Twisha Sharma Dowry Death Case: Bhopal Court Refuses Bail to Retired Judge Giribala Singh, Cites Risk of Evidence Being Influenced
The alleged dowry death case of model-turned-actor Twisha Sharma took a significant legal turn on Friday after a Bhopal sessions court declined to grant bail to retired judicial officer Giribala Singh, observing that her release at this stage could adversely impact the ongoing investigation.
The court held that the apprehension expressed by the prosecution regarding possible interference with evidence was supported by the material collected during the probe and, therefore, could not be brushed aside.
After examining the case diary and other records placed before it, First Additional Sessions Judge Ram Pratap Mishra concluded that investigators had gathered sufficient prima facie material pointing towards the accused’s alleged role in the offence.
The court noted that the accusations involve a grave crime against a woman, punishable with life imprisonment under the Bharatiya Nyaya Sanhita, making it inappropriate to extend the benefit of bail while the investigation is still in progress.
Judicial records referred to in the order include WhatsApp conversations, call-detail records and statements recorded from members of the deceased’s family.
According to the court, these documents collectively indicate the applicant’s alleged involvement and justify continued judicial custody until the investigation reaches a more advanced stage.
Particular emphasis was also laid on Giribala Singh’s professional background. The court recorded that she had earlier served as the Principal District and Sessions Judge in Bhopal and was heading the District Consumer Disputes Redressal Commission in the city when the incident occurred.
Considering her former position, the court observed that the concerns raised by both the investigating agency and the complainant regarding possible influence over evidence or witnesses could not be considered unfounded.
Arguments advanced by the defence seeking relief on humanitarian grounds did not persuade the court.
It ruled that factors such as the accused being a woman, her advancing age, responsibility towards her 100-year-old mother and participation in religious activities could not outweigh the seriousness of the allegations.
The court further found no medical evidence indicating any illness severe enough to justify release on bail, adding that necessary treatment could be provided while she remains in judicial custody.
The order also clarified that rival claims put forward by the prosecution and the defence would ultimately be tested during trial.
At the present stage, however, the court said only a prima facie assessment was required, and the material available in the case diary was sufficient to indicate the accused’s alleged involvement.
The criminal proceedings stem from the death of 27-year-old Twisha Sharma, who married advocate Samarth Singh on December 9, 2025.
Barely five months into the marriage, she was found dead at her matrimonial home in Katara Hills, Bhopal, on the night of May 12, 2026.
AIIMS Bhopal informed the police shortly after midnight, following which a magisterial inquiry was initiated.
Medical findings became a crucial part of the investigation. The post-mortem report concluded that Twisha died due to ante-mortem hanging.
Doctors also documented multiple simple ante-mortem injuries on her body, observing that they were likely caused by a blunt object before her death.
The case gathered momentum after Twisha’s family levelled serious allegations against her husband, advocate Samarth Singh, and mother-in-law Giribala Singh.
They claimed she had been subjected to sustained mental and physical harassment over dowry demands.
The family further alleged that her pregnancy was questioned by her husband and mother-in-law, who allegedly pressured her into terminating it against her wishes.
Acting on these allegations, the Madhya Pradesh Police registered an FIR on May 15 against Samarth Singh and Giribala Singh under provisions relating to dowry death, cruelty by husband or relatives and the Dowry Prohibition Act.
Dissatisfied with the manner in which the investigation was initially handled, Twisha’s family has also sought a Central Bureau of Investigation (CBI) probe, alleging lapses in the collection and preservation of evidence.

मॉडल से अभिनेत्री बनी ट्विशा शर्मा की संदिग्ध दहेज मृत्यु से जुड़े बहुचर्चित मामले में शुक्रवार को महत्वपूर्ण न्यायिक घटनाक्रम सामने आया।
भोपाल की सत्र अदालत ने सेवानिवृत्त न्यायिक अधिकारी गिरिबाला सिंह की जमानत याचिका खारिज करते हुए कहा कि इस स्तर पर उन्हें रिहा किया जाना जांच की निष्पक्षता को प्रभावित कर सकता है।
अदालत ने माना कि अभियोजन पक्ष द्वारा साक्ष्यों पर प्रभाव पड़ने की जो आशंका व्यक्त की गई है, वह अब तक एकत्र किए गए तथ्यों के आधार पर पूरी तरह निराधार नहीं कही जा सकती।
प्रथम अपर सत्र न्यायाधीश राम प्रताप मिश्रा ने केस डायरी और जांच से जुड़े अभिलेखों का परीक्षण करने के बाद कहा कि उपलब्ध सामग्री प्रथम दृष्टया आरोपी की कथित संलिप्तता की ओर संकेत करती है।
अदालत ने कहा कि यह महिलाओं के विरुद्ध अत्यंत गंभीर अपराध है, जिसमें भारतीय न्याय संहिता के तहत आजीवन कारावास तक का प्रावधान है। ऐसे में जांच पूरी होने से पहले जमानत देना न्यायोचित नहीं होगा।
जांच एजेंसी द्वारा प्रस्तुत साक्ष्यों में व्हाट्सएप चैट, कॉल डिटेल रिकॉर्ड तथा मृतका के परिजनों के बयान शामिल हैं।
न्यायालय ने अपने आदेश में कहा कि इन सभी तथ्यों का समग्र अध्ययन आरोपी की कथित भूमिका का प्रारंभिक आधार प्रस्तुत करता है और यही कारण है कि फिलहाल उन्हें न्यायिक हिरासत से राहत नहीं दी जा सकती।
अदालत ने अपने आदेश में गिरिबाला सिंह की पूर्व न्यायिक सेवाओं का भी उल्लेख किया। न्यायालय ने कहा कि वह भोपाल की प्रधान जिला एवं सत्र न्यायाधीश रह चुकी हैं तथा घटना के समय जिला उपभोक्ता विवाद प्रतितोष आयोग, भोपाल की अध्यक्ष थीं।
ऐसे में जांच एजेंसी और शिकायतकर्ता द्वारा यह आशंका व्यक्त किया जाना कि उनकी रिहाई से साक्ष्यों अथवा गवाहों पर प्रभाव पड़ सकता है, पूरी तरह असंगत नहीं माना जा सकता।
मानवीय आधार पर जमानत देने की बचाव पक्ष की दलीलों को भी अदालत ने स्वीकार नहीं किया।
न्यायालय ने कहा कि आरोपी की आयु, महिला होना, 100 वर्षीय माता की देखभाल की जिम्मेदारी अथवा धार्मिक गतिविधियों में सक्रियता जैसे आधार आरोपों की गंभीरता को कम नहीं करते।
अदालत ने यह भी स्पष्ट किया कि चिकित्सीय अभिलेखों में ऐसी कोई गंभीर बीमारी सामने नहीं आई है जिसके कारण जमानत आवश्यक हो।
यदि जरूरत पड़ी तो न्यायिक अभिरक्षा में ही समुचित उपचार उपलब्ध कराया जा सकता है।
अपने आदेश में अदालत ने यह भी कहा कि अभियोजन और बचाव पक्ष द्वारा लगाए गए आरोपों का अंतिम परीक्षण मुकदमे की सुनवाई के दौरान होगा।
फिलहाल केवल प्रथम दृष्टया उपलब्ध सामग्री का मूल्यांकन किया गया है और केस डायरी में दर्ज तथ्यों से आरोपी की कथित संलिप्तता का पर्याप्त आधार दिखाई देता है।
यह मामला 27 वर्षीय ट्विशा शर्मा की मृत्यु से जुड़ा है, जिन्होंने 9 दिसंबर 2025 को अधिवक्ता समर्थ सिंह से विवाह किया था।
विवाह के लगभग पांच महीने बाद, 12 मई 2026 की रात, वह भोपाल के कटारा हिल्स स्थित अपने ससुराल में मृत पाई गईं।
एम्स भोपाल ने 13 मई की मध्यरात्रि के बाद पुलिस को सूचना दी, जिसके बाद मजिस्ट्रियल जांच शुरू की गई।
पोस्टमार्टम रिपोर्ट ने जांच को नया आयाम दिया। चिकित्सकों ने मृत्यु का कारण जीवित अवस्था में फांसी लगना बताया।
रिपोर्ट में शरीर पर कई साधारण प्रकृति की बाहरी चोटों का भी उल्लेख किया गया, जिन्हें किसी कठोर वस्तु से लगी चोट माना गया और जिन्हें मृत्यु से पहले की चोटें बताया गया।
घटना के बाद ट्विशा के परिजनों ने पति समर्थ सिंह और सास गिरिबाला सिंह पर गंभीर आरोप लगाए। परिवार का कहना है कि विवाह के बाद ट्विशा को दहेज की मांग को लेकर लगातार मानसिक और शारीरिक प्रताड़ना झेलनी पड़ी।
उन्होंने यह भी आरोप लगाया कि उसकी गर्भावस्था पर संदेह जताते हुए उस पर कथित रूप से गर्भपात कराने का दबाव डाला गया।
इन आरोपों के आधार पर मध्य प्रदेश पुलिस ने 15 मई को समर्थ सिंह और गिरिबाला सिंह के खिलाफ दहेज मृत्यु, पति या उसके परिजनों द्वारा क्रूरता तथा दहेज प्रतिषेध अधिनियम की धाराओं में प्राथमिकी दर्ज की।
प्रारंभिक जांच और साक्ष्यों के संरक्षण में गंभीर लापरवाही का आरोप लगाते हुए ट्विशा के परिवार ने मामले की जांच केंद्रीय अन्वेषण ब्यूरो (सीबीआई) को सौंपने की भी मांग की है।
