Allahabad High Court Grants Custody Parole to Atiq Ahmed’s Sons Umar and Ali for Brother Aban Ahmed’s Burial in Prayagraj

The Allahabad High Court on Friday permitted Mohammad Umar and Ali Ahmed, sons of deceased gangster-politician Atiq Ahmed, to be released on temporary custody parole to participate in the burial ceremony of their younger brother, Aban Ahmed.
Aban lost his life in a road accident on August 6 while reportedly travelling to Jhansi to meet his elder brother lodged in jail.
He was the youngest among Atiq Ahmed’s five sons.
While granting the relief, the Division Bench observed that the protection of individual freedoms forms an essential foundation of a strong nation.
The court emphasized that constitutional values remain significant even when dealing with persons facing criminal proceedings.
The Bench directed that immediately after the burial rituals and the permitted interaction among the family members conclude, both Umar and Ali must be escorted back to their respective correctional facilities under continuous police supervision.
The order imposed several strict conditions governing the temporary release.
The court barred both undertrial prisoners from making any public statements or interacting with journalists through print, television, digital platforms or social media during the parole period.
The judges further prohibited them from joining any procession, gathering or programme other than the religious rites connected with Aban Ahmed’s last rites at the Kasari Masari Graveyard in Prayagraj.
The court also restricted their communication during the parole period.
They may interact only with the cleric conducting the funeral, their paternal aunt, Parveen Qureshi, and their brother, Ahzam Ahmed.
Contact with any other individual has not been permitted.
Additionally, the High Court directed both prisoners to comply fully with every instruction issued by police and district authorities throughout the duration of their custody parole.
Mohammad Umar is presently lodged in Lucknow jail as an undertrial in the Mohit Jaiswal kidnapping case, while Ali Ahmed remains incarcerated in Jhansi jail in connection with an extortion case.
The order was passed by a Division Bench comprising Justice Ajay Bhanot and Justice Divesh Chandra Samant while deciding a petition filed by Parveen Qureshi, the paternal aunt of the brothers.
In her plea, Qureshi requested the court to allow the two undertrial prisoners to attend the burial and perform the customary religious ceremonies following the death of their younger sibling.
The court noted that the funeral is scheduled to take place on August 8 at approximately 8 p.m. at the Kasari Masari Graveyard in Prayagraj.
Atiq Ahmed had represented the Allahabad West Assembly constituency five times as a legislator before winning the Phulpur Lok Sabha seat on a Samajwadi Party ticket in the 2004 parliamentary election.
The constituency has historical significance as it was represented multiple times by India’s first Prime Minister, Jawaharlal Nehru.
Atiq’s younger brother Ashraf Ahmed also served as an MLA from the Allahabad West constituency.
On April 15, 2023, Atiq Ahmed and his brother Ashraf were shot dead while being escorted by police for a mandatory medical examination at Colvin Hospital in Prayagraj in connection with the Umesh Pal murder case.
The attackers, disguised as media personnel, opened fire at close range in front of television cameras before surrendering to police at the scene.
Among Atiq Ahmed’s five sons, Asad Ahmed was killed during a police encounter in 2023 while being sought in the Umesh Pal murder investigation.
Umar and Ali remain in judicial custody in separate criminal cases, while another son, Ahzam Ahmed, survives the family. Aban Ahmed, who died in the recent road accident, was the youngest of the five brothers.

इलाहाबाद हाईकोर्ट ने शुक्रवार को दिवंगत माफिया से राजनेता बने अतीक अहमद के पुत्र मोहम्मद उमर और अली अहमद को उनके छोटे भाई अबान अहमद के सुपुर्द-ए-खाक में शामिल होने के लिए अस्थायी कस्टडी पैरोल प्रदान की।
अबान अहमद की 6 अगस्त को सड़क दुर्घटना में मृत्यु हो गई थी। बताया गया कि वह झांसी जेल में बंद अपने भाई से मिलने जा रहे थे। वह अतीक अहमद के पांच पुत्रों में सबसे छोटे थे।
न्यायालय ने राहत देते हुए कहा कि किसी भी राष्ट्र की मजबूती उसके नागरिकों की स्वतंत्रताओं के संरक्षण से जुड़ी होती है।
पीठ ने स्पष्ट किया कि न्यायिक प्रक्रिया के दौरान भी संवैधानिक मूल्यों की रक्षा सर्वोपरि है।
खंडपीठ ने निर्देश दिया कि अंतिम संस्कार की धार्मिक प्रक्रिया और परिवार के सदस्यों से निर्धारित मुलाकात पूरी होने के बाद दोनों बंदियों को पुलिस सुरक्षा में तुरंत उनकी संबंधित जेलों में वापस ले जाया जाएगा।
अदालत ने पैरोल अवधि के दौरान कई कड़े प्रतिबंध भी लगाए।
आदेश के अनुसार दोनों बंदी किसी सार्वजनिक सभा को संबोधित नहीं करेंगे और न ही प्रिंट, इलेक्ट्रॉनिक, डिजिटल अथवा सोशल मीडिया से किसी प्रकार की बातचीत करेंगे।
न्यायालय ने यह भी स्पष्ट किया कि वे अंतिम संस्कार से संबंधित धार्मिक अनुष्ठानों के अतिरिक्त किसी जुलूस, कार्यक्रम या अन्य आयोजन में भाग नहीं लेंगे।
यह कार्यक्रम प्रयागराज स्थित कसारी मसारी कब्रिस्तान में आयोजित होगा।
पीठ ने दोनों बंदियों के संपर्क पर भी सीमा निर्धारित की। उन्हें केवल अंतिम संस्कार कराने वाले धार्मिक विद्वान, अपनी बुआ परवीन कुरैशी तथा भाई अहजम अहमद से मिलने की अनुमति होगी।
किसी अन्य व्यक्ति से संवाद की अनुमति नहीं दी गई है।
इसके अतिरिक्त अदालत ने निर्देश दिया कि कस्टडी पैरोल की पूरी अवधि के दौरान दोनों बंदी पुलिस और प्रशासन द्वारा दिए जाने वाले प्रत्येक निर्देश का अक्षरशः पालन करेंगे।
मोहम्मद उमर वर्तमान में मोहित जायसवाल अपहरण प्रकरण में लखनऊ जेल में न्यायिक अभिरक्षा में हैं, जबकि अली अहमद रंगदारी से जुड़े एक मामले में झांसी जेल में निरुद्ध हैं।
यह आदेश न्यायमूर्ति अजय भनोट और न्यायमूर्ति दिवेश चंद्र समंत की खंडपीठ ने पारित किया। अदालत परवीन कुरैशी द्वारा दायर याचिका पर सुनवाई कर रही थी, जो दोनों बंदियों की है। हैं।
याचिका में अनुरोध किया गया था कि दोनों विचाराधीन कैदियों को उनके छोटे भाई के दफन और उससे जुड़े धार्मिक अनुष्ठानों में भाग लेने की अनुमति प्रदान की जाए।
अदालत के समक्ष यह जानकारी दी गई कि अंतिम संस्कार 8 अगस्त की रात लगभग 8 बजे प्रयागराज के कसारी मसारी कब्रिस्तान में संपन्न होगा।
अतीक अहमद ने इलाहाबाद पश्चिम विधानसभा क्षेत्र से पांच बार विधायक के रूप में प्रतिनिधित्व किया था। वर्ष 2004 में उन्होंने समाजवादी पार्टी के प्रत्याशी के रूप में फूलपुर लोकसभा सीट से चुनाव जीतकर संसद पहुंची।
यह वही ऐतिहासिक संसदीय क्षेत्र है, जहां से भारत के प्रथम प्रधानमंत्री पंडित जवाहरलाल नेहरू कई बार सांसद निर्वाचित हुए थे।
अतीक के छोटे भाई अशरफ अहमद भी इलाहाबाद पश्चिम सीट से विधायक रह चुके हैं।
15 अप्रैल 2023 की रात अतीक अहमद और उनके भाई अशरफ अहमद की प्रयागराज के कॉल्विन अस्पताल के बाहर उस समय गोली मारकर हत्या कर दी गई थी, जब पुलिस उन्हें उमेश पाल हत्याकांड से जुड़े मामले में अनिवार्य चिकित्सकीय परीक्षण के लिए ले जा रही थी।
हमलावर पत्रकार बनकर पहुंचे और कैमरों के सामने नजदीक से गोलियां चलाने के बाद मौके पर ही पुलिस के समक्ष आत्मसमर्पण कर दिया।
अतीक अहमद के पांच पुत्रों में से असद अहमद वर्ष 2023 में पुलिस मुठभेड़ में मारा गया था। उस पर उमेश पाल हत्याकांड में वांछित होने का आरोप था।
मोहम्मद उमर और अली अहमद अलग-अलग मामलों में न्यायिक अभिरक्षा में हैं, जबकि परिवार के जीवित सदस्यों में अहजम अहमद शामिल हैं।
हालिया सड़क दुर्घटना में जान गंवाने वाले अबान अहमद परिवार के सबसे छोटे पुत्र थे।
