Allahabad High Court Rejects Tauqueer Raza Bail in Bareilly Violence Case, Says ‘Sar Tan Se Juda’ Slogan Challenges Law

Court says slogan cannot be equated with religious chants; notes alleged call for gathering, subsequent violence and conduct after the incident

PRAYAGRAJ: The Allahabad High Court has refused to grant bail to Maulana Tauqueer Raza Khan in the September 2025 Bareilly violence case, holding that the slogan “Gustakhi-e-Nabi ki ek hi saza, sar tan se juda” stands on a fundamentally different footing from religious chants invoking God or Guru.

Justice Ashutosh Srivastava, while dealing with the bail plea, said slogans such as “Naara-e-Takbeer, Allahu Akbar”, “Jo Bole So Nihaal Sat Sri Akaal”, “Jai Shree Ram” and “Har Har Mahadev” express reverence towards the respective religious figures or deities.

The disputed slogan, however, was viewed by the court as a challenge to the authority of law and the sovereignty and integrity of India, besides allegedly encouraging armed rebellion.

On that reasoning, the court said it was not persuaded to release Raza on bail at the present stage and rejected his application in an order dated September 7.

Raza has been in custody since September 27, 2025, following an FIR arising from the violence that broke out in Bareilly on September 26.

The prosecution has described him as the alleged “kingpin” and mastermind behind the disturbances.

The case stems from a proposed gathering at the Islamia Inter College grounds.

According to the prosecution, members of the Muslim community had been called to assemble there to protest what they described as atrocities and false cases against them.

The administration subsequently imposed restrictions under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), barring gatherings of five or more people in public places.

The state alleged that the restriction was nevertheless violated when around 200 to 250 people proceeded towards the Islamia grounds.

Police attempts to stop the gathering were allegedly followed by stone-pelting, attacks involving petrol bombs and firing at the police team.

Several police personnel were injured, and public property was damaged, according to the prosecution’s case.

Raza’s defence, however, maintained that he had neither joined the gathering nor participated in the violence.

His lawyers pointed out that he had been placed under house arrest at about 10 am on September 26 and was therefore not at the site when the violence occurred.

They further argued that he had made no speech or appeal calling for violence, disorder or a disturbance of public peace.

The High Court also took note of the fact that Raza was not physically present at the scene and had remained confined for some time at the residence of a co-accused.

However, the court examined his alleged role in calling for the gathering before the restrictions were imposed.

According to the court record, Raza had called upon members of the Muslim community to gather at Islamia Inter College after Friday prayers, with the stated purpose of protesting government action and submitting a memorandum to the President of India through the Bareilly district magistrate.

The defence argued that the call was later withdrawn after permission for the gathering was denied and Section 163 BNSS restrictions came into force.

The court nevertheless noted the prosecution’s claim that people subsequently moved towards the Islamia grounds despite the restrictions.

The court further considered allegations concerning Raza’s conduct after the violence.

It noted that he had delivered a speech thanking the people for responding to his call and applauding their actions, a conduct which the court said could not be approved.

The bail ruling therefore turned not only on Raza’s physical absence from the scene but also on the allegations concerning the call for the gathering, the events that followed and his subsequent conduct.

The court ultimately concluded that the circumstances did not warrant his release on bail at this stage.

 

तौकीर रजा की जमानत याचिका खारिज, हाईकोर्ट ने ‘सर तन से जुदा’ नारे पर की अहम टिप्पणी

कोर्ट ने कहा- धार्मिक आस्था से जुड़े नारों की तुलना इस नारे से नहीं की जा सकती; हिंसा से पहले सभा के आह्वान और बाद के आचरण का भी लिया संज्ञान

प्रयागराज: सितंबर 2025 के बरेली हिंसा मामले में इलाहाबाद हाईकोर्ट ने मौलाना तौकीर रजा खान को फिलहाल राहत देने से इनकार कर दिया है।

न्यायमूर्ति आशुतोष श्रीवास्तव की पीठ ने उनकी जमानत अर्जी खारिज करते हुए विवादित “गुस्ताखी-ए-नबी की एक ही सजा, सर तन से जुदा” नारे को धार्मिक आस्था व्यक्त करने वाले अन्य नारों से अलग माना।

अदालत ने कहा कि “नारा-ए-तकबीर, अल्लाहु अकबर”, “जो बोले सो निहाल सत श्री अकाल”, “जय श्री राम” और “हर हर महादेव” जैसे नारे संबंधित ईश्वर या गुरु के प्रति सम्मान और आस्था व्यक्त करते हैं।

इसके विपरीत, हाईकोर्ट के अनुसार “सर तन से जुदा” नारा कानून के अधिकार को चुनौती देने वाला है और देश की संप्रभुता एवं अखंडता के लिए भी चुनौती के रूप में देखा गया।

अदालत ने कहा कि यह लोगों को सशस्त्र विद्रोह के लिए उकसाने वाला है, जो कानून के तहत दंडनीय है।

इन्हीं परिस्थितियों को देखते हुए कोर्ट ने कहा कि मौजूदा चरण में आवेदक को जमानत पर रिहा करने का आधार नहीं बनता।

सात सितंबर के आदेश में तौकीर रजा की जमानत याचिका को अदालत ने अस्वीकार कर दिया।

तौकीर रजा पर मामला 26 सितंबर 2025 को बरेली में हुई हिंसा से जुड़ा है। इस मामले में उन्हें 27 सितंबर 2025 से जेल में रखा गया है। अभियोजन पक्ष ने उन्हें मामले का कथित किंगपिन और मास्टरमाइंड बताया है।

मामले की पृष्ठभूमि एक प्रस्तावित सभा से जुड़ी है। अभियोजन के अनुसार, मुस्लिम समुदाय के लोगों से इस्लामिया इंटर कॉलेज मैदान में एकत्र होने का आह्वान किया गया था।

इसका उद्देश्य कथित अत्याचारों और उनके खिलाफ दर्ज किए गए कथित झूठे मुकदमों के विरोध में प्रदर्शन करना था।

इसी बीच स्थानीय प्रशासन ने भारतीय नागरिक सुरक्षा संहिता (BNSS) की धारा 163 के तहत सार्वजनिक स्थान पर पांच या उससे अधिक लोगों के एकत्र होने पर रोक लगा दी थी।

राज्य सरकार की ओर से आरोप लगाया गया कि प्रतिबंध के बावजूद करीब 200 से 250 लोग इस्लामिया मैदान की ओर बढ़े।

पुलिस ने उन्हें रोकने का प्रयास किया तो कथित तौर पर पथराव, पेट्रोल बम से हमला और पुलिस दल पर फायरिंग की गई।

अभियोजन के मुताबिक इस दौरान कई पुलिसकर्मी घायल हुए और सार्वजनिक संपत्ति को नुकसान पहुंचा।

हालांकि, तौकीर रजा की ओर से इन आरोपों का विरोध किया गया।

बचाव पक्ष ने कहा कि वह न तो भीड़ जुटाने में शामिल थे और न ही हिंसा में भाग लिया। उनके वकीलों ने अदालत को बताया कि 26 सितंबर को सुबह करीब 10 बजे उन्हें नजरबंद कर दिया गया था, इसलिए घटना के समय वह मौके पर मौजूद नहीं थे।

यह भी दलील दी गई कि उन्होंने ऐसा कोई भाषण या अपील नहीं की थी जिसे हिंसा, अव्यवस्था या सार्वजनिक शांति भंग करने के लिए उकसाने वाला माना जा सके।

हाईकोर्ट ने इस तथ्य को भी दर्ज किया कि तौकीर रजा घटनास्थल पर मौजूद नहीं थे और कुछ समय तक एक सह-आरोपी के घर में सीमित रहे।

इसके बावजूद अदालत ने सभा बुलाने से संबंधित उनकी कथित भूमिका को मामले के संदर्भ में महत्वपूर्ण माना।

अदालत के समक्ष रखे गए मामले के अनुसार, रजा ने जुमे की नमाज के बाद मुस्लिम समुदाय के लोगों से इस्लामिया इंटर कॉलेज में जुटने की अपील की थी।

बताया गया कि सभा का उद्देश्य सरकार की कार्रवाई के विरोध में ज्ञापन तैयार कर उसे बरेली के जिलाधिकारी के माध्यम से भारत के राष्ट्रपति तक पहुंचाना था।

बचाव पक्ष ने दलील दी कि अनुमति नहीं मिलने और धारा 163 लागू होने के बाद सभा के लिए दिया गया आह्वान वापस ले लिया गया था।

हालांकि, अदालत ने अभियोजन के उस पक्ष पर भी गौर किया कि इसके बाद भी लोग इस्लामिया मैदान की ओर बढ़े और पुलिस द्वारा रोके जाने पर हिंसा हुई।

कोर्ट ने घटना के बाद तौकीर रजा के कथित आचरण का भी उल्लेख किया।

आदेश में कहा गया कि उन्होंने एक भाषण में भीड़ के उनके आह्वान पर प्रतिक्रिया देने के लिए धन्यवाद दिया और उनके किए गए कार्यों की सराहना की। अदालत ने इस आचरण को स्वीकार्य नहीं माना।

इस तरह जमानत पर फैसला केवल घटनास्थल पर रजा की कथित गैरमौजूदगी तक सीमित नहीं रहा।

अदालत ने सभा के आह्वान, प्रतिबंध के बावजूद भीड़ के आगे बढ़ने से जुड़े अभियोजन के आरोप, हिंसा के बाद के कथित आचरण और विवादित नारे की प्रकृति को भी अपने विचार में शामिल किया। इन्हीं

आधारों पर हाईकोर्ट ने इस चरण में जमानत देने से इनकार कर दिया।
