Zia-ul-Haque Murder Case: Court Accepts CBI Closure Report Against Raja Bhaiya, Four Others
More than 13 years after the Kunda DSP was killed amid violence in Pratapgarh’s Balipur village, Special CBI Court finds insufficient material to take cognisance against the five accused
LUCKNOW/PRATAPGARH: More than 13 years after the killing of Kunda Deputy Superintendent of Police Zia-ul-Haque during violence in Pratapgarh, a Special CBI Court has accepted the Central Bureau of Investigation’s closure report in the case against former Uttar Pradesh minister and Kunda MLA Raghuraj Pratap Singh, popularly known as Raja Bhaiya, and four others.
The court concluded that the material placed before it did not provide sufficient grounds to proceed against the five accused.
It also found that the objections raised by Haque’s wife, Parveen Azad, in her protest petition did not establish a prosecutable case against those named in her complaint.
The ruling marks the latest development in a case that began with the killing of village pradhan Nanhe Yadav in Balipur on March 2, 2013, and was followed within hours by the death of DSP Haque, who had gone to the village after violence broke out.
How the Balipur violence unfolded
Nanhe Yadav was allegedly shot near a tea stall in Balipur on the morning of March 2, 2013. His brother Phool Chand subsequently approached the Hathigwan police station, following which a murder case was registered against four people.
Tension escalated when Nanhe Yadav’s body was taken back to the village.
According to the investigation records described in the case, members of his family and supporters allegedly confronted the police personnel accompanying the body, forcing the officers to retreat.
Haque, then serving as Kunda circle officer, was also caught up in the violence. While attempting to move away from the scene, he reportedly fell after his foot slipped into a drain. He was subsequently assaulted with sticks and other weapons.
The night also saw the death of Nanhe Yadav’s brother Suresh.
The CBI later concluded that Suresh was fatally injured when a double-barrel gun went off accidentally during the confrontation.
The violence generated multiple FIRs. The CBI eventually took over the investigations into the deaths of Nanhe Yadav, Suresh and Haque.
Wife’s FIR named Raja Bhaiya and four others
A separate FIR lodged by Parveen Azad, Haque’s wife, accused Raja Bhaiya and four associates — Gulshan Yadav, Hari Om Srivastava, Rohit Singh and Guddu Singh — of being involved in the killing.
Azad alleged that her husband had been assaulted on the instructions of Raja Bhaiya and subsequently shot. She maintained that the killing was part of a planned act and later challenged the CBI’s decision to close the case.
The CBI initially submitted a closure report in July 2013. Azad opposed the report through a protest petition, arguing that the investigation had not adequately examined crucial aspects of her husband’s death.
The court did not accept the first closure report at that stage. In July 2014, it directed the agency to conduct a further investigation, raising questions about aspects of the police response during the attack on Haque.
The court had also questioned how Haque could have sustained fatal injuries while other members of the police team reportedly suffered only comparatively minor injuries.
The court had further sought clarity on why a polygraph examination had been conducted only on Raja Bhaiya and not on the other individuals named in Azad’s complaint.
CBI conducts fresh probe
Following the court’s direction, the CBI reopened the relevant aspects of the investigation. The agency subsequently submitted another closure report before the Lucknow court on December 22, 2023.
The latest proceedings centred on whether the material collected during the additional investigation was sufficient to establish the involvement of Raja Bhaiya and the four other accused.
According to the court’s latest order, the evidence on record did not provide a sufficient basis for taking cognisance of an offence against them.
The court also held that Azad’s protest petition did not demonstrate through documentary or oral evidence that the five had participated in the alleged crime.
Separate murder trial ended in convictions
The proceedings involving Raja Bhaiya and the four others were separate from the main prosecution arising from the police FIR concerning Haque’s killing.
In that case, the CBI had filed a chargesheet against several accused.
After the case proceeded to trial, a court in October 2024 sentenced 10 accused to life imprisonment after finding them guilty of murder, rioting and other offences.
The distinction between the two proceedings is significant: the latest order concerns the allegations specifically made against Raja Bhaiya and four others in Azad’s FIR, while the convictions in 2024 arose from a separate prosecution relating to Haque’s murder.
Family declines comment
Following the latest court decision, Azad declined to comment. Attempts to contact Haque’s parents were unsuccessful, while their lawyer also declined to respond.
The case has remained one of the most closely watched criminal proceedings associated with Pratapgarh and Kunda since the events of March 2013.
The latest court order brings the proceedings against the five accused named in Azad’s complaint to another significant juncture after more than a decade of investigation and litigation.
जिया-उल-हक हत्याकांड: राजा भैया समेत पांच के खिलाफ CBI की क्लोजर रिपोर्ट कोर्ट ने मानी
प्रतापगढ़ के बलीपुर कांड के 13 साल बाद फैसला; विशेष CBI अदालत ने कहा- आरोपियों के खिलाफ संज्ञान लेने के लिए पर्याप्त साक्ष्य नहीं
लखनऊ/प्रतापगढ़, 23 सितंबर: प्रतापगढ़ के चर्चित बलीपुर कांड में तत्कालीन कुंडा क्षेत्राधिकारी डीएसपी जिया-उल-हक की मौत से जुड़े मामले में विशेष CBI अदालत ने केंद्रीय जांच ब्यूरो की क्लोजर रिपोर्ट स्वीकार कर ली है।
यह मामला तत्कालीन उत्तर प्रदेश मंत्री और कुंडा विधायक रघुराज प्रताप सिंह उर्फ राजा भैया तथा चार अन्य लोगों के खिलाफ दर्ज FIR से संबंधित था।
अदालत ने माना कि उपलब्ध सामग्री के आधार पर पांचों आरोपियों के खिलाफ अपराध का संज्ञान लेने के लिए पर्याप्त आधार मौजूद नहीं है।
जिया-उल-हक की पत्नी परवीन आजाद की ओर से दाखिल विरोध याचिका में लगाए गए आरोप भी अदालत को इस स्तर पर पर्याप्त नहीं लगे।
यह मामला 2 मार्च 2013 को प्रतापगढ़ के बलीपुर गांव में ग्राम प्रधान नन्हे यादव की हत्या के बाद शुरू हुई हिंसा से जुड़ा है।
नन्हे यादव की हत्या के कुछ घंटे बाद गांव में पहुंचे तत्कालीन कुंडा सीओ जिया-उल-हक की भी हिंसा के दौरान मौत हो गई थी।
नन्हे यादव की हत्या के बाद बिगड़े हालात
2 मार्च 2013 की सुबह बलीपुर गांव में एक चाय की दुकान के पास नन्हे यादव की कथित तौर पर गोली मारकर हत्या कर दी गई थी।
घटना के बाद उनके भाई फूलचंद यादव ने हथिगवां थाने में सूचना दी, जिसके आधार पर चार लोगों के खिलाफ मामला दर्ज किया गया।
नन्हे यादव का शव जब गांव लाया गया तो माहौल तनावपूर्ण हो गया। जांच में सामने आए घटनाक्रम के अनुसार, शव के साथ पहुंचे पुलिसकर्मियों का कथित तौर पर परिवार के सदस्यों और समर्थकों से टकराव हुआ और पुलिस टीम को वहां से पीछे हटना पड़ा।
इसी दौरान जिया-उल-हक भी हिंसा की चपेट में आ गए। बताया गया कि बचने की कोशिश में उनका पैर नाले में फिसल गया और वह गिर पड़े।
इसके बाद भीड़ ने कथित तौर पर उन पर लाठी-डंडों और अन्य हथियारों से हमला किया।
घटना के दौरान नन्हे यादव के भाई सुरेश की भी मौत हो गई। CBI की जांच के अनुसार, हाथापाई के दौरान उनकी डबल बैरल बंदूक से कथित तौर पर अचानक गोली चल गई, जिससे वह घायल हुए और बाद में उनकी मृत्यु हो गई।
बलीपुर की घटनाओं को लेकर कई FIR दर्ज हुईं और बाद में विभिन्न मामलों की जांच CBI को सौंपी गई।
पत्नी की FIR में राजा भैया और चार अन्य के नाम
डीएसपी जिया-उल-हक की पत्नी परवीन आजाद ने अलग FIR दर्ज कराते हुए राजा भैया के अलावा गुलशन यादव, हरिओम श्रीवास्तव, रोहित सिंह और गुड्डू सिंह को आरोपी बनाया था।
आजाद ने आरोप लगाया था कि उनके पति पर पहले हमला किया गया और बाद में उनकी हत्या कर दी गई। उन्होंने इसे सुनियोजित कार्रवाई बताते हुए जांच में गंभीर पहलुओं की अनदेखी किए जाने का आरोप भी लगाया था।
CBI ने जुलाई 2013 में इस FIR के आधार पर पहली बार क्लोजर रिपोर्ट दाखिल की थी। आजाद ने इसका विरोध करते हुए अदालत में प्रोटेस्ट पिटीशन दायर की और कहा कि उनके पति की मौत से जुड़े महत्वपूर्ण पहलुओं की पर्याप्त जांच नहीं की गई।
अदालत ने उस समय CBI की रिपोर्ट को स्वीकार नहीं किया और जुलाई 2014 में मामले में आगे की जांच का आदेश दिया।
अदालत ने उस समय पुलिस टीम की भूमिका और घटनास्थल पर जिया-उल-हक को बचाने के प्रयासों को लेकर भी सवाल उठाए थे।
अदालत ने यह भी सवाल उठाया था कि FIR में नामजद अन्य लोगों के बजाय केवल राजा भैया का पॉलीग्राफ परीक्षण क्यों कराया गया।
दोबारा जांच के बाद फिर क्लोजर रिपोर्ट
अदालत के निर्देश के बाद CBI ने मामले के संबंधित पहलुओं की नए सिरे से जांच की। जांच पूरी होने के बाद एजेंसी ने 22 दिसंबर 2023 को लखनऊ की अदालत में दूसरी क्लोजर रिपोर्ट दाखिल की।
मौजूदा सुनवाई में मुख्य सवाल यह था कि अतिरिक्त जांच के दौरान जुटाए गए साक्ष्य क्या राजा भैया और अन्य चार आरोपियों के खिलाफ आपराधिक कार्रवाई आगे बढ़ाने के लिए पर्याप्त हैं।
अदालत ने उपलब्ध रिकॉर्ड की समीक्षा के बाद निष्कर्ष निकाला कि आरोपियों के खिलाफ अपराध का संज्ञान लेने के लिए पर्याप्त सामग्री नहीं है।
अदालत ने यह भी कहा कि शिकायतकर्ता की प्रोटेस्ट पिटीशन में ऐसे मौखिक या दस्तावेजी साक्ष्य पर्याप्त रूप से सामने नहीं रखे गए, जिनसे पांचों की कथित अपराध में भागीदारी स्थापित हो सके।
जिया-उल-हक हत्याकांड के अलग मामले में 10 को उम्रकैद
जिया-उल-हक की हत्या से जुड़े एक अन्य मुकदमे की स्थिति इससे अलग रही। यह मामला पुलिस अधिकारी की ओर से दर्ज कराई गई FIR पर आधारित था।
इस मामले में CBI ने कई आरोपियों के खिलाफ आरोपपत्र दाखिल किया था। सुनवाई के बाद अक्टूबर 2024 में अदालत ने 10 आरोपियों को हत्या, दंगा और अन्य अपराधों में दोषी ठहराते हुए उम्रकैद की सजा सुनाई।
इसलिए वर्तमान अदालत का आदेश उन पांच लोगों के खिलाफ दर्ज अलग FIR और उससे संबंधित CBI जांच पर है, जबकि 2024 की सजाएं जिया-उल-हक की हत्या से जुड़े दूसरे अभियोजन में हुई थीं।
परिवार ने टिप्पणी करने से किया इनकार
नवीनतम अदालत के फैसले के बाद परवीन आजाद ने टिप्पणी करने से इनकार कर दिया। जिया-उल-हक के माता-पिता से संपर्क नहीं हो सका, जबकि उनके वकील ने भी इस मामले पर प्रतिक्रिया देने से इनकार किया।
मार्च 2013 का बलीपुर कांड उत्तर प्रदेश के चर्चित आपराधिक मामलों में रहा है। जिया-उल-हक की मौत, नन्हे यादव और सुरेश यादव की मौत तथा उसके बाद हुई CBI जांच और लंबी कानूनी प्रक्रिया ने इस मामले को एक दशक से अधिक समय तक सुर्खियों में बनाए रखा है।
