Supreme Court Orders Preservation of Protest Evidence, Considers Rules for Demonstrations Near Courts

A petition arising from the October 12 opposition march seeks tighter safeguards around judicial institutions and contempt action against several political leaders. The Supreme Court has sought responses but has not initiated contempt proceedings.

NEW DELHI: The Supreme Court has moved to examine how political demonstrations near judicial institutions should be regulated, directing authorities to preserve evidence relating to an opposition protest held outside its premises earlier this month.

The intervention came on Thursday as a bench headed by Chief Justice of India Surya Kant and comprising Justice Joymalya Bagchi took up a petition stemming from the October 12 march towards the apex court.

During the hearing, the Chief Justice delivered a pointed message that the judiciary could not be subjected to intimidation or pressure.

The court issued notice on the petition, inviting responses from the parties concerned.

However, it stopped short of ordering criminal contempt proceedings against the political figures named in the plea, making clear that the question would not be decided at this stage.

The petition seeks action against Congress MP Rahul Gandhi, Congress president Mallikarjun Kharge, Samajwadi Party leader Akhilesh Yadav, Trinamool Congress MP Mahua Moitra and others.

Its broader objective is to establish clear restrictions on political gatherings around the Supreme Court and high courts.

Court seeks to protect records linked to October 12 march

Preserving evidence from the demonstration emerged as an immediate concern during the proceedings.

The bench directed law enforcement authorities to retain CCTV recordings and other digital material connected with the incident rather than allow potentially relevant evidence to be lost.

The order also covers material held by private individuals or organisations, which may preserve it for possible use in the proceedings.

Solicitor General Tushar Mehta informed the court that the Delhi Police Commissioner had already circulated instructions to police stations to retain the relevant surveillance footage and send copies to police headquarters for additional safekeeping.

Senior advocate Gaurav Bhatia, appearing for the petitioners, had sought a specific interim direction covering recordings from the Supreme Court complex.

The bench observed that a direction requiring people holding relevant footage to produce it before the court was already in place.

Judges reject suggestion that the institution can be pressured

The hearing also addressed concerns raised by lawyers about political statements and demonstrations around the country’s highest court.

Bhatia referred to a memorandum reportedly endorsed by approximately 200 lawyers who expressed unease over remarks they believed could undermine the judiciary.

He argued that the legal community was troubled by the events of October 12 and that political activity near the court should not be allowed to compromise its institutional independence.

The Chief Justice responded that the court was aware of the developments and would not be intimidated.

He indicated that judges were familiar with statements made publicly by political leaders as well as arguments advanced by them in court.

Bhatia said his submissions were motivated by faith in the judicial system and concern about any attempt to influence it.

He urged the court to ensure that the area surrounding its premises remained protected from activities capable of interfering with judicial work.

Despite the strong exchanges, the bench confined its immediate action to issuing notice and preserving evidence. No contempt proceedings were launched during the hearing.

Dispute over Election Commission preceded demonstration

The legal challenge originates from a political confrontation over the functioning of the Election Commission of India and Chief Election Commissioner Gyanesh Kumar.

Opposition leaders and their supporters marched towards the Supreme Court on October 12 while raising concerns about alleged electoral irregularities.

The demonstration followed an unsuccessful request by Rahul Gandhi and Mallikarjun Kharge to meet the Chief Justice and submit a memorandum outlining their concerns about the poll panel.

The CJI had indicated that grievances of this nature could be pursued through the appropriate legal channels.

The petition, filed by advocates including Digant Mishra, asks the court to frame guidelines for protests near the Supreme Court and high courts.

It proposes a blanket ban on political demonstrations inside judicial complexes and seeks safeguards against organised political campaigns intended to influence matters pending before judges.

The Union government, Delhi Police Commissioner and several political leaders and organisations have been listed as respondents.

Deleted Congress post and journalist’s allegation cited

The plea also draws attention to a social media post published by the Congress’s Kerala unit on October 12.

The post, which was subsequently deleted, addressed the Chief Justice as “Dear Surya Kant” and called for his resignation if law and order was outside his responsibility.

Separately, the petition refers to an allegation that a pregnant journalist was pushed during the demonstration near the court.

The claim forms part of the petitioners’ account of the events and should not be treated as an established finding unless supported by verified evidence.

The proceedings could have wider implications for the way demonstrations are conducted near judicial institutions.

For now, the Supreme Court has sought the concerned parties’ responses and ordered the preservation of potentially relevant evidence.

Whether new restrictions or further legal action are warranted remains to be considered.
