Allahabad High Court Questions Repeated Police Interference in Consenting Adults’ Marriage Disputes
The Allahabad High Court expressed strong concern over repeated police intervention in cases involving marriages between consenting adults.
The court observed that the role of the police is to investigate criminal offences, not to interfere in lawful marriages.
It remarked that despite several judicial directions on the issue, unnecessary police involvement continues.
During the hearing, a bench comprising Justice Munishwar Nath Bhandari and Justice Anil Kumar took note of allegations that the father of the woman’s partner had been repeatedly summoned to the police station and pressured in connection with the case.
Seeking an explanation, the court issued a notice to the Station House Officer (SHO) of Sarai Khwaja police station in Jaunpur, asking him to clarify the reasons behind his actions.
The matter relates to a petition filed before the High Court by a Jaunpur resident, who alleged harassment by the police after a woman voluntarily married a man of her own choice.
An FIR had earlier been registered against the man on charges of kidnapping. However, the court noted that his arrest had already been stayed in August 2024.
The High Court further observed that the woman had already submitted her statement before the trial court, and the police had also filed the final report in the case.
Despite these developments, the petition alleged that the man’s father continued to be summoned to the police station and subjected to harassment.
Questioning the conduct of the police, the bench asked how the man’s elderly father could still be called to the police station after the final report had already been filed. The court has fixed the matter for August for its next hearing.

इलाहाबाद हाईकोर्ट ने बालिग युवक-युवती की सहमति से हुई शादी के मामलों में पुलिस की बार-बार दखलअंदाजी पर गंभीर नाराजगी जताई है।
अदालत ने स्पष्ट किया कि पुलिस का दायित्व अपराधों की जांच करना है, न कि वैध वैवाहिक संबंधों में अनावश्यक हस्तक्षेप करना। कोर्ट ने कहा कि पूर्व में दिए गए न्यायिक निर्देशों के बावजूद ऐसी घटनाएं लगातार सामने आ रही हैं।
न्यायमूर्ति मुनीश्वर नाथ भंडारी और न्यायमूर्ति अनिल कुमार की खंडपीठ ने सुनवाई के दौरान इस बात का संज्ञान लिया कि युवती के पति के पिता को बार-बार थाने बुलाकर पूछताछ की जा रही है।
इस पर अदालत ने जौनपुर के सराय ख्वाजा थाना प्रभारी को कारण बताओ नोटिस जारी करते हुए उनके इस व्यवहार पर स्पष्टीकरण मांगा है।
यह मामला जौनपुर निवासी द्वारा दायर याचिका से जुड़ा है। याचिका में कहा गया है कि युवती ने अपनी इच्छा से युवक से विवाह किया था, लेकिन इसके बावजूद युवक के खिलाफ अपहरण का मुकदमा दर्ज कर लिया गया।
हाईकोर्ट ने उल्लेख किया कि अगस्त 2024 में ही युवक की गिरफ्तारी पर रोक लगा दी गई थी।
अदालत ने यह भी रेखांकित किया कि युवती अपना बयान संबंधित अदालत में दर्ज करा चुकी है और पुलिस इस मामले में फाइनल रिपोर्ट भी दाखिल कर चुकी है।
इसके बावजूद याचिका के अनुसार युवक के पिता को लगातार थाने पर बुलाकर परेशान किया जा रहा है।
सुनवाई के दौरान हाईकोर्ट ने पुलिस अधिकारियों से सवाल किया कि जब मामले में फाइनल रिपोर्ट दाखिल हो चुकी है, तब युवक के बुजुर्ग पिता को किस आधार पर बार-बार थाने बुलाया जा रहा है। मामले की अगली सुनवाई अगस्त में निर्धारित की गई है।
