Allahabad High Court Crackdown: UP Bar Council Orders Statewide List of Lawyers Facing Serious Criminal Cases

 Prayagraj: Acting on the directions of the Allahabad High Court, the Bar Council of Uttar Pradesh has instructed every Bar Association in the state to furnish details of advocates against whom First Information Reports (FIRs) have been registered in serious criminal cases, chargesheets have been filed, or criminal proceedings are currently pending before courts.

All Bar Associations have been directed to forward the information to the Bar Council within 15 days.

Through a notification issued on July 23, the Bar Council Secretary has cautioned that failure to comply with the directive within the stipulated period will invite stringent consequences.

The circular makes it clear that any Bar Association failing to submit the required details will automatically lose its affiliation with the Bar Council of Uttar Pradesh.

Apart from the risk of derecognition, the Bar Council has also stated that non-compliance would amount to violation of the Allahabad High Court’s order.

In such cases, a report identifying the defaulting Bar Associations will be placed before the High Court for appropriate action.

The latest directive stems from an order passed by the Allahabad High Court on June 3, 2026, in Mohd. Kafeel vs State of Uttar Pradesh (Petition No. 12231 of 2025).

While hearing the matter, the court had directed the Bar Council to initiate suitable measures against advocates facing serious criminal allegations.

During the same proceedings, the High Court also expressed strong dissatisfaction over the report submitted by the Bar Council of Uttar Pradesh regarding verification of advocates’ educational qualifications.

The report disclosed that only 105 advocates, out of nearly five lakh enrolled lawyers in the state, had been identified as having secured enrolment based on forged academic degrees.

Questioning the credibility of the exercise, the court observed that identifying merely 105 advocates with fake qualifications after a statewide verification drive appeared to be nothing more than a symbolic and superficial exercise.

According to the Bench, the figure was grossly disproportionate to the magnitude of the problem, considering Uttar Pradesh has one of the country’s largest legal fraternities.

The court further remarked that the widespread instances of forged documents, the enrolment of advocates over a period extending from 1991 to 2023, and the prolonged misuse of the names of reputed educational institutions, including Allahabad University, strongly indicated that the actual number of advocates practising on the strength of fraudulent qualifications was likely to be substantially higher than what the Bar Council’s report suggested.

Keeping the matter under close judicial scrutiny, the High Court has scheduled the next hearing for August 20, 2026, to review compliance with its directions.

The Registrar (Compliance) has been instructed to place a consolidated status report before the court on the next date of hearing.


इलाहाबाद हाईकोर्ट का बड़ा निर्देश: गंभीर आपराधिक मामलों वाले वकीलों की सूची 15 दिन में मांगी, यूपी बार काउंसिल ने जारी किया आदेश

इलाहाबाद हाईकोर्ट के निर्देशों का पालन करते हुए उत्तर प्रदेश बार काउंसिल ने राज्य की सभी बार एसोसिएशनों को आदेश जारी कर उन अधिवक्ताओं की विस्तृत सूची उपलब्ध कराने को कहा है, जिनके विरुद्ध गंभीर आपराधिक मामलों में प्राथमिकी (एफआईआर) दर्ज है, आरोपपत्र दाखिल हो चुका है अथवा जिनके खिलाफ आपराधिक मुकदमे न्यायालयों में लंबित हैं।

सभी बार एसोसिएशनों को यह जानकारी 15 दिनों के भीतर बार काउंसिल को भेजने के निर्देश दिए गए हैं।

23 जुलाई को जारी अधिसूचना में बार काउंसिल के सचिव ने स्पष्ट चेतावनी दी है कि निर्धारित समय-सीमा के भीतर सूची प्रस्तुत नहीं करने वाली किसी भी बार एसोसिएशन के विरुद्ध कठोर कार्रवाई की जाएगी।

आदेश में कहा गया है कि ऐसी स्थिति में संबंधित बार एसोसिएशन की बार काउंसिल से संबद्धता स्वतः समाप्त मानी जाएगी।

बार काउंसिल ने यह भी स्पष्ट किया है कि आदेश का पालन न करना इलाहाबाद हाईकोर्ट के निर्देशों की अवहेलना माना जाएगा।

ऐसे सभी मामलों की जानकारी एक अलग रिपोर्ट के माध्यम से न्यायालय को भेजी जाएगी ताकि आवश्यक कानूनी कार्रवाई की जा सके।

यह निर्देश इलाहाबाद हाईकोर्ट द्वारा 3 जून 2026 को मोहम्मद कफील बनाम उत्तर प्रदेश राज्य (याचिका संख्या 12231/2025) में पारित आदेश के अनुपालन में जारी किया गया है।

इस मामले की सुनवाई के दौरान हाईकोर्ट ने गंभीर आपराधिक मामलों का सामना कर रहे अधिवक्ताओं के विरुद्ध उचित कार्रवाई सुनिश्चित करने का निर्देश दिया था।

इसी सुनवाई में हाईकोर्ट ने उत्तर प्रदेश बार काउंसिल द्वारा अधिवक्ताओं की शैक्षणिक योग्यता के सत्यापन संबंधी रिपोर्ट पर भी गहरी नाराजगी व्यक्त की थी।

बार काउंसिल ने अपनी रिपोर्ट में बताया था कि राज्य के लगभग पांच लाख पंजीकृत अधिवक्ताओं में से केवल 105 अधिवक्ताओं की पहचान फर्जी डिग्रियों के आधार पर नामांकन कराने वाले व्यक्तियों के रूप में की गई है।

इस रिपोर्ट पर सवाल उठाते हुए न्यायालय ने कहा कि पूरे प्रदेश में सत्यापन अभियान चलाने के बावजूद केवल 105 अधिवक्ताओं की पहचान होना वास्तविक स्थिति से मेल नहीं खाता और यह महज औपचारिक एवं सतही कवायद प्रतीत होती है।

अदालत ने माना कि उत्तर प्रदेश जैसे विशाल अधिवक्ता समुदाय वाले राज्य में यह संख्या समस्या के वास्तविक स्वरूप की तुलना में अत्यंत कम है।

अपने आदेश में हाईकोर्ट ने यह भी टिप्पणी की कि वर्ष 1991 से 2023 तक लंबे समय में फर्जी दस्तावेजों के माध्यम से नामांकन, प्रतिष्ठित विश्वविद्यालयों—विशेषकर इलाहाबाद विश्वविद्यालय—के नाम के दुरुपयोग तथा व्यापक स्तर पर जालसाजी की घटनाएं इस ओर संकेत करती हैं कि फर्जी शैक्षणिक प्रमाणपत्रों के आधार पर वकालत करने वाले अधिवक्ताओं की वास्तविक संख्या बार काउंसिल द्वारा प्रस्तुत आंकड़ों से कहीं अधिक हो सकती है।

मामले की निगरानी जारी रखते हुए इलाहाबाद हाईकोर्ट ने अगली सुनवाई 20 अगस्त 2026 निर्धारित की है।

न्यायालय ने रजिस्ट्रार (कम्प्लायंस) को निर्देश दिया है कि अगली तिथि पर अनुपालन से संबंधित समेकित रिपोर्ट प्रस्तुत की जाए, ताकि अदालत अपने आदेशों के पालन की समीक्षा कर सके।
