Centre Unveils Tougher Anti-Paper Leak Bill Amid CJP Protests; Up to 10 Years’ Jail, ₹10 Crore Fine and Fast-Track Courts Proposed

Responding to nearly 50 days of sustained protests led by the Cockroach Janta Party (CJP) over the NEET-UG paper leak controversy, the Narendra Modi-led NDA government has proposed sweeping amendments to India’s anti-paper leak legislation.

The revised legal framework seeks to impose harsher punishments, accelerate investigations and trials, and strengthen institutional mechanisms to curb organised examination fraud.

Instead of conceding to the Opposition’s demand for the resignation of Education Minister Dharmendra Pradhan, the Centre has chosen to address public concerns by introducing a significantly tougher legal regime.

While the CJP and Congress have continued to press for political accountability, the government has maintained that stronger legislation will serve as a more effective deterrent against examination-related crimes.

Earlier this week, Prime Minister Narendra Modi reiterated the government’s resolve to protect students’ interests, stating in a video message that anyone attempting to “play with the future of the youth” would face the strictest legal consequences.

The proposed amendments are being presented as part of that broader commitment to restore public confidence in the examination system.

Among the most notable provisions in the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, scheduled to be introduced in the Lok Sabha on Monday, is the creation of Special Fast Track Courts and dedicated Special Task Forces to investigate and prosecute organised examination fraud.

Approval of the proposed legislation would represent the first major revision of the Public Examinations (Prevention of Unfair Means) Act, 2024.

The amendments significantly enhance punitive provisions applicable to individual offenders, examination service providers and organised cheating syndicates, signalling the government’s intention to tighten enforcement.

The proposed overhaul also amounts to an acknowledgement that examination paper leaks have continued despite the enactment of the 2024 law, raising persistent concerns about the credibility and integrity of India’s public examination system.

Unlike the original legislation, which primarily established a legal framework to criminalise organised examination malpractice, the new Bill focuses on ensuring time-bound investigations and speedy judicial proceedings while imposing substantially tougher penalties for offenders.

According to the Statement of Objects and Reasons accompanying the proposed legislation, the 2024 Act was enacted to eliminate unfair practices in public examinations, improve transparency, strengthen fairness, enhance institutional credibility and reinforce public trust in the country’s examination process.

Although the 2024 law is often associated with the NEET-UG controversy, it had actually been passed by Parliament in February 2024, several months before the NEET-UG examination was conducted in May that year and allegations of question paper leaks surfaced.

However, the law formally came into force only on June 21, 2024, at a time when the government was facing mounting criticism over alleged irregularities in the NEET-UG examination as well as the cancellation of the UGC-NET examination.

The latest amendment has emerged directly in response to the NEET-UG 2026 paper leak, which became the principal trigger for the ongoing protest at Jantar Mantar led by the Cockroach Janta Party, an organisation whose name originated from a remark made by the Chief Justice of India in an unrelated context.

One of the most significant features of the amendment is the substantial enhancement of punishments across different categories of offenders.

The proposed law introduces stricter sentencing standards depending upon the nature of the offence and the role of the accused.

For individual offenders, the minimum term of imprisonment is proposed to increase from three years to five years, while the maximum sentence would be doubled from five years to ten years. The highest monetary penalty would also rise sharply from ₹10 lakh to ₹50 lakh.

Entities responsible for conducting public examinations would face much steeper financial consequences if found guilty.

The maximum penalty for service providers is proposed to increase fivefold—from ₹1 crore to ₹5 crore—while the maximum period of blacklisting would also be doubled from four years to eight years.

Senior executives, directors and persons responsible for managing examination service providers would also face tougher criminal liability.

Under the proposed amendments, the minimum prison sentence would increase from three years to five years, whereas the financial penalty would rise from ₹1 crore to ₹5 crore. The maximum jail term would continue to remain ten years.

Cases involving organised criminal networks, examination authorities, service providers or institutions engaged in coordinated examination fraud would attract even stricter punishment.

The minimum imprisonment would increase from five years to seven years, while the minimum fine would rise tenfold from ₹1 crore to ₹10 crore. The maximum sentence, however, would remain ten years.

Perhaps the most far-reaching reform proposed in the Bill is the introduction of mandatory timelines for investigations and judicial proceedings.

A newly inserted Section 12A provides that every investigation, whether conducted by state police, a central investigating agency or a Special Task Force constituted by the Union government, must be completed within two months.

The legislation further requires every State and Union Territory to establish a Special Fast Track Court dedicated exclusively to offences under the Act.

These courts would conduct hearings on a day-to-day basis and, except under unavoidable circumstances supported by written reasons, conclude trials within three months from the filing of the chargesheet.

Even cases that are currently pending before other courts would be transferred to the designated Special Fast Track Courts and disposed of within three months from the date of transfer.

The amendment also makes it mandatory to appoint Special Public Prosecutors for each such court to ensure expeditious prosecution.

Another major institutional reform empowers the Union government to establish Special Task Forces specifically for investigating offences under the Act.

At present, the Centre’s authority is limited to transferring cases to central investigating agencies, but the proposed amendment considerably expands its investigative powers.

The Bill also streamlines the appellate process by providing that appeals against judgments, convictions or other orders of the Special Fast Track Courts will be heard by Division Benches of the respective High Courts.

It further stipulates that such appeals should, as far as practicable, be decided within three months of admission.

Appeals challenging bail orders would likewise be maintainable under the proposed legal framework.

लगभग 50 दिनों से जारी कॉकरोच जनता पार्टी (CJP) के आंदोलन और NEET-UG प्रश्नपत्र लीक विवाद के बीच केंद्र सरकार ने सार्वजनिक परीक्षाओं में होने वाली धांधली पर अंकुश लगाने के लिए मौजूदा कानून को और अधिक कठोर बनाने का प्रस्ताव तैयार किया है।

नरेंद्र मोदी सरकार द्वारा लाए जा रहे संशोधन विधेयक में कड़ी सजा, समयबद्ध जांच, त्वरित सुनवाई और संगठित परीक्षा अपराधों से निपटने के लिए विशेष संस्थागत व्यवस्था का प्रावधान किया गया है।

शिक्षा मंत्री धर्मेंद्र प्रधान के इस्तीफे की मांग पर झुकने के बजाय केंद्र ने इस नए कानूनी ढांचे के माध्यम से छात्रों और अभिभावकों की चिंताओं का समाधान करने की रणनीति अपनाई है।

जहां CJP और कांग्रेस के नेतृत्व वाला विपक्ष राजनीतिक जवाबदेही की मांग पर कायम है, वहीं सरकार का कहना है कि सख्त कानून ही भविष्य में प्रश्नपत्र लीक जैसी घटनाओं पर प्रभावी रोक लगा सकेगा।

इसी सप्ताह जारी अपने वीडियो संदेश में प्रधानमंत्री नरेंद्र मोदी ने स्पष्ट किया था कि देश के युवाओं के भविष्य के साथ खिलवाड़ करने वालों को किसी भी कीमत पर बख्शा नहीं जाएगा।

प्रस्तावित संशोधन उसी प्रतिबद्धता का हिस्सा माना जा रहा है, जिसके माध्यम से परीक्षा प्रणाली में जनता का भरोसा फिर से स्थापित करने का प्रयास किया जा रहा है।

लोकसभा में सोमवार को पेश किए जाने वाले पब्लिक एग्जामिनेशन (अनफेयर मीन्स की रोकथाम) संशोधन विधेयक, 2026 का सबसे महत्वपूर्ण प्रावधान संगठित परीक्षा धोखाधड़ी की जांच और सुनवाई के लिए विशेष फास्ट-ट्रैक अदालतों तथा विशेष कार्यबल (स्पेशल टास्क फोर्स) की स्थापना है।

यदि संसद इस विधेयक को मंजूरी देती है तो यह पब्लिक एग्जामिनेशन (अनफेयर मीन्स की रोकथाम) अधिनियम, 2024 में पहला बड़ा संशोधन होगा।

प्रस्तावित बदलावों के तहत व्यक्तिगत अपराधियों, परीक्षा आयोजित करने वाली एजेंसियों तथा संगठित नकल और पेपर लीक गिरोहों के लिए कहीं अधिक कठोर दंड का प्रावधान किया गया है।

यह संशोधन इस बात का भी संकेत माना जा रहा है कि 2024 में कानून लागू होने के बावजूद प्रश्नपत्र लीक की घटनाएं पूरी तरह नहीं रुक सकीं और इससे सार्वजनिक परीक्षा प्रणाली की विश्वसनीयता पर लगातार प्रश्नचिह्न बने रहे।

जहां 2024 का कानून मुख्य रूप से संगठित परीक्षा अपराधों को दंडनीय बनाने के उद्देश्य से तैयार किया गया था, वहीं नया संशोधन जांच और मुकदमों को निर्धारित समय-सीमा के भीतर पूरा करने तथा दोषियों के लिए कहीं अधिक कड़े दंड सुनिश्चित करने पर केंद्रित है।

विधेयक के साथ प्रस्तुत उद्देश्य एवं कारण विवरण में कहा गया है कि वर्ष 2024 का कानून सार्वजनिक परीक्षाओं में अनुचित साधनों पर रोक लगाने, पारदर्शिता बढ़ाने, निष्पक्षता सुनिश्चित करने, परीक्षा प्रणाली की विश्वसनीयता मजबूत करने तथा जनता का विश्वास कायम रखने के उद्देश्य से बनाया गया था।

हालांकि 2024 का कानून अक्सर NEET-UG विवाद से जोड़ा जाता है, लेकिन वास्तविकता यह है कि संसद ने इसे फरवरी 2024 में पारित कर दिया था।

उस समय तक मई 2024 की NEET-UG परीक्षा आयोजित भी नहीं हुई थी और प्रश्नपत्र लीक के आरोप सामने नहीं आए थे।

इसके बावजूद यह कानून औपचारिक रूप से 21 जून 2024 से लागू किया गया, जब NEET-UG में कथित अनियमितताओं और UGC-NET परीक्षा रद्द किए जाने को लेकर केंद्र सरकार की व्यापक आलोचना हो रही थी।

वर्ष 2026 का यह संशोधन सीधे तौर पर इस वर्ष हुए NEET-UG पेपर लीक से जुड़ा माना जा रहा है। इसी विवाद ने जंतर-मंतर पर CJP द्वारा चलाए जा रहे आंदोलन को जन्म दिया, जिसने पूरे देश में परीक्षा सुधार की बहस को नई दिशा दी।

संशोधन विधेयक की सबसे प्रमुख विशेषताओं में अपराधियों की विभिन्न श्रेणियों के लिए अलग-अलग और कहीं अधिक कठोर दंड का प्रावधान शामिल है।

अपराध की प्रकृति और आरोपी की भूमिका के आधार पर सजा निर्धारित की जाएगी।

व्यक्तिगत अपराधियों के लिए न्यूनतम कारावास तीन वर्ष से बढ़ाकर पांच वर्ष तथा अधिकतम सजा पांच वर्ष से बढ़ाकर दस वर्ष करने का प्रस्ताव है।

इसके साथ ही अधिकतम आर्थिक दंड ₹10 लाख से बढ़ाकर ₹50 लाख कर दिया जाएगा।

सार्वजनिक परीक्षाएं आयोजित करने वाली सेवा प्रदाता संस्थाओं पर भी कहीं अधिक कड़ी कार्रवाई का प्रस्ताव रखा गया है।

दोषी पाए जाने पर अधिकतम जुर्माना ₹1 करोड़ से बढ़ाकर ₹5 करोड़ किया जाएगा, जबकि ब्लैकलिस्ट करने की अधिकतम अवधि चार वर्ष से बढ़ाकर आठ वर्ष करने का प्रस्ताव है।

यदि किसी सेवा प्रदाता संस्था के निदेशक, वरिष्ठ प्रबंधन अधिकारी या प्रभारी व्यक्ति की संलिप्तता सिद्ध होती है, तो उसके लिए न्यूनतम कारावास तीन वर्ष के बजाय पांच वर्ष होगा।

जुर्माना भी ₹1 करोड़ से बढ़ाकर ₹5 करोड़ कर दिया जाएगा, जबकि अधिकतम सजा दस वर्ष ही रहेगी।

परीक्षा प्राधिकरणों, सेवा प्रदाताओं या अन्य संस्थानों से जुड़े संगठित अपराधों के मामलों में और अधिक कठोर प्रावधान किए गए हैं। ऐसे मामलों में न्यूनतम कारावास पांच वर्ष से बढ़ाकर सात वर्ष तथा न्यूनतम जुर्माना ₹1 करोड़ से बढ़ाकर ₹10 करोड़ करने का प्रस्ताव है।

अधिकतम सजा दस वर्ष ही रहेगी।

विधेयक का सबसे महत्वपूर्ण सुधार जांच और मुकदमों के लिए अनिवार्य समय-सीमा निर्धारित करना माना जा रहा है।

प्रस्तावित नई धारा 12ए के अनुसार, चाहे जांच राज्य पुलिस करे, कोई केंद्रीय जांच एजेंसी करे अथवा केंद्र सरकार द्वारा गठित विशेष कार्यबल—हर स्थिति में जांच दो महीने के भीतर पूरी करना अनिवार्य होगा।

इसके अतिरिक्त प्रत्येक राज्य और केंद्रशासित प्रदेश को इस कानून के तहत मामलों की सुनवाई के लिए विशेष फास्ट-ट्रैक अदालत नामित करनी होगी।

इन अदालतों में रोजाना सुनवाई होगी और केवल अपरिहार्य परिस्थितियों में ही स्थगन दिया जा सकेगा। आरोपपत्र दाखिल होने के तीन महीने के भीतर मुकदमे का निपटारा करने का लक्ष्य रखा गया है।

वर्तमान में लंबित मामलों को भी इन विशेष अदालतों में स्थानांतरित किया जाएगा और स्थानांतरण की तिथि से तीन महीने के भीतर उनका निर्णय करना होगा।

साथ ही प्रत्येक ऐसी अदालत के लिए विशेष लोक अभियोजक की नियुक्ति भी अनिवार्य की जाएगी।

एक अन्य महत्वपूर्ण प्रावधान के तहत केंद्र सरकार को इस कानून के अंतर्गत अपराधों की जांच के लिए विशेष कार्यबल गठित करने का अधिकार मिलेगा।

फिलहाल केंद्र केवल मामलों को केंद्रीय जांच एजेंसियों को स्थानांतरित कर सकता है, लेकिन संशोधन के बाद उसकी जांच संबंधी शक्तियां और अधिक व्यापक हो जाएंगी।

विधेयक में अपील की प्रक्रिया को भी समयबद्ध बनाया गया है। विशेष फास्ट-ट्रैक अदालतों के निर्णय, सजा या अन्य आदेशों के विरुद्ध संबंधित उच्च न्यायालय की खंडपीठ में अपील की जा सकेगी और यथासंभव तीन महीने के भीतर उसका निस्तारण किया जाएगा।

जमानत संबंधी आदेशों के विरुद्ध अपील का अधिकार भी इस संशोधन में शामिल किया गया है।
