Supreme Court Seeks SIT Status Report in Ayodhya Ram Temple Donation Case, Signals Further Directions
Fresh developments emerged in the alleged misappropriation of donations received at the Ram Temple in Ayodhya after the Supreme Court directed the Special Investigation Team (SIT) constituted by the Uttar Pradesh government to submit a detailed status report on the ongoing probe.
The court also indicated that it may issue additional directions once it reviews the progress of the investigation.
A Bench led by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, was hearing a batch of petitions seeking an independent inquiry into the alleged financial irregularities linked to the affairs of the Shri Ram Janmabhoomi Teerth Kshetra Trust.
During the proceedings, the Bench asked the Uttar Pradesh government to disclose the names of all officers serving on the SIT.
Observing that greater clarity was required before proceeding further, the Bench remarked that it wanted to know the composition of the investigation team.
The judges directed the state government to file a comprehensive status report, adding that further judicial directions could be considered after examining the findings placed before the court.
Meanwhile, notices were also issued to the Shri Ram Janmabhoomi Teerth Kshetra Trust, with the court making it clear that the Trust’s response would be necessary before taking the matter forward.
Appearing for the Uttar Pradesh government, Solicitor General Tushar Mehta, assisted by Senior Additional Advocate General Sharan Dev Singh Thakur, informed the Bench that the investigation was progressing.
The proceedings come at a time when the Uttar Pradesh Police investigation into the alleged donation embezzlement is continuing.
According to the case records, eight individuals are currently in judicial custody after an FIR was registered on the basis of findings made during the SIT inquiry.
One of the petitions has been filed by Narendra Kumar Goswami, who appeared before the court in person.
He has sought a Central Bureau of Investigation (CBI) probe into the alleged financial scam and has also requested that the Comptroller and Auditor General (CAG) conduct an audit of the Trust’s accounts.
Another petition has been moved by advocates Ajay Kumar Rai and Dinesh Kumar Yadav, who are also representing themselves.
Their plea seeks registration of an FIR along with a fair, independent, and time-bound investigation by the CBI into the alleged diversion and misuse of donations collected at the temple.
A separate petition filed by RJD Member of Parliament Sudhakar Singh has urged the apex court to order a court-monitored CBI investigation along with a comprehensive forensic audit of the Trust’s finances.
The petition seeks an independent examination of every financial transaction, donation, and asset associated with the Trust.
Besides requesting a forensic audit of cash donations, digital transactions and movable and immovable assets, the plea also asks the court to ensure preservation of all financial records, including physical files, electronic ledgers, UPI transaction logs and bank statements, so that no evidence is allegedly altered or destroyed during the course of the investigation.
The petition further proposes the creation of a court-supervised oversight mechanism.
It has requested that, until the investigation is completed, the Trust should not undertake major financial or administrative decisions, including awarding large contracts, making significant investments, spending Trust funds, creating third-party interests or transferring assets without prior approval from the proposed supervisory body.
In the interest of transparency, the plea also seeks directions requiring the Trust to submit before the Supreme Court a complete record of every donation received since its establishment.
This includes cash contributions, online transfers, digital payments, foreign donations and valuables such as gold, silver and other precious items, together with details regarding their accounting, custody and utilisation.
The petition has additionally requested that audited financial statements, donation records, and expenditure details be placed in the public domain through the Trust’s official website.
At the same time, it has urged that confidential information relating to individual donors should remain adequately protected.
अयोध्या राम मंदिर चंदा मामले में सुप्रीम कोर्ट सख्त, एसआईटी से मांगी जांच रिपोर्ट, आगे और निर्देशों के संकेत
अयोध्या स्थित राम मंदिर में श्रद्धालुओं से प्राप्त चंदे में कथित गड़बड़ी के मामले ने सोमवार को सुप्रीम कोर्ट में महत्वपूर्ण मोड़ ले लिया। शीर्ष अदालत ने उत्तर प्रदेश सरकार द्वारा गठित विशेष जांच दल (एसआईटी) को जांच की वर्तमान स्थिति पर विस्तृत रिपोर्ट दाखिल करने का निर्देश दिया।
साथ ही अदालत ने संकेत दिए कि रिपोर्ट का अध्ययन करने के बाद आवश्यक हुआ तो वह इस मामले में अतिरिक्त निर्देश भी जारी कर सकती है।
मुख्य न्यायाधीश न्यायमूर्ति सूर्यकांत की अध्यक्षता वाली पीठ, जिसमें न्यायमूर्ति जॉयमाल्य बागची और न्यायमूर्ति वी. मोहना भी शामिल थे, श्रीराम जन्मभूमि तीर्थ क्षेत्र ट्रस्ट के वित्तीय मामलों में कथित अनियमितताओं की स्वतंत्र जांच की मांग वाली विभिन्न याचिकाओं पर सुनवाई कर रही थी।
सुनवाई के दौरान पीठ ने राज्य सरकार से एसआईटी में शामिल सभी अधिकारियों के नाम भी उपलब्ध कराने को कहा।
अदालत ने स्पष्ट किया कि जांच दल की संरचना और अब तक हुई प्रगति की जानकारी उसके समक्ष आना आवश्यक है।
पीठ ने राज्य सरकार को विस्तृत स्टेटस रिपोर्ट दाखिल करने का निर्देश देते हुए कहा कि रिपोर्ट का परीक्षण करने के बाद जरूरत पड़ने पर आगे के न्यायिक निर्देश जारी किए जा सकते हैं।
सुनवाई के दौरान सुप्रीम कोर्ट ने श्रीराम जन्मभूमि तीर्थ क्षेत्र ट्रस्ट को भी नोटिस जारी किया और कहा कि मामले पर आगे विचार करने से पहले ट्रस्ट का पक्ष जानना आवश्यक होगा।
उत्तर प्रदेश सरकार की ओर से उपस्थित सॉलिसिटर जनरल तुषार मेहता तथा वरिष्ठ अपर महाधिवक्ता शरण देव सिंह ठाकुर ने अदालत को बताया कि जांच प्रक्रिया लगातार जारी है।
यह सुनवाई ऐसे समय हुई है जब उत्तर प्रदेश पुलिस कथित चंदा गबन मामले की जांच कर रही है। एसआईटी की प्रारंभिक जांच के आधार पर दर्ज एफआईआर के बाद अब तक आठ लोगों को हिरासत में लिया जा चुका है और मामले की जांच आगे बढ़ रही है।
याचिकाकर्ता नरेंद्र कुमार गोस्वामी ने स्वयं अदालत में उपस्थित होकर इस कथित घोटाले की जांच केंद्रीय अन्वेषण ब्यूरो (सीबीआई) से कराने की मांग की है। साथ ही उन्होंने नियंत्रक एवं महालेखा परीक्षक (कैग) से ट्रस्ट के वित्तीय रिकॉर्ड का विशेष ऑडिट कराने का भी अनुरोध किया है।
इसी प्रकार अधिवक्ता अजय कुमार राय और दिनेश कुमार यादव द्वारा दायर अलग याचिका में भी एफआईआर दर्ज कराने तथा मंदिर में प्राप्त चंदे के कथित दुरुपयोग की निष्पक्ष, स्वतंत्र और समयबद्ध सीबीआई जांच कराने की मांग की गई है।
राष्ट्रीय जनता दल के सांसद सुधाकर सिंह की ओर से दाखिल तीसरी याचिका में अदालत की निगरानी में सीबीआई जांच कराने के साथ-साथ ट्रस्ट की पूरी वित्तीय व्यवस्था का व्यापक फॉरेंसिक ऑडिट कराने की मांग की गई है।
याचिका में सभी दान, लेन-देन और ट्रस्ट की परिसंपत्तियों की स्वतंत्र एजेंसी से वैज्ञानिक जांच कराने का अनुरोध किया गया है।
याचिका में यह भी कहा गया है कि जांच पूरी होने तक सभी वित्तीय दस्तावेज, कागजी अभिलेख, डिजिटल लेखा-बही, यूपीआई लेन-देन का विवरण और बैंक खातों से जुड़े रिकॉर्ड सुरक्षित रखे जाएं ताकि किसी भी संभावित साक्ष्य के साथ छेड़छाड़ की आशंका समाप्त हो सके।
इसके अलावा अदालत की निगरानी में एक स्वतंत्र पर्यवेक्षण तंत्र गठित करने की भी मांग की गई है। याचिका में अनुरोध किया गया है कि जांच पूरी होने तक ट्रस्ट को बड़े वित्तीय या प्रशासनिक फैसले लेने, भारी-भरकम ठेके देने, बड़े निवेश करने, ट्रस्ट की निधि खर्च करने, किसी तीसरे पक्ष के अधिकार सृजित करने अथवा संपत्तियों के हस्तांतरण जैसे कदम उठाने से रोका जाए, जब तक प्रस्तावित निगरानी समिति की पूर्व स्वीकृति प्राप्त न हो।
पारदर्शिता सुनिश्चित करने के उद्देश्य से याचिका में यह भी आग्रह किया गया है कि ट्रस्ट अपने गठन से अब तक प्राप्त सभी प्रकार के दान—नकद राशि, बैंक हस्तांतरण, डिजिटल भुगतान, विदेशी अंशदान तथा सोना, चांदी और अन्य बहुमूल्य वस्तुओं सहित—का पूरा लेखा-जोखा सुप्रीम कोर्ट के समक्ष प्रस्तुत करे।
साथ ही इन धनराशियों के लेखांकन, सुरक्षित रख-रखाव और उपयोग का विस्तृत विवरण भी उपलब्ध कराया जाए।
याचिका में यह भी मांग की गई है कि ट्रस्ट अपने ऑडिट किए गए वित्तीय विवरण, दान संबंधी अभिलेख और धनराशि के उपयोग का ब्यौरा अपनी आधिकारिक वेबसाइट पर सार्वजनिक करे। हालांकि, यह भी कहा गया है कि दानदाताओं की निजी और गोपनीय जानकारी की सुरक्षा हर स्थिति में सुनिश्चित की जानी चाहिए।
