Justice Yashwant Varma Cash Case: Inquiry Panel Finds All Three Charges Proved
Parliament tables 126-page report; panel says former Allahabad High Court judge failed to satisfactorily explain cash found at official residence, but ownership of money was not conclusively established
A three-member statutory inquiry committee has found all three charges framed against former Allahabad High Court judge Justice Yashwant Varma proved in connection with the discovery of a large quantity of unaccounted currency at his official residence in New Delhi.
The 126-page report, tabled in both Houses of Parliament on Wednesday, stops short of concluding that Justice Varma personally owned the cash, saying there was insufficient evidence to establish individual ownership.
But the committee rejected his contention that he had no knowledge of the currency or responsibility for what happened to it after it was discovered following a fire at the residence on March 14, 2025.
The findings represent the most significant formal adverse conclusion yet in the controversy that has engulfed Justice Varma since the cash discovery.
The inquiry committee said the overall evidence established the presence of substantial currency at the official premises, the inability of Justice Varma to provide a satisfactory explanation for it, the failure to preserve the material and its subsequent disappearance from the site.
The panel also concluded that there was no sufficiently substantiated defence capable of overcoming the evidence placed before it.
Committee rejects claim that storeroom was outside Varma’s control
The committee examined Justice Varma’s argument that the storeroom where the cash was found was effectively beyond his control.
It did not accept that contention.
The panel took note of evidence relating to a locked cabinet containing the judge’s personal belongings inside the room and concluded that the circumstances established a sufficient connection between Justice Varma and the premises.
On that basis, the first article of charge was held proved.
The inquiry panel comprised Supreme Court judge Justice Aravind Kumar, then Chief Justice of the Bombay High Court Justice Shrikrishna Chandrashekhar, who has since been elevated to the Supreme Court, and senior advocate BV Acharya.
Panel criticises Varma’s explanations
The committee also scrutinised the successive explanations offered by Justice Varma during the proceedings.
It considered his initial position that he did not know the cash and his later allegations that the currency had been planted as part of a conspiracy.
His objections concerning the manner in which evidence was collected and preserved were also examined.
The committee concluded that these explanations did not adequately account for the cash discovered at the premises or undermine the evidence before it.
A further adverse inference was drawn from Justice Varma’s decision not to appear in the witness box and face cross-examination.
The panel described parts of his defence as false and characterised his overall explanation as evasive and misleading. The third article of charge was consequently also held proved.
How the cash controversy began
The controversy dates back to March 14, 2025, when a fire broke out at Justice Varma’s official residence in New Delhi while he was serving as a Delhi High Court judge.
During the firefighting operation, burnt and partially burnt currency notes were discovered in a storeroom on the premises.
The incident triggered an in-house inquiry ordered by then Chief Justice of India Sanjiv Khanna.
After the internal inquiry found Justice Varma’s explanation unsatisfactory, CJI Khanna asked him to resign or face the constitutional process for removal.
Justice Varma declined to resign at that stage, following which the report was forwarded to the President and Prime Minister.
A parliamentary removal process subsequently began after a motion against him was admitted in the Lok Sabha and a statutory inquiry committee was constituted.
Justice Varma maintained his opposition to the allegations and challenged aspects of the inquiry process.
Justice Varma resigned during parliamentary inquiry
Justice Varma eventually resigned from judicial office on April 9, 2026, while the parliamentary inquiry was still in progress.
He also withdrew from the committee proceedings, alleging that the process was unfair.
The committee nevertheless completed its statutory work and submitted its report to Lok Sabha Speaker Om Birla in May.
The report was subsequently scheduled for consideration by Parliament and was tabled in both Houses on Wednesday.
The resignation has created an unusual constitutional and legal question over the consequences of the committee’s findings.
Earlier reports indicated that Justice Varma’s resignation had been viewed as bringing the removal proceedings to an end because impeachment is a mechanism for removing a sitting judge.
At the same time, the decision to table the report has kept alive debate over whether Parliament can take any further action in light of findings concerning conduct while he held judicial office.
Ownership of cash not conclusively established
One of the important qualifications in the committee’s findings is that it did not conclude that the currency belonged personally to Justice Varma.
Instead, the panel focused on the circumstances surrounding the presence of the money at his official premises, his inability to provide what it considered a satisfactory explanation, and the subsequent non-availability of the currency.
That distinction is significant because a finding that the charges were proved is not identical to a finding that the judge personally owned every rupee recovered or that the cash was conclusively linked to him as personal property.
The report, however, found that his explanations were insufficient to displace the evidence presented before the committee.
A case with wider implications for judicial accountability
The findings are likely to intensify the national debate over accountability mechanisms for judges of India’s higher judiciary.
The Justice Varma episode has exposed the constitutional difficulty of dealing with allegations of misconduct when a judge facing removal proceedings resigns before Parliament completes the process.
The committee’s report now provides a formal statutory record of its conclusions, even as questions remain about what legal or parliamentary consequences, if any, can follow after his resignation.
For now, the committee has placed its central conclusion on record: all three articles of charge were proved, while the evidence did not establish personal ownership of the cash to the required degree.
The report’s tabling therefore marks a new phase in a controversy that began with a fire at a judge’s official residence and evolved into one of India’s most closely watched judicial accountability cases.

नई दिल्ली: इलाहाबाद हाईकोर्ट के पूर्व न्यायाधीश जस्टिस यशवंत वर्मा के सरकारी आवास से कथित तौर पर मिली बेहिसाब नकदी के मामले में गठित तीन सदस्यीय वैधानिक जांच समिति ने उनके खिलाफ लगाए गए तीनों आरोपों को साबित माना है।
126 पन्नों की समिति की रिपोर्ट बुधवार को संसद के दोनों सदनों में पेश की गई। हालांकि, रिपोर्ट ने यह निष्कर्ष नहीं निकाला कि बरामद नकदी व्यक्तिगत रूप से जस्टिस वर्मा की थी।
समिति ने कहा कि उपलब्ध साक्ष्य से धन पर उनकी व्यक्तिगत मिल्कियत निर्णायक रूप से स्थापित नहीं होती।
लेकिन पैनल ने यह तर्क स्वीकार नहीं किया कि उन्हें नकदी की जानकारी नहीं थी या आग लगने के बाद उसके साथ क्या हुआ, इसकी उनकी कोई जिम्मेदारी नहीं थी।
समिति के अनुसार, सरकारी आवास में बड़ी मात्रा में नकदी की मौजूदगी, उसकी संतोषजनक व्याख्या करने में विफलता, सामग्री को सुरक्षित नहीं रखे जाने और बाद में नकदी के उपलब्ध नहीं रहने जैसे तथ्यों का समग्र रिकॉर्ड सामने मौजूद था।
समिति को ऐसा कोई ठोस बचाव भी नहीं मिला जो उसके समक्ष पेश साक्ष्यों को निष्प्रभावी कर सके।
स्टोर रूम पर नियंत्रण का दावा नहीं माना
जांच समिति ने जस्टिस वर्मा के उस तर्क को भी खारिज कर दिया कि जिस स्टोर रूम में नकदी मिली, वह उनके नियंत्रण से बाहर था।
पैनल ने उस कमरे में रखी एक बंद अलमारी से जुड़े साक्ष्यों पर ध्यान दिया, जिसमें जस्टिस वर्मा का निजी सामान रखा था।
इन परिस्थितियों के आधार पर समिति ने माना कि उस परिसर के साथ न्यायाधीश का पर्याप्त संबंध स्थापित होता है।
इसी आधार पर पहले आरोप को साबित माना गया।
समिति में सुप्रीम कोर्ट के न्यायाधीश जस्टिस अरविंद कुमार, तत्कालीन बॉम्बे हाईकोर्ट के मुख्य न्यायाधीश जस्टिस श्रीकृष्ण चंद्रशेखर—जो बाद में सुप्रीम कोर्ट में पदोन्नत हुए—और वरिष्ठ अधिवक्ता बीवी आचार्य शामिल थे।
जस्टिस वर्मा की सफाई पर भी सवाल
पैनल ने जांच के दौरान जस्टिस वर्मा की ओर से दिए गए अलग-अलग स्पष्टीकरणों की भी विस्तार से समीक्षा की।
शुरुआत में उन्होंने नकदी के बारे में जानकारी होने से इनकार किया था। बाद में उन्होंने नकदी रखे जाने को कथित साजिश और उसे फंसाने की कोशिश से जोड़ा। उन्होंने साक्ष्यों को जुटाने और सुरक्षित रखने के तरीके पर भी सवाल उठाए।
लेकिन समिति के अनुसार, ये दलीलें उस नकदी की मौजूदगी का संतोषजनक जवाब नहीं दे सकीं और न ही जांच के दौरान सामने आए साक्ष्यों को कमजोर कर पाईं।
जस्टिस वर्मा के गवाह के रूप में पेश होकर जिरह का सामना नहीं करने के फैसले को भी समिति ने उनके खिलाफ प्रतिकूल निष्कर्ष निकालने का आधार माना।
पैनल ने उनके बचाव के कुछ हिस्सों को गलत बताया और समग्र स्पष्टीकरण को टालमटोल वाला तथा भ्रामक माना। इसके आधार पर तीसरे आरोप को भी साबित कर दिया गया।
मार्च 2025 में आग के बाद सामने आया था मामला
यह पूरा विवाद 14 मार्च 2025 को शुरू हुआ, जब नई दिल्ली स्थित जस्टिस वर्मा के सरकारी आवास में आग लग गई थी।
उस समय वह दिल्ली हाईकोर्ट के न्यायाधीश थे। आग बुझाने की कार्रवाई के दौरान परिसर के एक स्टोर रूम में जली और आंशिक रूप से जली हुई मुद्रा मिलने की बात सामने आई।
घटना के बाद तत्कालीन भारत के मुख्य न्यायाधीश जस्टिस संजीव खन्ना ने इन-हाउस जांच का आदेश दिया।
आंतरिक जांच में जस्टिस वर्मा की सफाई को संतोषजनक नहीं पाए जाने के बाद तत्कालीन CJI ने उनसे इस्तीफा देने या संवैधानिक रूप से हटाए जाने की प्रक्रिया का सामना करने को कहा।
उस समय जस्टिस वर्मा ने इस्तीफा देने से इनकार किया और रिपोर्ट राष्ट्रपति तथा प्रधानमंत्री को भेज दी गई।
इसके बाद लोकसभा में उनके खिलाफ हटाने का प्रस्ताव स्वीकार किया गया और Judges (Inquiry) Act के तहत वैधानिक जांच समिति गठित की गई।
जांच पूरी होने से पहले दिया इस्तीफा
जस्टिस वर्मा ने अंततः 9 अप्रैल 2026 को न्यायिक पद से इस्तीफा दे दिया। उस समय उनके खिलाफ संसदीय जांच जारी थी। उन्होंने समिति की कार्यवाही से भी खुद को अलग कर लिया और प्रक्रिया की निष्पक्षता पर सवाल उठाए।
इसके बावजूद समिति ने अपनी वैधानिक प्रक्रिया पूरी की और मई में अपनी रिपोर्ट लोकसभा अध्यक्ष ओम बिरला को सौंप दी। बाद में रिपोर्ट को संसद में पेश किए जाने की प्रक्रिया आगे बढ़ी।
उनके इस्तीफे के कारण मामला अब एक असामान्य संवैधानिक स्थिति में पहुंच गया है। आम तौर पर महाभियोग जैसी प्रक्रिया किसी पद पर कार्यरत न्यायाधीश को हटाने के लिए होती है।
जस्टिस वर्मा के इस्तीफे के बाद यह सवाल उठ रहा है कि उनके खिलाफ संसद की आगे की कार्रवाई की संवैधानिक सीमा क्या होगी।
नकदी की व्यक्तिगत मिल्कियत पर समिति ने नहीं दी निर्णायक राय
रिपोर्ट का एक महत्वपूर्ण पहलू यह है कि समिति ने यह नहीं कहा कि बरामद पूरी नकदी व्यक्तिगत रूप से जस्टिस वर्मा की थी।
इसके बजाय जांच का जोर इस बात पर रहा कि नकदी सरकारी आवास के परिसर में मौजूद थी, जस्टिस वर्मा उसकी संतोषजनक व्याख्या नहीं कर सके और बाद में वह नकदी उपलब्ध नहीं रही।
इस अंतर का कानूनी महत्व है। तीनों आरोपों के साबित होने का निष्कर्ष अपने आप में यह साबित नहीं करता कि बरामद प्रत्येक नोट जस्टिस वर्मा की निजी संपत्ति था।
फिर भी समिति ने यह माना कि उनकी ओर से दिया गया बचाव उसके सामने मौजूद साक्ष्यों को खारिज करने के लिए पर्याप्त नहीं था।
न्यायिक जवाबदेही पर बढ़ेगी बहस
जस्टिस वर्मा मामले की रिपोर्ट न्यायपालिका की जवाबदेही को लेकर एक बड़ी संवैधानिक बहस को फिर सामने ला सकती है।
मामले ने यह जटिल सवाल भी खड़ा किया है कि यदि किसी उच्च न्यायालय के न्यायाधीश के खिलाफ हटाने की प्रक्रिया शुरू हो और वह संसद की प्रक्रिया पूरी होने से पहले इस्तीफा दे दे, तो जांच में सामने आए निष्कर्षों का आगे क्या संवैधानिक प्रभाव होगा।
अब समिति की रिपोर्ट ने अपने निष्कर्ष औपचारिक रूप से दर्ज कर दिए हैं—तीनों आरोप साबित पाए गए, लेकिन नकदी की व्यक्तिगत मिल्कियत जस्टिस वर्मा से निर्णायक रूप से जोड़ने के लिए पर्याप्त साक्ष्य नहीं मिला।
इस तरह 14 मार्च 2025 को सरकारी आवास में लगी आग से शुरू हुआ विवाद अब न्यायिक जवाबदेही, संवैधानिक प्रक्रिया और संसद की शक्तियों से जुड़े एक असाधारण मामले में बदल चुका है।
