Allahabad High Court Takes Serious Note Of Non-Compliance Of UP Gangsters Act

The Allahabad High Court has taken serious note of the non-compliance of provisions of the UP Gangsters Act in the state in the prescribed manner and directed that while preparing the gang chart, its details should be given in the prescribed column in the prescribed format, and apart from this, a separate list of criminal history of the person, who is being included in the list of gangsters should be presented.

While staying the arrest of the petitioner- Jai Prakash Bind alias Neta of Bhadohi, against whom a case was registered under the Gangsters Act, a division bench comprising of Justice Siddharth and Justice Praveen Kumar Giri directed the Registrar compliance to provide a copy of this order to the UP home secretary and director general of police (DGP) so that DMs, Police Commissioners, SSPs, SPs and police station heads of the state can be instructed to comply with this order.

The court has also sought a reply from the state government.

An FIR was registered against the petitioner under the Gangster Act in the Gyanpur police station of Bhadohi. The petitioner had filed a petition demanding cancellation of the FIR. The court found that only one criminal case is registered in column six of the petitioner’s gang chart. While the state counsel said that four cases are registered in column five of the gang chart but their details are not mentioned.

The court said that there is a clear rule for giving details in columns five and six, which has not been complied with in this petition. It is necessary to give complete details of column five. Details of criminal history were not submitted. The division bench said that even before this, other courts have given instructions on this. But they are not being complied with. Therefore, the Home Secretary and Director General of Police should ensure compliance with this.
