Allahabad High Court Ends 33-Year Ordeal of Ghaziabad Homebuyer, Bars GDA From Raising Any Fresh Demand
Prayagraj: Delivering a significant verdict reinforcing the rights of homebuyers against arbitrary actions by development authorities, the Allahabad High Court has brought to a close the three-decade-long legal battle of an elderly woman by setting aside the Ghaziabad Development Authority’s (GDA) recovery proceedings and directing that no additional payment shall be demanded from her in connection with the allotted property.
The judgment was delivered by a Division Bench comprising Justice Saral Srivastava and Justice Garima Prashad, which allowed the writ petition after concluding that the petitioner could not be made to suffer for prolonged delays and administrative shortcomings entirely attributable to the Ghaziabad Development Authority.
The dispute dates back to 1993, when Smt. Manju Parashar was allotted an Economically Weaker Section (EWS) house under the Govindpuram Housing Scheme in Ghaziabad.
Despite the allotment being made, the development authority failed to hand over possession of the house for nearly 18 years, leaving the allottee waiting for a home that had already been assigned to her.
Rather than fulfilling its contractual obligations, the Authority repeatedly revised the cost of the property, altered the original terms of allotment and continued issuing fresh demand notices, including interest and penalty charges.
These repeated revisions compelled the petitioner to wage a prolonged legal battle before the Consumer Forum as well as the Allahabad High Court.
Appearing on behalf of the petitioner, advocate Akshat Sinha argued that once an allotment had been finalised, the Development Authority had no legal justification to unilaterally alter the contractual terms to the disadvantage of the allottee while simultaneously withholding possession of the property.
He further contended that a law-abiding allottee could not be burdened with financial liabilities arising solely from the Authority’s own inaction and administrative failures.
After examining the submissions, the High Court agreed with the petitioner’s arguments and held that an allottee cannot be penalised for delays caused by a statutory development authority.
The Bench observed that making the petitioner pay additional amounts after decades of litigation, particularly after she had already deposited the enhanced cost of the house, would amount to gross injustice and would be contrary to the principles of fairness and equity.
In its final directions, the Court quashed the impugned recovery order, permanently restrained the Ghaziabad Development Authority from raising any further financial demand relating to the allotment, safeguarded the petitioner’s possession of the property and instructed the Authority to complete all remaining legal and administrative formalities within a period of three months.
Bringing an end to a legal struggle that stretched over 33 years, the verdict offers long-awaited relief to an elderly woman who spent a substantial part of her life pursuing possession of a house that had been allotted to her decades earlier.
The ruling restores not only her legal rights but also a sense of dignity after years of uncertainty and litigation.
Legal observers believe the judgment could have far-reaching implications for thousands of homebuyers facing delayed possession, escalating costs and arbitrary recovery notices issued by development authorities.
The ruling reiterates the principle that statutory bodies are expected to function fairly, transparently and responsibly, and cannot derive any advantage from their own administrative lapses or prolonged delays.

प्रयागराज: आवंटियों के अधिकारों की रक्षा करते हुए और विकास प्राधिकरणों की मनमानी पर कड़ा संदेश देते हुए इलाहाबाद हाईकोर्ट ने एक ऐतिहासिक फैसला सुनाया है।
अदालत ने गाजियाबाद विकास प्राधिकरण (जीडीए) की वसूली संबंधी कार्रवाई को निरस्त करते हुए स्पष्ट कर दिया कि संबंधित आवंटी से भविष्य में किसी भी प्रकार की अतिरिक्त धनराशि की मांग नहीं की जाएगी।
इस फैसले के साथ ही एक बुजुर्ग महिला की 33 वर्ष लंबी कानूनी लड़ाई का अंत हो गया।
न्यायमूर्ति सरल श्रीवास्तव और न्यायमूर्ति गरिमा प्रशाद की खंडपीठ ने याचिका स्वीकार करते हुए कहा कि विकास प्राधिकरण की प्रशासनिक लापरवाही और अनावश्यक विलंब का खामियाजा किसी निर्दोष आवंटी को नहीं भुगतना पड़ सकता।
अदालत ने माना कि पूरे मामले में हुई देरी के लिए पूरी तरह गाजियाबाद विकास प्राधिकरण जिम्मेदार था।
मामले की शुरुआत वर्ष 1993 में हुई थी, जब श्रीमती मंजू पराशर को गाजियाबाद के गोविंदपुरम स्थित आर्थिक रूप से कमजोर वर्ग (ईडब्ल्यूएस) आवास योजना के तहत एक मकान आवंटित किया गया था।
आवंटन होने के बावजूद विकास प्राधिकरण ने लगभग 18 वर्षों तक उन्हें मकान का कब्जा नहीं सौंपा, जिससे उन्हें लंबे समय तक अपने ही आवंटित घर से वंचित रहना पड़ा।
स्थिति को सुधारने के बजाय विकास प्राधिकरण लगातार मकान की कीमत में संशोधन करता रहा, आवंटन की शर्तों में बदलाव करता रहा और ब्याज तथा जुर्माने सहित नई-नई मांगें भेजता रहा।
इन परिस्थितियों ने श्रीमती पराशर को उपभोक्ता फोरम से लेकर इलाहाबाद हाईकोर्ट तक लंबी कानूनी लड़ाई लड़ने के लिए मजबूर कर दिया।
याचिकाकर्ता की ओर से अधिवक्ता अक्षत सिन्हा ने अदालत के समक्ष दलील दी कि एक बार आवंटन हो जाने के बाद विकास प्राधिकरण को अनुबंध की शर्तों में एकतरफा बदलाव करने का कोई अधिकार नहीं है, विशेषकर तब जब वह स्वयं वर्षों तक मकान का कब्जा देने में विफल रहा हो।
उन्होंने यह भी कहा कि प्राधिकरण की अपनी प्रशासनिक विफलताओं और देरी का आर्थिक बोझ किसी ईमानदार आवंटी पर नहीं डाला जा सकता।
दोनों पक्षों की दलीलें सुनने के बाद हाईकोर्ट ने माना कि विकास प्राधिकरण की लापरवाही के कारण हुई देरी के लिए आवंटी को जिम्मेदार नहीं ठहराया जा सकता।
अदालत ने कहा कि दशकों तक चले मुकदमे के बाद, जब याचिकाकर्ता पहले ही संशोधित कीमत जमा कर चुकी हैं, तब उनसे अतिरिक्त धनराशि की मांग करना न्याय और समानता के सिद्धांतों के विपरीत होगा।
अपने अंतिम आदेश में हाईकोर्ट ने विवादित वसूली आदेश को निरस्त कर दिया, गाजियाबाद विकास प्राधिकरण को भविष्य में किसी भी प्रकार की अतिरिक्त मांग उठाने से रोक दिया, महिला के मकान पर उनके कब्जे को पूर्ण संरक्षण प्रदान किया तथा प्राधिकरण को निर्देश दिया कि तीन महीने के भीतर सभी शेष वैधानिक और प्रशासनिक औपचारिकताएं पूरी की जाएं।
करीब 33 वर्षों तक चले इस संघर्ष का पटाक्षेप करते हुए अदालत के फैसले ने एक बुजुर्ग महिला को बड़ी राहत पहुंचाई है, जिन्होंने अपने वैधानिक अधिकार और अपने आवंटित घर का कब्जा पाने के लिए जीवन का लंबा समय अदालतों के चक्कर लगाते हुए बिताया।
इस निर्णय ने उन्हें केवल कानूनी जीत ही नहीं, बल्कि वर्षों की अनिश्चितता के बाद सम्मान और मानसिक संतोष भी दिलाया है।
कानूनी विशेषज्ञों का मानना है कि यह फैसला उन हजारों आवंटियों के लिए भी महत्वपूर्ण मिसाल बनेगा, जो विकास प्राधिकरणों द्वारा कब्जा देने में देरी, मनमाने शुल्क और अनुचित वसूली की समस्याओं का सामना कर रहे हैं।
अदालत ने स्पष्ट संदेश दिया है कि वैधानिक संस्थाओं से निष्पक्ष, पारदर्शी और जवाबदेह तरीके से काम करने की अपेक्षा की जाती है तथा वे अपनी ही प्रशासनिक लापरवाही या देरी का लाभ उठाकर नागरिकों पर अतिरिक्त बोझ नहीं डाल सकतीं।
