Haldwani Row Deepens as Congress Takes Rahul Gandhi FIR to National Streets

NEW DELHI: What began as a dispute over an event held at a rally ground in Uttarakhand has rapidly turned into another confrontation between the Congress and BJP over caste, constitutional rights and political speech.
The Congress is preparing demonstrations across India on Monday evening after Uttarakhand Police registered a case against Leader of Opposition Rahul Gandhi.
The party has decided to use the controversy to press its larger argument that social justice and protection from caste discrimination remain matters of constitutional importance.
The immediate flashpoint is Haldwani’s Ramlila Maidan.
A religious ceremony described as a “shuddhikaran havan” was organised there on August 11, after Congress president Mallikarjun Kharge had addressed a public meeting at the venue.
Gandhi objected to the ceremony and called for criminal action against those responsible.
He also sought application of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, arguing that the episode reflected the continuing presence of untouchability and caste prejudice in Indian society.
The demand subsequently became part of the dispute that led to a police complaint against Gandhi.
The complainant has presented a markedly different account of the Haldwani event, saying it was a cleanliness and religious programme involving members of the Scheduled Caste community and was not directed at Kharge or any particular caste.
The complaint says the complainant belongs to the Valmiki community and participated in the August 11 programme along with other members of the Scheduled Caste community.
He has rejected the interpretation that the event was connected to an individual or caste.
Police have registered the case against Gandhi under provisions dealing with alleged promotion of hostility between groups and deliberate conduct intended to offend religious sentiments.
An SC/ST Act provision concerning the submission of false or frivolous information to a public servant has also been invoked.
The legal action has prompted a sharp political response from Congress leadership.
Party general secretary (organisation) K C Venugopal accused the BJP of turning the machinery of the state against those raising concerns about alleged mistreatment of Dalits.
For the Congress, the central issue is not limited to the FIR.
Venugopal said the party wants those behind the Haldwani ceremony prosecuted and argued that the action against Gandhi should not overshadow the allegation involving Kharge.
The party has therefore chosen the streets as its next political arena.
Congress workers have been asked to demonstrate in different parts of the country, with the protests expected to focus on social justice, caste discrimination and what the party describes as an assault on constitutional values.
The controversy also comes at a time when Gandhi has been increasingly using caste and social-justice issues as part of the Opposition’s political campaign.
His intervention in the Haldwani dispute has now opened a fresh legal and political front between the Congress and the BJP.
The BJP’s position, reflected in the complaint, challenges the Congress interpretation of the ceremony and maintains that it had no connection with any particular individual or caste.
The dispute is consequently unfolding on two parallel tracks: a police investigation into the allegations made against Gandhi, and a political campaign by the Congress seeking action over the original Haldwani ceremony.
How the police investigation develops, and whether further action is taken over the August 11 event, is now likely to determine the next phase of the confrontation.

नई दिल्ली: उत्तराखंड के हल्द्वानी में एक रैली स्थल पर हुए धार्मिक आयोजन को लेकर शुरू हुआ विवाद अब कांग्रेस और भाजपा के बीच बड़े राजनीतिक संघर्ष का रूप ले चुका है।
राहुल गांधी के खिलाफ दर्ज पुलिस मामले के बाद कांग्रेस ने सोमवार शाम देश के विभिन्न हिस्सों में प्रदर्शन करने का फैसला किया है।
पार्टी इस पूरे प्रकरण को केवल एक पुलिस केस तक सीमित रखने के बजाय सामाजिक न्याय, जातीय भेदभाव और संवैधानिक अधिकारों से जोड़कर देख रही है।
कांग्रेस का कहना है कि हल्द्वानी की घटना पर सवाल उठाने वाले राहुल गांधी के खिलाफ कार्रवाई करना मूल विवाद से ध्यान हटाने जैसा है।
इस विवाद का केंद्र हल्द्वानी का रामलीला मैदान है।
कांग्रेस अध्यक्ष मल्लिकार्जुन खड़गे की वहां हुई रैली के बाद 11 अगस्त को उसी स्थान पर ‘शुद्धिकरण हवन’ के रूप में वर्णित एक धार्मिक कार्यक्रम आयोजित किया गया था।
राहुल गांधी ने इस आयोजन पर आपत्ति जताते हुए इसे लेकर कानूनी कार्रवाई की मांग की थी।
उन्होंने प्रधानमंत्री नरेंद्र मोदी से हस्तक्षेप करने और जिम्मेदार लोगों के खिलाफ SC/ST अत्याचार निवारण कानून के तहत मामला दर्ज कराने की मांग की थी।
गांधी ने इस घटना को देश में दलितों के सामने मौजूद छुआछूत और सामाजिक भेदभाव की समस्या से जोड़ते हुए भाजपा और RSS की विचारधारा पर भी सवाल उठाए थे।
इसके बाद उनके खिलाफ पुलिस में शिकायत पहुंची, लेकिन शिकायतकर्ता ने घटनाक्रम की अलग तस्वीर पेश की।
उसका कहना है कि 11 अगस्त को रामलीला मैदान में सफाई अभियान और धार्मिक कार्यक्रम आयोजित किया गया था, जिसमें अनुसूचित जाति समुदाय के लोग भी शामिल थे।
शिकायतकर्ता के मुताबिक, इस कार्यक्रम का किसी खास व्यक्ति या जाति को निशाना बनाने से कोई संबंध नहीं था।
शिकायतकर्ता ने खुद को वाल्मीकि समुदाय का सदस्य बताया है। उसका दावा है कि आयोजन को खड़गे या किसी विशेष जाति के संदर्भ में देखना सही नहीं है।
इसी शिकायत के आधार पर उत्तराखंड पुलिस ने राहुल गांधी के खिलाफ अलग-अलग समूहों में वैमनस्य पैदा करने और जानबूझकर धार्मिक भावनाओं को आहत करने से जुड़े प्रावधानों में मामला दर्ज किया है।
SC/ST कानून के तहत सरकारी अधिकारी को कथित रूप से झूठी या आधारहीन सूचना देने से संबंधित प्रावधान भी FIR में शामिल किया गया है।
पुलिस कार्रवाई के बाद कांग्रेस ने अपने संगठन को देशव्यापी प्रदर्शन के लिए तैयार किया है।
पार्टी महासचिव (संगठन) केसी वेणुगोपाल ने भाजपा पर तीखा हमला करते हुए आरोप लगाया कि दलितों के साथ कथित अन्याय का मुद्दा उठाने वालों के खिलाफ सरकारी तंत्र का इस्तेमाल किया जा रहा है।
कांग्रेस का कहना है कि असली सवाल राहुल गांधी पर दर्ज मामले से आगे का है। पार्टी चाहती है कि खड़गे की रैली के बाद हुए आयोजन के लिए जिम्मेदार लोगों के खिलाफ भी कार्रवाई हो।
इसी मांग को लेकर सोमवार शाम कांग्रेस कार्यकर्ताओं के सड़कों पर उतरने की योजना है।
इस घटनाक्रम ने गांधी के लिए भी एक नया राजनीतिक और कानूनी मोर्चा खोल दिया है।
वे पहले से ही जाति जनगणना, सामाजिक प्रतिनिधित्व और सामाजिक न्याय जैसे मुद्दों को विपक्षी राजनीति के प्रमुख विषयों में शामिल करते रहे हैं।
दूसरी ओर, शिकायत में सामने आया पक्ष कांग्रेस की व्याख्या से अलग है और आयोजन को किसी व्यक्ति या जाति के खिलाफ कार्रवाई के तौर पर देखे जाने से इनकार करता है।
इसलिए हल्द्वानी का विवाद अब दो स्तरों पर आगे बढ़ रहा है।
एक ओर पुलिस गांधी के खिलाफ दर्ज शिकायत की जांच कर रही है, तो दूसरी ओर कांग्रेस मूल आयोजन को लेकर कार्रवाई की अपनी मांग को राजनीतिक आंदोलन में बदल रही है।
आगे की पुलिस जांच और 11 अगस्त के कार्यक्रम को लेकर होने वाली कार्रवाई यह तय करेगी कि यह विवाद कानूनी स्तर पर किस दिशा में जाता है।
फिलहाल, राहुल गांधी पर FIR के बाद कांग्रेस ने इसे राष्ट्रीय राजनीतिक मुद्दा बनाने का संकेत दे दिया है।
