New Delhi: Nagaland Chief Minister Neiphiu Rio has joined the growing opposition from the Northeast to the proposed amendments to the Foreign Contribution (Regulation) Act (FCRA), urging Union Home Minister Amit Shah to send the legislation to a Joint Parliamentary Committee for a detailed examination.
Rio’s intervention makes him the third chief minister from the region to formally raise concerns over the proposed FCRA Amendment Bill, 2026.
Mizoram Chief Minister Lalduhoma and Meghalaya Chief Minister Conrad Sangma have also engaged the Centre over concerns expressed by Christian organisations in their respective states.
In a three-page letter dated August 9, Rio told Shah that he had held detailed discussions with Christian leaders, representatives of the Nagaland Baptist Church Council and the Bishop of Kohima.
According to Rio, they had outlined difficulties faced by churches and Christian organisations in conducting humanitarian, educational, healthcare and social-service programmes.
The Nagaland chief minister said the proposed changes, if enacted in their current form, could make those difficulties more severe, particularly for smaller institutions operating at the grassroots level.
He highlighted the dependence of many such organisations on limited resources while providing services in remote, economically disadvantaged and underserved areas.
Rio asked the Centre to consider referring the Bill to a Joint Parliamentary Committee, allowing wider consultation before any final decision.
The intervention comes amid uncertainty over whether the government will bring the FCRA Bill up for discussion during the ongoing Parliament session.
Mizoram’s Lalduhoma had indicated last week that the legislation could come up for debate on August 12.
However, the Business Advisory Committee, which considered the parliamentary schedule last week and again on Monday, did not allocate time for the Bill.
That has led to speculation that the government may not seek to pass the legislation during the current session.
The Centre, meanwhile, says consultations are continuing.
A senior minister said the government had sought additional suggestions from groups that met Shah last week but had not received further inputs despite reminders.
The government has also sought to address one of the principal concerns raised during the consultations by assuring stakeholders that the proposed law would not operate retrospectively.
The minister said the government had already made clear that the provisions would not adversely affect any particular faith or community.
The proposed legislation was introduced in the Lok Sabha during the Budget Session in March.
It had previously generated strong political opposition and failed to progress to passage amid protests, including controversy in Kerala ahead of the state’s Assembly elections.
Much of the concern among Christian organisations centres on provisions dealing with the status and assets of organisations whose FCRA registration expires, is not renewed or is cancelled.
The Bill proposes a framework under which a designated authority could oversee the vesting, management and disposal of foreign contributions and assets in specified circumstances.
The proposed provisions would also allow the government-appointed authority to take control of, manage or dispose of assets created using foreign contributions when an organisation’s FCRA registration is cancelled, suspended or not renewed.
Opposition groups and religious organisations have argued that such provisions could have significant consequences for charitable institutions, including schools, hospitals, orphanages, homes for the elderly and other welfare establishments.
The issue has acquired particular political sensitivity in the Northeast because of the region’s large Christian populations.
According to the figures cited in the material, Christians account for 87.93% of Nagaland’s population, 87% of Mizoram’s and 74% of Meghalaya’s.
Lalduhoma met Shah last Thursday with senior Christian leaders from Mizoram, including representatives of the Council of Churches in Mizoram and the Mizoram Kohhran Hruaitute Committee.
The delegation submitted a memorandum outlining six concerns.
Lalduhoma said the Centre had assured them that the proposed law would not have retrospective effect.
He added that Shah had indicated that responses to the delegation’s other concerns would be provided in writing.
On the same day, DMK Rajya Sabha MP P Wilson, who heads the Joint Action Forum on Minorities, also met Shah with religious representatives from different denominations.
Wilson said the delegation sought withdrawal of the legislation in its present form.
As an alternative, it called for referral of the Bill to a Joint Parliamentary Committee for consultation with stakeholders and examination of its constitutional, legal and practical implications.
The delegation also sought repeal of Section 15 of the existing FCRA, arguing that provisions allowing foreign contributions or charitable assets to be vested should not remain in any form.
According to Wilson, the proposed changes could substantially alter the existing regulatory system by introducing provisions concerning automatic cessation of registration, government control over institutions and the vesting or permanent transfer of charitable assets.
Meghalaya Chief Minister Conrad Sangma had earlier met Shah with a delegation of church leaders.
According to a person familiar with that meeting, Sangma urged the Centre to protect the constitutional rights of minority institutions while maintaining transparency and regulatory oversight.
The delegation also submitted copies of amendments proposed by churches in Meghalaya.
The government, however, maintains that its objective is to improve regulation and transparency and that stakeholder concerns are being considered as part of the consultation process.
With the Business Advisory Committee yet to earmark time for the FCRA Bill and several Northeast leaders pressing for wider scrutiny, the legislation’s immediate parliamentary fate remains uncertain.
The next indication is likely to come from the government’s final scheduling decisions for the remaining days of the session.

नई दिल्ली: नागालैंड के मुख्यमंत्री नेइफ्यू रियो ने विदेशी अंशदान विनियमन अधिनियम यानी FCRA में प्रस्तावित बदलावों को लेकर केंद्रीय गृह मंत्री अमित शाह को पत्र लिखकर चिंता जताई है।
उन्होंने मांग की है कि FCRA संशोधन विधेयक, 2026 को व्यापक जांच और हितधारकों से विचार-विमर्श के लिए संयुक्त संसदीय समिति के पास भेजा जाए।
रियो इस मुद्दे पर केंद्र के समक्ष औपचारिक रूप से चिंता रखने वाले पूर्वोत्तर के तीसरे मुख्यमंत्री बन गए हैं। इससे पहले मिजोरम के मुख्यमंत्री लालदुहोमा और मेघालय के मुख्यमंत्री कॉनराड संगमा भी प्रस्तावित कानून को लेकर केंद्र से चर्चा कर चुके हैं।
9 अगस्त को लिखे गए तीन पन्नों के पत्र में रियो ने कहा कि उन्होंने ईसाई धर्मगुरुओं, नागालैंड बैपटिस्ट चर्च काउंसिल (NBCC) के प्रतिनिधियों और कोहिमा के बिशप के साथ विस्तार से बातचीत की है।
उनके अनुसार, चर्च और ईसाई संस्थाओं ने अपने मानवीय, शैक्षणिक, स्वास्थ्य तथा सामाजिक सेवा कार्यक्रमों के संचालन में सामने आ रही कठिनाइयों से उन्हें अवगत कराया।
रियो ने कहा कि यदि प्रस्तावित संशोधन मौजूदा स्वरूप में लागू किए जाते हैं, तो इन संस्थाओं की मुश्किलें और बढ़ सकती हैं।
उन्होंने विशेष रूप से उन छोटे संस्थानों का उल्लेख किया जो सीमित संसाधनों के बावजूद दूरदराज, आर्थिक रूप से कमजोर और सुविधाओं से वंचित समुदायों तक सेवाएं पहुंचाते हैं।
नागालैंड के मुख्यमंत्री ने केंद्र से आग्रह किया कि विधेयक को संयुक्त संसदीय समिति के पास भेजकर व्यापक विचार-विमर्श कराया जाए और उसके बाद ही आगे की कार्रवाई की जाए।
रियो का यह कदम ऐसे समय आया है जब संसद के मौजूदा सत्र में FCRA विधेयक के भविष्य को लेकर भी स्थिति स्पष्ट नहीं है।
मिजोरम के मुख्यमंत्री लालदुहोमा ने पिछले सप्ताह संकेत दिया था कि विधेयक पर 12 अगस्त को चर्चा हो सकती है।
लेकिन पिछले सप्ताह और सोमवार को हुई बिजनेस एडवाइजरी कमेटी की बैठकों में FCRA विधेयक के लिए समय आवंटित नहीं किया गया।
इसके बाद यह अटकलें तेज हो गई हैं कि सरकार मौजूदा सत्र में विधेयक को पारित कराने की कोशिश शायद न करे।
उधर, केंद्र सरकार का कहना है कि विधेयक को लेकर संबंधित पक्षों के साथ बातचीत जारी है।
एक वरिष्ठ मंत्री के अनुसार, गृह मंत्री अमित शाह से मुलाकात करने वाले कुछ समूहों से अतिरिक्त सुझाव मांगे गए थे, लेकिन याद दिलाए जाने के बावजूद अभी तक वे सुझाव प्राप्त नहीं हुए हैं।
सरकार ने यह भी स्पष्ट किया है कि प्रस्तावित कानून को पूर्वव्यापी यानी रेट्रोस्पेक्टिव तरीके से लागू नहीं किया जाएगा।
मंत्री के अनुसार, सरकार पहले ही यह आश्वासन दे चुकी है कि विधेयक के प्रावधान किसी धर्म या समुदाय को प्रतिकूल रूप से प्रभावित करने के उद्देश्य से लागू नहीं किए जाएंगे।
प्रस्तावित विधेयक मार्च में बजट सत्र के दौरान लोकसभा में पेश किया गया था।
इससे पहले भी इसे विपक्ष के विरोध और विशेष रूप से चुनावी दौर से गुजर रहे केरल में ईसाई संगठनों की आपत्तियों के कारण तीखी राजनीतिक प्रतिक्रिया का सामना करना पड़ा था।
विवाद का एक प्रमुख कारण उन प्रावधानों को लेकर है जो FCRA पंजीकरण समाप्त होने, नवीनीकरण नहीं होने या पंजीकरण रद्द किए जाने की स्थिति में संबंधित संस्थाओं की विदेशी अंशदान से बनी संपत्तियों के भविष्य से जुड़े हैं।
प्रस्तावित संशोधनों में विदेशी अंशदान और उससे बनी संपत्तियों के हस्तांतरण, निगरानी, प्रबंधन और निपटान के लिए एक नामित प्राधिकरण की व्यवस्था का प्रावधान है।
कुछ परिस्थितियों में सरकार द्वारा नियुक्त यह प्राधिकरण उन संपत्तियों को अपने नियंत्रण में ले सकता है, उनका प्रबंधन कर सकता है या उन्हें बेच सकता है, जो विदेशी अंशदान से किसी गैर-सरकारी संगठन द्वारा बनाई गई हों और जिसका FCRA लाइसेंस रद्द, निलंबित या नवीनीकृत नहीं किया गया हो।
विपक्षी नेताओं और धार्मिक संगठनों का कहना है कि ऐसे प्रावधानों का स्कूलों, अस्पतालों, अनाथालयों, वृद्धाश्रमों और अन्य धर्मार्थ संस्थाओं पर व्यापक प्रभाव पड़ सकता है।
पूर्वोत्तर में यह मुद्दा इसलिए भी संवेदनशील है क्योंकि नागालैंड, मिजोरम और मेघालय में ईसाई आबादी का अनुपात काफी अधिक है।
उपलब्ध आंकड़ों के अनुसार, नागालैंड की आबादी में ईसाइयों की हिस्सेदारी 87.93 प्रतिशत, मिजोरम में 87 प्रतिशत और मेघालय में 74 प्रतिशत है।
पिछले गुरुवार को लालदुहोमा ने वरिष्ठ ईसाई नेताओं के प्रतिनिधिमंडल के साथ अमित शाह से मुलाकात की थी।
प्रतिनिधिमंडल में काउंसिल ऑफ चर्चेज इन मिजोरम और मिजोरम कोहरान ह्रुइतुते कमेटी के प्रतिनिधि भी शामिल थे। प्रतिनिधिमंडल ने विधेयक को लेकर छह प्रमुख चिंताएं सामने रखी थीं।
बैठक के बाद लालदुहोमा ने कहा था कि उन्हें यह आश्वासन मिला है कि कानून का पूर्वव्यापी प्रभाव नहीं होगा।
उन्होंने यह भी बताया कि अन्य मुद्दों पर गृह मंत्री की ओर से लिखित जवाब दिए जाने की बात कही गई है।
इसी दिन डीएमके के राज्यसभा सांसद पी. विल्सन ने भी विभिन्न संप्रदायों के धार्मिक नेताओं के प्रतिनिधिमंडल के साथ शाह से मुलाकात की थी।

विल्सन के अनुसार, प्रतिनिधिमंडल ने मौजूदा स्वरूप में विधेयक वापस लेने की मांग की। वैकल्पिक तौर पर संयुक्त संसदीय समिति को भेजकर सभी संबंधित पक्षों से व्यापक विचार-विमर्श और विधेयक के संवैधानिक, कानूनी तथा व्यावहारिक प्रभावों की विस्तृत जांच कराने की मांग की गई।
प्रतिनिधिमंडल ने FCRA की धारा 15 को हटाने की मांग भी रखी।
उसका तर्क था कि विदेशी अंशदान या धर्मार्थ संपत्तियों को सरकारी नियंत्रण में लेने की अनुमति देने वाला कोई प्रावधान किसी भी रूप में कायम नहीं रहना चाहिए।
विल्सन के मुताबिक, प्रस्तावित संशोधनों से मौजूदा नियामकीय व्यवस्था में बड़ा बदलाव आ सकता है।
इनमें पंजीकरण स्वतः समाप्त होने, संस्थाओं के प्रबंधन में सरकारी भूमिका तथा धर्मार्थ संपत्तियों के हस्तांतरण या स्थायी नियंत्रण जैसे प्रावधान शामिल हैं।
मेघालय के मुख्यमंत्री कॉनराड संगमा भी पिछले महीने चर्च नेताओं के प्रतिनिधिमंडल के साथ अमित शाह से मिल चुके हैं।
घटनाक्रम की जानकारी रखने वाले एक व्यक्ति के अनुसार, संगमा ने केंद्र से अल्पसंख्यक संस्थानों के संवैधानिक अधिकारों की रक्षा करने का आग्रह किया था।
प्रतिनिधिमंडल ने मेघालय के चर्च संगठनों द्वारा सुझाए गए संशोधनों की प्रतियां भी सरकार को दी थीं।
केंद्र सरकार का कहना है कि विधेयक का उद्देश्य FCRA व्यवस्था में पारदर्शिता और नियमन को मजबूत करना है तथा हितधारकों की चिंताओं पर बातचीत के माध्यम से विचार किया जा रहा है।
हालांकि, बिजनेस एडवाइजरी कमेटी द्वारा अभी तक विधेयक के लिए समय निर्धारित नहीं किए जाने और पूर्वोत्तर के कई मुख्यमंत्रियों द्वारा इसे संयुक्त संसदीय समिति के पास भेजने की मांग किए जाने से मौजूदा सत्र में इसकी स्थिति अनिश्चित बनी हुई है।
अब सबकी नजर संसद के बचे हुए दिनों की कार्यसूची पर है। इसी से स्पष्ट होगा कि सरकार FCRA संशोधन विधेयक को मौजूदा सत्र में चर्चा और पारित कराने के लिए आगे बढ़ाती है या इसे फिलहाल टाल दिया जाता है।
