Allahabad High Court Protects Five-Time Azan at Saharanpur Mosque, Sets Loudspeaker Conditions

Court says police cannot stop Azan at Ayesha Mosque if petitioners comply with noise rules and an earlier ruling on amplifiers.

PRAYAGRAJ: The Allahabad High Court has cleared the way for five-time Azan at Ayesha Mosque in Saharanpur while making it clear that any use of loudspeakers must remain within the limits prescribed by law.

The order means the Saharanpur police and district administration cannot prevent the petitioners from offering Azan five times a day if they first give a formal undertaking to follow the Noise Pollution (Regulation and Control) Rules, 2000, as well as the court’s earlier ruling governing loudspeakers during Azan.

A division bench of Justice Ajit Kumar and Justice Garima Prashad issued the directions while disposing of a petition filed by Shanawaz Khan and five other Saharanpur residents.

The dispute before the court was not over the performance of Azan itself. The state told the bench that the petitioners were free to recite Azan. The issue concerned the conditions under which an amplification device could be used.

Court links permission to compliance

The petitioners had approached the High Court after alleging that authorities were preventing them from using loudspeakers for Azan despite judicial decisions dealing with the subject.

During the proceedings, the state maintained that there was no prohibition on Azan. Its objection was limited to the operation of loudspeakers, which, it said, must comply with statutory noise limits and restrictions on their use.

The petitioners subsequently assured the court that they would respect those requirements. They agreed to regulate the use of amplification equipment in accordance with both the applicable noise-control regulations and the court’s previous directions.

The bench consequently required the petitioners to submit an application supported by a notarised affidavit. The affidavit must carry their undertaking that they will abide by the Noise Pollution Rules and the directions laid down in the earlier case.

Once that formal undertaking is submitted, the police and district administration have been directed not to obstruct the petitioners from performing Azan five times at the mosque.

2020 ruling remains the governing framework

The court’s latest order draws heavily on its 2020 judgment in Afzal Ansari and two others v. State of UP and two others, which dealt specifically with the use of sound amplification during Azan.

That judgment drew a distinction between Azan itself and the use of electronic equipment to broadcast it.

While the court recognised the religious significance of Azan, it held that amplifying the call through loudspeakers or similar devices could not automatically be treated as an essential part of the religion.

The earlier ruling also made clear that the operation of sound-amplifying equipment is subject to constitutional considerations relating to public order, health and other applicable restrictions.

One of the important restrictions concerned nighttime use. The 2020 judgment held that district authorities could not permit sound-amplifying devices to operate between 10 pm and 6 am.

It further stated that loudspeakers cannot be used without the required permission and that applications for their use must be considered under the law, including the noise pollution regulations.

At the same time, the judgment recognised that a muezzin could deliver Azan from a mosque’s minaret using the human voice without an amplification device.

Authorities retain power to act if undertaking is breached

The latest order does not give the petitioners an unrestricted right to operate loudspeakers.

Instead, the protection granted by the High Court is tied directly to their written undertaking. The district administration and police have been instructed to ensure that the conditions contained in the affidavit are observed.

If the petitioners breach their undertaking or violate the applicable rules, authorities are free to take action in accordance with law.

The order, dated October 1, therefore balances the right to perform Azan with restrictions governing amplified sound. It does not remove the statutory controls on loudspeakers, nor does it permit their unrestricted use.

For the petitioners, the ruling provides judicial protection against interference with the five daily calls to prayer, provided the conditions laid down by the court and the noise-control framework are followed.

नियमों और 2020 के फैसले का पालन करने पर पुलिस अजान में बाधा नहीं डाल सकेगी; उल्लंघन होने पर कार्रवाई की छूट

प्रयागराज: इलाहाबाद हाईकोर्ट ने सहारनपुर की अयशा मस्जिद में दिन में पांच बार अजान किए जाने के रास्ते में प्रशासनिक हस्तक्षेप पर रोक लगा दी है। हालांकि अदालत ने साफ किया है कि लाउडस्पीकर के इस्तेमाल को कानून में तय शोर सीमा और अदालत के पुराने निर्देशों के अनुरूप ही रखना होगा।

अदालत के आदेश के मुताबिक, यदि याचिकाकर्ता लिखित और नोटरीकृत शपथपत्र के जरिए Noise Pollution (Regulation and Control) Rules, 2000 तथा हाईकोर्ट के 2020 के फैसले का पालन करने का वचन देते हैं, तो सहारनपुर पुलिस और जिला प्रशासन उन्हें पांचों वक्त अजान करने से नहीं रोक सकेंगे।

यह आदेश न्यायमूर्ति अजीत कुमार और न्यायमूर्ति गरिमा प्रसाद की खंडपीठ ने सहारनपुर निवासी शनवाज खान और पांच अन्य लोगों की याचिका पर सुनवाई के बाद दिया।

विवाद अजान पर नहीं, लाउडस्पीकर के इस्तेमाल पर था

मामले की सुनवाई के दौरान राज्य सरकार की ओर से अदालत को बताया गया कि याचिकाकर्ताओं को अजान पढ़ने से नहीं रोका जा रहा है। प्रशासन की आपत्ति केवल अजान के लिए लाउडस्पीकर के इस्तेमाल के तरीके को लेकर है।

याचिकाकर्ताओं का कहना था कि अदालतों के पुराने फैसलों में लाउडस्पीकर के इस्तेमाल से संबंधित व्यवस्था होने के बावजूद उन्हें मस्जिद में अजान के लिए इसका इस्तेमाल नहीं करने दिया जा रहा था।

सुनवाई के दौरान याचिकाकर्ताओं ने अदालत को भरोसा दिया कि वे ध्वनि विस्तारक यंत्रों के इस्तेमाल में निर्धारित कानूनी प्रावधानों का पालन करेंगे। उन्होंने यह भी स्वीकार किया कि इस संबंध में हाईकोर्ट के पहले के निर्देशों का पालन करना होगा।

इसके बाद खंडपीठ ने याचिकाकर्ताओं से नोटरीकृत शपथपत्र के साथ औपचारिक आवेदन देने को कहा। इसमें उन्हें यह लिखित आश्वासन देना होगा कि वे शोर नियंत्रण नियमों और अदालत के पुराने निर्देशों का उल्लंघन नहीं करेंगे।

यह औपचारिकता पूरी होने के बाद पुलिस और जिला प्रशासन को अयशा मस्जिद में पांचों वक्त अजान किए जाने में हस्तक्षेप नहीं करने का निर्देश दिया गया है।

2020 के फैसले में अजान और लाउडस्पीकर में किया गया था अंतर

मौजूदा मामले में अदालत ने अपने 2020 के फैसले अफजल अंसारी एवं अन्य बनाम उत्तर प्रदेश राज्य एवं अन्य में तय किए गए सिद्धांतों को आधार बनाया।

उस फैसले में हाईकोर्ट ने अजान और उसे प्रसारित करने के लिए इलेक्ट्रॉनिक ध्वनि विस्तारक उपकरणों के इस्तेमाल को अलग-अलग माना था। अदालत ने माना था कि अजान इस्लाम का महत्वपूर्ण धार्मिक हिस्सा हो सकती है, लेकिन लाउडस्पीकर या दूसरे ध्वनि विस्तारक उपकरण के जरिए अजान देना धर्म का अनिवार्य हिस्सा नहीं माना जा सकता।

अदालत ने यह भी स्पष्ट किया था कि ध्वनि विस्तारक यंत्रों का इस्तेमाल सार्वजनिक व्यवस्था, स्वास्थ्य और संविधान के तहत लागू अन्य प्रावधानों के अधीन रहेगा।

2020 के फैसले में रात के समय लाउडस्पीकर के इस्तेमाल पर भी स्पष्ट सीमा बताई गई थी। जिला प्रशासन रात 10 बजे से सुबह 6 बजे के बीच ध्वनि विस्तारक यंत्रों के इस्तेमाल की अनुमति नहीं दे सकता।

इसके अलावा बिना अनुमति लाउडस्पीकर चलाना भी कानूनी रूप से स्वीकार्य नहीं माना गया था। ऐसे उपकरणों के इस्तेमाल की अनुमति से जुड़े आवेदनों पर Noise Pollution Rules सहित लागू कानूनों के अनुसार फैसला किए जाने की बात कही गई थी।

वहीं, अदालत ने यह भी स्पष्ट किया था कि मस्जिद की मीनार से बिना किसी ध्वनि विस्तारक उपकरण के मानवीय आवाज में मुअज्जिन अजान दे सकता है।

नियम तोड़े तो प्रशासन कर सकेगा कार्रवाई

हाईकोर्ट के ताजा आदेश को लाउडस्पीकर के बेरोकटोक इस्तेमाल की अनुमति के तौर पर नहीं देखा जा सकता। अदालत ने याचिकाकर्ताओं को राहत उनके लिखित आश्वासन के आधार पर दी है।

पुलिस और जिला प्रशासन को यह सुनिश्चित करने की जिम्मेदारी दी गई है कि शपथपत्र में किए गए वादे का पालन हो। यदि याचिकाकर्ता अपने आश्वासन या लागू नियमों का उल्लंघन करते हैं, तो अधिकारियों को कानून के मुताबिक उचित कार्रवाई करने की स्वतंत्रता होगी।

1 अक्टूबर को दिए गए इस आदेश में अदालत ने धार्मिक गतिविधि और ध्वनि प्रदूषण से जुड़े कानूनी प्रतिबंधों के बीच संतुलन कायम किया है।

इसका सीधा अर्थ यह है कि अयशा मस्जिद में पांचों वक्त अजान पर प्रशासन रोक नहीं लगा सकता, लेकिन लाउडस्पीकर का इस्तेमाल निर्धारित नियमों और हाईकोर्ट के पूर्व निर्देशों के दायरे में ही करना होगा।
