Allahabad High Court Rejects PIL Seeking Enforcement of Court Sitting Hours, Says Mandamus Cannot Be Issued Against Judges

Prayagraj: A Public Interest Litigation (PIL) seeking strict implementation of the Allahabad High Court’s prescribed court sitting hours has been dismissed, with the court making it clear that no writ of mandamus can be issued against judges of the High Court.

The Bench also found the petition to be founded on incomplete facts, holding that it lacked the factual basis necessary for judicial intervention.

Delivering the verdict on Tuesday, the Division Bench of Chief Justice Arun Bhansali and Justice Kshitij Shailendra ruled that the petitioner, a practising advocate, had failed to establish a case warranting the relief sought.

The judges observed that the material placed before the court was insufficient to sustain the allegations made in the petition.

Advocate Arun Mishra, who filed the PIL, had urged the court to enforce a Full Court resolution dated August 27, 2008, which prescribes court working hours from 10 a.m. to 1 p.m., followed by a lunch recess until 2 p.m., with proceedings resuming from 2 p.m. to 4 p.m.

According to the plea, several courtrooms allegedly did not begin proceedings at the scheduled time on May 5, 2026, despite being listed to function that day.

Referring to the events of that morning, the petitioner claimed that only a handful of courts commenced hearings at 10:05 a.m., while some others reportedly assembled at 10:10 a.m., 10:15 a.m. and even 10:20 a.m.

He contended that such delays constituted a departure from the approved timetable and sought judicial directions to ensure strict compliance in the future.

In addition to seeking enforcement of the prescribed schedule, the petition requested that any delay in the commencement of court proceedings be publicly notified.

It suggested that such information be displayed on notice boards as well as reflected in the daily cause list so that advocates and litigants could be informed beforehand about any deviation from the scheduled timings.

Declining to entertain the plea, the Bench held that the relief sought rested on incomplete particulars.

The court pointed out that the petitioner had not disclosed how many Benches, on the date in question, had continued to function beyond the prescribed hours while carrying on judicial work. In the absence of such essential details, the allegations remained unsupported.

Recording its reasons in the order dated July 28, the Bench categorically observed that a writ of mandamus directed against judges of the High Court was legally impermissible.

“The nature of relief, which has been sought in the petition, is based on incomplete facts, as the petitioner has not cared to indicate as to how many courts on that particular day sat beyond the time fixed and continued to discharge the judicial work,” the court noted.

It further remarked, “Seeking a mandamus, which essentially is directed against the Judges of this Court, cannot be countenanced.”

The order also reproduced the Full Court resolution passed on August 27, 2008. Under that decision, effective from September 1, 2008, court sitting hours at the Allahabad Bench were fixed from 10 a.m. to 1 p.m. and from 2 p.m. to 4 p.m., with a one-hour lunch interval between 1 p.m. and 2 p.m.

The resolution further clarified that the existing court timings at the Lucknow Bench would remain unchanged and that all previous directions on the subject stood modified accordingly.

इलाहाबाद हाईकोर्ट ने अदालतों के निर्धारित कार्य समय का कड़ाई से पालन सुनिश्चित कराने की मांग वाली जनहित याचिका (पीआईएल) को खारिज करते हुए स्पष्ट किया है कि हाईकोर्ट के न्यायाधीशों के विरुद्ध मंडामस (Mandamus) की रिट जारी नहीं की जा सकती।

अदालत ने यह भी माना कि याचिका अधूरे तथ्यों पर आधारित थी और उसमें न्यायिक हस्तक्षेप के लिए आवश्यक तथ्यात्मक आधार मौजूद नहीं था।

मंगलवार को मुख्य न्यायाधीश अरुण भंसाली तथा न्यायमूर्ति क्षितिज शैलेन्द्र की खंडपीठ ने कहा कि याचिकाकर्ता, जो स्वयं एक अधिवक्ता हैं, अपने आरोपों के समर्थन में पर्याप्त सामग्री प्रस्तुत करने में असफल रहे।

अदालत ने कहा कि उपलब्ध तथ्यों के आधार पर मांगी गई राहत प्रदान नहीं की जा सकती।

अधिवक्ता अरुण मिश्रा द्वारा दायर इस जनहित याचिका में 27 अगस्त 2008 की पूर्ण पीठ (फुल कोर्ट) की उस संकल्पना को लागू कराने की मांग की गई थी, जिसके अनुसार इलाहाबाद में अदालतों का कार्य समय सुबह 10 बजे से दोपहर 1 बजे तक तथा दोपहर 2 बजे से शाम 4 बजे तक निर्धारित किया गया था।

याचिका में आरोप लगाया गया कि 5 मई 2026 को सूचीबद्ध होने के बावजूद कई अदालतों ने निर्धारित समय पर कार्यवाही शुरू नहीं की।

याचिकाकर्ता का कहना था कि उस दिन केवल कुछ अदालतों में ही सुबह 10:05 बजे कार्यवाही प्रारम्भ हुई, जबकि अनेक अदालतों में सुनवाई 10:10 बजे, 10:15 बजे और 10:20 बजे शुरू हुई।

उनका तर्क था कि यह निर्धारित समय-सारिणी से विचलन है और भविष्य में इसके सख्ती से पालन के लिए न्यायालय को निर्देश जारी करने चाहिए।

याचिका में यह भी आग्रह किया गया था कि यदि किसी अदालत की कार्यवाही निर्धारित समय से विलंब से शुरू हो, तो इसकी सूचना नोटिस बोर्ड और दैनिक कॉज लिस्ट पर प्रदर्शित की जाए ताकि अधिवक्ताओं और वादकारियों को पहले से इसकी जानकारी मिल सके।

पीठ ने याचिका को अस्वीकार करते हुए कहा कि मांगी गई राहत अपूर्ण तथ्यों पर आधारित है। अदालत ने उल्लेख किया कि याचिकाकर्ता ने यह तक नहीं बताया कि संबंधित दिन कितनी अदालतें निर्धारित समय से अधिक बैठीं और न्यायिक कार्य करती रहीं। ऐसे आवश्यक तथ्यों के अभाव में याचिका का आधार कमजोर पाया गया।

28 जुलाई के आदेश में अदालत ने स्पष्ट शब्दों में कहा कि जिस प्रकार की राहत मांगी गई है, वह वस्तुतः हाईकोर्ट के न्यायाधीशों के विरुद्ध मंडामस जारी करने जैसी है, जिसकी अनुमति कानून नहीं देता।

आदेश में कहा गया, “याचिका में मांगी गई राहत अधूरे तथ्यों पर आधारित है, क्योंकि याचिकाकर्ता ने यह बताने का प्रयास ही नहीं किया कि संबंधित दिन कितनी अदालतें निर्धारित समय से अधिक बैठीं और न्यायिक कार्य करती रहीं।”

अदालत ने आगे कहा कि “ऐसी मंडामस की रिट, जो मूलतः इस न्यायालय के न्यायाधीशों के विरुद्ध निर्देशित हो, स्वीकार नहीं की जा सकती।”

निर्णय में 27 अगस्त 2008 को पारित फुल कोर्ट के प्रस्ताव का भी उल्लेख किया गया। इस प्रस्ताव के अनुसार 1 सितम्बर 2008 से इलाहाबाद स्थित अदालतों के बैठने का समय सुबह 10 बजे से दोपहर 1 बजे तक तथा दोपहर 2 बजे से शाम 4 बजे तक निर्धारित किया गया था, जबकि दोपहर 1 बजे से 2 बजे तक भोजनावकाश रहेगा।

प्रस्ताव में यह भी स्पष्ट किया गया था कि लखनऊ पीठ की कार्यावधि पूर्ववत जारी रहेगी तथा इस विषय पर जारी पूर्व आदेश इसी सीमा तक संशोधित माने जाएंगे।
