Supreme Court to Hear Pleas on Alleged Police Excesses During NEET Protest Crackdown on Monday
New Delhi: The Supreme Court is scheduled to hear on Monday two petitions alleging excessive use of force by police against students participating in demonstrations over the alleged NEET question paper leak.
The pleas relate to incidents reported at Delhi’s Jantar Mantar as well as protests held in several parts of the country since the agitation began earlier this week.
A three-judge Bench headed by Chief Justice of India Surya Kant, and comprising Justices Joymalya Bagchi and V. Mohana, agreed to take up the matter after senior advocates Gopal Sankaranarayanan and Shyam Divan sought an urgent hearing.
Responding to their request, the Chief Justice said the petitions would be listed and considered by the court.
Highlighting the urgency of the matter, Senior Advocate Sankaranarayanan informed the Bench that two separate petitions had been filed concerning allegations of police action against student protesters across different states.
He submitted that the issue required immediate judicial attention as similar incidents were continuing to occur every day.
Expressing concern over the manner in which the protests were being handled, the senior counsel alleged that law enforcement personnel had resorted to disproportionate force against students.
He argued that judicial intervention had become necessary to ensure that constitutional safeguards were not undermined during the ongoing demonstrations.
Sankaranarayanan further informed the court that he had initially waited for the Supreme Court Registry to assign diary numbers before seeking an urgent listing.
He said the petitions had now been formally registered and all necessary procedural requirements had been completed, with the concerned state governments being made parties to the proceedings.
The petitions come against the backdrop of continuing allegations by protesters that police personnel used batons and tear gas while dispersing demonstrations.
Law enforcement agencies, however, have maintained that action was taken only after protesters allegedly attempted to breach security barricades and attacked police personnel.
Several First Information Reports (FIRs) have since been registered, and security arrangements have been further strengthened.
Earlier in the day, Chief Justice Surya Kant also addressed media reports claiming that he had declined to list a petition seeking the Supreme Court’s intervention into the alleged police action against students in Delhi.
The Chief Justice categorically rejected the reports, stating that no formal petition had been filed before the court at that stage.
Clarifying the sequence of events, the Chief Justice observed that the court had received only a representation from a lawyer and not a properly instituted petition.
He also expressed concern over what he described as inaccurate media reporting, saying reports suggesting that the Supreme Court had refused to hear the matter were factually incorrect and created a misleading public impression.

नई दिल्ली: कथित नीट प्रश्नपत्र लीक के विरोध में देशभर में जारी छात्र आंदोलन के दौरान पुलिस द्वारा बल प्रयोग के आरोपों से जुड़ी दो याचिकाओं पर सुप्रीम कोर्ट सोमवार को सुनवाई करेगा।
इन याचिकाओं में दिल्ली के जंतर-मंतर सहित विभिन्न राज्यों में प्रदर्शन कर रहे छात्रों के खिलाफ कथित पुलिस कार्रवाई को चुनौती दी गई है।
मुख्य न्यायाधीश न्यायमूर्ति सूर्यकांत की अध्यक्षता वाली तीन सदस्यीय पीठ, जिसमें न्यायमूर्ति जॉयमाल्य बागची और न्यायमूर्ति वी. मोहना भी शामिल हैं, ने वरिष्ठ अधिवक्ता गोपाल शंकरनारायणन और श्याम दीवान की ओर से तत्काल सुनवाई का अनुरोध किए जाने के बाद मामले को सूचीबद्ध करने पर सहमति जताई।
मुख्य न्यायाधीश ने कहा कि अदालत इन याचिकाओं पर सुनवाई करेगी।
वरिष्ठ अधिवक्ता शंकरनारायणन ने पीठ को बताया कि देश के विभिन्न हिस्सों में छात्र आंदोलनों के दौरान हुई कथित पुलिस कार्रवाई से संबंधित दो अलग-अलग याचिकाएं दाखिल की गई हैं। उन्होंने कहा कि यह अत्यंत तात्कालिक मामला है क्योंकि प्रदर्शनकारियों के खिलाफ ऐसी घटनाएं लगातार सामने आ रही हैं।
उन्होंने अदालत के समक्ष आरोप लगाया कि आंदोलन कर रहे छात्रों के खिलाफ पुलिस आवश्यकता से अधिक बल का प्रयोग कर रही है। उनके अनुसार, हालात लगातार गंभीर होते जा रहे हैं और नागरिकों के संवैधानिक अधिकारों की रक्षा के लिए न्यायालय का हस्तक्षेप आवश्यक हो गया है।
शंकरनारायणन ने यह भी बताया कि उन्होंने पहले सुप्रीम कोर्ट की रजिस्ट्री से डायरी नंबर जारी होने का इंतजार किया, जिसके बाद ही तत्काल सुनवाई की मांग की गई।
उन्होंने कहा कि अब दोनों याचिकाएं विधिवत दायर हो चुकी हैं और संबंधित राज्य सरकारों को भी पक्षकार बनाया गया है।
यह मामला ऐसे समय सामने आया है जब प्रदर्शनकारी लगातार आरोप लगा रहे हैं कि पुलिस ने उन्हें तितर-बितर करने के लिए लाठीचार्ज और आंसू गैस का इस्तेमाल किया।
दूसरी ओर पुलिस का कहना है कि कार्रवाई तब की गई जब कुछ प्रदर्शनकारियों ने सुरक्षा घेरा तोड़ने का प्रयास किया और पुलिसकर्मियों पर हमला किया। इन घटनाओं के बाद कई एफआईआर दर्ज की गई हैं और सुरक्षा व्यवस्था भी कड़ी कर दी गई है।
इससे पहले दिन में मुख्य न्यायाधीश सूर्यकांत ने उन मीडिया रिपोर्टों का भी खंडन किया, जिनमें दावा किया गया था कि उन्होंने दिल्ली में छात्रों के खिलाफ कथित पुलिस कार्रवाई से संबंधित याचिका को सुनवाई के लिए सूचीबद्ध करने से इनकार कर दिया था।
उन्होंने स्पष्ट किया कि उस समय तक अदालत के समक्ष कोई औपचारिक याचिका दायर ही नहीं की गई थी।
घटनाक्रम स्पष्ट करते हुए मुख्य न्यायाधीश ने कहा कि न्यायालय को केवल एक अधिवक्ता की ओर से प्रतिनिधित्व प्राप्त हुआ था, विधिवत याचिका नहीं।
उन्होंने मीडिया में प्रकाशित खबरों पर भी चिंता जताई और कहा कि यह कहना पूरी तरह गलत है कि सर्वोच्च न्यायालय ने मामले की सुनवाई से इनकार किया था। उनके अनुसार, ऐसी भ्रामक रिपोर्टिंग से जनता के बीच तथ्यात्मक रूप से गलत संदेश जाता है।
