Allahabad High Court Orders Inquiry Into Ghaziabad Police Over FIR Delay in Sexual Assault Case

Court says police cannot demand WhatsApp chats or call recordings before registering FIR; UP DGP asked to supervise inquiry personally
PRAYAGRAJ/GHAZIABAD: The Allahabad High Court has directed the Uttar Pradesh Director General of Police to conduct an inquiry into the conduct of police officials in Ghaziabad after a woman’s complaint alleging sexual assault, molestation and criminal intimidation was not acted upon promptly.
The court’s order includes scrutiny of the conduct of officials at the Wave City police station and the role of senior officers, including the Ghaziabad Commissioner of Police, over the failure to register an FIR when the complaint allegedly disclosed cognizable offences.
A division bench comprising Justice Chandra Dhari Singh and Justice Tarun Saxena passed the order while dismissing a petition filed by Arpit Gupta, who had sought quashing of an FIR registered against him on the direction of a magistrate.
The court made it clear that the police cannot make registration of an FIR in a cognizable sexual-offence complaint conditional upon the complainant first producing supporting material such as WhatsApp conversations, call recordings or other evidence.
According to the court, determining the truth of the allegations and gathering supporting evidence are matters for the investigation.
At the FIR stage, the police are required to record information disclosing a cognizable offence rather than to decide whether the allegations will ultimately be proved.
Court questions police response
The bench expressed concern over why the Wave City police station did not register a case when the woman approached it with allegations that, on their face, disclosed cognizable offences.
The court also questioned why a subsequent complaint addressed to the Ghaziabad Commissioner of Police on July 7, 2026, did not lead to registration of an FIR or an effective investigation.
The High Court has directed the UP DGP to examine the matter and issue show-cause notices to the Commissioner of Police, the station house officer and other officers concerned, asking them to explain why the FIR was not registered at the appropriate stage.
The DGP has also been directed to personally supervise the inquiry and submit a report to the High Court through a personal affidavit within four weeks.
Woman alleged sexual misconduct by employer
The case arose from allegations made by a woman who was employed by Gupta, described in the proceedings as the owner of real estate firm Parit Associates (OPC) Private Limited.
According to her complaint, she alleged that Gupta subjected her to inappropriate physical conduct inside his office cabin and threatened her against disclosing the alleged incidents.
She further alleged that in March 2026 he digitally raped her by inserting a finger into her private parts. She also alleged that he put his hand inside her top and touched her breasts.
The woman said she subsequently resigned from her job on April 8.
She later alleged that an extortion case was registered against her on April 14. She was arrested in connection with that case and subsequently obtained bail from the High Court.
After her release, she approached the Wave City police with allegations including molestation, digital rape and criminal intimidation.
When she alleged that the police did not take action, she moved the Ghaziabad court seeking directions for registration of an FIR.
Police cited lack of supporting material
Before the magistrate, police officials reportedly said the woman had been asked to provide WhatsApp chats, call recordings or other material supporting her allegations but had not produced such evidence.
The police also suggested that the allegations appeared exaggerated and could have been made as a pressure tactic or as a counterblast to the extortion proceedings.
The magistrate, however, directed the police to register an FIR and investigate the allegations in accordance with law.
Following that direction, an FIR was registered against Gupta under Sections 64, 74, 75(2), 76 and 351(3) of the Bharatiya Nyaya Sanhita (BNS), relating respectively to rape, assault or criminal force against a woman with intent to outrage her modesty, sexual harassment, assault with intent to disrobe and criminal intimidation.
BNS Sections 74, 75 and 76 cover the corresponding offences against women.
Gupta subsequently approached the Allahabad High Court seeking to have the FIR quashed.
High Court refuses to quash FIR
The bench declined to interfere with the criminal proceedings, holding that the allegations required investigation and that the FIR could not be set aside merely because the complainant had not initially produced documentary or electronic material supporting her version.
The court stressed that allegations involving sexual harassment or sexual assault at the workplace demand a sensitive, impartial and legally compliant investigation.
The High Court also underscored the distinction between registration of an FIR and determination of guilt: the former is triggered when information discloses a cognizable offence, while the investigation is the stage at which police collect evidence and assess the allegations.
The judgment was delivered on August 6, 2026.
What the order means
The ruling reinforces an important principle for criminal investigations: a complainant is not expected to conduct the police investigation herself before an FIR is registered.
Once information placed before the police discloses a cognizable offence, the responsibility for investigating the allegations and collecting relevant evidence rests with the investigating agency.
The court’s direction for an inquiry into the conduct of the Ghaziabad police officials now puts the focus on whether the officers complied with their statutory duties when the woman initially approached them.
The inquiry will also examine the role of senior officers, including the Ghaziabad Commissioner of Police, and determine why the complaint did not result in an FIR before the magistrate intervened.
The allegations against Gupta remain allegations unless established in accordance with law. The High Court’s refusal to quash the FIR does not amount to a finding of guilt.

प्रयागराज/गाजियाबाद: यौन उत्पीड़न, छेड़छाड़ और आपराधिक धमकी के आरोप वाली एक महिला की शिकायत पर समय से FIR दर्ज नहीं करने के मामले में इलाहाबाद हाईकोर्ट ने गाजियाबाद पुलिस की कार्यप्रणाली पर गंभीर सवाल उठाए हैं।
अदालत ने उत्तर प्रदेश के पुलिस महानिदेशक (DGP) को पूरे मामले की जांच कराने और संबंधित पुलिस अधिकारियों की भूमिका की पड़ताल करने का निर्देश दिया है।
जस्टिस चंद्र धारी सिंह और जस्टिस तरुण सक्सेना की खंडपीठ ने यह आदेश आरोपी अरपित गुप्ता की याचिका खारिज करते हुए दिया। गुप्ता ने अपने खिलाफ मजिस्ट्रेट के निर्देश पर दर्ज FIR को रद्द करने की मांग की थी।
हाईकोर्ट ने स्पष्ट किया कि किसी संज्ञेय अपराध की सूचना मिलने पर पुलिस शिकायतकर्ता से पहले WhatsApp चैट, कॉल रिकॉर्डिंग या अन्य इलेक्ट्रॉनिक सबूत मांगकर FIR दर्ज करने से पीछे नहीं हट सकती।
शिकायत में संज्ञेय अपराध का खुलासा होने पर उसकी जांच करना और आवश्यक साक्ष्य जुटाना पुलिस की जिम्मेदारी है।
पुलिस की कार्यप्रणाली पर अदालत ने उठाए सवाल
अदालत ने यह जानना जरूरी समझा कि जब महिला ने Wave City थाने में ऐसी शिकायत दी थी, जिसमें प्रथम दृष्टया संज्ञेय अपराधों के आरोप सामने आ रहे थे, तब FIR क्यों दर्ज नहीं की गई।
अदालत ने यह भी सवाल उठाया कि 7 जुलाई 2026 को गाजियाबाद के पुलिस कमिश्नर को दी गई शिकायत के बाद भी FIR दर्ज करने या प्रभावी जांच शुरू करने की दिशा में कार्रवाई क्यों नहीं हुई।
मामले को गंभीरता से लेते हुए हाईकोर्ट ने DGP को Wave City थाने के पुलिसकर्मियों के आचरण और संबंधित अधिकारियों की भूमिका की जांच करने को कहा है।
पुलिस कमिश्नर, थाना प्रभारी और अन्य संबंधित अधिकारियों को नोटिस जारी कर उनसे पूछा जाएगा कि शिकायत मिलने के बाद FIR क्यों दर्ज नहीं की गई।
DGP को जांच की व्यक्तिगत रूप से निगरानी करने और चार सप्ताह के भीतर व्यक्तिगत हलफनामे के माध्यम से हाईकोर्ट में रिपोर्ट दाखिल करने का निर्देश दिया गया है।
कर्मचारी महिला ने लगाए गंभीर आरोप
मामला गुप्ता के यहां काम करने वाली एक महिला की शिकायत से जुड़ा है।
अदालत के समक्ष रखे गए विवरण के अनुसार, महिला ने आरोप लगाया कि गुप्ता अपने केबिन में उसके साथ अशोभनीय व्यवहार करता था और घटना के बारे में किसी को बताने पर उसे धमकाता था।
महिला ने आरोप लगाया कि मार्च 2026 में गुप्ता ने उसकी निजी अंगों में उंगली डालकर उसके साथ डिजिटल रेप किया।
उसने यह भी आरोप लगाया कि गुप्ता ने उसके टॉप के भीतर हाथ डालकर उसके स्तनों को दबाया।
महिला के अनुसार, इन घटनाओं के बाद उसने 8 अप्रैल को नौकरी छोड़ दी।
इसके बाद 14 अप्रैल को उसके खिलाफ कथित तौर पर जबरन वसूली का मुकदमा दर्ज कराया गया। इस मामले में उसे गिरफ्तार किया गया और बाद में हाईकोर्ट से जमानत मिल गई।
रिहाई के बाद महिला ने Wave City थाने में शिकायत देकर छेड़छाड़, डिजिटल रेप और आपराधिक धमकी के आरोप लगाए।
पुलिस से कार्रवाई नहीं होने का आरोप लगाते हुए उसने गाजियाबाद के अतिरिक्त मुख्य न्यायिक मजिस्ट्रेट की अदालत का रुख किया।
पुलिस ने कहा—चैट और रिकॉर्डिंग नहीं दी गई
मजिस्ट्रेट के समक्ष पुलिस की ओर से कहा गया कि महिला से आरोपों के समर्थन में WhatsApp चैट, कॉल रिकॉर्डिंग अथवा अन्य साक्ष्य उपलब्ध कराने को कहा गया था, लेकिन वह ऐसा कोई सामग्री प्रस्तुत नहीं कर सकी।
पुलिस ने यह भी दावा किया कि आरोप बढ़ा-चढ़ाकर लगाए गए प्रतीत होते हैं और संभव है कि वे दबाव बनाने या पहले दर्ज जबरन वसूली के मामले के जवाब में लगाए गए हों।
हालांकि, मजिस्ट्रेट ने पुलिस के तर्क को स्वीकार नहीं किया और कानून के अनुसार FIR दर्ज कर आरोपों की जांच करने का आदेश दिया।
इसके बाद गुप्ता के खिलाफ भारतीय न्याय संहिता (BNS) की धारा 64, 74, 75(2), 76 और 351(3) के तहत FIR दर्ज की गई।
इन धाराओं में क्रमशः बलात्कार, महिला की गरिमा भंग करने के इरादे से हमला या आपराधिक बल का इस्तेमाल, यौन उत्पीड़न, महिला को निर्वस्त्र करने के इरादे से हमला तथा आपराधिक धमकी से संबंधित अपराध शामिल हैं।
इसके बाद गुप्ता ने FIR रद्द कराने के लिए इलाहाबाद हाईकोर्ट में याचिका दाखिल की।
हाईकोर्ट ने FIR रद्द करने से किया इनकार
खंडपीठ ने FIR रद्द करने से इनकार कर दिया।
अदालत ने कहा कि आरोपों की सच्चाई या झूठ का अंतिम निर्धारण FIR दर्ज करने के चरण पर नहीं किया जाना चाहिए। यह जांच के दौरान साक्ष्य जुटाकर तय किया जाना है।
अदालत ने यह भी रेखांकित किया कि कार्यस्थल पर यौन उत्पीड़न या यौन हमले के आरोपों की जांच संवेदनशील, निष्पक्ष और कानून के अनुरूप तरीके से होनी चाहिए।
हाईकोर्ट ने पुलिस की भूमिका को लेकर महत्वपूर्ण अंतर स्पष्ट किया—शिकायतकर्ता से अपराध साबित करने के लिए शुरुआती स्तर पर पूरा साक्ष्य जुटाने की अपेक्षा नहीं की जा सकती।
जब शिकायत में संज्ञेय अपराध का खुलासा हो, तो FIR दर्ज करना और उसके बाद साक्ष्य एकत्र करना जांच एजेंसी की जिम्मेदारी है।
यह फैसला 6 अगस्त 2026 को सुनाया गया।
अदालत के आदेश का व्यापक महत्व
इस आदेश से एक महत्वपूर्ण कानूनी सिद्धांत फिर सामने आया है कि FIR दर्ज कराने के लिए शिकायतकर्ता को स्वयं पुलिस की जांच पूरी करने की आवश्यकता नहीं है।
संज्ञेय अपराध की सूचना मिलने पर पुलिस को कानून के अनुसार कार्रवाई करनी होती है और आरोपों की जांच के दौरान साक्ष्य जुटाने होते हैं।
अब DGP की निगरानी में होने वाली जांच यह देखेगी कि महिला की प्रारंभिक शिकायत पर Wave City पुलिस ने अपनी कानूनी जिम्मेदारी का पालन क्यों नहीं किया।
जांच में वरिष्ठ अधिकारियों की भूमिका भी देखी जाएगी, जिसमें गाजियाबाद के पुलिस कमिश्नर सहित संबंधित अधिकारी शामिल हैं।
हालांकि, अदालत द्वारा FIR रद्द करने से इनकार करना आरोपी को दोषी ठहराना नहीं है। गुप्ता के खिलाफ लगाए गए आरोपों की पुष्टि या खंडन कानून के अनुसार होने वाली जांच और न्यायिक प्रक्रिया में ही होगा।
