Bombay High Court Orders CBI Probe Into Disha Salian Death, Directs Fresh Investigation
Six Years After 28-Year-Old’s Death in Mumbai, Court Orders FIR and Comprehensive Probe; Says No One Should Be Treated as Accused Without Evidence
Mumbai, September 2: The Bombay High Court on Wednesday ordered a fresh investigation by the Central Bureau of Investigation (CBI) into the 2020 death of celebrity manager Disha Salian, a case that has remained surrounded by controversy and public speculation since she died in Mumbai six years ago.
A division bench of Justices Sarang V. Kotwal and Ranjitsinha R. Bhonsale directed the CBI to register an FIR and assign a senior, experienced officer to examine the circumstances surrounding Salian’s death.
The court also made an important legal distinction: the registration of an FIR or the ordering of an investigation does not mean that any particular person is guilty.
No individual is to be treated as an accused unless the investigating officer finds sufficient material to establish reasonable suspicion.
The court’s order came on a petition filed by Salian’s father, Satish Salian, who had challenged the earlier police conclusion and sought an independent investigation.
The court has also directed that the relevant records of the Mumbai Police investigation be handed over to the CBI.
What Happened to Disha Salian in 2020?
Disha Salian, 28, died on June 8, 2020, after falling from the 14th floor of a residential building in Mumbai’s Malad area. She had been with her fiancé and friends before the incident.
Mumbai Police initially registered an Accidental Death Report (ADR). Following an investigation, police maintained that Salian had died by suicide and reported that they had found no evidence indicating foul play.
A closure report submitted before a magistrate in February 2021 stated that nothing suspicious or objectionable had emerged from the inquiry.
That conclusion, however, did not end the controversy.
Why the Case Became Linked to Sushant Singh Rajput’s Death
The circumstances surrounding Salian’s death acquired national attention largely because she had briefly worked as the manager of actor Sushant Singh Rajput, who died in Mumbai just six days later, on June 14, 2020.
The close timing of the two deaths generated widespread speculation about whether the incidents were connected.
No established investigative finding has demonstrated such a connection, but the theory became a recurring feature of public and political debate surrounding both cases.
Rajput’s death itself triggered a major investigation and prolonged public scrutiny, bringing renewed attention to the circumstances surrounding Salian’s death as well.
Father Challenges Police Version
Salian’s father, Satish Salian, has consistently disputed the suicide theory.
In his petition before the High Court, he alleged that his daughter had been sexually assaulted and murdered and accused the authorities of failing to properly investigate crucial aspects of the case.
He approached the High Court in 2025, arguing that the version of events had effectively been settled before a thorough investigation had taken place.
He also alleged that influential individuals had been protected and that important facts had not been brought to light.
The police, on the other hand, defended their earlier investigation.
They maintained that Salian’s death was a suicide and told the court that Satish Salian’s statement had been recorded on multiple occasions.
Police also pointed out that her mother’s statement had been recorded before a judicial magistrate and that the parents had not initially expressed suspicion against anyone in connection with their daughter’s death.
Political Controversy Added Another Layer
The case also acquired a political dimension in Maharashtra.
In 2022, BJP leaders Narayan Rane and Nitesh Rane publicly raised allegations concerning Salian’s death and alleged a cover-up.
A case was subsequently registered against them following a complaint by Salian’s mother, Vasanti Salian, over allegations that remarks had cast aspersions on her daughter’s character.
The Ranes also repeatedly raised allegations concerning the possible involvement of Aaditya Thackeray, a prominent Shiv Sena (UBT) leader and son of former Maharashtra chief minister Uddhav Thackeray.
The allegations have been disputed, and Aaditya Thackeray has denied wrongdoing.
The political controversy intensified scrutiny of the original investigation and eventually contributed to demands for a fresh examination of the case.
Maharashtra Government Ordered Re-investigation
The case was reopened for further examination after the Maharashtra government ordered a reassessment of the earlier inquiry.
A Special Investigation Team (SIT) subsequently examined the matter and re-recorded statements of witnesses.
According to the government’s submissions before the High Court, investigators examined CCTV footage and recorded statements from six witnesses, with none alleging foul play.
Despite those findings, Salian’s father continued to maintain that the investigation had failed to address significant questions surrounding the death.
Court Questions Closure of Investigation
During the proceedings, the High Court scrutinised the manner in which the earlier investigation had been conducted and questioned whether all relevant aspects had been adequately examined before the matter was closed.
Among the issues raised was the location of Salian’s body in relation to the building from which she fell.
Her father’s lawyer, Nilesh Ojha, argued that the body being found approximately 10 feet away from the building raised questions that required scientific examination.
The lawyer also claimed that an analysis commissioned by the family suggested that the fall should have resulted in the body landing directly below rather than at that distance.
These remain claims advanced by the petitioner’s side and are not findings established by the court.
The court’s intervention is therefore significant because it reopens a case that had previously been treated by police as a suicide and later examined by an SIT.
CBI to Determine What the Evidence Shows
The High Court has now placed the responsibility for the next stage of the investigation with the CBI.
The agency is expected to examine the available evidence and the circumstances surrounding Salian’s death afresh.
The court has made clear that the purpose of the exercise is to establish facts, rather than to presume guilt.
If the investigation ultimately establishes that a cognisable offence has been committed, the CBI can proceed in accordance with law.
If no prosecutable case emerges, an appropriate report can be submitted before the competent court.
The order marks a significant new chapter in one of the most closely watched unresolved death cases to emerge from Mumbai in 2020, while also underscoring the principle that allegations must ultimately be tested against evidence.

मुंबई, 2 सितंबर: मुंबई की चर्चित सेलिब्रिटी मैनेजर दिशा सालियान की वर्ष 2020 में हुई मौत के मामले में बुधवार को बॉम्बे हाईकोर्ट ने महत्वपूर्ण आदेश देते हुए जांच केंद्रीय अन्वेषण ब्यूरो (CBI) को सौंप दी।
अदालत ने केंद्रीय एजेंसी को प्राथमिकी दर्ज कर मामले की व्यापक जांच करने तथा एक वरिष्ठ और अनुभवी अधिकारी को जांच की जिम्मेदारी देने का निर्देश दिया है।
न्यायमूर्ति सारंग वी. कोतवाल और न्यायमूर्ति रंजितसिंहा आर. भोंसले की खंडपीठ ने स्पष्ट किया कि किसी मामले में FIR दर्ज होना अपने आप में किसी व्यक्ति के अपराधी होने का प्रमाण नहीं है।
जांच के दौरान पर्याप्त सामग्री सामने आने और किसी व्यक्ति के खिलाफ युक्तिसंगत संदेह के आधार मिलने पर ही उसे आरोपी के रूप में देखा जा सकता है।
यह आदेश दिशा सालियान के पिता सतीश सालियान की याचिका पर आया, जिसमें उन्होंने मुंबई पुलिस की पिछली जांच और उसकी निष्पत्ति पर सवाल उठाते हुए स्वतंत्र जांच की मांग की थी।
अदालत ने मुंबई पुलिस से मामले से जुड़े दस्तावेज और रिकॉर्ड CBI को सौंपने के निर्देश भी दिए हैं।
2020 में क्या हुआ था?
28 वर्षीय दिशा सालियान की 8 जून 2020 को मुंबई के मालाड इलाके में एक आवासीय इमारत की 14वीं मंजिल से गिरने के बाद मौत हो गई थी।
घटना से पहले वह अपने मंगेतर और कुछ दोस्तों के साथ मौजूद थीं।
मुंबई पुलिस ने प्रारंभ में इसे आकस्मिक मृत्यु रिपोर्ट (ADR) के रूप में दर्ज किया था।
जांच के बाद पुलिस का निष्कर्ष था कि दिशा ने आत्महत्या की थी और मामले में किसी आपराधिक साजिश या बाहरी हस्तक्षेप के प्रमाण नहीं मिले।
फरवरी 2021 में मजिस्ट्रेट के समक्ष दाखिल की गई क्लोजर रिपोर्ट में भी पुलिस ने कहा था कि जांच के दौरान कोई संदिग्ध या आपत्तिजनक तथ्य सामने नहीं आया।
लेकिन इस निष्कर्ष के बाद भी मामला पूरी तरह शांत नहीं हुआ।
सुशांत सिंह राजपूत की मौत के बाद बढ़ा विवाद
दिशा सालियान की मौत को देशभर में व्यापक चर्चा तब मिली, जब यह तथ्य सामने आया कि उन्होंने कुछ समय तक अभिनेता सुशांत सिंह राजपूत के मैनेजर के रूप में काम किया था।
दिशा की मौत के ठीक छह दिन बाद 14 जून 2020 को सुशांत सिंह राजपूत की मौत ने दोनों घटनाओं को लेकर तरह-तरह के सवाल और अटकलों को जन्म दिया।
दोनों मामलों के बीच संबंध होने की चर्चाएं लंबे समय तक सार्वजनिक और राजनीतिक विमर्श का हिस्सा बनी रहीं।
हालांकि, दोनों घटनाओं के बीच किसी आपराधिक संबंध को स्थापित करने वाला कोई निर्णायक जांच निष्कर्ष सामने नहीं आया था।
इसके बावजूद सुशांत मामले की व्यापक जांच और उससे जुड़ी सार्वजनिक बहस के चलते दिशा सालियान की मौत भी लगातार चर्चा में बनी रही।
पिता ने आत्महत्या के निष्कर्ष को दी चुनौती
दिशा के पिता सतीश सालियान ने शुरू से ही पुलिस के आत्महत्या वाले निष्कर्ष पर असहमति जताई।
हाईकोर्ट में दायर याचिका में उन्होंने आरोप लगाया कि उनकी बेटी के साथ यौन हिंसा के बाद उसकी हत्या की गई और जांच एजेंसियों ने मामले के महत्वपूर्ण पहलुओं को उचित तरीके से नहीं परखा।
उन्होंने वर्ष 2025 में हाईकोर्ट का रुख करते हुए स्वतंत्र एवं पारदर्शी जांच की मांग की। याचिका में पुलिस पर प्रभावशाली लोगों को बचाने और महत्वपूर्ण तथ्यों को सामने न लाने जैसे गंभीर आरोप लगाए गए।
दूसरी ओर, पुलिस ने इन आरोपों से असहमति जताते हुए अपनी पिछली जांच का बचाव किया। पुलिस का कहना था कि दिशा की मौत आत्महत्या थी और उसके पिता के बयान कई बार दर्ज किए गए थे।
पुलिस ने यह भी बताया कि दिशा की मां वसंती सालियान का बयान न्यायिक मजिस्ट्रेट के समक्ष दर्ज हुआ था और माता-पिता ने उस समय किसी व्यक्ति पर संदेह नहीं जताया था।
मामले ने लिया राजनीतिक रंग
दिशा सालियान प्रकरण धीरे-धीरे महाराष्ट्र की राजनीति से भी जुड़ गया। वर्ष 2022 में भाजपा नेताओं नारायण राणे और नितेश राणे ने दिशा की मौत को लेकर सवाल उठाए और मामले में कथित तौर पर पर्दा डालने के आरोप लगाए।
इसके बाद दिशा की मां वसंती सालियान की शिकायत पर दोनों नेताओं के खिलाफ उनकी बेटी के चरित्र को लेकर कथित रूप से आपत्तिजनक टिप्पणी और मानहानि से संबंधित मामला दर्ज किया गया था।
राणे परिवार की ओर से बार-बार शिवसेना (यूबीटी) नेता आदित्य ठाकरे का नाम भी मामले के संदर्भ में उठाया गया।
आदित्य ठाकरे ने इन आरोपों से इनकार किया है। इस राजनीतिक विवाद ने मामले को और अधिक सार्वजनिक एवं राजनीतिक बहस के केंद्र में ला दिया।
SIT ने भी दोबारा की थी जांच
बाद में महाराष्ट्र सरकार ने मामले की दोबारा समीक्षा के निर्देश दिए। इसके बाद गठित विशेष जांच दल (SIT) ने मामले की पुनः जांच की और गवाहों के बयान दोबारा दर्ज किए।
राज्य सरकार की ओर से हाईकोर्ट में दी गई जानकारी के अनुसार, जांचकर्ताओं ने CCTV फुटेज की भी पड़ताल की और छह लोगों के बयान दर्ज किए।
सरकार का कहना था कि इन गवाहों में से किसी ने भी जांच के दौरान किसी तरह की आपराधिक साजिश या बाहरी हस्तक्षेप की बात नहीं कही।
इसके बावजूद सतीश सालियान अपनी बेटी की मौत की परिस्थितियों को लेकर संतुष्ट नहीं हुए और उन्होंने स्वतंत्र जांच की मांग जारी रखी।
शव की स्थिति समेत कई सवालों पर हुई बहस
हाईकोर्ट में सुनवाई के दौरान याचिकाकर्ता की ओर से जांच के कई पहलुओं पर सवाल उठाए गए।
सतीश सालियान के वकील निलेश ओझा ने विशेष रूप से इस बात का उल्लेख किया कि जिस इमारत से दिशा के गिरने की बात कही गई, शव उससे करीब 10 फीट की दूरी पर मिला था।
परिवार की ओर से दावा किया गया कि इस दूरी और गिरने की दिशा को लेकर वैज्ञानिक परीक्षण की आवश्यकता थी।
वकील ने अदालत के समक्ष यह भी कहा कि परिवार द्वारा कराए गए एक विश्लेषण में कथित तौर पर शव के सीधे नीचे गिरने की संभावना बताई गई थी।
हालांकि, ये याचिकाकर्ता पक्ष की ओर से अदालत में रखे गए दावे हैं, जिन्हें स्वतंत्र रूप से न्यायिक रूप से सत्यापित तथ्य नहीं माना जा सकता। अब इन सभी पहलुओं की जांच CBI के समक्ष होगी।
अब CBI करेगी मामले की पड़ताल
बॉम्बे हाईकोर्ट के आदेश के बाद अब मामले की जांच का अगला चरण CBI के हाथ में होगा। केंद्रीय एजेंसी को दिशा सालियान की मौत से जुड़े घटनाक्रम, उपलब्ध साक्ष्यों, पूर्व जांच के रिकॉर्ड और अन्य प्रासंगिक पहलुओं की नए सिरे से पड़ताल करनी होगी।
अदालत ने यह भी स्पष्ट किया है कि जांच का उद्देश्य किसी व्यक्ति को पहले से दोषी मानना नहीं, बल्कि उपलब्ध तथ्यों और साक्ष्यों के आधार पर वास्तविक स्थिति सामने लाना है।
यदि जांच में संज्ञेय अपराध के पर्याप्त आधार मिलते हैं तो कानून के अनुसार आगे कार्रवाई की जाएगी; और यदि ऐसा कोई मामला नहीं बनता है तो CBI संबंधित अदालत के समक्ष उपयुक्त रिपोर्ट दाखिल कर सकती है।
छह वर्ष पुराने इस मामले में हाईकोर्ट का ताजा आदेश इसलिए महत्वपूर्ण है क्योंकि पुलिस की ओर से पहले आत्महत्या का निष्कर्ष दिए जाने और बाद में SIT द्वारा मामले की समीक्षा किए जाने के बावजूद अब एक स्वतंत्र केंद्रीय एजेंसी को व्यापक जांच का जिम्मा दिया गया है।
