Allahabad High Court Refuses to Quash Dowry Death Case, Says Medical Opinion Alone Cannot End Proceedings

Court says disputed questions surrounding woman’s death, alleged dowry harassment and medical evidence must be examined at trial.

PRAYAGRAJ, September 24, 2026: The Allahabad High Court has declined to terminate criminal proceedings against a woman accused in a dowry-death and cruelty case, holding that the disputed circumstances surrounding the death cannot be conclusively settled at the stage of a petition seeking quashing of the case.

The ruling came in a plea filed by Nirmala Devi, the mother-in-law of the deceased, who had sought cancellation of the police charge-sheet, the magistrate’s cognizance and summoning order, and all subsequent criminal proceedings.

The case was considered under the High Court’s inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

The court found that the investigation material, taken at face value, disclosed sufficient grounds for the prosecution to continue.

It therefore refused to substitute a detailed assessment of the evidence for the trial process.

A woman died after falling seriously ill.

The dispute centres on the death of the woman, who had married in May 2021. According to the case record, she had allegedly faced dowry-related harassment and cruelty at her matrimonial home.

She reportedly left the marital home in June 2024 and returned several months later after assurances from her matrimonial family.

In February 2025, she allegedly told her mother that she had been assaulted. Soon afterwards, she was found unconscious at her matrimonial residence.

She was initially taken for treatment in the Firozabad area and later shifted to Ujala Cygnus Rainbow Hospital in Agra. She died on February 25, 2025.

The medical evidence became a central feature of the defence. The post-mortem report attributed the death to shock resulting from myocardial infarction, while hospital records referred to fever, seizures and possible meningitis.

Nirmala Devi relied heavily on this material to argue that the death was attributable to a medical condition rather than any criminal act.

The defence argued there was no dowry death.

Before the High Court, the applicant’s case was that the basic legal requirements for a dowry-death prosecution were absent.

The defence maintained that there had been neither an unlawful dowry demand nor cruelty attributable to Nirmala Devi.

It argued that the available medical material pointed towards a natural or medical cause of death and did not establish poisoning, burns, bodily injuries or another external cause.

The applicant therefore contended that continuing the prosecution would amount to misuse of the criminal process.

She also relied on earlier Supreme Court decisions to support her plea for intervention at the preliminary stage. The prosecution pointed to alleged financial transactions.

The complainant’s side disputed the defence narrative and argued that the investigation had uncovered material requiring examination during a full trial.

Among the allegations placed before the court were claims of repeated demands for money and harassment after the marriage.

The prosecution material reportedly referred to RTGS transfers totalling ₹16.25 lakh into the applicant’s account as well as an alleged ₹7 lakh cash payment connected with the marriage.

The complainant’s side also relied on the allegation that the deceased had spoken to her mother shortly before her death and disclosed that she had been physically assaulted.

These allegations, the court noted in substance, could not simply be discarded while exercising the limited jurisdiction available for quashing criminal proceedings.

Court says medical evidence needs fuller examination

A significant aspect of the judgment concerns the difference between assessing medical material at trial and using it to terminate a criminal case at the threshold.

The defence relied on the post-mortem finding of myocardial infarction to argue that there was no connection between the death and the alleged matrimonial harassment.

The opposing side, however, argued that the medical records did not by themselves settle every question surrounding the death.

Issues concerning the deceased’s treatment, the cause and sequence of her medical deterioration, and the possibility of other contributing factors would require evidence from doctors and medical experts.

The court accepted that these questions could not appropriately be resolved in a summary quashing proceeding.

It indicated that examination of treating physicians, expert testimony and other scientific material—including histopathological, toxicological and viscera-related evidence—could become relevant during the trial.

Allegations must meet statutory definition of cruelty

The court also drew attention to the legal distinction between ordinary matrimonial discord and the offence of cruelty under the Bharatiya Nyaya Sanhita.

The statutory provisions require the alleged conduct to satisfy the prescribed definition; every quarrel or instance of unpleasant behaviour within a marriage does not automatically amount to criminal cruelty.

In this case, however, the court found that the allegations against the applicant were sufficiently specific and that the investigation had produced material warranting further judicial examination.

High Court declines to conduct a mini-trial

The court’s approach was ultimately guided by the limits of its inherent jurisdiction.

According to the judgment, the defence version involved questions that could only be properly tested by examining witnesses and evaluating documentary and scientific evidence.

Determining which version was correct at the quashing stage would effectively amount to conducting a premature trial.

The court therefore declined to decide whether the woman’s death was exclusively the result of cardiac complications or whether the prosecution allegations could ultimately be established.

Instead, it held that the available material made out a prima facie case sufficient for the criminal proceedings to move forward.

Charge-sheet and criminal proceedings remain in force

The police had filed the charge-sheet on September 10, 2025.

The magistrate subsequently took cognizance and issued the summoning order on January 3, 2026.

Nirmala Devi’s plea sought to overturn those proceedings, but the High Court refused to do so.

The application under Section 528 BNSS was consequently dismissed, leaving the criminal case to proceed before the competent court.

The ruling does not determine the applicant’s guilt or establish the prosecution allegations as proved.

Its immediate effect is procedural: the accused will have to face the trial, where the competing accounts, medical evidence and allegations concerning dowry-related conduct can be tested in accordance with law.

The judgment thus underscores a familiar principle in criminal procedure: where the record raises contested factual questions requiring witness and expert examination, the High Court’s extraordinary jurisdiction is not ordinarily the forum for deciding those questions conclusively at the threshold.

हाईकोर्ट ने कहा- महिला की मौत, कथित दहेज उत्पीड़न और मेडिकल साक्ष्यों से जुड़े विवाद का फैसला ट्रायल में ही होगा

प्रयागराज, 24 सितंबर 2026: इलाहाबाद हाईकोर्ट ने दहेज मृत्यु और वैवाहिक क्रूरता से जुड़े एक मामले में आरोपी सास के खिलाफ चल रही आपराधिक कार्यवाही खत्म करने से इनकार कर दिया है।

अदालत ने कहा कि महिला की मौत की परिस्थितियों और उससे जुड़े मेडिकल साक्ष्यों को लेकर उठे विवादों का अंतिम फैसला मुकदमे के दौरान साक्ष्यों की जांच के बाद ही किया जा सकता है।

मामले में आरोपी निर्मला देवी, जो मृतका की सास हैं, ने हाईकोर्ट में याचिका दाखिल कर पुलिस की चार्जशीट, मजिस्ट्रेट के संज्ञान और समन आदेश तथा उसके आधार पर चल रही पूरी आपराधिक कार्यवाही को रद्द करने की मांग की थी।

याचिका भारतीय नागरिक सुरक्षा संहिता (BNSS) की धारा 528 के तहत हाईकोर्ट के अंतर्निहित अधिकार क्षेत्र में दाखिल की गई थी।

हाईकोर्ट ने कहा कि जांच के दौरान सामने आया रिकॉर्ड प्रथम दृष्टया ऐसे तथ्य पेश करता है जिनके आधार पर मुकदमे को आगे बढ़ाया जा सकता है।

अदालत ने इस स्तर पर साक्ष्यों की विस्तृत जांच करके मुकदमे का निष्कर्ष निकालने से परहेज किया।

गंभीर बीमारी के बाद हुई थी महिला की मौत

मामले का केंद्र विवाहिता की मौत है। रिकॉर्ड के अनुसार महिला का विवाह मई 2021 में हुआ था और ससुराल में उसके साथ कथित तौर पर दहेज को लेकर उत्पीड़न और क्रूरता किए जाने के आरोप लगाए गए थे।

बताया गया कि वह जून 2024 में ससुराल छोड़कर चली गई थी और बाद में परिवार की ओर से दिए गए आश्वासन के बाद जनवरी 2025 में वापस लौटी।

फरवरी 2025 में उसने कथित तौर पर अपनी मां को बताया कि उसके साथ मारपीट की गई है। इसके कुछ ही समय बाद वह अपने ससुराल में अचेत अवस्था में मिली।

उसे पहले फिरोजाबाद क्षेत्र में उपचार के लिए ले जाया गया और बाद में आगरा स्थित उजाला सिग्नस रेनबो अस्पताल में भर्ती कराया गया। 25 फरवरी 2025 को उसकी मौत हो गई।

मामले में मेडिकल रिपोर्ट बचाव पक्ष के तर्क का प्रमुख आधार बनी। पोस्टमार्टम रिपोर्ट में मौत का कारण मायोकार्डियल इंफार्क्शन यानी हृदयाघात से उत्पन्न शॉक बताया गया, जबकि अस्पताल के रिकॉर्ड में बुखार, दौरे और संभावित मेनिन्जाइटिस जैसी स्थितियों का उल्लेख था।

निर्मला देवी ने इन्हीं दस्तावेजों के आधार पर तर्क दिया कि मौत किसी आपराधिक कृत्य के कारण नहीं बल्कि चिकित्सकीय जटिलताओं के चलते हुई।

बचाव पक्ष ने दहेज मृत्यु के आरोप को नकारा

हाईकोर्ट में आरोपी की ओर से कहा गया कि दहेज मृत्यु से जुड़े अपराध के लिए जरूरी कानूनी तत्व इस मामले में मौजूद नहीं हैं।

बचाव पक्ष ने दावा किया कि निर्मला देवी की ओर से न तो अतिरिक्त दहेज की मांग की गई और न ही मृतका के साथ ऐसी क्रूरता की गई जिसे कानून के तहत अपराध माना जा सके।

यह भी तर्क दिया गया कि उपलब्ध मेडिकल रिकॉर्ड किसी बाहरी चोट, जहर, जलने या अन्य अप्राकृतिक कारण की पुष्टि नहीं करता।

इसी आधार पर याचिकाकर्ता ने कहा कि आपराधिक कार्यवाही जारी रखना कानून की प्रक्रिया का दुरुपयोग होगा। अपने पक्ष में बचाव ने सुप्रीम कोर्ट के पूर्व फैसलों का भी हवाला दिया।

अभियोजन पक्ष ने पैसों के लेन-देन का हवाला दिया

शिकायतकर्ता पक्ष ने बचाव की इस कहानी का विरोध किया और कहा कि जांच में ऐसे तथ्य सामने आए हैं जिनकी न्यायिक जांच जरूरी है।

अभियोजन की ओर से कथित तौर पर लगातार पैसों की मांग और विवाह के बाद उत्पीड़न का मुद्दा उठाया गया। रिकॉर्ड में आरोपी के खाते में 16.25 लाख रुपये के RTGS हस्तांतरण तथा विवाह के समय कथित तौर पर 7 लाख रुपये नकद दिए जाने का उल्लेख किया गया।

शिकायतकर्ता पक्ष ने यह आरोप भी रखा कि मृत्यु से कुछ समय पहले महिला ने अपनी मां को फोन कर अपने साथ मारपीट किए जाने की जानकारी दी थी।

हाईकोर्ट के समक्ष रखे गए इन तथ्यों को इस स्तर पर पूरी तरह खारिज करना अदालत ने उचित नहीं माना।

सिर्फ पोस्टमार्टम रिपोर्ट से केस खत्म नहीं हो सकता

फैसले का एक महत्वपूर्ण पहलू यह है कि अदालत ने मेडिकल रिपोर्ट और मुकदमे में उसके अंतिम मूल्यांकन के बीच अंतर को रेखांकित किया।

बचाव पक्ष ने हृदयाघात से जुड़े पोस्टमार्टम निष्कर्ष को आधार बनाकर कहा कि महिला की मौत का कथित दहेज उत्पीड़न से कोई संबंध नहीं था।

दूसरी ओर, शिकायतकर्ता पक्ष ने कहा कि अस्पताल के रिकॉर्ड और पोस्टमार्टम रिपोर्ट से मौत से जुड़े सभी सवालों का अंतिम उत्तर नहीं मिलता।

महिला की बीमारी कैसे बढ़ी, उपचार के दौरान क्या परिस्थितियां रहीं और क्या किसी अन्य कारक की भूमिका थी—इन सवालों के जवाब डॉक्टरों और विशेषज्ञों की गवाही से ही सामने आ सकते हैं।

हाईकोर्ट ने इस तर्क को स्वीकार करते हुए कहा कि ऐसे विवादित मेडिकल सवालों का समाधान धारा 528 BNSS के तहत संक्षिप्त कार्यवाही में नहीं किया जा सकता।

अदालत ने संकेत दिया कि ट्रायल के दौरान इलाज करने वाले डॉक्टरों, मेडिकल विशेषज्ञों तथा हिस्टोपैथोलॉजिकल, टॉक्सिकोलॉजिकल और विसरा संबंधी साक्ष्यों की जरूरत पड़ सकती है।

हर वैवाहिक विवाद को क्रूरता नहीं माना जा सकता

अदालत ने भारतीय न्याय संहिता के तहत क्रूरता की कानूनी परिभाषा पर भी ध्यान दिया।

किसी विवाह में सामान्य मतभेद, कहासुनी या हर प्रकार का दुर्व्यवहार अपने आप आपराधिक क्रूरता नहीं बन जाता। आरोपों को कानून में निर्धारित कसौटी पर खरा उतरना आवश्यक है।

हालांकि, इस मामले में हाईकोर्ट ने माना कि आरोपी के खिलाफ लगाए गए आरोप विशिष्ट प्रकृति के हैं और जांच में ऐसा सामग्री सामने आई है जिसकी आगे न्यायिक जांच की आवश्यकता है।

हाईकोर्ट ने कहा- इस स्तर पर ‘मिनी ट्रायल’ नहीं किया जा सकता

अदालत के फैसले का मूल आधार यह रहा कि मामले में कई ऐसे सवाल हैं जिनका जवाब गवाहों और विशेषज्ञों की गवाही के बाद ही मिल सकता है।

यदि हाईकोर्ट इस स्तर पर बचाव पक्ष की कहानी और अभियोजन के दावों की विस्तृत तुलना करके यह तय करने लगे कि महिला की मौत केवल हृदय संबंधी बीमारी से हुई या कथित उत्पीड़न की भी कोई भूमिका थी, तो यह एक तरह से मुकदमे की सुनवाई पहले ही कर देने जैसा होगा।

इसलिए अदालत ने इन विवादित तथ्यों पर अंतिम निष्कर्ष निकालने से इनकार किया।

हाईकोर्ट ने माना कि उपलब्ध सामग्री प्रथम दृष्टया अपराधों का मामला सामने लाती है और इसलिए आपराधिक कार्यवाही को जारी रहना चाहिए।

चार्जशीट और आपराधिक मुकदमा जारी रहेगा

पुलिस ने 10 सितंबर 2025 को मामले में चार्जशीट दाखिल की थी। इसके बाद मजिस्ट्रेट ने 3 जनवरी 2026 को संज्ञान लेते हुए आरोपी को समन जारी किया था।

निर्मला देवी ने इन्हीं कार्यवाहियों को रद्द कराने के लिए हाईकोर्ट का रुख किया था, लेकिन अदालत ने उनकी याचिका खारिज कर दी। इसके साथ ही धारा 528 BNSS के तहत दाखिल आवेदन को भी निस्तारित कर दिया गया।

हालांकि, हाईकोर्ट के इस आदेश का अर्थ यह नहीं है कि आरोपी को दोषी ठहरा दिया गया है या अभियोजन के आरोप साबित हो गए हैं। अदालत ने केवल यह तय किया है कि मामले में मौजूद विवादित तथ्यों और साक्ष्यों की जांच ट्रायल के दौरान होनी चाहिए।

इस फैसले का व्यावहारिक अर्थ यह है कि आरोपी को अब निचली अदालत में चलने वाली आपराधिक कार्यवाही का सामना करना होगा, जहां गवाहों, मेडिकल विशेषज्ञों और अन्य साक्ष्यों के आधार पर यह तय किया जाएगा कि अभियोजन के आरोप कानून की कसौटी पर साबित होते हैं या नहीं।

फैसला इस सिद्धांत को भी रेखांकित करता है कि जब किसी आपराधिक मामले में तथ्य और साक्ष्य गंभीर रूप से विवादित हों, तो हाईकोर्ट अपनी असाधारण अधिकारिता का इस्तेमाल करके मुकदमे की शुरुआत में ही उन सवालों का अंतिम फैसला नहीं करता।
