Bar and Bench Must Work as One for Effective Justice Delivery, Says Allahabad HC Chief Justice
Chief Justice Arun Bhansali stresses mutual respect, coordination and stronger judicial infrastructure at Bar Association event in Prayagraj
Prayagraj: Allahabad High Court Chief Justice Arun Bhansali has underlined the importance of a strong working relationship between lawyers and judges, saying effective justice delivery depends on close coordination between the Bar and the Bench.
Addressing a programme organised by the Bar Association, Bhansali said lawyers and judges should not be viewed as rival institutions.
Instead, he described them as two indispensable parts of the same justice system, with the effectiveness of one closely connected to the strength of the other.
The Chief Justice said public confidence in the rule of law is strengthened when the Bar and Bench perform their respective responsibilities with mutual understanding and a shared commitment to justice.
Reflecting on the history of the legal profession, Bhansali noted that several distinguished advocates associated with the Bar had made significant contributions well beyond courtroom practice.
Many had played prominent roles in public life and the freedom movement, while also campaigning for social reform and speaking up for the rights of disadvantaged sections.
He said the collective experience and legal knowledge of the advocacy community had contributed significantly to the development and strengthening of the Constitution.
According to Bhansali, the Constitution continues to remain a living and evolving document because lawyers continue to defend constitutional principles and citizens’ rights.
The Chief Justice also acknowledged the practical difficulties faced by members of the Bar.
While every concern may not be capable of an immediate resolution, he said the judiciary remains attentive to the problems raised by advocates and is committed to finding workable solutions wherever possible.
Improving facilities for lawyers is another area receiving attention, Bhansali said.
The recently constructed advocates’ chambers and new parking arrangements were cited as examples of efforts to create a more supportive working environment for members of the legal profession.
Referring to the constitutional principle of separation of powers, the Chief Justice said the judiciary and executive have clearly defined responsibilities under the Constitution.
At the same time, he stressed that cooperation among constitutional institutions is essential when matters of wider public interest, speedy justice and judicial infrastructure are involved.
He described the integrated court complexes being developed across Uttar Pradesh as a positive illustration of institutional cooperation aimed at improving the justice delivery system.
Concluding his remarks, Bhansali appreciated the Bar Association for organising the programme and expressed hope that the relationship based on mutual respect, dialogue and cooperation among the state government, judiciary and legal fraternity would continue to grow stronger.

प्रयागराज: इलाहाबाद हाईकोर्ट के मुख्य न्यायमूर्ति अरुण भंसाली ने न्याय व्यवस्था को प्रभावी बनाने के लिए बार और बेंच के बीच मजबूत समन्वय को आवश्यक बताया है।
उन्होंने कहा कि न्यायपालिका और अधिवक्ता समुदाय की भूमिकाएं अलग जरूर हैं, लेकिन दोनों का अंतिम उद्देश्य नागरिकों को प्रभावी और निष्पक्ष न्याय उपलब्ध कराना है।
बार एसोसिएशन के सम्मान समारोह में अधिवक्ताओं को संबोधित करते हुए मुख्य न्यायमूर्ति ने कहा कि बार और बेंच को एक-दूसरे का प्रतिद्वंद्वी समझने के बजाय न्याय प्रणाली के परस्पर जुड़े हुए दो महत्वपूर्ण अंगों के रूप में देखा जाना चाहिए।
एक की कार्यक्षमता और मजबूती का सीधा असर दूसरे की क्षमता पर पड़ता है।
उन्होंने कहा कि जब अधिवक्ता और न्यायाधीश आपसी सम्मान और समझ के साथ अपनी संवैधानिक एवं पेशेवर जिम्मेदारियां निभाते हैं, तो इससे कानून के शासन में आम नागरिकों का भरोसा और मजबूत होता है।
कानूनी पेशे के गौरवशाली इतिहास का उल्लेख करते हुए भंसाली ने कहा कि बार से जुड़े अनेक प्रतिष्ठित अधिवक्ताओं ने अदालतों तक अपनी भूमिका सीमित नहीं रखी।
उन्होंने सार्वजनिक जीवन में महत्वपूर्ण योगदान देने के साथ-साथ देश के स्वतंत्रता आंदोलन में भी सक्रिय भूमिका निभाई। कई अधिवक्ताओं ने सामाजिक बदलाव के लिए आवाज उठाई और वंचित वर्गों के अधिकारों की पैरवी की।
मुख्य न्यायमूर्ति ने कहा कि अधिवक्ता समुदाय के व्यापक अनुभव और कानूनी ज्ञान ने संविधान को मजबूत बनाने में महत्वपूर्ण योगदान दिया है।
उन्होंने कहा कि संवैधानिक सिद्धांतों और नागरिक अधिकारों की रक्षा के प्रति अधिवक्ताओं की प्रतिबद्धता संविधान को आज भी जीवंत और गतिशील बनाए रखने में अहम भूमिका निभाती है।
अधिवक्ताओं की रोजमर्रा की व्यावहारिक कठिनाइयों का जिक्र करते हुए उन्होंने कहा कि हर समस्या का समाधान तत्काल करना संभव नहीं हो सकता।
हालांकि, न्यायपालिका अधिवक्ताओं की चिंताओं को गंभीरता से समझती है और जहां संभव हो, वहां व्यावहारिक एवं टिकाऊ समाधान निकालने के लिए प्रयासरत रहती है।
उन्होंने कहा कि अधिवक्ताओं के कामकाज के लिए बेहतर सुविधाएं उपलब्ध कराने की दिशा में भी लगातार प्रयास किए जा रहे हैं।
हाल में तैयार किए गए नए अधिवक्ता चैंबर और पार्किंग सुविधाओं को उन्होंने इसी प्रक्रिया का हिस्सा बताया।
संवैधानिक व्यवस्था में शक्तियों के विभाजन का उल्लेख करते हुए मुख्य न्यायमूर्ति ने कहा कि न्यायपालिका और कार्यपालिका की अपनी-अपनी निर्धारित जिम्मेदारियां हैं।
इसके बावजूद व्यापक जनहित से जुड़े मामलों, त्वरित न्याय और न्यायिक आधारभूत ढांचे के विकास के लिए संवैधानिक संस्थाओं के बीच सहयोग और समन्वय बेहद महत्वपूर्ण है।
उन्होंने उत्तर प्रदेश के विभिन्न हिस्सों में विकसित किए जा रहे एकीकृत अदालत परिसरों को संस्थागत सहयोग का उपयोगी उदाहरण बताया।
उनके अनुसार, इस तरह के प्रयास न्यायिक व्यवस्था को अधिक सुविधाजनक और प्रभावी बनाने में मदद करेंगे।
कार्यक्रम के समापन पर मुख्य न्यायमूर्ति ने बार एसोसिएशन के आयोजन की सराहना की।
उन्होंने उम्मीद जताई कि राज्य सरकार, न्यायपालिका और अधिवक्ता समुदाय के बीच सम्मान, संवाद और सहयोग का संबंध आगे भी मजबूत होता रहेगा।
