सुप्रीम कोर्ट ने मंगलवार को अभिनेता शाहरुख खान के मुंबई स्थित समुद्र किनारे बने प्रतिष्ठित आवास ‘मन्नत’ में दो अतिरिक्त मंजिलों के निर्माण को चुनौती देने वाली याचिका खारिज कर दी। शीर्ष अदालत ने मामले में हस्तक्षेप से इनकार करते हुए कहा कि याचिकाकर्ता की नीयत को लेकर गंभीर संदेह पैदा हो गया है और ऐसी स्थिति में वह याचिका पर विचार नहीं करेगी।
मुख्य न्यायाधीश सूर्यकांत की अध्यक्षता वाली पीठ, जिसमें न्यायमूर्ति जॉयमाल्या बागची और न्यायमूर्ति वी. मोहना भी शामिल थे, ने सामाजिक कार्यकर्ता संतोष धौंडकर की अपील को अस्वीकार कर दिया।
यह अपील राष्ट्रीय हरित अधिकरण (एनजीटी) के सितंबर 2025 के उस आदेश के खिलाफ दायर की गई थी, जिसमें जनवरी 2025 में मन्नत की सातवीं और आठवीं मंजिल के निर्माण के लिए दी गई तटीय विनियमन क्षेत्र (सीआरजेड) की अनुमति को चुनौती देने वाली याचिका खारिज कर दी गई थी। इस मामले में गौरी खान को भी पक्षकार बनाया गया था।
याचिकाकर्ता की ओर से वरिष्ठ अधिवक्ता शोएब आलम ने दलील दी कि पर्यावरणीय नियमों का पालन किए बिना निर्माण की अनुमति दी गई। उनका कहना था कि किसी भी व्यक्ति को केवल प्रसिद्ध अभिनेता होने के कारण विशेष छूट नहीं मिलनी चाहिए।
उन्होंने अदालत को बताया कि संबंधित क्षेत्र में ₹5 करोड़ से अधिक लागत वाली किसी भी निर्माण परियोजना के लिए केंद्रीय पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय से पूर्व पर्यावरणीय स्वीकृति आवश्यक होती है, जबकि इस मामले में ऐसी अनुमति प्राप्त नहीं की गई।
याचिका में यह भी दावा किया गया कि जिस भूखंड पर मन्नत स्थित है, उसे मूल विकास योजना में कला दीर्घा (आर्ट गैलरी) के लिए आरक्षित किया गया था।
आरोप लगाया गया कि जून 2004 में इस आरक्षण को महाराष्ट्र तटीय क्षेत्र प्रबंधन प्राधिकरण की अनिवार्य अनुमति लिए बिना समाप्त कर दिया गया, जिससे बाद की सभी स्वीकृतियों की वैधता पर प्रश्नचिह्न लग जाता है।
सुनवाई के दौरान अदालत को बताया गया कि भवन में पहले से दो बेसमेंट और छह मंजिलें थीं। बाद में मिली सीआरजेड मंजूरी के तहत इसे आठ मंजिल तक विस्तारित करने की अनुमति दी गई, जिससे इसकी कुल ऊंचाई 37 मीटर से अधिक हो गई।
याचिकाकर्ता ने यह आरोप भी लगाया कि निर्माण कार्य के दौरान दो विरासत संरचनाओं को आवश्यक अनुमति लिए बिना ध्वस्त कर दिया गया।
हालांकि, पीठ ने इस आरोप पर सवाल उठाते हुए टिप्पणी की कि विरासत भवन का मुद्दा अब काफी देर से उठाया जा रहा है।
जब अदालत ने हस्तक्षेप करने में अनिच्छा दिखाई तो याचिकाकर्ता ने मामले को नए सिरे से सुनवाई के लिए एनजीटी को वापस भेजने का अनुरोध किया, लेकिन अदालत ने इसे भी अस्वीकार कर दिया।
इससे पहले राष्ट्रीय हरित अधिकरण ने अपने आदेश में कहा था कि मन्नत का मूल भवन वर्ष 1991 में सीआरजेड नियम लागू होने से पहले से अस्तित्व में था।
अधिकरण ने यह भी स्पष्ट किया कि वर्तमान परियोजना केवल पहले से मौजूद भवन में दो अतिरिक्त मंजिलें जोड़ने तक सीमित है। साथ ही यह भी दर्ज किया गया कि नवंबर 2024 में बृहन्मुंबई महानगरपालिका ने संशोधित भवन योजना को विधिवत मंजूरी प्रदान कर दी थी।
शाहरुख खान और उनका परिवार पिछले दो दशकों से अधिक समय से मन्नत में रह रहा है। स्वीकृत योजना के अनुसार भवन में दो नई मंजिलें बनाई जाएंगी, जिन्हें डुप्लेक्स के रूप में विकसित किया जाएगा और दोनों को आंतरिक सीढ़ी से जोड़ा जाएगा।
लगभग 27,000 वर्ग फुट निर्मित क्षेत्र में फैला यह ऐतिहासिक बंगला मुंबई के सबसे प्रसिद्ध निजी आवासों में गिना जाता है।
