Bombay HC Orders Fresh Probe into Disha Salian Death, Flags 10 ‘Reasonable Suspicions’

Court directs CBI to register FIR and investigate June 2020 death; judges say Mumbai Police probe leaves several questions unanswered.

MUMBAI: The Bombay High Court has directed the Central Bureau of Investigation (CBI) to register an FIR and conduct a fresh investigation into the June 2020 death of Disha Salian, the former manager of actor Sushant Singh Rajput, after identifying a series of unexplained circumstances in the original police inquiry.

A bench comprising Justices Sarang V Kotwal and Ranjitsinha R Bhonsale said the material before it disclosed circumstances that created “reasonable suspicions” about the manner in which the initial investigation was conducted.

The judges observed that the Mumbai Police inquiry appeared to “raise more questions than it answers”.

The court, however, made it clear that its observations were confined to determining whether a fresh FIR and investigation were justified.

It did not hold any individual responsible for Salian’s death.

The CBI has been asked to examine the matter independently and from all relevant angles, including whether the available circumstances point to the commission of an offence and whether there is sufficient material to raise suspicion against any person.

Delay in examining the scene

One of the principal issues identified by the High Court was the gap between the police reaching the location and the preparation of the spot panchnama.

According to the court, police officers arrived at the building shortly after the incident, but the formal panchnama was prepared more than nine hours later.

The judges said the delay was significant, particularly because circumstances suggested that the police had considered the possibility of foul play.

The court also noted that several important events occurred before the accidental death report (ADR) was formally registered, without adequate explanation in the record.

Questions over the accidental death report

The timing of the ADR also came under scrutiny. Salian’s death was recorded as having occurred at about 2.25 am on June 9, while the ADR was registered at 3.07 am.

The court pointed out that the ADR referred to statements attributed to Salian’s parents indicating that they had no suspicion regarding her death.

However, her father reportedly reached the hospital only around 4 am.

The judges questioned how his statement could have been incorporated into an ADR registered before his arrival.

Police seen at the building before the death was recorded.

CCTV footage became another point of concern for the court. The footage showed police personnel at the building between approximately 1 am and 2.14 am.

The High Court said the investigation records did not adequately explain the presence of the officers, their identities,s or what they were doing at the premises during that period.

The absence of an explanation in both the ADR and the subsequent investigation contributed to the court’s concerns about the original inquiry.

Blood evidence and nature of injuries

The court also examined discrepancies concerning blood evidence at the scene.

Two witnesses whose statements were considered important reportedly told investigators that Salian had landed face-first after falling and that blood was coming from her head.

Yet, according to the court, investigators did not collect blood-stained soil from the location.

The recorded injuries also raised questions. Apart from an injury to the chin, there was no recorded bleeding injury to the head, despite the witnesses’ accounts.

The judges further observed that it was difficult to reconcile a fall from the 12th floor onto the face with the injuries recorded in the postmortem report.

While skull and rib fractures were noted, the court said there were no fractures of the face, nose or jaw.

It stressed that the issue would ultimately require assessment by appropriate experts.

Chemical analysis raised another discrepancy.

The court referred to an observation made by an Assistant Chemical Analyzer, who told police that articles involved in a fall of such magnitude would ordinarily be expected to carry a greater quantity of blood.

However, when the seized articles were examined, the amount of blood was described as “less blood”.

The High Court noted that investigators themselves appeared to have been uncertain about the discrepancy and had questioned the postmortem doctor about why Salian’s clothes contained less blood.

Dispute over bedroom door

The condition of the bedroom door was another matter highlighted by the judges.

One witness reportedly stated that Salian had locked herself inside the room and that the door had subsequently been forced open.

The spot panchnama, however, did not record any damage to either the door or its lock. The High Court said the apparent contradiction had not been satisfactorily explained.

Forensic samples did not correspond with postmortem record

The court also found a discrepancy between the samples described in the postmortem documentation and those ultimately sent to the forensic laboratory.

The postmortem report referred to particular swab samples, while the envelopes received by the Forensic Science Laboratory contained slide smears instead.

Doctors reportedly attributed the difference to a clerical mistake.

The High Court nevertheless described the mismatch as a “glaring feature” requiring consideration in a fresh investigation.

Questions over seizure documentation

The judges also questioned aspects of the police interaction with the doctor who conducted the postmortem.

The court noted that police asked the doctor about the condition in which Salian had been brought to the hospital, despite the investigation records indicating that her clothes had already been seized.

If the police were already aware of the seizure, the court observed, there appeared to be no occasion for such a question to have been put to the doctor.

Phone and laptop seized eight days later.

The delay in securing Salian’s electronic devices was another factor considered significant by the High Court.

Her mobile phone and laptop were regarded as important potential evidence, yet they were not seized when the spot panchnama was conducted on June 9.

Instead, the devices were taken into police custody eight days later, on June 17, from a friend who had been holding them.

The court considered the delay relevant while assessing whether potentially important evidence had been properly secured during the initial stages of the investigation.

CBI asked to examine case afresh

After considering the circumstances collectively, the High Court concluded that the matter warranted registration of an FIR and a fresh investigation.

The judges said such an inquiry was particularly necessary because the passage of time could result in evidence being lost or destroyed, making it more difficult to establish what happened.

At the same time, the court cautioned that its observations should not be interpreted as conclusions against any particular individual.

The CBI will now have to independently examine the evidence, determine whether an offence was committed and assess whether the material provides sufficient grounds to suspect any person in connection with Salian’s death.

मुंबई: बॉम्बे हाईकोर्ट ने अभिनेता सुशांत सिंह राजपूत की पूर्व मैनेजर दिशा सालियान की जून 2020 में हुई मौत के मामले में नए सिरे से जांच का आदेश दिया है।

अदालत ने केंद्रीय जांच ब्यूरो (CBI) को FIR दर्ज कर मामले की स्वतंत्र जांच करने का निर्देश दिया है।

न्यायमूर्ति सारंग वी. कोतवाल और न्यायमूर्ति रंजितसिंहा आर. भोंसले की पीठ ने शुरुआती जांच से जुड़े कई ऐसे पहलुओं को रेखांकित किया, जिन्हें उसने “उचित संदेह” पैदा करने वाला बताया।

अदालत ने कहा कि मुंबई पुलिस की जांच में कुछ ऐसे सवाल हैं जिनका संतोषजनक जवाब रिकॉर्ड में नहीं मिलता और जांच “जवाब देने के बजाय अधिक सवाल खड़े करती है।”

हालांकि, हाईकोर्ट ने स्पष्ट किया कि ये टिप्पणियां केवल इस सवाल पर विचार करते हुए की गई हैं कि क्या FIR दर्ज कर नए सिरे से जांच शुरू की जानी चाहिए।

अदालत ने किसी व्यक्ति को दिशा सालियान की मौत के लिए जिम्मेदार नहीं ठहराया है।

CBI को निर्देश दिया गया है कि वह मामले के हर पहलू की स्वतंत्र रूप से जांच करे और यह तय करे कि उपलब्ध साक्ष्यों से किसी अपराध के होने के पर्याप्त आधार बनते हैं या नहीं।

घटनास्थल का पंचनामा बनाने में नौ घंटे से अधिक की देरी

हाईकोर्ट की प्रमुख चिंताओं में घटनास्थल का पंचनामा तैयार करने में हुई देरी शामिल रही।

अदालत के मुताबिक, पुलिस घटना के तुरंत बाद घटनास्थल पर पहुंच गई थी, लेकिन पंचनामा नौ घंटे से भी अधिक समय बाद तैयार किया गया। पीठ ने इस देरी को महत्वपूर्ण माना, खासकर इसलिए क्योंकि कुछ परिस्थितियों से संकेत मिलता था कि पुलिस को घटना में किसी तरह की गड़बड़ी या आपराधिक पहलू की आशंका थी।

अदालत ने यह भी कहा कि आकस्मिक मृत्यु रिपोर्ट यानी ADR दर्ज किए जाने से पहले कई महत्वपूर्ण घटनाएं हुईं, लेकिन जांच रिकॉर्ड में उनका पर्याप्त स्पष्टीकरण नहीं मिलता।

ADR में दर्ज समय पर भी उठे सवाल

दिशा सालियान की मृत्यु का समय 9 जून की रात 2.25 बजे बताया गया, जबकि ADR सुबह 3.07 बजे दर्ज की गई।

हाईकोर्ट ने इस बात पर सवाल उठाया कि ADR में दिशा के माता-पिता के ऐसे कथित बयान का उल्लेख था, जिसमें उन्होंने किसी तरह का संदेह नहीं जताया था। लेकिन दिशा के पिता अस्पताल करीब 4 बजे पहुंचे थे।

ऐसे में अदालत ने पूछा कि ADR दर्ज होने के समय से पहले उनके बयान का उसमें उल्लेख कैसे किया गया।

मौत दर्ज होने से पहले CCTV में दिखे पुलिसकर्मी

CCTV फुटेज भी अदालत के सामने महत्वपूर्ण मुद्दा बना। फुटेज के अनुसार, रात करीब 1 बजे से 2.14 बजे के बीच कुछ पुलिसकर्मी इमारत में मौजूद दिखाई दिए।

हाईकोर्ट ने कहा कि ADR या बाद की जांच में यह स्पष्ट नहीं किया गया कि ये पुलिसकर्मी कौन थे, वे वहां क्यों पहुंचे थे और उस दौरान उन्होंने क्या कार्रवाई की।

अदालत के अनुसार, पुलिस की मौजूदगी से जुड़े इस पहलू का स्पष्ट जवाब जांच रिकॉर्ड में नहीं है।

खून और चोटों को लेकर विसंगतियां

हाईकोर्ट ने घटनास्थल पर खून से जुड़े साक्ष्यों को लेकर भी सवाल उठाए।

दो महत्वपूर्ण गवाहों के बयानों में कथित तौर पर कहा गया था कि दिशा नीचे गिरते समय चेहरे के बल गिरी थीं और उनके सिर से खून निकल रहा था। इसके बावजूद पुलिस ने घटनास्थल से खून से सनी मिट्टी या संबंधित साक्ष्य एकत्र नहीं किए।

अदालत ने चोटों के विवरण को भी विचारणीय माना। रिकॉर्ड में ठोड़ी पर चोट का उल्लेख था, लेकिन सिर पर खून बहने वाली चोट दर्ज नहीं थी।

पीठ ने यह भी कहा कि 12वीं मंजिल से चेहरे के बल गिरने की स्थिति में केवल ठोड़ी पर चोट होना स्वीकार करना कठिन है, जबकि खोपड़ी और पसलियों में फ्रैक्चर का उल्लेख किया गया था। चेहरे, नाक या जबड़े में फ्रैक्चर दर्ज नहीं था।

अदालत ने कहा कि चोटों के इस पहलू का विशेषज्ञों द्वारा परीक्षण आवश्यक होगा।

रासायनिक विश्लेषक की रिपोर्ट से भी उठा सवाल

अदालत ने Assistant Chemical Analyzer की उस टिप्पणी का भी उल्लेख किया, जिसमें कहा गया था कि इतनी ऊंचाई से गिरने जैसी घटना से जुड़े कपड़ों या अन्य सामान पर सामान्य तौर पर अधिक मात्रा में खून मिलने की उम्मीद होती।

लेकिन जब संबंधित वस्तुओं को खोला गया, तो उनमें खून की मात्रा कम पाई गई।

हाईकोर्ट ने ध्यान दिलाया कि जांचकर्ताओं को भी इस अंतर का कारण स्पष्ट नहीं था और उन्होंने पोस्टमार्टम करने वाले डॉक्टर से दिशा के कपड़ों पर कम खून होने के संबंध में सवाल किया था।

कमरे के दरवाजे को लेकर भी विरोधाभास

दिशा जिस कमरे में थीं, उसके दरवाजे को लेकर भी अदालत ने सवाल उठाया।

एक गवाह के अनुसार, दिशा ने खुद को कमरे के भीतर बंद कर लिया था और बाद में दरवाजा तोड़कर खोला गया।

लेकिन घटनास्थल के पंचनामा में दरवाजे या उसके लॉक के टूटने या क्षतिग्रस्त होने का उल्लेख नहीं था। हाईकोर्ट ने इस अंतर को भी जांच में स्पष्ट नहीं किया गया पहलू माना।

पोस्टमार्टम और FSL नमूनों में अंतर

फोरेंसिक जांच के लिए भेजे गए नमूनों और पोस्टमार्टम रिपोर्ट के बीच भी अदालत ने विसंगति पाई।

पोस्टमार्टम रिपोर्ट में कुछ विशेष स्वैब नमूनों का उल्लेख था, जबकि FSL को भेजे गए लिफाफों में स्लाइड स्मीयर पाए गए।

डॉक्टरों ने इसे लिपिकीय गलती बताया था। हालांकि, हाईकोर्ट ने इस अंतर को “गंभीर विसंगति” बताते हुए इसे नए सिरे से जांचे जाने योग्य माना।

जब्ती रिकॉर्ड पर भी अदालत के सवाल

अदालत ने पोस्टमार्टम करने वाले डॉक्टर से पुलिस द्वारा पूछे गए कुछ सवालों पर भी विचार किया।

हाईकोर्ट ने कहा कि पुलिस ने डॉक्टर से यह पूछा कि दिशा को किस स्थिति में अस्पताल लाया गया था, जबकि रिकॉर्ड के अनुसार पुलिस को पहले से पता था कि उनके कपड़े जब्त किए जा चुके थे।

पीठ के अनुसार, यदि पुलिस को कपड़ों की जब्ती की जानकारी पहले से थी तो डॉक्टर से ऐसा सवाल पूछे जाने का कोई स्पष्ट कारण नजर नहीं आता।

मोबाइल और लैपटॉप आठ दिन बाद किए गए जब्त

दिशा सालियान के मोबाइल फोन और लैपटॉप को भी अदालत ने महत्वपूर्ण संभावित साक्ष्य माना।

इसके बावजूद दोनों उपकरण 9 जून को घटनास्थल का पंचनामा तैयार करते समय जब्त नहीं किए गए। पुलिस ने इन्हें 17 जून को, यानी आठ दिन बाद, उनकी एक मित्र के कब्जे से अपने पास लिया।

अदालत ने इलेक्ट्रॉनिक उपकरणों की जब्ती में हुई इस देरी को भी शुरुआती जांच के मूल्यांकन में महत्वपूर्ण माना।

CBI को नए सिरे से जांच का निर्देश

इन सभी परिस्थितियों को एक साथ देखते हुए बॉम्बे हाईकोर्ट ने माना कि मामले में FIR दर्ज कर नए सिरे से जांच  शुरू करने का आधार बनता है।

अदालत ने कहा कि समय बीतने के साथ महत्वपूर्ण साक्ष्यों के नष्ट होने या खो जाने की आशंका बढ़ सकती है। इसलिए मामले की आगे की जांच में उपलब्ध सामग्री को स्वतंत्र रूप से परखा जाना जरूरी है।

हालांकि, हाईकोर्ट ने यह भी स्पष्ट किया कि उसके द्वारा उठाए गए सवालों को किसी व्यक्ति के खिलाफ अंतिम निष्कर्ष के रूप में नहीं देखा जाना चाहिए।

अब CBI को स्वतंत्र जांच के दौरान यह निर्धारित करना होगा कि कोई अपराध हुआ था या नहीं और उपलब्ध साक्ष्यों के आधार पर किसी व्यक्ति के खिलाफ संदेह के पर्याप्त आधार बनते हैं या नहीं।
